Juvenile justiceAdministration ofNew South Wales.Juvenile delinquentsRehabilitationThis study examines the process of Youth Justice Conferencing in New South Wales within the context of the theory and aims of the restorative justice movement. Analysis of relevant literature and theory suggests that restorative justice is a broad and encompassing movement that entails a decision making process where victims, communities and offenders come together in a joint response to an offence. Although this breadth has allowed and encouraged a proliferation of programs that respond to particular needs and particular demands of culture and social context, the consequence is that both understandings and practices of restorative justices are variable. When theoretical understandings are so varied there will necessarily be a lack of commonality in the way principles are articulated. If practice is not linked directly to principled theory it is inevitable that processes will be vulnerable at all levels to the interaction between context, situations and participant characteristics that may easily deflect the focus from the true purpose of restorative justice. This thesis attempts to clarify the restorative principles relevant to the NSW program with reference to Braithwaite and Pettit???s republican theory (1990) and their notion of dominion. In turn these principles are used to identify five practical elements to be used as a framework to guide youth conferences. Such a framework highlights potential areas for improvement in conference preparation and practice. A case study approach was used to collect data and involved the observation of eighty five Youth Justice Conferences in three New South Wales conferencing regions. As well, one hundred and fifty two currently practising Youth Justice Conferencing practitioners (Police, Conveners, Managers) in New South Wales completed a mail out questionnaire. Findings from the study suggest that conference processes are influenced by the presence or absence of five particular elements: the attendance of victims, the attendance of communities, the attendance of offender support, reparation to victims, communities and offenders and the experience of non-domination during the conference space. However, findings also suggest that ???situational??? factors may mediate these key elements to enhance or compromise the overall process. This thesis suggests that many of the issues arising in NSW conferences result from the failure to articulate the links between restorative justice theory and practice. While in NSW such links may intentionally have been unarticulated in order to encourage a freedom within the process, in reality the lack of clarification has led to a freedom in discretion that sometimes diminishes the chance of success. Therefore it proposes the need for a more articulated translation of theory into principles that will in turn frame practice. In this way the thesis uses the normative theory proposed by Braithwaite and Pettit (1990) to provide an explanatory and ideal framework for best practice in NSW Youth Justice Conferencing.

Abstract:
Many social workers are unaware of their responsibilities related to African American, male, juvenile delinquents who have gang affiliation. Punishment by detention is detrimental to these youth because detention perpetuates criminal careers and does not rehabilitate juvenile offenders. The purpose of this action research study was to determine how social workers understood their role in the rehabilitation of gang-affiliated, African American, male juvenile delinquents. Differential association theory was used as the conceptual framework to understand the detriment of youth being incarcerated without rehabilitation. One focus group of 5 social workers was formed using purposive sampling of social workers who worked with the juvenile delinquent population in different settings. Manual transcription, hand coding, and thematic analysis were used to analyze the data. Participants explained why social workers see the population of African American, male, juvenile delinquents with gang involvement as vulnerable, reasons for gang affiliation, barriers to treatment, and how to engage this population. Findings include strategies to promote positivity within urban environments, foster a sense community in these areas, and engage clients. Recommendations were made to advocate for policy change, incorporate the arts into intervention, and to create urban beautification programs. Findings and recommendations from this study might bring about social change by providing insight into how social workers understand their role in the rehabilitation of the population of African American, male, juvenile delinquents with gang involvement and what can be done to enhance the social work involvement.

Abstract:
With the advent of increased juvenile delinquency in our nation, the need for prevention and rehabilitation is paramount. Juvenile delinquent acts are becoming more serious and violent with offenders perpetrating at younger ages. Analysis suggests an increase in juvenile crime in the near future (Stone, 2000). Pinpointing the cause of delinquency is an arduous task because of the many contributing factors (e.g., impulsivity, aggression, low intellect, poor family attachment, drug, and alcohol abuse). By changing the emotional deficits found in beginning delinquency, the likelihood of developing delinquent behavior may be impeded. Research indicates that adolescents who commit crimes are lacking in empathy (e.g., Aleksic, 1975; Cohen & Strayer, 1996; Ellis, 1982; Gibbs, 1987; Marcus & Gray, 1998), thus, promoting empathy may be an avenue for prevention and rehabilitation. This study examined the levels of empathy of adjudicated youth in four juvenile correctional facilities in Texas. Using the Interpersonal Reactivity Index (IRI), empathy levels of 170 youth were examined. Youth in the study demonstrated low levels of empathy. The study found that empathy levels of adjudicated youth were differentiated by incarcerating facility, IQ, type of offense, disability status, and phase level of a re-socialization training program. Age was not found to be a significant factor for differentiating empathy levels. Youth demonstrated similiar empathy levels at three of the four incarcerating facilities. However, empathy scores were still below average. IQ ranges were differentiated by the IRI, and found to be lower than normed scores. Type of committing offense was discriminated and found to indicate low empathy levels. Youth without an identified disability scored lower than subjects with emotional/behavioral disorders (E/BD) and youth with learning disabilities (LD). This may reflect the pattern of underidentification of juveniles in correctional facilities (Nelson, Rutherford, & Wolford, 1987). Phases of Re-socialization is an instructional therapuetic program with an empathy component used at the Texas Youth Commission correctional facilities. Data from the study indicated that youth at higher phase levels demonstrated increased empathy. Much of the data are inconsistent, thus establishing the need for further research. A deeper understanding of the impact of each factor (e.g., incarcerating facility, age, IQ, type of offense, disability status, phase) may be accomplished by further research. However, data from this study is consistent with previous research (e.g., Daberman, 1999; Ellis, 1982; Gibbs, 1987; Lee & Prentice, 1988), indicating a link between juvenile delinquents and empathic deficits.

