Kukino, Sarah E. S. "Juvenile Transfer to Adult Criminal Court: Why Transfer is Not the Best Method in Addressing Juvenile Delinquency." Scholarship @ Claremont, 2015. http://scholarship.claremont.edu/cmc_theses/1042.

Abstract:
Reducing juvenile delinquency is an important issue because today’s juvenile population will become the next generation of contributing members to society. Therefore, the juvenile justice system is faced with the challenge of creating effective methods of decreasing delinquency and providing necessary treatment to juvenile offenders. Legislators implemented juvenile transfer to adult criminal court with the intent of increasing punishments in order to deter future juvenile crime and to hold juvenile offenders accountable for their criminal behavior. This paper shows why juvenile transfer is not an effective method in addressing the issues of juvenile delinquency by looking at several studies that analyze the negative effects of transfer in increasing recidivism and serious violent crimes. Furthermore, research shows that juvenile transfer undermines the criminal culpability of juvenile offenders who are undoubtedly not as mature and psychosocially developed as adult offenders. This implies that the juvenile justice system is faced with the ongoing challenge of finding new ways to address juvenile delinquency. This paper suggests that the juvenile justice system should return to an individualized rehabilitative system that focuses on the needs of individual offenders in providing appropriate treatment and services that will allow the juvenile to re-integrate back into the community.

Abstract:
At the end of the nineteenth century, individuals identified as child savers pioneered an unprecedented movement to save America’s children from physical and moral harm. The establishment of the juvenile justice system came as a result of the actions of the child savers. Researchers have focused extensively on many aspects of the juvenile justice system including studies on the effectiveness of the system to tracking the changes the system has undergone since its establishment. Numerous other studies examined opinions of the juvenile justice system. However, the research has focused solely on the general public, juvenile probation officers and juvenile correctional staff. The current study examined the actual participants within the juvenile justice system - the juvenile offenders - to gauge their perceptions of the system that was created to protect and turn them into law-abiding individuals. A survey was conducted with juvenile offenders housed within two conservative, Midwestern juvenile correctional facilities. The juveniles believed that rehabilitation should be an integral goal of the juvenile justice system and they endorsed community-based interventions as a means to change behavior. The results indicate that the juvenile offenders are in tune with the general public as seeing the juvenile justice system as a child saving institution rather than as a punitive endeavor.

Abstract:
This current study addresses potential impediments to attachment that may differentiate between incarcerated juveniles who have committed sexual crimes and incarcerated juveniles who have not committed such offenses. The exploration of such potential barriers to attachment has been organized around Bronfenbrenner's Ecological Model. Subjects were 2948 incarcerated male adolescents adjudicated to the Virginia Department of Juvenile Justice and were divided based solely upon adjudicating offense: Juvenile non-violent, non-sexual offenders (JNVNSO, n=1149), Juvenile violent, non-sexual offenders (JVNSO, n=1433) and Juvenile sexual offenders (JSO, n=366). Results indicated that JSOs differed from JNVNSOs and JVNSOs in their histories of sexual abuse as well as placements in foster care. Attachment impairment and the number of risk factors present were also found to be significantly related. Future research directions and potential policy repercussions are also addressed.

Abstract:
Includes bibliographical references (leaves 74-88).
Juvenile crime is a growing problem in Malawi. International research has focussed on the causes of this type of crime in an attempt to explain and deal with this phenomenon. This study adds to the scholarly knowledge by exploring the life stories of 22 male juvenile offenders currently incarcerated for various crimes in Malawi. Semi-structured life-history interviews were conducted and results are consistent with the existing literature - specifically on risk factors, control theories and life-course theories. This study showed that several factors in childhood and adolescence contributed to the participants' offending behaviour. Participants also made sense of their behaviour by constructing themselves as victims of life circumstances, spiritual and supernatural forces, and an inequitable justice system. Some of these attributional models are uncommon in criminological literature.

