Full textProducto de las movilizaciones estudiantiles llevadas a cabo por estudiantes secundarios(as) y universitarios(as) el 2006 y 2011, nuestra jurisprudencia ha tenido ocasión de pronunciarse intensamente a raíz de la acción de protección utilizada por los(as) estudiantes frente a las expulsiones y cancelaciones de matrículas –entre otras medidas disciplinarias- en los establecimientos educacionales. A propósito de ello, nuestros tribunales superiores de justicia han esgrimido diferentes argumentos, que han pasado desde el derecho de propiedad sobre la matrícula: propietarización, en los años 80 y que, en la actualidad, son abordadas a través del derecho a la igualdad (artículo 19 Nº2 CPR) y al debido proceso (artículo 19 Nº3 CPR), criticado –este último- por ser una especie de cláusula abierta en que toda arbitrariedad tendría cabida dentro de este derecho. Se analizarán los derechos y principios infringidos a través de estas acciones tomadas por los establecimientos educacionales, y se sistematizarán los casos que han hecho uso del recurso de protección, así como los argumentos que han tenido las Cortes de nuestro país para acogerlos o rechazarlos

To atteint this purpose, we had, in one hand, to establish its normative nature in the legal system of niger and, in the other hand, to verify practicaly this normativity. That verification led to the analysis of jurisprudence in niger in such legal fields as civil law, criminal law, social law, administrative law and constitutional law. But previously, in order to familiarise the reader with the milieu of research, a preliminary chapter presents the judicial institutions of the republic of niger. In general, the reflection was based upon a theoretical analysis of jurisprudence in the legal system of the republic of niger, constitued of the statute law inspired from france and the customarily laws. That explain why the reflection was based on the french analysis in this domain. More over, trying not to part from the real, it has been constantly taken care to confronting the result of the analysis with the case law in the legal system of the republic of niger, in the way it's applied and the role played by the supreme court of niger

Full textThe constitutionnal control of parliament acts established by the constitution of 1958 has helped on completing the state of law in france. The decisions of the constitutionnal council in budgetary and financial matters for twenty five years have been very extensive and influential. These decisions have transformed in depth the french budgetary law specially concerning the form and content of the finance bill, the regularity of budgetary process in parliament and the admissibility of financial amendments by members of parliament. Till then, this budgetary law had remained rather static, the only evolution resulting from the growing state intervention in economic life and from stronghthening executive power in institutionnal life. The influence of these decisions has been decisive. The technicity of financial and budgetary matters has urged the constitutionnal judges to make their methods more precise and, due to the growing number of decisions, the constitutionnal council made them more coherent in such a way that a "global constitutionnal policy in budgetary matters" exist now. Basically, from a legal viewpoint. These decisions have clarified eventually the traditionnal debate on the legal regime of the budget and they have completely renewed the budgetary law. Politically speaking, the constitutionnal judges acting as the keepers of what we could call a "budgetary raison d'etat", has striven also to settle in a balanced way the budgetary and financial disputes which have arisen in the french political life. So, budget has been one of priviledged field of intervention by the constitutionnal council for twenty five years. First of all, the council has succeeded in becoming one of the most essential institution of the fifth republic, but also has turned out to act as a real and respected judge

Full textThe idea that law is unrelated to value is a commonplace in modern legal thinking. For this reason, it deserved to be questioned. If law is above all a discourse, value is certainly an object of that discourse, as evidenced by the many controversies that the notion is likely to provoke. Norm and value, legal norm and moral value, fact and law, are examples of the controversies that the issue of values is likely to generate. Contrary to common belief, the analysis shows that value constitutes a real legal object for which it is possible, within a particular field of legal discipline and following a specific conceptualization approach, to report. First, the analysis shows that the value belongs to the normative gender (intension of the concept). It thus contributes to the legal rationality. If the value can be understood as a norm, it is, in any case, a specific norm; distinct from the way in which legal thought has, until now, conceived the legal norm. Legal value is then a substantially valid norm - as opposed to the formally valid legal norm - but also a hypothetical norm - as opposed to the categorical moral value. Defined in this way, value is particularly suited to explain certain contemporary developments specific to the legal phenomenon (development of fundamental rights, convergence of legal systems, evolution from constitutionality control to proportionality control). Secondly, the analysis shows that, defined in this way, values are omnipresent in constitutional jurisprudence (extension of the concept). The value propositions constitute the essential terms of the French constitutional judge's decision and also guide its interpretation. In the first case, the values are indeed reference norms of the decision and are then embodied in the language categories mobilized by the constitutional judge – in particular the constitutional requirements, necessities and imperatives. In the second case, the values constitute the sense of the decisions of the constitutional judge and make it possible to assign a certain rationality to constitutional normativity – constitutionality