Abstract:
The prediction of adolescents' antisocial behavior was central to this investigation. Specifically, use of the Psychopathy Checklist, Revised (PCL) as a predictor of the treatment outcome of a residential unit for juvenile delinquents was evaluated. Toward this goal, three foci guided hypothesis generation and testing. Multiple hypotheses were tested to consider (a) the predictive validity of the PCL, (b) the match between the PCL and Moffitt's (1993b) taxonomy of antisocial behavior and (c) the utility of the PCL as a selection instrument for assignment of juvenile delinquents to behavioral residential unit treatment. Subjects consisted of 80 adolescent, racially-mixed males (28 unit residents, 52 high school students).Predictive validity was evidenced for criteria consisting of future incarceration and future violent and nonviolent criminal offenses committed over the year following PCL administration. Prediction of future incarceration produced results similar to those found with adult prisoners (80% of psychopaths and 21% of nonpsychopaths were incarcerated). Moreover, PCL scores accounted for 26% of the variability in violent offenses and 40% of the variability of nonviolent offenses committed by subjects during the follow-up year.The match between Moffitt's taxonomy of antisocial behavior and the PCL was evidenced by data gathered on those subjects who were known to have engaged in antisocial behavior (N=71). The constructs that Moffitt (1993b) argued would mediate antisocial behavior and are measured with PCL items (such as neuropsychological executive functioning) significantly improved the prediction of future antisocial behavior over that accounted for by Moffitt's taxonomy. In fact, PCL items accounted for more unique variability in future offenses committed than did Moffitt's taxonomy.Utility analyses indicated that the PCL could be used to improve the prevention of success-improbable delinquents from being assigned residential treatment. Dollar value utility analysis indicated that over $5800 per resident could be reallocated to other interventions by assigning success-improbable delinquents to other treatments. Doing so was projected to result in over $175,000 less to be spent on treating unsuccessful residents. It was also argued that utility analysis figures could be to argue for development of alternative programs for delinquents who would probably be unsuccessful in the residential unit program. Residents who presented with internalized psychiatric disorders were not identified using the proposed cutoff score. Therefore, it was recommended that a second test be used to detect delinquents in need of in-patient psychiatric care.

Abstract:
Because there has been a paucity of research on the educational needs of females with academic, behavioral, and emotional problems involved with the juvenile justice system, this study has been an attempt to classify and compare specific characteristics of this population. In particular, it examined their demographics, disability prevalence rates, along with academic, behavioral, and emotional functioning levels, in order to further understand their relationship to the resocialization or recidivism of the different groups of female juveniles incarcerated in the state of Texas, and contribute to the research for further developing successful prevention and intervention programs. Various demographic factors of the female juveniles in this study were examined: (a) offender type, (b) county of commitment, (c) race/ethnicity, (d) age at first referral, and (e) English language proficiency. Prevalence rates of special education disabilities were determined. Academic functioning was measured by (a) IQ; (b) last school grade completed; (c) Test of Adult Basic Education (TABE) reading gain score; and (d) TABE math gain score. Behavioral functioning was indicated through (a) offense history, (b) documented behavior incidents, and (c) total risk score. Emotional functioning included DSM-IV diagnoses and treatment needs. Due to the design of the research being a descriptive exploration, the findings produced this compilation of attributes. The population of study typically reached an education level of 8th grade or less before becoming incarcerated. Their IQ is usually in the range of 80 to 90 points, with their reading and math achievement levels lagging about five years behind those of their age group. Their gains in reading and math are usually two to three levels per year. The female juveniles averaged 10 documented behavior incidents during their periods of incarceration. Their Global Assessment of Functioning (GAF) scores at intake showed they had moderate mental health symptoms and/or moderate difficulty in social, occupational, or school functioning. For this study population, there were almost twice as many recidivists as first-time offenders, and the findings showed that their characteristics, even those of different disability groups, were much more alike than different.

