Full textThe inner search for truth will allow the judge to benefit from a knowledge of the documents by a volontary or forced exhibition and also to carry out an examination of these, if their sincerity is challenged or their interpretatiion is necessary. This same inner search can also lead the magistrate to a supervisioin or to investigations concerning the parties declarations susceptible of constituing a confession, an oath, a presumption of the beginning of a written proof equivalent. By another way, the judge will establish an outer search for truth in direction of the facts out of the course or toward third persons forrigners from the initial case. This outer search will allow the magistrate to lead personnal investigations cooncerning the case's facts or the intrust a specialist for a technical mission. This same outer search can also lead the judge to proceed to the audition of thirds as witnesses, as amicus curiae, or to the bringing into of some others finally, the third associated to this truth manifestation can himself be a publiv peosecutor or a judge

Full textThe question of judges legitimacy is certainly one of the most fundamental in modern democratic states. The two main systems in the democratic world (common law and civil law) have different traditions which gave specific solutions, but they share a common goal : the protection of Human Rights. This goal does not imply democratic legitimacy. Actually there are no reasons, neither theoretical nor pragmatic, to submit judges to any kind of election (I). But present institutions have to face an institutional paradox : judges has to be connected to the State, that suggest relations with the political power and judge's independence has to be insure (II). However in modern democracy there is no doubt that judges should have a fundamental place in the legal order. And they have such high position in constitutions. Because there is no real individual freedom if individual rights are not protect by an independent institution (III). (Full abstract inside)

Full textThe independence of an examining magistrate is now a topical question loth in algeria and france. As an investigator and as a juridiction, the judge has, in the two legal systeme, a huge power on people and things and this helps him to accomplish the mission he is in charge of, to instinct for and against to reach the truth. However, this neutrality will not be achieved completely unless the examining magistrate is assured of the respect of defence rights and the lawfulness of the procedure which balance is preached to by both the algerian and french codes. Neverthless, the independance of a judge as a magistrate or as a juridiction is seriously compromised particulary with regard to the public prosecutor. The proposed or envisaged solutions in algeria and france are still not sufficient. The only possible remedy is to give to private parties powers at least equal to those given to the prosecuting magistrates

The relations between the applicant taxpayer and the judge in the course of a trial follow the rules of administrative litigation (written, contradictory, inquisitorial characters). Full textThe idea of democraty involves that the legitimacy of a power must come from election. Therefore the first conclusion that is drawn from this statement is that, the judge is not legitimate because he is not elected but nominated by the executive power. This conclusion is totally wrong because legitimacy can not just comme from election, there are others sources of legitimacy, every fonction must have her own sources of legitimacy. So, the comptetence of the judge, his relative independance, his impartiality and the rules of procedures that he follows are the fondaments of his legitimacy. But those criterias are unsufficient and unable to explain the transformation of the role of the judge. In fact, this transformation has also transform the question of legitimacy and the problem today is the one of the legitimacy of the production of social norms. This is due to the emergence of new judicial actors who appear on the judicial scene and solve conflicts as if the were the real masters of judicial power. We are definetely going to face new forms of regulation of conflicts and it will be quite interesting to interrogate ourselves on the new role of the judge in the postmodern society

Full textJules Verne’s novels appeared at a time when the progress of techniques and the development of reading modified the literary practice. As expressed in the contract with his publisher, Jules Hetzel, his works is intended for a large readership, with both the purposes of educating and entertaining. The intertextual method enables us to see how Verne’s novels reflect the XIXth century, by following the leading thread of the self comment of the text. The richness and the variety of the materials the author uses stress the considerable work he did to achieve his own creation. A work which consists in transforming and assimilating other people's texts (literary, documentary works, opinions, cliches, etc. ). It is of major interest for two reasons : the intertextual method is attentive to voices and moods which compose Verne’s texts : it brings us to appreciate the originality of this works which belongs to the XIXth century and continues to attract nowadays readers. In return, this works leads us to widen the notion of intertextuality to an interaction between verbal elements within the text and, from that point of view, to re-examine the representation of the text by itself

Full textThis thesis intends to analyze the concept of preventive war from the standpoint of political philosophy: the history of its constitution as a specific discourse; the attempts to find a precise and effective definition of it; its effects on the tradition of the just war theory. This research employs a synthetic methodology, analyzing as well texts and historical artefacts that are non-philosophical. The result will be a history of the concepts, practices and institutions related to preventive war.With the work of Thucydides as methodological and historical point of departure, our research tries to determine the permanent principles ruling the justification of preventive war. First, we will determine the occurrences of this concept in the corpus of political philosophy, a method that explains the array of authors this thesis surveys, from Thucydides and Cicero to Fichte, Clausewitz, Hegel, or Thomas Schelling, including Saint Augustine, Saint Thomas, Vitoria and the School of Salamanca, Bodin, Gentili, Grotius, Pufendorf and Vattel. We will focus particularly on the way this concept is inseparable of the dialectic between Machiavellism and Antimachiavellism, analyzing authors such as Machiavelli, Francis Bacon, Gentillet, Frederick II of Prussia, Richelieu, Naudé and Botero.Besides, we will analyze the history of preventive war searching for an internal logic at work in the majority of the great conflagrations of the past. The existence of such a preventive logic will lead us to re-evaluate traditional just war theory, imperialism and aggression