Full textThe research analyses the economic content of the decisions of the French constitutional court. Which decisions can be qualified as economic decisions ? Is there a specificity of such economic decisions compared to other kinds of decisions ? We conclude that as far as economic policies are concerned we can observe a marked judicial self-restraint of the court. This judicial self-restraint can be interpreted as a sign of a kind of ″economic neutrality″ of the French constitution. Despite this apparent neutrality, it is possible to detect an underlying philosophy in the Constitutional Council’s decisions related to the judicial limitation of the legislator’s intervention and to the division of powers in the matter of economic policy. The analysis will be compared with the economic thinking, and will take into account the European construction, at a time when European Union impose burdens on Member States’ economic policies, and in a context calling for a redefinition of the structural links between law, economics and policy

Full textAttempts to account for the sources of law via the traditional comparative approach between precedent as in the English system and case-law in the French do not allow us to assess globally how, within either system, binding decisions are made and how these are perceived as the means to solve future litigation. Such an objective can only be pursued by taking a wider view of the processes in which decisions which will lead to case-law rules, are made. As a first step, a study of the decision-making process can enable us to assess the potential for producing and applying case-law rules. The aim here is to compare both the judicial systems and the procedures called into play in litigation so as to examine the manner in which, within the decision-making process certain selections are put into operation so that over and beyond the occasion on which it was made, a decision will become binding. This implies both a qualitative as well as quantitative examination of the rules made. It is important therefore to determine to what extent procedure influences the reasoning within the decision-making process. A useful example of this is the case law dealing with the question of medical negligence which highlights the disparity between the two systems. Secondly, an examination of decisions will illustrate the extent to which the motivation to reach conclusions is essential to the production of these rules This will lead us then to consider the characteristics of the rules elaborated within each system and to highlight the conditions which have lead to the reproduction of particular and concrete rules in England as opposed to more general and abstract rules born out of the French system of case-law. The aim of this paper is to offer a pragmatic examination and an overall perspective on two systems of jurisprudential decision-making based on radically opposing systems of logic

Full textThe obiter dictum is a little known figure of the civil case-law of the Court of cassation. Yet, its presence amongst cases is regularly acknowledged, and even questioned by legal scholars. Better known by supranational courts or the institutions of superior courts of Public Law, its existence remains unsettling. It was, thus, necessary to better understand the reservations towards this object, and then observe what makes the specificity of the obiter dicta of the Court of cassation as well as to try to identify this phenomena. Once the consciousness of the existence and the specificities of this process had been acquired, its notion could be studied. The obiter dictum of the Court of cassation had to be distinguished from its counterpart that remains inherent and indispensable to the Common Law. Although the designation is identical, the reality they encompass varies. After having, also, separated the obiter dictum from other elements of the discourse of the Court of cassation, a definition was proposed by combinning two criteria : the insertion of an utterance within the decision and its extrinsic nature regarding the decisional field. The study of the status of the obiter dictum revealed its true nature of a tool. The practice of this instrument by the cassation judge needed to be detailed, whilst equally taking into account the contemporary reflections surrounding the reform of the Court of cassation in order to consider what would become of the obiter dictum. The observation of its functions allowed us to shine a light on its anticipatory role. If the obiter dictum seems to be a useful instrument serving the jurisdictional missions of the cassation judge, its virtues are not without limits. It cannot be thought of as a systematic remedy to the negative effects of courts overruling. A precious tool in the hands of the cassation judge, the obiter dictum appears, within the context of the questions regarding the opportunity and modalities of a reform of the Court of cassation, as an instrument searching for/in search of equilibrium

Full textDans cette dissertation je m'appuie sur les écrits de Platon sur la musique et le droit pour déterminer la relation entre les dimensions esthétique et juridique de l'ordre politique et, plus particulièrement, pour montrer comment ces dimensions se manifestent chez les citoyens et entrent dans le jugement politique. Le postulat central de ma thèse est que, pour Platon, la justice requiert un attachement affectif qui, à son tour, exige qu'elle soit coextensive à une sorte de beauté musicale. Pour que les conditions de justice soient réunies, nous devons non seulement définir la justice mais la désirer, tout comme nous désirons la beauté; la dimension musicale du droit satisfait à cette exigence affective. Pour les anciens, le droit et la musique avaient les mêmes propriétés intrinsèques d'ordre, d'établissement, et de restauration; l'ambiguïté du terme nomos, voulant dire tant chanson que droit, souligne cette vision du monde selon laquelle l'éthique et l'esthétique sont régies par les mêmes principes. Chez Platon, le désir musical agit dans ce cadre: la musique engendre dans l'âme une reconnaissance cognitive pré-rationnelle de l'ordre intrinsèque qui en constitue la beauté; l'inspiration musicale, à son tour, est le moteur de la citoyenneté juridique active. Il est étonnant de constater le peu d'attention consacré dans les travaux d'érudition au traitement de la musique chez Platon et seul un petit nombre d'auteurs voient Platon comme étant engagé à l'égard de la règle de droit. Je montre que l'attention qu'accorde Platon à la musique et à la règle de droit tout au long des dialogues souligne l'importance sur le plan politique d'une éducation à la fois esthétique et juridique; la fonction pédagogique du droit est de promouvoir un éthos civique dans lequel les principes de justice sont pour les citoyens une source d'engagement passionné, d'inspiration et, ultérieurement, de plaisir.

