Abstract:
This research focuses on freedom of faith between the holy Quran and Islamic jurisprudence. It explores the concept of freedom in general and the freedom of faith in particular to find out to what extent the holy Quran pays attention to these freedoms. The research then tries to find out to what extent these freedoms are reflected in the Islamic jurisprudence, focusing on certain jurisprudences that seem to contradict the holy Quran, such as Islamic jurisprudence regarding infidels and polytheists, apostates and dualist-infidels. The research concludes that there is a difference between the extent of freedom in the holy Quran and in the Islamic jurisprudence, since these freedoms have a wider extent in the holy Quran as compared to the Islamic jurisprudence. It is also concluded that the Islamic jurisprudences, which seem to us to be extreme, in fact originate from a time and place that are completely different from our time and place.

Through the mid-twentieth century, jurisprudents considered sociological jurisprudence to be one of the most influential theories of law in the United States. By end of the century, however, it had virtually disappeared. The publication of Roger Cotterrell’s Sociological Jurisprudence: Juristic Thought and Social Inquiry (2018) provides an occasion to examine what this theory of law was about, why it disappeared, and its prospects for revival. The topics covered in this essay are the circumstances surrounding the origin of sociological jurisprudence, the tenets of sociological jurisprudence, the successes of sociological jurisprudence, its relationship with sociology of law, its relationship with legal realism, its place in contemporary jurisprudence, and finally, the need to keep jurisprudence open.

The jurisprudence rule is a majority judgment where the judgment over minor jurisprudence issues is directly identified. The jurisprudent standard is a majority judgment where the judgment over minor jurisprudence issues concerning an aspect of jurisprudence is directly identified. The fundamental rule means the total rules whereby judgments concerning its minor issues are identified. They are known as total issues whereby judgments can be deduced from their evidences from the holy Quran and Sunna in addition to other evidences. -The difference between the jurisprudence rule, the jurisprudence standard and fundamental rule is also identified. -Five jurisprudence rules have been identified and their applications are mentioned, as follows; the foundation does collocate with the substitute, judgment on speech is better than negating it, the worst of the loath something is better to beleft give away, injustice is abolished and does not need to be revoked.

As a primary source of law, jurisprudence is a reference in constituting legal prescriptions for notaries in their works as public officials. Due to strengthening jurisprudence in the Indonesian legal system, jurisprudence cannot be ignored by the notary officeholders. Therefore, the main issue is whether jurisprudences have a role in constituting legal prescriptions for notaries in their works as public officials or not. This study was designed using a qualitative approach. Data analysis was conducted in a deductive-qualitative approach with a writing model carried out by "writing in contexts. The results showed that state law (laws) is the primary legal basis for doing authentic deeds by notaries. The implementation of the law must take precedence to achieve the goal of legal certainty in doing authentic deeds. As a result of strengthening the role of jurisprudence in Indonesia, notaries should also attend to the existence of jurisprudence. The purpose of enforcing jurisprudence by the notary is as an effort to (i) fill the legal avoidance, (ii) complete the applicable legal procedures, (iii) become a legal prescription for notaries, (iv) become a source of positive law, (v) keep abreast of legal developments in society, (vi) serve as test material for notaries and (vii) get a new legal construction that replaces the old legal concept. In conclusion, jurisprudence is one of the sources of law which must also be considered and paid attention to by notaries.

Abstract:
Environmental Jurisprudence’s highest achievement is its codification of a change in ethics, and a legal recognition that both individual and governmental agency responsibility extend to the natural world. This article provides an overview of Environmental Jurisprudence as it relates to environmental ethics. It examines both the foundation of Environmental Jurisprudence as well as the concept of human rights. The article also critically discusses international environmental law from the perspective of human rights. This research concludes by arguing that despite the attempt made in the international regime for adding eco-centric values in environmental law, environmental jurisprudence to date has continued with anthropocentric ideas with all concerns for safeguarding the means of human survival.

Le sujet traite a pour objet l'effet des jurisprudences europeennes sur la jurisprudence du conseil d'etat. Son interet reside dans l'apport normatif des jurisprudences au droit applique par les juges. Son analyse part de l'autorite du droit europeen (droit communautaire et convention europeenne des droits de l'homme) sur le droit francais. L'effet des jurisprudences europeennes doit alors etre apprecie par rapport a la reference par le conseil d'etat aux regles constitutionnelles francaises gouvernant l'autorite du droit international dans l'ordre juridique francais. Il atteint la fonction juridictionnelle du conseil d'etat car les juges europeens determinent les conditions d'une protection juridictionnelle effective des droits nes du droit communautaire ou des droits judiciaires consacres par la convention europeenne et ses protocoles additionnels. Cette premiere partie de l'analyse menee, doit etre completee par une prise en compte de l'autonomie du conseil d'etat qui conditionne l'effet des jurisprudences europeennes sur sa jurisprudence. Cette autonomie puise son fondement dans l'ordre juridique francais et n'est pas remise en cause par les rapports entre les ordres juridictionnels qui restent separes et depourvus de hierarchie entre eux. Tout comme l'autorite du droit europeen, il a fallu saisir la portee de l'autonomie du conseil d'etat qui s'observe du double point de vue de sa fonction juridictionnelle, et de sa fonction jurisprudentielle. C'est au regard de cette double approche qu'a pu etre apprecie, sur chaque point analyse, l'effet des jurisprudences europeennes sur la jurisprudence du conseil d'etat.