Abstract: This Master¿s thesis investigates the dissemination of scientific knowledge for children as a genre, with Astronomy books as our corpus. The aim of this research is to provide a comparative analysis concerning the production conditions of six titles, its reading gestures and effects. In order to do so, we firstly consider the genre (and subgenre) to which the books belong, pointing out its language, norms and specific purposes, without admitting that there is a single (and unanimous) dissemination of scientific knowledge. Subsequently, we engage in a fast incursion through the field of Astronomy, in order to understand its influence and presence in the contemporary daily routine, especially in literature. Our purpose is to show that this field of knowledge flows both in the popular (folk) imagination and in the objectivity of researches and investments in Science and Technology. Finally, in the third and last chapter we describe the selected books from three prisms: the pedagogical, recreational and poetical functioning. With this research, we would like to offer a critical view of the multiple manners in which the cosmos is presented in books for children. Thus, we hope to provide an interpretation that reveals that a child opening a book can get to know the universe not only via scientific terms and data, but also with a discourse ¿ i.e. an effect between speakers ¿ that cherish doubts, dreams and a profound fascination for the universe

Abstract: Juvenile myoclonic epilepsy is a common disease found among the group of all idiopathic generalized epilepsies. It shows a good prognosis, and seizures can be controlled easily. The objective of the present study was to make a comparison between thalamic analysis and functional and structural neuroimaging. We selected twenty-one patients (thirteen females) with mean age 30 ± 9 years old from our clinic in Hospital das Clinicas da UNICAMP, in (Campinas). Eighteen healthy volunteers (eleven females) with mean age 35 ± 6 years old were selected for the control group,. All subjects were submitted to a structured protocol of research including magnetic resonance. A 3D sequence with a single voxel (2x2x2cm3) on right thalamus was also performed for spectroscopy. Voxel based morphometry and shape analysis demonstrated thalamic abnormalities in anterior and inferior portions. Brain spectroscopy showed a decrease in NAA/Cr ratio. There is a dysfunction of the thalamus, and this pattern of structural abnormality suggests that the thalamus is involved in the neural network associated with myoclonic epilepsy

Abstract:
Juvenile Justice: An Introduction, 8th edition, presents a comprehensive picture of juvenile offending, delinquency theories, and how juvenile justice actors and agencies react to delinquency. It covers the history and development of the juvenile justice system and the unique issues related to juveniles, offering evidence-based suggestions for successful interventions and treatment and examining the new balance model of juvenile court. This new edition not only includes the latest available statistics on juvenile crime and victimization, drug use, court processing, and corrections, but provides insightful analysis of recent developments, such as those related to the use of probation supervision fees; responses to gangs and cyber bullying; implementing the deterrence model (Project Hope); the possible impact of drug legalization; the school-to-prison pipeline; the extent of victimization and mental illness in institutions; and implications of major court decisions regarding juveniles, such as Life Without Parole (LWOP) for juveniles. Each chapter enhances student understanding with Key Terms, a "What You Need to Know" section highlighting important points, and Discussion Questions. Links at key points in the text show students where they can go to get the latest information, and a comprehensive glossary aids comprehension.

Abstract:
The overall objective of this study was to identify and compare the characteristics of juvenile delinquents who commit sexual offenses with juvenile delinquents who commit offenses other than sexual offenses. To attain this objective, the following areas on juvenile offenders were studied: a) characteristics (b) family structure (c) family background (d) academic performance. A comparative research design was employed in this study. A questionnaire was designed specifically to collect data from the files of thirty-four residents who resided at the Atlanta Youth Development Center. A T-Test was used to test whether or not differences existed between these groups. Results indicated that overall, there were no significant differences between the two groups. This study was an attempt to describe juvenile sex offenders to determine if they differed from other juvenile offenders. The findings may aid in the development and implementation of services desperately needed for juvenile offenders and their families.

