Full textDespite the unpleasant living conditions in prison, recidivism seems to be an uncontrollable phenomenon. It is evident that prison life is harsh with inmates having to sleep on the floors due to overpopulation, frequently subjected to physical and sexual abuse, and overpopulation leading to numerous communicable diseases, such as tuberculosis, HIV/AIDS and sexually transmitted infections. Prison should therefore, be the least favourable ecosystem in which to be incorporated. However, research indicates that thousands of youth return to prison habitually. This study aimed to explore juvenile inmates perceptions of their return to prison. Although recidivism is often measured in terms of the success of rehabilitation programmes, this study focused on eliciting socio-economic factors influencing recidivism.

Full textENGLISH ABSTRACT: Adolescence is a challenging development stage because youths engage in risk-taking behaviour, including anti-social and criminal acts. Factors which contribute to youth becoming involved in crime include having a poor self-concept, being male, the negative behaviour of parents, family dysfunction, low socio-economic status, low literacy levels or being illiterate, peers who exercise a negative influence, and poor role models. Diversion strategies are practised worldwide, including South Africa, to deal with the growing number of youth in conflict with the law. After diversion practice was legalised in South Africa, some challenges have been experienced with implementation. However, the views of social workers are limited regarding diversion practices after the Child Justice Act no 75 of 2008 was introduced. The objective of the study is to gain insights from social workers who facilitate diversion programmes with male juvenile delinquents. In this study, attention was paid to explaining the nature of juvenile delinquency of male adolescents in a South African context; describing diversion programmes in terms of the Child Justice Act no 75 of 2008 to deal with children outside the criminal justice system; discerning the scope, nature and contribution of diversion programmes for the rehabilitation of delinquents; investigating the views of social workers on diversion programmes for male juvenile delinquents; and to make recommendations regarding the facilitation of diversion programmes with male juvenile delinquents. A combination of quantitative and qualitative research approaches were used in the study. The study further assumed an exploratory and descriptive research design due to the limited information available regarding the views of social workers on diversion programmes with male juvenile delinquents. A purposive sampling method was used to select the participants. Data was gathered by means of a structured questionnaire, which was administered during 20 individual interviews. This allowed for a holistic view to be gained of participants' opinions about and insights into the topic. The design of the questionnaire was based on the information obtained from the literature review. The findings of the empirical investigation mainly confirmed the findings of the literature study that males are more vulnerable to juvenile delinquency, that parents and families play substantial roles in the causes of juvenile delinquency and, lastly, that diversion programmes offer much benefit to youth offenders. The most important recommendations resulting from the study indicate that social workers should become more skilled and equipped to facilitate therapeutic groups as this will contribute to the reduction of re-offending. Parental and family involvement in diversion programmes is essential as it will increase the impact on the youth offender. In addition, the recommendations indicate the significance of monitoring and evaluation of diversion programmes, in this way ensuring the proper implementation of the Act. Lastly, it is suggested that more research be done about diversion practices internationally to increase knowledge regarding implementation.
AFRIKAANSE OPSOMMING: Die puberteitsjare is 'n uitdagende ontwikkelingsfase omdat die jeugdige riskante gedrag toon, soos antisosiale optrede en die pleeg van misdaad. Faktore wat bydra tot die jeugdige se betrokkenheid by misdaad is die feit dat hy tot die manlike geslag behoort, 'n lae selfbeeld het, die negatiewe gedrag van ouers, uit 'n gebroke huis kom, aan lae sosioekonomiese status ly, die lae vlak van of geen geletterdheid het nie, vriende wat 'n negatiewe invloed uitoefen, en swak rolmodelle. Afwendingstrategieë word wêreldwyd beoefen, ook in Suid-Afrika, om die toenemende aantal jeugdiges wat met die gereg bots, te help. Nadat afwendingspraktyke in Suid-Afrika gewettig is, is sekere uitdagings in die praktyk ervaar. Min menings is deur maatskaplike werkers geopper oor afwendingspraktyke nadat bepalings ingevolge die Kindergeregtigheidswet nr 75 van 2008 toegepas is. Die doel van die studie is om insigte te verleng van maatskaplike werkers wat afwendingsprogramme met manlike jeugmisdadigers fasiliteer. Aandag is geskenk aan die aard van jeugoortredings deur manlike jeugdiges in Suid-Afrika, beskrywings van afwendingsprogramme wat jeugdiges buite die strafregtelike stelsel behandel ingevolge die Kindergeregtigheidswet nr 75 van 2008, om insigte te win oor die omvang, aard en bydrae van afwendingsprogramme vir manlike jeugoortreders met die oog op rehabilitasie, om die menings en insigte van maatskaplike werkers oor afwendingsprogramme vir manlike jeugoortreders te ondersoek, en om aanbevelings te doen oor die fasilitering van afwendingsprogramme vir sulke oortreders. 'n Kombinasie van kwantitatiewe en kwalitatiewe navorsingsbenaderings is in hierdie studie gevolg. Tydens hierdie ondersoek is ook beide 'n verkennende en beskrywende navorsingsontwerp benut, omdat die literatuur 'n gebrek toon aan die insigte van maatskaplike werkers oor afwendingsprogramme met manlike jeugoortreders. 'n Doelgerigte steekproeftrekking is gebruik om die deelnemers te keur. Gegewens is ingewin deur middel van 'n gestruktureerde vraelys in twintig afsonderlike onderhoude. Sodoende kon 'n geheelbeeld van die deelnemers se menings en insigte aangaande die onderwerp verkry word. Die samestelling van die vraelys is gegrond op inligting wat uit die literatuuroorsig verkry is. Die bevindinge van die ondersoek het grootendeels dié van die literatuuroorsig bevestig, naamlik dat mans meer kwesbaar is vir jeugoortredings, dat ouers en gesinne 'n groot rol speel in die oorsake van jeugoortredings, en dat jeugoortreders baat kan vind by afwendingsprogramme. Die belangrikste aanbevelings voortspruitend uit hierdie studie dui daarop dat maatskaplike werkers meer vaardighede moet opdoen en toegerus moet word om terapeutiese groepe te fasiliteer aangesien dit sal bydra tot die vermindering van die herhaling van die oortreding. Dit is belangrik dat ouers en families betrokke is by afwendingsprogramme omdat dit 'n groter uitwerking op die jeugoortreder sal hê. Die aanbevelings dui ook op die belangrikheid van die monitering en evaluering van afwendingsprogramme om te verseker dat die bepalings ingevolge die Wet korrek toegepas word. Laastens, daar word voorgestel dat meer navorsing oor afwendingspraktyke internasionaal gedoen word om kennis oor die implementering daarvan te verbreed.