Abstract:

Despite the unpleasant living conditions in prison, recidivism seems to be an uncontrollable phenomenon. It is evident that prison life is harsh with inmates having to sleep on the floors due to overpopulation, frequently subjected to physical and sexual abuse, and overpopulation leading to numerous communicable diseases, such as tuberculosis, HIV/AIDS and sexually transmitted infections. Prison should therefore, be the least favourable ecosystem in which to be incorporated. However, research indicates that thousands of youth return to prison habitually. This study aimed to explore juvenile inmates perceptions of their return to prison. Although recidivism is often measured in terms of the success of rehabilitation programmes, this study focused on eliciting socio-economic factors influencing recidivism.

Abstract:
The Aggression Replacement Training Program (ART) is an approach to reduce aggression in Young Offenders. This program was implemented with a sample of youths on probation and living in the community (N = 21). The goal was to evaluate the efficacy of the program, and to measure changes in aggression, skill acquisition and recidivism rates. A quasi-experimental nonequivalent control group design was used. The Aggression Questionnaire and Skillstreaming Checklist were the main source of data and results were compared pre- and posttest. Recidivism rates were determined six months after the start of the program. An improvement in aggression scores was found in the ART sample, but this was not statistically significant. Only 5.8% of the total sample that had recidivated, committed an aggressive crime. Recommendations are made to maximize the efficacy of the ART program for the future.

The present study examined the effects of group home staffing variables on the proportion of successful program completions by adjudicated juvenile delinquents. A survey questionnaire was sent to most small group homes serving this population in California. Respondents became the 114 participants. There were no significant relationships between the staff/resident ratios and successful completion, between the inconsistency measure and successful completion, or between staffing pattern type and successful completion. Homes that employed live-in part-time family counselors had the highest staff/resident ratios. Homes that employed family counselors working in shifts had the highest staffing inconsistency.

ENGLISH ABSTRACT: Adolescence is a challenging development stage because youths engage in risk-taking behaviour, including anti-social and criminal acts. Factors which contribute to youth becoming involved in crime include having a poor self-concept, being male, the negative behaviour of parents, family dysfunction, low socio-economic status, low literacy levels or being illiterate, peers who exercise a negative influence, and poor role models. Diversion strategies are practised worldwide, including South Africa, to deal with the growing number of youth in conflict with the law. After diversion practice was legalised in South Africa, some challenges have been experienced with implementation. However, the views of social workers are limited regarding diversion practices after the Child Justice Act no 75 of 2008 was introduced. The objective of the study is to gain insights from social workers who facilitate diversion programmes with male juvenile delinquents. In this study, attention was paid to explaining the nature of juvenile delinquency of male adolescents in a South African context; describing diversion programmes in terms of the Child Justice Act no 75 of 2008 to deal with children outside the criminal justice system; discerning the scope, nature and contribution of diversion programmes for the rehabilitation of delinquents; investigating the views of social workers on diversion programmes for male juvenile delinquents; and to make recommendations regarding the facilitation of diversion programmes with male juvenile delinquents. A combination of quantitative and qualitative research approaches were used in the study. The study further assumed an exploratory and descriptive research design due to the limited information available regarding the views of social workers on diversion programmes with male juvenile delinquents. A purposive sampling method was used to select the participants. Data was gathered by means of a structured questionnaire, which was administered during 20 individual interviews. This allowed for a holistic view to be gained of participants' opinions about and insights into the topic. The design of the questionnaire was based on the information obtained from the literature review. The findings of the empirical investigation mainly confirmed the findings of the literature study that males are more vulnerable to juvenile delinquency, that parents and families play substantial roles in the causes of juvenile delinquency and, lastly, that diversion programmes offer much benefit to youth offenders. The most important recommendations resulting from the study indicate that social workers should become more skilled and equipped to facilitate therapeutic groups as this will contribute to the reduction of re-offending. Parental and family involvement in diversion programmes is essential as it will increase the impact on the youth offender. In addition, the recommendations indicate the significance of monitoring and evaluation of diversion programmes, in this way ensuring the proper implementation of the Act. Lastly, it is suggested that more research be done about diversion practices internationally to increase knowledge regarding implementation.