Abstract:
In recent time, juvenile delinquency and its associated problems pose serious threat to Lesotho and across the globe. This includes actions and inactions of children below the age of eighteen, of which the child is subject to conviction by the state. This study investigated the social background patterns of juvenile delinquents to ascertain their contributions to juvenile delinquencies in Lesotho. The study made use of all the 43 juveniles who were in the Juvenile Training Centre (JTC) in Maseru at the time of this research. Relevant data were collected through the use of survey questionnaires with close-ended questions. The results in the main corroborated what exists in literature that most delinquents come from broken homes; most delinquents are males; delinquency is at a higher rate in urban areas compared to the rural areas and that most delinquents are part of peer groups who engage in delinquent behaviours. Precisely, Maseru the capital city of Lesotho and Leribe were found to be the districts with highest rates of juvenile delinquency. It was also discovered that most of the juveniles have fathers who are employed in the mining industry. The most committed offence across the country was robbery. The high rates of robbery, housebreaking and stock theft indicate that poverty may be the factor behind the scene in Lesotho, which requires urgent attention from the government to tackle and eradicate poverty.

Barry, Monica Anne. "Understanding youth offending : in search of 'social recognition'." Thesis, University of Stirling, 2004. http://hdl.handle.net/1893/2022.

Full text
Abstract:
This thesis, whilst taking a predominantly criminological topic as its subject matter, incorporates other sociological and social psychological debates around youth transitions, power relations, youth culture and capital. In so doing, this thesis attempts to come to terms with the wider problems faced by young people who become embroiled in offending. It argues that the transition to 'adulthood' is heavily implicated in the fact that most offending occurs in late childhood and youth. This study asked 20 young women and 20 young men about why they started and stopped offending and what influenced or inhibited them in that behaviour as they grew older. What these young people suggested was that their decision to offend - or not offend - was very much based on their need to feel included in their social world, through friendships in childhood and through wider commitments in adulthood. The process of moving through the transitional arrangements from childhood, through youth, to adulthood seems to run parallel with the process of starting offending, maintaining such behaviour over a period of time and eventually stopping offending in favour of greater conventionality and stability. This analysis of the parallel paths between the process of youth transitions and the process of offending draws on the theoretical concepts of Pierre Bourdieu, in particular that of capital accumulation. But it goes further in suggesting the need to take into account not only capital accumulation but also capital expenditure and power imbalances - power imbalances based not only on class distinctions, as Bourdieu suggests, but also on age and status.

Abstract:
Each year more than 100,000 juveniles are incarcerated in residential rehabilitative facilities. As part of their course of treatment, educational services are mandated for these incarcerated youth. Programs serving these individuals must provide adequate and appropriate educational programs for these juveniles. With a growing public concern over juvenile delinquency and recidivism, programs are being held accountable for the effectiveness and quality of the programming they offer. In Florida, juvenile justice programs offering educational services are monitored annually by the Juvenile Justice Education Enhancement Program. These programs receive a Quality Assurance (QA) rating as determined by a review team that spends several days in the program reviewing documentation and interviewing youth and program staff. This study proposes to examine any potential relationship between the rating a program receives and how successful youth are in returning to mainstream society and subsequently school. Linear regression analysis is the main statistical method to answer four research questions designed to examine these potential relationship. A total of 177 Moderate and High Risk programs were included in the study and the QA scores they received over a three year were analyzed. Surprisingly, the research and subsequent analysis shows little relationship between educational program quality and success rates for juveniles exiting incarceration. This result may warrant further study as to the additional factors contributing to a youth's re-involvement in the juvenile justice system.

Within the past twenty years, juvenile sexual assault has become a major focus on several levels, including appropriate treatment variables, indicators of recidivism, and appropriate legal response to adolescents with a history of deviant sexual acting out. There are several variables that warrant research in the process of clarifying the differences between adolescent child molesters and adolescent rapists, in an effort to determine recidivism and criminal characteristics of each subtype. Level of coercion, victim selection, age of victim, level of offense, familiar history, self-esteem disorders and age of offender are variables that are summarized in this study. The researcher employed a cross sectional correlational design in order to determine whether juvenile rapists and juvenile child molesters differed on several variables, and to explore relationships and differences among several factors. Several different tests of significance were used for testing the hypothesis and research questions in this study, including t-tests, and Pearson Chi-Square correlations. The subjects in this study consist of 120 male, juvenile sex offenders (aged 13-19), all adjudicated delinquent and in the custody of the Massachusetts Department of Youth Services. Of the 120 subjects, 48 of the juveniles (40%) offended against victims classified as "child victims", or victims who were at least 5 years younger than the offending juvenile, and 72 of the juveniles (60%) offended against peer aged victims. Results of the study indicate the following: there is no significant age difference between adolescent child molesters and adolescent rapists; adolescent rapist and adolescent child molesters have similar abuse histories; adolescent child molesters tend to use less violent methods of coercion than adolescent rapists, adolescent child molesters are more likely than adolescent rapists to choose males as victims; adolescent child mo esters and adolescent rapists both choose to victimize acquaintances at an usually high rate; adolescent child molesters and adolescent rapists commit the same type of sexual offenses at an equal rate. Discussed also in this study is a review of current laws and statutes regarding juvenile sex offenders.