Full textENGLISH ABSTRACT: Juvenile offenders have certain characteristics, which separate them from the law abiding young people. These characteristics, together with the subcultures inside prison in which they become socialized, can cause dysfunctional development, which in turn can lead to recidivism. To approach this client system and plan intervention according to the ecological perspective, the social worker needs to be equipped with a certain knowledge base. Firstly, knowledge is necessary about the profile of the juvenile offender. Secondly, the social worker has to understand the impact that a prison environment can have on the juvenile. Thirdly, it is also important that the worker knows how these factors can influence the intervention process and also be aware of different methods to strengthen the social functioning of the juvenile in pnson. This study endeavours to create a scientifically based framework for the development of a strategy for intervention with the juvenile offender, in order to bring about appropriate social functioning and by doing this, reduce recidivism. The research includes aspects of all three the recognized types of research, namely: exploratory, descriptive and explanatory. The profile of the juvenile offender, as well as ways in which the prison environment impacts on his development was determined by means of interviews and described in terms of the effect it might have on the intervention process. The respondents consisted of 11 ex juvenile offenders. Conclusions and recommendations were made which focussed, amongst others, on the various phases in the group work process and the development of knowledge regarding the juvenile offender. This research report can be utilized by social workers for effective intervention with juvenile offenders in prison.
AFRIKAANSE OPSOMMING: Jeugoortreders het sekere karaktereienskappe wat hul van wetsgehoorsame jeugdiges onderskei. Hierdie karaktertrekke, tesame met die gevangeniskultuur waarbinne hul gesosialiseer word, veroorsaak disfunksionele ontwikkeling wat weer na residivisme kan lei. Om volgens 'n ekologiese perspektief intervensie met hierdie kliëntsisteem te benader, is dit eerstens noodsaaklik dat die maatskaplike werker die profiel van die jeugmisdadiger ken. Tweedens is dit nodig dat die werker die impak van die gevangenisomgewing op die jeugdige verstaan. Derdens is dit belangrik dat die werker weet hoe hierdie faktore op die hulpverleningsproses kan impakteer en ook bewus moet wees van verskeie metodes om die jeugdige in die gevangenis se maatskaplike funksionering te beïnvloed. Hierdie studie bevat kenmerke van al drie die erkende navorsingsdoelstellings, naamlik verkenning, beskrywing en verklaring. Die ondersoek het ten doel om 'n wetenskaplik gefundeerde raamwerk daar te stel vir die ontwikkeling van 'n intervensiestrategie ten opsigte van jeugmisdadigers in die gevangenis, ten einde funksionele maatskaplike funksionering mee te bring en sodoende residivisme te verminder. Die profiel van die jeugmisdadiger en die impak van die omgewing op sy ontwikkeling is deur middel van onderhoude bepaal en beskryf in terme van die invloed wat dit op die intervensieproses kan hê. Respondente in die navorsing het uit elf vrygelate jeugmisdadigers bestaan. Gevolgtrekkings en aanbevelings is gemaak wat onder andere gefokus het op die verskeie fases in die groepwerkproses en ontwikkeling van kennis oor die betrokke kliëntsisteem. Hierdie navorsingsverslag sal deur maatskaplike werkers benut kan word vir effektiewe hulpverlening aan jeugdiges in die gevangenis.