Faktore wat bydra tot die jeugdige se betrokkenheid by misdaad is die feit dat hy tot die manlike geslag behoort, 'n lae selfbeeld het, die negatiewe gedrag van ouers, uit 'n gebroke huis kom, aan lae sosioekonomiese status ly, die lae vlak van of geen geletterdheid het nie, vriende wat 'n negatiewe invloed uitoefen, en swak rolmodelle. Afwendingstrategieë word wêreldwyd beoefen, ook in Suid-Afrika, om die toenemende aantal jeugdiges wat met die gereg bots, te help. Nadat afwendingspraktyke in Suid-Afrika gewettig is, is sekere uitdagings in die praktyk ervaar. Min menings is deur maatskaplike werkers geopper oor afwendingspraktyke nadat bepalings ingevolge die Kindergeregtigheidswet nr 75 van 2008 toegepas is. Die doel van die studie is om insigte te verleng van maatskaplike werkers wat afwendingsprogramme met manlike jeugmisdadigers fasiliteer. Aandag is geskenk aan die aard van jeugoortredings deur manlike jeugdiges in Suid-Afrika, beskrywings van afwendingsprogramme wat jeugdiges buite die strafregtelike stelsel behandel ingevolge die Kindergeregtigheidswet nr 75 van 2008, om insigte te win oor die omvang, aard en bydrae van afwendingsprogramme vir manlike jeugoortreders met die oog op rehabilitasie, om die menings en insigte van maatskaplike werkers oor afwendingsprogramme vir manlike jeugoortreders te ondersoek, en om aanbevelings te doen oor die fasilitering van afwendingsprogramme vir sulke oortreders. 'n Kombinasie van kwantitatiewe en kwalitatiewe navorsingsbenaderings is in hierdie studie gevolg. Tydens hierdie ondersoek is ook beide 'n verkennende en beskrywende navorsingsontwerp benut, omdat die literatuur 'n gebrek toon aan die insigte van maatskaplike werkers oor afwendingsprogramme met manlike jeugoortreders. Die bevindinge van die ondersoek het grootendeels dié van die literatuuroorsig bevestig, naamlik dat mans meer kwesbaar is vir jeugoortredings, dat ouers en gesinne 'n groot rol speel in die oorsake van jeugoortredings, en dat jeugoortreders baat kan vind by afwendingsprogramme. Die belangrikste aanbevelings voortspruitend uit hierdie studie dui daarop dat maatskaplike werkers meer vaardighede moet opdoen en toegerus moet word om terapeutiese groepe te fasiliteer aangesien dit sal bydra tot die vermindering van die herhaling van die oortreding. Abstract:
Serious and violent juvenile offenders cause a disproportionate amount of harm to society, yet this population receives very little attention within the realm of empirical research. This research study examined the recidivism outcomes of 296 serious and violent offenders previously exposed to rehabilitative treatment in the Capital and Serious Violent Offender Program provided by the Texas Youth Commission. This group of juveniles was followed for three years following their release from institutionalization. This analysis revealed that 52% of those released were rearrested at least once during the follow-up period for any offense, while 48% of those released desisted from crime altogether. Of those 296 released, 34% were rearrested for at least one new felony offense. The analyses indicate that those involved in various forms of institutional misconduct during institutionalization were significantly more likely to recidivate. African-American race and institutional misconduct in the form of rule infractions emerged as the most consistent predictors of recidivism for this sample. This study concludes with a discussion of policy implications and risk assessment related to the decisions that are made to release this population of violent juvenile offenders.

Successful outdoor camp programs are being threatened by decreased funding and increased focus on the control of juvenile delinquents. To determine the success of outdoor camp programs for the juvenile delinquent, it is important to examine the recidivism rates of those who go through the programs compared to those who do not. By properly infusing outdoor camp programs with resiliency education, new programs can be created with even more success. This paper is a literature review of the present state of research in both fields. With the background information presented here, the goal is to become a 'springboard' for further research.