Full textStudying the jurisprudentially activity of French Council of State could easily mean that we will, again, study the Jurisprudence, and establish if it is source of law or not. In reality, the purpose of this work is different. Considering the jurisprudentially activity of French Council of State was inevitable in a context where this Highest Court of the administrative jurisdictional order meets more and more competitors in its mission of making law. We could study the influence of European Court of Human Rights or the one of the Justice Court of European Community on French Council of State, but our work is mainly dealing with the activity of jurisdictions created in 1987 : the Administrative Courts of Appeal. Indeed, these Courts were created to release French Council of State in its mission of making the jurisprudence. And today, these Courts of appeal know a great activity in setting the jurisprudence, in such a way that we can wonder if, after twenty years of practice, these Courts are not competing with French Council of State in the activity of making law. By a pragmatic analysis of different stratagems used by French Council of State to continue to have a monopoly of making law, we can see that the Highest Court of the Administrative jurisdictional order is always present and very active on the jurisprudentially scene, as such as the decline of the prescriptive activity of French Council of State is not again topical, even if the Courts of Appeal take up a greatest space in this activity of making law

Full textFor too long, lawyers were the only scholars scrutinizing the ECJ case-law. Consequently, numerous jurisprudential analyses have scarcely portrayed the complexity of the underpinning concepts beneath the ECJ case-law. These approaches to the ECJ case-law have only been partial, it will be argued, due to the neglect of the fundamental principle driving the ECJ case-law’s evolution – meaning, the principle of economic efficiency. This neglect can be explained from the absence of thoroughly in-depth economic analyses of European law, and especially of the ECJ case-law. This thesis aims at filling up this gap. Beyond the economic analysis of the ECJ case-law allowing for an original, updated and renewed perspective of the EU judicial reasoning, this thesis shall pave the way for a better grasping of the academic debate pertaining to the alleged economic efficiency of the Common law over civil law traditions. Moreover, this thesis, from this original viewpoint that is an overtly economic perspective of the EU judicial reasoning, shall draw new conclusions on some specific stances of the EU judges. The systemic approach undertaken here from the perspective of the principle of economic efficiency shall lead us to formulate the scientific hypothesis that is falsifiable and falsified. Indeed, the hypothesis of the economic efficiency of the ECJ case-law shall be advanced

Full textRecent years have witnessed a rapprochement between public law and private law. An administrative act is now in case law subjected to the market. Private law logics include the regime of liability and tender agreement. This trend is usually arrested by the privatist doctrine through the analysis of activities under public law. The privatization of public law would respond to a loss of specificity of public service and a dilution of the concept of public interest. However, two findings encouraged to change the way to analyse this: first the sustainability of a judicial dualism and then the distinction between two categories of legal persons, public entities and private individuals. While this study deals with the particular context of constitutional litigation, and the empirical data analysed herein mainly consist of the decisions of the Constitutional Council, as well as the minutes of the Council's meetings, this research goes beyond the scope of constitutional litigation, and is intended to be a true conceptual investigation into the concept of overruling.Indeed, the concept of overruling, which was originally doctrinal, and which today is becoming a common concept in jurisdictional practice, is a concept that designates a jurisprudential phenomenon practiced by all orders of jurisdiction in the French legal system.This study proposes to delve into this concept of overruling, using theoretical means (in particular drawing on linguistics, psychology, legal theory, philosophy, history of law, epistemology and formal logic), which have never before been used in the investigation of overruling.However, although nourished by theoretical exoticism, this study is not to be outdone in terms of legal analysis and will provide the reader with a solid analysis of the decisions of the Constitutional Council which count as overrulings, as well as an analysis of the causes and consequences of the overruling, in the specific context of constitutional litigation