Abstract:
Families (N=139) participating in the Reducing Youth Offending Programmes (RYOP) in Auckland and Christchurch, New Zealand completed questionnaires exploring a range of family factors that influence youth offending behaviour. The aim of this research was two fold; firstly to investigate the Therapist Adherence Measures (TAM) and assess whether the same six subscales, which have been found in previous research, were also obtained in the New Zealand data, and whether TAM results predicted recidivism. The second goal was to investigate if other measures of family functioning (FRC and YBS) and therapist alliance (WAI-S) could provide additional information to the TAM with regards to recidivism. Results indicate that the RYOP TAM's produced different subscale results to the six subscales in earlier MST studies and as such a three-factor subscale model was proposed. The other measures (FRC, YBS and WAI-S) investigated added little information beyond the TAM concerning recidivism.

Latex is the main product extracted from rubber tree (Hevea brasiliensis). In Brazil, at the end of the production cycle of latex, rubber wood is traditionally used for energy purposes but international studies have reported consolidated practice that result in added-value products. Several researchers have observed raised and worsening of tapping panel dryness, a disease that impairs the production of latex. The main objective of this study was to evaluate the quality of rubber wood of commercial clones GT 1 and RRIM 600 in three distinct health conditions: trees producing latex (healthy), trees with tapping panel dryness of abiotic/physiological origin and trees with tapping panel dryness of biotic/pathological origin. Six trees of each health condition of the two clones from plantations in the São José do Rio Preto region – Sao Paulo State, Brazil - aged 20 years or more were sampled. Anatomical and physical-mechanical parameters evaluated were fibers length (occurrence and delimitation juvenile–mature wood), specific gravity and apparent density, shrinkage and anisotropy index, compression parallel to grain strength, bending strength and rigidity and Janka hardness. Results showed that juvenile wood occurs from pith up to 40% and 32% of ray for GT 1 and RRIM 600 clones respectively, allowing the association of the age of 6 to 8 years of plantation as transition between juvenile and mature wood. The mean specific gravity of rubber wood from both clones varied from 580 kg/m³ to 595 kg/m³ and there wasn’t statistical difference of this parameter among health conditions and between clones. Rubber wood... (Complete abstract click electronic access below)

Abstract:
Every year about 200 children are diagnosed with juvenile idiopathic arthritis (JIA) in Sweden. It is not only in specialized care nurses meet children who suffer from JIA, but also in universal health care. The aim of the study was to express the nursing care for children with juvenile idiopathic arthritis. This study is a literature study. The result highlights what is important in the nursing care of nursing children with JIA. This is presented in three themes: Attitudes, Information and teaching and Emotional support. A good attitude towards the children is very important so they feel a trust to the health care. It is important to make the children involved. Children are experts on the experience of their own illness. The children need emotional support to handle their everyday life. The support can come from the nurse or from Internet pages. If children shall be able to manage their condition and their situation, it requires education and information. The information can be provided from brochures, books, the nurse or the Internet. It would be desirable if nursing school would include nursing children. The knowledge a regular nurse has after the graduation can be taken advantage because they can pay attention to the symptoms a child with JIA has and shape nursing interventions. The research within JIA is limited from a nursing perspective, and knowledge gaps need attention.