Full textKohlberg's Structural Issue Moral Judgement Interview and several questionnaires were administered and journals kept by the educators and the researcher. Analysis of these data allowed us to describe how the program was implemented and showed that the intervention appreciably increased the stage of moral judgement of participants and improved the "moral atmosphere" of the program. In comparison to previous evaluations of the Just Community Approach, this program had more impact on these outcomes. It is suggested that the effects of the program could be strengthened by more intensive training of educators.

Full textUsing a systems theoretical orientation the objective of this study was to implement a strategic approach for psychotherapeutic intervention with six male institutionalized white adolescents at a local custodial school. It was hypothesized that a strategic approach would control absconding for the duration of the investigation. Surveys of the literature were undertaken to provide the background to psychotherapeutic intervention with adolescents in custodial institutions, strategic psychotherapy and absconding. Absconding was selected as the condition for evaluating the interventions because it was an unambiguous indicator of school-based recidivism, viz., the adolescent was either on the property or he was not. The study was structured as a design-and-demonstrate investigation. Audiotape recordings were made during the sessions. Transcriptions of characteristic procedures and sequences of the strategic approach to psychotherapeutic intervention were presented, inter alia, paradoxes, reframing, metaphors, rituals, the declaration of therapeutic impotence. Evaluation of the interventions was based on follow-up interviews with the subjects and a qualitative analysis of risk of absconding aver the course of the intervention process. At the end of the investigation there was some evidence which suggested that five out of the six subjects were not as committed to absconding as they had claimed to be at the beginning of the study. The design of the study did not allow for the conclusion that the strategic approach for controlling absconding was of greater merit than any other form of intervention or no intervention at all. It was noted, however, that twelve of the eighteen potential subjects for the study indicated that they would abscond as soon as the opportunity arose. Therefore it was recommended that the issue of absconding be given priority in therapy on the admission of each new pupil. Given a strategic approach to addressing the issue of absconding in therapy, attention was drawn to a major aim of this type of intervention, viz., to generate a sense of personal autonomy. Hence a further recommendation was that once a pupil had made a commitment not to abscond, his sense of autonomy would need to be supported by an expeditious transfer to one of the more open hostels.

Full textENGLISH ABSTRACT: This study focuses on the implementation of, as well as identifying problem areas associated with the YES-programme offered by NICRO. This specific programme was chosen because most of the young offenders referred to NICRO complete this programme. Young offenders are referred to the programme by the magistrates' court. These are youth that have been arrested for petty crimes such as shoplifting, damage to property and possession of drugs. This programme is also aimed at first time offenders but it became evident throughout the study that these youths might have been arrested once but seems to have been involved in crime at some level prior to being arrested. Youth between the ages of thirteen and eighteen years are accepted into the programme, with exceptions sometimes made for nineteen year olds who are still attending school. Participation in the programme is strictly voluntary, but there must be an admission of guilt on the part of the youth before he/she will be considered for this kind of diversionary alternative. The programme attempts to involve both parent and child in the process of learning and therefore parents are required to attend the first and last sessions with their children. Sessions attended by parents. focus on the improving relationships and communication between parent and child. The programme is viewed as an alternative sanction, and will enable youth to be punished for their crimes whilst at the same time learning new skills, and most importantly, not gaining a criminal record. The programme stretches over eight weeks with weekly sessions that focus on self-concept, decision-making, children's rights and respecting both themselves and those around them. The researcher formed part of the process through both facilitating sessions as well as observing sessions. For these reasons the research methodology focussed primarily on participant observation and interviews.

Deelname aan die program is vrywillig maar die jeugdige moet skuldig pleit voordat hy/sy inaggeneem kan word vir die afwentelingsprogram. Die navorser het deel van die proses uitgemaak deur beide programme waar te neem sowel as programme te fasiliteer. Die navorsingsmetode wat dus benut was, was deelnemende waarneming sowel as onderhoudvoering.

