Full textThe autocratic running of the political power during post independence first three decades in Benin, Mali and, to a least extent, in Senegal, led to questioning their political system through sovereign national conferences, in Benin and Mali whereas in Senegal, it was expressed through constitutional reorganizations. Therefore, the three countries have adopted regimes inspired from the democratic practice of Western countries, with constitutional jurisdictions as a linchpin. Such jurisdictions, owing to the effective implementation of their determining functions, contribute to the development, enhancement and strengthening of the constitutional justice. However, certain malfunctioning and shortcomings, the consideration of which could significantly improve the efficiency of the said constitutional jurisdictions, prompt to qualifying their established achievements as well as their key role

Full textUnderstand, describe and document the information behavior of beninese lawyers in both the academic and professional fields. It is the main objective of this thesis that has chosen the positioning of informational practices in the information sciences especially in the study of users in context. This work has mobilized both theoretical and empirical studies. Four theoretical studies have been conducted to understand the legal and justice context in Benin, developments in information and communication technologies (TIC) in the legal and judicial sector, information practices in terms of models and the specific theories in the field of law. These theoretical approaches were confronted with four empirical studies, two quantitative and two qualitative. Regarding the quantitative approach, 375 students and 60 teacher-researchers from the law faculties of the universities of Benin were interviewed. As for qualitative studies, they are made up of semi-directive interviews with 35 magistrates of courts and courts in the southern part of the country and 15 lawyers in Cotonou. At the end of these studies, it is clear that Beninese lawyers in the course of their professional activities make use of information. They do it to solve legal problems. They refer in the first place to printed sources, namely books and legal works; Then to electronic sources, in this case the Internet, and finally consult their colleagues, confreres or comrades. The criteria governing these sources of information are primarily the accessibility-availability of information, the relevance-usefulness of information and the content of information. All lawyers surveyed share information but face several barriers to accessing information. Examples of such obstacles include the excessive cost of certain legal works, the instability of electric power, the breakdown of the Internet connection, the obsolete nature of certain documents

Full textVery little research in management science has succeeded in shedding light on the relationships between the concepts of attraction and retention of young people freshly entering the labor market in Africa. The purpose of this research is to provide insights into the attitude and reasons for the early turnover of early-stage workers in Benin. In this thesis, the theory of the voluntary exchange of resources and the standard of reciprocity of Blau (1964), which determine the commitment and satisfaction of young workers to the human resources management practices deployed in their organization, are mobilized in this thesis. Guided by the Churchill paradigm (1979), our dual (qualitative and quantitative) survey showed that organizational (interactional) justice negatively influences the intention to leave young workers through partial intervention of satisfaction, supervisor support, promotion, normative commitment, calculated commitment and training. These people can leave their organization if they are denied a promotion. Positive and negative affects lower the level of satisfaction. Stress increases the intention to leave through the full mediation of affective and normative commitment, as well as satisfaction. These results give rise to theoretical and managerial implications that are presented in this research

Full textThis reflection aims to contribute to the development of amicable modes of dispute resolution in the Beninese legal culture in order to allow litigants, mostly illiterate, to have timely alternatives to traditional judicial methods. While the justice system faces many challenges, both in France and in Benin, the development and promotion of amicable dispute resolution have been noted as having some success in this area in France. In Benin, the legislator encourages, but does not propose any particular regime for the effective recourse to amicable settlement of disputes. This research thus attempts to examine in depth and to question the existing legislative mechanisms, as the stakes in terms of access to justice are considerable. The main issues of this thesis are therefore related to the perspectives of the development of amicable mode and their supervision to remedy the inadequacies and counter-performances of the Beninese state justice

Full textThis doctoral thesis analyses the ecological inequalities in the african cities, by focusing on the example of Cotonou in Benin, with regard to cholera. As a pathology related to the exposure to an unhealthy environment, cholera forms a relevant marker of the ecological inequalities under all their forms: whether they are inequalities of exposure to the environmental nuisances, access to urban amenities, capacity to question the public power as far as environmental nuisances are concerned or participation in environmental projects. Through the approach by “effect of place”, we showed that the differential incidence of the cholera between the districts of Cotonou is related not only to the combined effect of the environment and the socio-economic profiles, social practices, but also with the public policies, inspired sometimes of the international recommendations in the field of the environment, and that overlook the socio-political local context