Full textDesde el inicio de sus funciones en 1996 y hasta 2012, antes de la entrada en vigenciade la Ley del Derecho a la Consulta Previa (29785), el Tribunal Constitucional peruanohabía emitido 21 sentencias en materia indígena. La mayoría de ellas ha sido objeto deanálisis asociados a un derecho indígena específi co. No obstante, luego de casi 20 añosde vida institucional es necesaria una mirada integral que dé luces sobre la forma en queel máximo órgano de interpretación constitucional en nuestro país ha visto y elaborado undiscurso, no solo sobre un derecho en particular sino sobre las circunstancias políticas,sociales y jurídicas que implica la presencia de pueblos indígenas dentro de un Estadonaciónmoderno; es decir, la existencia de pluralidad étnica en el marco de una estructuraestatal diseñada sobre la base de la igualdad abstracta de todos sus ciudadanos. Así, elpresente artículo plantea cuatro propuestas ético-políticas para la gestión de la pluralidadétnica en estados nacionales: el asimilacionismo, el integracionismo, el multiculturalismo yla interculturalidad. A partir de dichos marcos de referencia se verá cómo el Tribunal Constitucionalperuano ha oscilado entre la postura más circunscripta y una más integradora,pero lamentablemente, no por eso la que mejor protege derechos indígenas.

Full textA presente dissertação diz respeito a um dos temas centrais da Teoria do Direito: o conceito de sanção. Muitos dos conceitos jurídicos básicos - inclusive o próprio conceito de Direito - encontram-se estritamente conectados com ele, de forma que um estudo cuidadoso sobre esse tema possibilitará que muitas outras questões fundamentais do Direito sejam, senão resolvidas, ao menos aclaradas. As inúmeras subdivisões que a complexidade do tema acarreta tornaram necessárias delimitações quanto ao objeto de estudo. Portanto, dentro da ampla esfera interessante ao pesquisador empenhado em deslindar o tema, optou-se por centrar a pesquisa em objetivos mais modestos: o de reconhecer e apresentar os principais problemas que encerram o conceito de sanção para a teoria do direito em três autores específicos - Jeremy Bentham, John Austin e Hans Kelsen - pertencentes a uma mesma tradição de pensamento jurídico, a Teoria Analítica do Direito (analytical jurisprudence). Tal escolha é facilmente justificável, em virtude da centralidade do conceito em suas concepções de Direito.
The present work refers to one of the central subjects of the Legal Theory: the concept of sanction. Many of the basic legal concepts - and the concept of Law itself - are strictly connected with it, in such a way that a careful study on this subject will make possible that many other basic questions of the Law are, if not solved, at least clarified. Because of the innumerable subdivisions caused by that the complexity of the subject, it had become necessary to delimitate the studied object. Therefore, within the wide area of interest presented by the subject, the researcher has opted to focus his/her work on more modest objectives: to recognize and to present the main problems concerning the concept of sanction inside the work of three specific authors - Jeremy Bentham, John Austin and Hans Kelsen -, being them all part of the same legal thought tradition, the analytical school of jurisprudence. Such choice is justified by the unquestionable importance that the authors confer to the sanctions in their legal theories.

Full textThe role of public administration is to conciliate the necessities of public interest with the rights and liberties of the individual. In doctrine and jurisprudence, it is this rule which generally sums up the relations between administrative action and private interests. This point of view is contradicted by the study of these relations throughout public administrative jurisprudence pronounced since the end of the last century. In actual fact, public interest appears to be the result of arbitration between various private interests. Our method has been, in part one, to define the terms "administrative action" and "private interests". These terms are then analyzed, descriptively in chapter one and distinctively in chapter two. Having defined the two key terms of the subject, it was then possible to examine the role of interests in public administrative jurisprudence (part two). The systematization of relations between administrative action and private interests can be described as follows : private interests seek the intervention of public administration but also impose constraints on its action (chapter one). As far as public interest is concerned, it legitimizes the advantages granted to private interests as well as the sacrifices demanded of them. Keeping in mind the fact revealed by our research that public and private interests are undeniably linked, these apparent contradictions no longer apply. Consequently, the pursuit of public interest may be identified with an arbitration wherein public administration valorizes one or another category of private interest. Since public interest is materially indeterminate, the object of arbitration is unlimited and the primacy of organic criterion demonstrates that public administration is alone qualified to decide

Full textHow does the Conseil constitutionnel apprehend the family? This question leads to study the relationship between constitutional law and family, whose mutual igorance seems acquired. A positivist and analytic approach of the jurisprudence of the Conseil constitutionnel however illustrates that this apparent mutual disinterest is not grounded. Family is an institution protected and protective according to positive constitutional law; the latter prescribes to protect the family and also prescribes to the family to protect. Constitutionnal law prescribed after all to build family. This question leads to study the legislative concretizations of the constitutional norms concerning family. This study illustrates the techniques used by the Conseil constitutional in its judicial review. The study also emphasizes the fact that this concretization protects, but also sometimes threatens, the recognition, the development and the unity of the family. The realization of the constitutional law leads after all to a legislative construction of the family. This question leads finally to observe that family consists more in the legal construction of an object than in the construction of a legal object. The concretization of constitutional norms concerning family illustrates in effect a “familial pluralism”, which contributes to reveal the dynamics of the legal construction of the family