Resumo: Esta dissertação concretizou-se devido às necessidades de ensino e aprendizagem de gêneros orais públicos formais na socioeducação. Teve como objetivo investigar formas de como o Seminário Escolar (SE) pode ser um dos instrumentos que medeiam o processo socioeducativo no desenvolvimento humano, cidadão e escolar de adolescentes que cumprem medida de internação na Fundação Casa (FC). Os participantes da pesquisa eram alunos de uma escola estadual que funciona dentro de uma das unidades de internação da FC, na cidade de Iaras, no interior de São Paulo. Para cumprir tal objetivo, elaborou-se uma sequência didática adaptada (SD) fundamentada na didatização do gênero SE a partir da qual foram produzidos textos pertencentes a esse gênero. Buscou-se desenvolver capacidades de linguagem com vistas à produção do gênero SE e, por extensão, impulsionar o desenvolvimento da autonomia e da cidadania de socioeducandos que cumprem medida de internação. Esta pesquisa inscreve-se no referencial teórico-metodológico do Interacionismo Sociodiscursivo (ISD); na Didática das Línguas da Escola de Genebra (2004); na concepção de linguagem e de gêneros bakhtiniana (2003), nos pressupostos teóricos do gênero SE em destaque aos estudos de Dolz; Schneuwly; de Pietro e Zahnd (2004), Gomes-Santos (2012) e na elaboração do modelo teórico proposto por Barros (2011). Abstract: This dissertation materialized due to the needs of teaching and learning of oral public genres formal in the socioeducation. It aimed to investigate ways in which the School Seminar (SE) can be one of the instruments that mediate the socio-educational process in the human, citizen and school development of adolescents who comply with the measure of criminal internment at Fundação Casa (FC). The study participants were students of a state school that works inside one of the FC internment units, in the city of Iaras, in the countryside of São Paulo. To accomplish this objective, an adapted didactic sequence (SD) was elaborated based on the Didatization of the SE genre from which texts belonging to this genre were produced. The aim was to develop language skills with a view to the production of the SE gender and, by extension, to promote the development of autonomy and citizenship of socio-educators who comply with criminal internment measures. This research is part of the theoretical-methodological framework of Sociodiscursive Interactionism (ISD); in the Teaching of Languages of the Geneva School (2004); in the conception of Bakhtinian language and genres (2003), in the theoretical assumptions of the SE genre in emphasis to the studies of Dolz; Schneuwly; of Pietro and Zahnd (2004), Gomes-Santos (2012) and in the elaboration of the theoretical model proposed by Barros (2011). Full textEsta dissertação teve como objeto de pesquisa o menor abandonado e delinquente de Sergipe do período de 1942 a 1974. É uma pesquisa histórica, de cunho bibliográfico e documental, com abordagem na História Cultural. O objetivo geral foi analisar como as autoridades lidavam com o problema do menor abandonado e delinquente. O recorte temporal está associado à criação da primeira instituição pública sergipana para acolher menores abandonados e delinquentes, chamada Cidade de Menores Getúlio Vargas, que funcionou de 1942, ano da sua inauguração, a 1974, ano em que fechou suas portas após uma crise no sistema de assistencialismo aos menores. Na primeira seção trabalhei as representações sobre o menor nos Novecentos; a legislação vigente; a relação da educação, disciplina e moral com a criminologia infantil. Na segunda seção apresentei a relação da Assistência Social e do Poder Judiciário em face o problema do menor; a importância da educação e da educação para o trabalho para a ressocialização do menor; a origem e o fim da Cidade de Menores de Sergipe; uma análise da sua semelhança com os modelos em que foi inspirada; o problema do menor em Sergipe, levando-se em consideração os encaminhamentos judiciais: da educação ao cárcere; a Casa das Meninas Santa Inês, como uma instituição para acolher meninas abandonadas em Sergipe e a configuração dos menores a partir dos processos judiciais; documentos e boletins individuais do judiciário; além de entrevistas com sujeitos que fizeram parte da Cidade de Menores Getúlio Vargas. Adotei como principais conceitos: abandonado (PEREIRA, 1994 e VEIGA e FARIA FILHO, 1999); delinquente (RIZZINI, 1995 e VEIGA e FARIA FILHO, 1999); educação (DURKHEIM, 1978 e JINZENJI, 2010); instrução (JINZENJI, 2010) e menor (RIZZINI, 2010; PERES, 2002 e VEIGA e FARIA FILHO, 1999). Assim, com esta pesquisa, pretendo contribuir com a historiografia sergipana sobre a história da educação do menor abandonado e delinquente em Sergipe.