Full textThe stakes of determinating the status of the professional judges and magistrates, whether in the judiciary or in the administrative field, are high: the deal being, in the interest of a healthy administration of justice, to weight their independence against the principles of hierarchical subordination an obedience that are at the core of the right system of civil service. The analysis shows that the constitution and the legislator have decided upon various mechanisms in order to insure the collective independence of judges and magistrates from the executive power, at the expense of their individual independence to each other, and more specifically, within their hierarchy. The rising independence of the various kinds of magistrates is proven mainly through the gradual eviction of the government from the determination of the statuary rules applied to these judges and magistrates, as well as the generalization of the Superior Councils, specific entities which help in softening the organic bond between the government and the magistrates. The path of the career of magistrates remain nonetheless close to the one of the state employee. The magistrates are indeed bound to the organisational power of their service by the chief of court. This check is felt even stronger at the time of the professional ascent of the magistrates, since it depends largely on the evaluation of their professional activity made by the chief of court. Moreover, the reality of non-displacement, a traditional guarantee of the independence of judges, has undergone a change and now represents a lessen protection for the magistrates. The civil liability of the State is being substituting for the one of the magistrates, only the disciplinary procedure, internal to the administration, is able to countercheck their responsability

Full textThis thesis is about the functioning of the judicial system that profoundly affects society. Four cases are sketched out to show some of the problems with the current state of the judicial system, which, has three main elements: theory, procedure, and organization. These elements are the main building blocks of the judicial machine and can be manipulated in order to achieve different results. The manipulation is done through what this thesis calls levers of the judicial system. These are subparts that can be seen as an extension of Bentham’s three-part model of the judicial system. Examples include the access to courts lever, acquisition of information lever, and court hierarchy lever. The chapters of this thesis will be centered around these levers. Only the most important levers in the judicial machine are examined in this work. The functioning of these levers can be affected by country-specific elements such as legal culture, history, and other legal rules that do not exist in the other judicial systems compared in this work. These are environmental elements or independent parameters. The manipulation of the positions of the levers of the judicial system can be done in order to deal with the problems the four cases identified

Full textThe thesis is conceived as an analysis of some essential themes of the literature in Jules Renard's works: the country and the peasants, the child, woman and love, life and death. The introduction contains a short presentation of the literary epoch and the writer, the reasons for the choice of these themes and the method of research. There are four chapters for each of the themes contained with the title: "Jules Renard or the life of a tree. The author of the thesis chose this image for clearly illustrate Jules Renard's life and literary work. Therefore the chapters have titles from nature: roots, growth of the three, flowers and fruits, lively and menaced tree. The chapter "roots" presents the theme of the country and the peasants in Jules Renard's rustic novels and in his diary. The second chapter "growth of the tree" presents the childhood based on the novel "Poil de carotte" and on the notes of the diary. "Flowers and fruits" contains an analysis of the love and the women in Renard's life and works. The ideal woman appears in Renard's dreams but he needs also the woman of his days, the wife. They are the flowers. The fruits are the temptation of the dream and the marital love. The analysis is based upon Renard's theatre, on his novels and on the diary. The last chapter is an analysis of the themes life and death in Jules Renard's diary. The author of the thesis presents the writer's life double character: a strong desire to live and to be active, and the obsession of the death, the fears and the sickness. The conclusions provide emphasis on the literary value of Jules Renard's works, on the modern aspects and his particular realism

Jules Verne plays an important part in our scientific horizon. This author is at once an heir of the XVIIIe century, a witness of his time, a precursor of the XXe century's stakes. Verne preents the danger represented by the absence of the hygienic awareness. The fate of humanity is at stake. There are several type of hydienes in "Les Voyages extraordinaires" : mental physical, public, urban, ecological, climatic. The first part of this study presents the Jules Verne's works and the last discoveries of the vernian's researchers. The second part tries to locate the evolution of the Jules Verne's hygienic ideas in his works. The third part reminds the ideas places fort the perfect hygiene : the "supreme point", the island and the utopic city. Finally, the fourth and last part shows that the reflexion about the hygiene, results to the constitution of an vernian's aesthetic

Full textIn « En songeant à un art poétique », Jules Supervielle defines his poetry as an attempt at humanization. How should this term be understood, and how does it enlighten Supervielle’s work ? In order to answer this question, this dissertation sets out to define the meaning of humanization through the lens of the double legacy of the humanism of the Renaissance and the humanitarianism of Romanticism, and in the light of partly unpublished manuscripts and letters. In the first part, this dissertation studies how Supervielle theorizes humanization. It leads to an analysis of a history of ideas and of literature, in order to define Supervielle’s conception of literature and in order to assess Jean Paulhan’s and René Étiemble’s roles in this theorization. The second part is a chronological study of humanization that takes the form of an essay of poetic geography. It focuses particularly on the work of the 1920’s and 1930’s. The third part is a genetic one : we study how humanization appears in the different states of a poem, a prose and a drama. The Study of humanization in Supervielle’s works enables us to have a better understanding of the literary landscape and of the entanglement of literary ideas in the first half of the twentieth century, in the margins of Surrealism