ENGLISH ABSTRACT: Juvenile offenders have certain characteristics, which separate them from the law abiding young people. These characteristics, together with the subcultures inside prison in which they become socialized, can cause dysfunctional development, which in turn can lead to recidivism. To approach this client system and plan intervention according to the ecological perspective, the social worker needs to be equipped with a certain knowledge base. Firstly, knowledge is necessary about the profile of the juvenile offender. Secondly, the social worker has to understand the impact that a prison environment can have on the juvenile. Thirdly, it is also important that the worker knows how these factors can influence the intervention process and also be aware of different methods to strengthen the social functioning of the juvenile in pnson. This study endeavours to create a scientifically based framework for the development of a strategy for intervention with the juvenile offender, in order to bring about appropriate social functioning and by doing this, reduce recidivism. The research includes aspects of all three the recognized types of research, namely: exploratory, descriptive and explanatory. The profile of the juvenile offender, as well as ways in which the prison environment impacts on his development was determined by means of interviews and described in terms of the effect it might have on the intervention process. The respondents consisted of 11 ex juvenile offenders. Conclusions and recommendations were made which focussed, amongst others, on the various phases in the group work process and the development of knowledge regarding the juvenile offender. This research report can be utilized by social workers for effective intervention with juvenile offenders in prison.
AFRIKAANSE OPSOMMING: Jeugoortreders het sekere karaktereienskappe wat hul van wetsgehoorsame jeugdiges onderskei. Hierdie karaktertrekke, tesame met die gevangeniskultuur waarbinne hul gesosialiseer word, veroorsaak disfunksionele ontwikkeling wat weer na residivisme kan lei. Om volgens 'n ekologiese perspektief intervensie met hierdie kliëntsisteem te benader, is dit eerstens noodsaaklik dat die maatskaplike werker die profiel van die jeugmisdadiger ken. Tweedens is dit nodig dat die werker die impak van die gevangenisomgewing op die jeugdige verstaan. Derdens is dit belangrik dat die werker weet hoe hierdie faktore op die hulpverleningsproses kan impakteer en ook bewus moet wees van verskeie metodes om die jeugdige in die gevangenis se maatskaplike funksionering te beïnvloed. Hierdie studie bevat kenmerke van al drie die erkende navorsingsdoelstellings, naamlik verkenning, beskrywing en verklaring. Die ondersoek het ten doel om 'n wetenskaplik gefundeerde raamwerk daar te stel vir die ontwikkeling van 'n intervensiestrategie ten opsigte van jeugmisdadigers in die gevangenis, ten einde funksionele maatskaplike funksionering mee te bring en sodoende residivisme te verminder. Die profiel van die jeugmisdadiger en die impak van die omgewing op sy ontwikkeling is deur middel van onderhoude bepaal en beskryf in terme van die invloed wat dit op die intervensieproses kan hê. Respondente in die navorsing het uit elf vrygelate jeugmisdadigers bestaan. Gevolgtrekkings en aanbevelings is gemaak wat onder andere gefokus het op die verskeie fases in die groepwerkproses en ontwikkeling van kennis oor die betrokke kliëntsisteem. Hierdie navorsingsverslag sal deur maatskaplike werkers benut kan word vir effektiewe hulpverlening aan jeugdiges in die gevangenis.

The present study examined the effects of group home staffing variables on the proportion of successful program completions by adjudicated juvenile delinquents. A survey questionnaire was sent to most small group homes serving this population in California. Respondents became the 114 participants. There were no significant relationships between the staff/resident ratios and successful completion, between the inconsistency measure and successful completion, or between staffing pattern type and successful completion. Homes that employed live-in part-time family counselors had the highest staff/resident ratios. Homes that employed family counselors working in shifts had the highest staffing inconsistency.

A description and analysis of the outcomes of an experiment with Kohlberg's Just Community Approach in the development of moral judgements of francophone delinquents is examined. Data were collected from 12 adolescents ranging in age from 17 to 18 years and from 8 adult educators involved in the Just Community Program at Boscoville Center (Montreal, Qc.) which was implemented between October 1987-October 1988.
Kohlberg's Structural Issue Moral Judgement Interview and several questionnaires were administered and journals kept by the educators and the researcher. Analysis of these data allowed us to describe how the program was implemented and showed that the intervention appreciably increased the stage of moral judgement of participants and improved the "moral atmosphere" of the program. In comparison to previous evaluations of the Just Community Approach, this program had more impact on these outcomes. It is suggested that the effects of the program could be strengthened by more intensive training of educators.