Abstract:
This is the first study of the Athenian juvenile justice system and, indeed, of any such system in Greece. The thesis concentrates on the operation of the juvenile court, the probation service and the role of the police in the formal and informal handling of delinquent and anti-social minors. In his proposals, the researcher reconceptualises the local justice system in a way which encourages the informal handling of petty offenders, the development of a range of community alternatives for the rising number of repeated and serious offenders and the enhancement of its links with the local community.

Murray, Brittany N. "Does religiosity deter juvenile delinquency?" Master's thesis, University of Central Florida, 2011. http://digital.library.ucf.edu/cdm/ref/collection/ETD/id/4991.

Abstract:
The study presented here uses data from the National Longitudinal Study of Adolescent Health Wave I (Add Health) to examine the association between juvenile delinquency and religiosity. Juvenile delinquency is an area that has received increasing research interest over the last decade; however, much of this research has primarily focused on family, peers, and education as factors that may reduce delinquent involvement. While all of these are influential in the lives of youth, it is possible there are other factors as well. Religiosity has been shown to have influential effects throughout the life course; however, little research has focused specifically on the relationship between religiosity and juvenile delinquency and even less has centered on this relationship in terms of gender and race/ethnicity. The results of this study will contribute to the literature on juvenile delinquency by providing an in-depth look at the effects of religiosity in adolescence, gender and racial/ethnic trends, as well as possibly provide information valuable to prevention efforts.

Abstract:
The present thesis is a detailed and in depth examination of the reasons of re-offending, perceived by young offenders in custody, drawn from the largest Young Offenders' Institution in Scotland. Mainly materialistic and affective reasons were provided, in line with previous research, yet the issue of drugs abuse emerged as salient. The thesis focused on the immediate and more proximally related factors of re-offending, predicting young offenders' decisions to re-offend in the future. One hundred and fifty two young offenders were randomly selected and participated in a structured interview. The interview assessed several background characteristics, their perceptions of the costs and benefits of their future offending, their perceived normative influences in their future offending and their perceptions of desisting from future offending by controlling several criminogenic factors in the future. In addition, the participants completed two self-reported measures: the Parental Bonding Instrument(PBI)- and the Moral Disengagement Scale(MDS). Intentions of re-offending in the future were predicted by perceived control and attitudes towards future offending. Background factors, related and predictive of recidivism and chronic offending, failed to contribute to the prediction of variation of intentions, over and above the contribution of perceptions of control and attitudes of re-offending. The results suggest that attitudes towards offending and perceptions of control over offending provide a parsimonious framework of assessing and predicting young offenders' intentions of reoffending in the future. Moreover, the detailed examination of the control and behavioural beliefs underlying the two constructs, perceived control to desist from offending and attitudes towards offending, can guide to the specific needs that are perceived as criminogenic by the young offenders and potentially inform the content and the direction of any intervention programs within the correctional settings of young offenders aiming at reducing levels of recidivism. Two dimensions of child-rearing practices, parental care and protection, were examined in relation to normative data, background characteristics and cognitive representations of future offending, and it was found that the relation between perceptions of parenting and intentions of re-offending were mediated by attitudes towards offending in the future. In addition, the associations of moral disengagement, as a failure of self-regulation of morality with past recidivism rates and age of initiation of offending were examined, and were found, contrary to expectations, mainly unrelated. However, the overall score of Moral Disengagement of the young offenders was significantly higher in comparison to normative data. The results suggest that Moral Disengagement could be a factor differentiating young people involved in criminal activity and processed by the legal system from young people who are not involved in criminal activity and/or are unaffected by official monitoring. Moral Disengagement, however, might not be related with frequency of offending within groups of young people in the correctional institutions. Moral disengagement was also found mainly unrelated with background characteristics of the young offenders, suggesting that self-regulation of morality is relatively independent from influences from the social environment. Finally, the relations of Moral Disengagement and cognitive representations of offending in the future were discussed in terms of self-regulation of hierarchically organised feedback loops.