Using a systems theoretical orientation the objective of this study was to implement a strategic approach for psychotherapeutic intervention with six male institutionalized white adolescents at a local custodial school. It was hypothesized that a strategic approach would control absconding for the duration of the investigation. Surveys of the literature were undertaken to provide the background to psychotherapeutic intervention with adolescents in custodial institutions, strategic psychotherapy and absconding. Absconding was selected as the condition for evaluating the interventions because it was an unambiguous indicator of school-based recidivism, viz., the adolescent was either on the property or he was not. The study was structured as a design-and-demonstrate investigation. Audiotape recordings were made during the sessions. Transcriptions of characteristic procedures and sequences of the strategic approach to psychotherapeutic intervention were presented, inter alia, paradoxes, reframing, metaphors, rituals, the declaration of therapeutic impotence. Evaluation of the interventions was based on follow-up interviews with the subjects and a qualitative analysis of risk of absconding aver the course of the intervention process. At the end of the investigation there was some evidence which suggested that five out of the six subjects were not as committed to absconding as they had claimed to be at the beginning of the study. The design of the study did not allow for the conclusion that the strategic approach for controlling absconding was of greater merit than any other form of intervention or no intervention at all. It was noted, however, that twelve of the eighteen potential subjects for the study indicated that they would abscond as soon as the opportunity arose. Therefore it was recommended that the issue of absconding be given priority in therapy on the admission of each new pupil. Given a strategic approach to addressing the issue of absconding in therapy, attention was drawn to a major aim of this type of intervention, viz., to generate a sense of personal autonomy. Hence a further recommendation was that once a pupil had made a commitment not to abscond, his sense of autonomy would need to be supported by an expeditious transfer to one of the more open hostels.

ENGLISH ABSTRACT: This study focuses on the implementation of, as well as identifying problem areas associated with the YES-programme offered by NICRO. This specific programme was chosen because most of the young offenders referred to NICRO complete this programme. Young offenders are referred to the programme by the magistrates' court. These are youth that have been arrested for petty crimes such as shoplifting, damage to property and possession of drugs. This programme is also aimed at first time offenders but it became evident throughout the study that these youths might have been arrested once but seems to have been involved in crime at some level prior to being arrested. Youth between the ages of thirteen and eighteen years are accepted into the programme, with exceptions sometimes made for nineteen year olds who are still attending school. Participation in the programme is strictly voluntary, but there must be an admission of guilt on the part of the youth before he/she will be considered for this kind of diversionary alternative. The programme attempts to involve both parent and child in the process of learning and therefore parents are required to attend the first and last sessions with their children. Sessions attended by parents. focus on the improving relationships and communication between parent and child. The programme is viewed as an alternative sanction, and will enable youth to be punished for their crimes whilst at the same time learning new skills, and most importantly, not gaining a criminal record. The programme stretches over eight weeks with weekly sessions that focus on self-concept, decision-making, children's rights and respecting both themselves and those around them. The researcher formed part of the process through both facilitating sessions as well as observing sessions. For these reasons the research methodology focussed primarily on participant observation and interviews.
AFRIKAANSE OPSOMMING: Die studie fokus op die proses van implementering en die identifisering van probleemareas binne die YES-program wat deur NICRO aangebied word. Die YES-program was spesifiek gekies omdat meeste van die jeugdiges wat na NICRO verwys word hierdie program voltooi. Jeugdiges word deur die hof verwys na die program wat dien as 'n afwentelingsprogram. Hierdie jeugdiges word meestal gearresteer vir geringe misdade soos winkeldiefstal, beskadiging van eiendom, en die besit van dwelms. Deelname aan die program is vrywillig maar die jeugdige moet skuldig pleit voordat hy/sy inaggeneem kan word vir die afwentelingsprogram. Die navorser het deel van die proses uitgemaak deur beide programme waar te neem sowel as programme te fasiliteer. Die navorsingsmetode wat dus benut was, was deelnemende waarneming sowel as onderhoudvoering.

Resumo: Esta dissertação concretizou-se devido às necessidades de ensino e aprendizagem de gêneros orais públicos formais na socioeducação. Teve como objetivo investigar formas de como o Seminário Escolar (SE) pode ser um dos instrumentos que medeiam o processo socioeducativo no desenvolvimento humano, cidadão e escolar de adolescentes que cumprem medida de internação na Fundação Casa (FC). Os participantes da pesquisa eram alunos de uma escola estadual que funciona dentro de uma das unidades de internação da FC, na cidade de Iaras, no interior de São Paulo. Para cumprir tal objetivo, elaborou-se uma sequência didática adaptada (SD) fundamentada na didatização do gênero SE a partir da qual foram produzidos textos pertencentes a esse gênero. Buscou-se desenvolver capacidades de linguagem com vistas à produção do gênero SE e, por extensão, impulsionar o desenvolvimento da autonomia e da cidadania de socioeducandos que cumprem medida de internação. Esta pesquisa inscreve-se no referencial teórico-metodológico do Interacionismo Sociodiscursivo (ISD); na Didática das Línguas da Escola de Genebra (2004); na concepção de linguagem e de gêneros bakhtiniana (2003), nos pressupostos teóricos do gênero SE em destaque aos estudos de Dolz; Schneuwly; de Pietro e Zahnd (2004), Gomes-Santos (2012) e na elaboração do modelo teórico proposto por Barros (2011). Abstract: This dissertation materialized due to the needs of teaching and learning of oral public genres formal in the socioeducation. It aimed to investigate ways in which the School Seminar (SE) can be one of the instruments that mediate the socio-educational process in the human, citizen and school development of adolescents who comply with the measure of criminal internment at Fundação Casa (FC). The study participants were students of a state school that works inside one of the FC internment units, in the city of Iaras, in the countryside of São Paulo. To accomplish this objective, an adapted didactic sequence (SD) was elaborated based on the Didatization of the SE genre from which texts belonging to this genre were produced. The aim was to develop language skills with a view to the production of the SE gender and, by extension, to promote the development of autonomy and citizenship of socio-educators who comply with criminal internment measures. This research is part of the theoretical-methodological framework of Sociodiscursive Interactionism (ISD); in the Teaching of Languages of the Geneva School (2004); in the conception of Bakhtinian language and genres (2003), in the theoretical assumptions of the SE genre in emphasis to the studies of Dolz; Schneuwly; of Pietro and Zahnd (2004), Gomes-Santos (2012) and in the elaboration of the theoretical model proposed by Barros (2011). There is a growing sense of apathy and lack of focus amongst the youth, which contributes to the threat of social integration. Constructive alternatives are therefore needed to curb gangsterism, drug abuse and other criminal activities among youth at risk. It has become imperative to challenge the present situation in which crime has become one of the most attractive options facing our youth. Through a programme of contructive engagement, a substantial difference can be made in their rehabilitation and ultimately their active participation in building a safer society. A strong emphasis should be placed on the development and implementation of effective restorative justice principles, alternative sentencing and community-based rehabilitation programmes, particularly for young people in marginalised communities.

The goal of this research study was to explore and describe the experiences of parents whose children have completed the diversion programme in order to make recommendations to probation officers, social workers and people who facilitate the diversion programmes. The study focused on the Youth Empowerment Scheme programme (YES Programme) because it is the diversion programme mostly used in the Eastern Cape. The aim of the programme is to divert young people in trouble with the law away from the criminal justice system and to rehabilitate the young offenders by providing them with essential life skills that can address the offenders’ real problems. In the study the researcher made use of a qualitative research approach in an attempt to explore the experiences of parents whose children have completed the YES programme. The permission of the gatekeeper was sought before the study commenced. The researcher used purposive sampling to recruit participants. Data was collected by means of semi-structured interviews. In analysing the data, the researcher used the steps for qualitative data analysis as stated in Creswell (2003:192). Three main themes along with sub-themes and categories were identified during the process of data analysis. The main findings that emanated from this study were: the seemingly upcoming culture of lack of respect for authority on the part of the youth of today. Another major finding of this study is that the traditional function of families, notably, socialisation of young people within the family structure is on the wane. The recommendations that emanated from this study are: that the YES programme needs to be adjusted to address the specific needs of children that are referred to the YES programme and those of their families and communities. Family life should be strengthened through community development programmes that seek to address family problems of any nature, namely, material, psycho-social, economic, to mention just a few. Community development programmes should address fragile families through community development approaches that are comprehensive and integrated.

An analysis of the effects of resocialization programming on juvenile offender resiliency levels was conducted with 220 juveniles committed to a maximum security facility. Data were examined on the subjects' age, race/ethnicity, length of time at the facility, level of resocialization, and resiliency score. The resocialization programming contains cognitive and social components that would be instrumental in augmenting juvenile offender resiliency levels. Analysis of the variables did not show a significant increase in juvenile offender resiliency levels. The results did display that students who were at the facility longer and who were in the older age groups had higher levels of resocialization.