Abstract:
The present study involved an examination of the delinquency problem in Saudi Arabia within the framework of social control theory. Specifically, the study was based on the thesis set forth by Travis Hirschi, i.e., that delinquent acts result when an individual's bond to society is weak or broken. Also taken into account, however, were the findings from the research of Wiatrowski, et al. that suggest a need for a) some modifications in Hirschi 's conceptual framework and b) inclusion of socio-economic factors in the social control model.

Abstract:
Submitted to the Faculty of Arts in fulfillment of the requirements for the Degree Mater of Arts in the Department of Criminal Justice at the University of Zululand, South Africa, 1993.
This investigation examined certain problems and dilemmas in the juvenile court. Three problem areas were included: The accusatorial - inquisitorial view as the main approach in the juvenile justice system. The rehabilitative - retributive approach and its application to juvenile offenders. (Magistrates' sentencing objectives and their application to juvenile offenders.) The possibility of the application of the pre-trial judicial investigation in the juvenile court. In addition, a number of items were simultaneously included in the investigation and, where applicable, are included in this report The research questionnaires were delivered by hand to a number of magistrates in the Eastern Cape, Orange Free State and Transvaal. After a few weeks the questionnaires were collected and unstructured interviews were conducted with some of the magistrates. A total of 39 questionnaires were collected and use was made of the descriptive statistical technique to summarize and condense the data to measurable units. Because of the explorative-descriptive nature of the investigation the results can only be generalized to Eastern Cape, Orange Free State and Transvaal The following are the more significant findings: 1. Adjudication of Juvenile Offenders • 10,3% of magistrates accepted the accusatorial, 25,6% the inquisitorial, 33,3% the accusatorial - inquisitorial, and 30,8% the inquisitorial - accusatorial approaches. • 82,1% of magistrates agreed that in no country would one find a system which is purely accusatorial or inquisitorial. • a substantial record of previous convictions is to 74,4% of magistrates on aggravating circumstances. • The majority 89,7% of magistrates would feel justified in making allowance for mitigating circumstances if they had a particular sentencing objective in mind. • 89,7% of magistrates would regard mitigating circumstances as a juvenile's right to have sentence reduced. 2. Sentencing of Juvenile Offenders • 74,3% of magistrates rated reformation as a sentencing objective for juvenile offenders, as Very important'. • 743% of magistrates rated the need to expose the juvenile offender to treatment • 64,1% of magistrates rated the sentencing principle of protecting society from juvenile crime and helping the juvenile offender's development as complementary. • The most important factor which influences magistrates in reaching a sentence of community service is where the offender will benefit, 84,6%. • 61,5% of magistrates kept punishment in mind for assault on police. The results demonstrate that the rehabilitative - treatment objective and the retributive - punishment objective are the main objectives of sentencing in the juvenile court. 3. Pre-trial judicial investigation in juvenile courts • Approximately 74,4% of magistrates were in favour of pre-trial judicial investigation. • 71,8% of magistrates agreed that probation officers, and 71,8% agreed that criminologists can be helpful in the juvenile court. • Finally, one can accept that the majority of magistrates in this investigation support the implementation of a pre-trial judicial investigation in the juvenile justice system.

Abstract:
This dissertation examines the role gender plays in predicting referral beyond juvenile court intake. Using referral data from Texas for 1999-2003, multinomial logistic regression is used to examine case processing decisions. Males were found to be more likely than females to be processed beyond intake for both status and delinquent offenses. Legal variables were found to influence processing decisions for delinquent offenses more than non-legal variables. In contrast, non-legal variables were found to influence processing decisions more than legal variables for status offenses. Finally, overall, minority females were not found to be more likely to be processed beyond intake than white females. Further research is needed to determine if the same finding is true for males.

Abstract: This study is part of the debate on adolescents in conflict with the law. As a central objective, based on the problematization of the institution of deprivation of liberty for adolescents in São Paulo, Fundação CASA, the analysis seeks to identify the processes of symmetry between this institution and the institutions directed toward adults, the "prisons". From this, we highlight, as a specific objective, the occurrence of rebellions as a key-symmetry for the present analysis: these events are given as limitsituations, from which one can grasp what is triggered in relations and institutions which are part of the institutional sociability, being present in the daily life of the actors that circulate through the institution