This dissertation was a research subject and the waif delinquent Sergipe period 1942-1974. It is a historical survey of bibliographical and documentary approach to the Cultural History. The overall goal was to analyze how the authorities dealt with the problem of homeless children and delinquent. The time frame is associated with the creation of the first public institution to host sergipana offenders and abandoned children, called the City of Minors Getúlio Vargas, which ran from 1942, the year of its inauguration in 1974, when it closed its doors after a crisis in the system welfare of minors. In the first section, i worked the representations of the lowest in the nineteen hundreds, the current legislation, the relationship of education, discipline and moral criminology child. In the second section, i presented the relationship of Social Assistance and the judiciary in the face of the problem smaller, the importance of education and education to work for the rehabilitation of the minor, the origin and the end of the Lower City of Sergipe; analysis of its resemblance to the models in which it was inspired , the problem of lower Sergipe, taking into account the judicial referrals: from education to prison, the House of Girls Santa Inês, as an institution to house abandoned girls in Sergipe and configuration of minors from legal proceedings; documents and newsletters individual judiciary, besides interviews with people who were part of the City of Minors Getúlio Vargas . Adopted as main concepts: "abandoned" (PEREIRA, 1994 and VEIGA and FARIA FILHO, 1999); "delinquent" (RIZZINI, 1995 and VEIGA and FARIA FILHO, 1999),"education" (DURKHEIM, 1978 and JINZENJI, 2010); statement (JINZENJI, 2010) and "minor" (RIZZINI, 2010; PERES, 2002 and VEIGA and FARIA FILHO, 1999). So with this research, i intend to contribute to the historiography sergipana about the history of education of homeless children and delinquent in Sergipe.
Esta dissertação teve como objeto de pesquisa o menor abandonado e delinquente de Sergipe do período de 1942 a 1974. É uma pesquisa histórica, de cunho bibliográfico e documental, com abordagem na História Cultural. O objetivo geral foi analisar como as autoridades lidavam com o problema do menor abandonado e delinquente. O recorte temporal está associado à criação da primeira instituição pública sergipana para acolher menores abandonados e delinquentes, chamada Cidade de Menores Getúlio Vargas, que funcionou de 1942, ano da sua inauguração, a 1974, ano em que fechou suas portas após uma crise no sistema de assistencialismo aos menores. Na primeira seção trabalhei as representações sobre o menor nos Novecentos; a legislação vigente; a relação da educação, disciplina e moral com a criminologia infantil. Na segunda seção apresentei a relação da Assistência Social e do Poder Judiciário em face o problema do menor; a importância da educação e da educação para o trabalho para a ressocialização do menor; a origem e o fim da Cidade de Menores de Sergipe; uma análise da sua semelhança com os modelos em que foi inspirada; o problema do menor em Sergipe, levando-se em consideração os encaminhamentos judiciais: da educação ao cárcere; a Casa das Meninas Santa Inês, como uma instituição para acolher meninas abandonadas em Sergipe e a configuração dos menores a partir dos processos judiciais; documentos e boletins individuais do judiciário; além de entrevistas com sujeitos que fizeram parte da Cidade de Menores Getúlio Vargas. Adotei como principais conceitos: abandonado (PEREIRA, 1994 e VEIGA e FARIA FILHO, 1999); delinquente (RIZZINI, 1995 e VEIGA e FARIA FILHO, 1999); educação (DURKHEIM, 1978 e JINZENJI, 2010); instrução (JINZENJI, 2010) e menor (RIZZINI, 2010; PERES, 2002 e VEIGA e FARIA FILHO, 1999). Assim, com esta pesquisa, pretendo contribuir com a historiografia sergipana sobre a história da educação do menor abandonado e delinquente em Sergipe.

Research on juvenile offender treatment and intervention has called for a shift from a deficits-based to a strengths-based approach (Marshall, Ward, Mann, Moulden, Fernandez, Serran, & Marshall, 2005; Wormith, Althouse, Simpson, Reitzel, Fagan, & Morgan, 2007; Zeldin, 2004). One potential approach to treatment fosters a sense of psychological empowerment in youth. Although research has yet to explore the experience of psychological empowerment within incarcerated youth, theory on empowerment suggests that it could help youth to create both cognitive (e.g., increased self-esteem, increased confidence) and behavioral (e.g., improving quality of life, social integration) changes in their lives (Cargo, Grams, Ottoson, Ward, & Green, 2003; Holden, Crankshaw, Nimsch, Hinnant, & Hund, 2004a). Empowerment-based programming may also help youth develop specific psychosocial capacities, such as competence, confidence, and self-efficacy, which are necessary skills for future success and community reintegration. The purpose of the current study was to establish a measure of psychological empowerment (PE) and explore potential behavioral correlates of PE for young men within Oregon Youth Authority (OYA) correctional and re-entry facilities. Using a cross-sectional, non-experimental design, quantitative data from self-report surveys of incarcerated youth on PE in three settings within correctional facilities as well as OYA staff ratings of behavioral success in five skill areas was collected. Confirmatory factor analyses did not support the three-factor structure of PE. A single-factor structure of Intrapersonal PE was found to fit the data in three correctional settings. The present study has implications for the reconceptualization and reoperationalization of psychological empowerment in this unique context. Using the confirmed sub-scale, results of hierarchical linear models indicated that Intrapersonal PE was a significant predictor of behavioral success in two of the five OYA domains. Even with an imperfect operationalization of PE, there was partial evidence for the predictive ability of Intrapersonal PE.