Producto de las movilizaciones estudiantiles llevadas a cabo por estudiantes secundarios(as) y universitarios(as) el 2006 y 2011, nuestra jurisprudencia ha tenido ocasión de pronunciarse intensamente a raíz de la acción de protección utilizada por los(as) estudiantes frente a las expulsiones y cancelaciones de matrículas –entre otras medidas disciplinarias- en los establecimientos educacionales. A propósito de ello, nuestros tribunales superiores de justicia han esgrimido diferentes argumentos, que han pasado desde el derecho de propiedad sobre la matrícula: propietarización, en los años 80 y que, en la actualidad, son abordadas a través del derecho a la igualdad (artículo 19 Nº2 CPR) y al debido proceso (artículo 19 Nº3 CPR), criticado –este último- por ser una especie de cláusula abierta en que toda arbitrariedad tendría cabida dentro de este derecho. Se analizarán los derechos y principios infringidos a través de estas acciones tomadas por los establecimientos educacionales, y se sistematizarán los casos que han hecho uso del recurso de protección, así como los argumentos que han tenido las Cortes de nuestro país para acogerlos o rechazarlos

L'objet de cette these est de demontrer l'implication de la jurisprudence, dans le processus de la production normative au niger. Pour arriver a ce resultat, il a fallu, dans une premiere partie, etablir la nature normative de cette jurisprudence au sein du systeme juridique nigerien et, dans une seconde partie, verifier concretement cette normativite. Cette verification a conduit a analyser la jurisprudence nigerienne dans plusieurs domaines, en l'occurence le droit civil, le droit social, le droit penal, le droit administratif et enfin, le droit constitutionnel. Au prealable, dans le but de familiariser le lecteur avec le milieu d'etude, un chapitre preliminaire a ete consacre aux institutions judiciaires nigeriennes. De facon generale, la reflexion s'est appuyee sur une analyse theorique de la jurisprudence dans le systeme juridique de reference, c'est-a-dire le droit nigerien, constitue, d'une part, par le droit ecrit d'inspiration francaise, et d'autre part, par les droits coutumiers non codifies. Ce qui explique pourquoi cette reflexion s'appuie sur les travaux de la doctrine francaise en ce domaine. Mais, gardant a l'esprit le souci du reel de maniere systematique, les analyses doctrinales francaises ont ete confrontees a la realite de la jurisprudence dans le systeme juridique nigerien, tel qu'il est vecu et tel qu'il est mis en oeuvre par la juridiction supreme du niger
The aim of this thesis is to demonstrate the implication of case law, in the normative process in niger. To atteint this purpose, we had, in one hand, to establish its normative nature in the legal system of niger and, in the other hand, to verify practicaly this normativity. That verification led to the analysis of jurisprudence in niger in such legal fields as civil law, criminal law, social law, administrative law and constitutional law. But previously, in order to familiarise the reader with the milieu of research, a preliminary chapter presents the judicial institutions of the republic of niger. In general, the reflection was based upon a theoretical analysis of jurisprudence in the legal system of the republic of niger, constitued of the statute law inspired from france and the customarily laws. That explain why the reflection was based on the french analysis in this domain. More over, trying not to part from the real, it has been constantly taken care to confronting the result of the analysis with the case law in the legal system of the republic of niger, in the way it's applied and the role played by the supreme court of niger

La jurisprudence a fortement influencé l'évolution du droit au logement. La Cour de cassation, en retenant que le droit au logement ne concerne que les résidences secondaires, a participé à la réécriture des règles relatives au contrat de bail. La jurisprudence Couitéas du Conseil d'Etat a largement inspiré la rédaction de la loi de 1991 portant réforme des procédures civiles d'exécution. La jurisprudence constitutionnelle, depuis 1995, a guidé le Parlement dans la mise en oeuvre du droit au logement. L'influence des jurisprudences est présente également au sujet de la définition du droit au logement. Les juges sont d'accord pour lui reconnaître les caractéristiques d'un droit de l'homme : le Conseil constitutionnel érige la possibilité pour toute personne de disposer d'un logement décent en objectif de valeur constitutionnelle, entraînant dans son sillage les juges administratifs et judiciaires de premier et de second degré ; la Cour de cassation exploite, quant à elle, la CEDH pour reconnaître la possibilité pour le locataire d'héberger ses proches. Il s'agit donc d'un droit dont l'autorité normative est désormais reconnue. Le respect de l'objectif de valeur constitutionnelle s'impose au législateur et au gouvernement sous la menace éventuelle d'une sanction du Conseil constitutionnel. Le respect de la CEDH s'impose aux bailleurs dans l'aménagement des clauses contractuelles de la location sous le contrôle du juge judiciaire. Ainsi, le droit au logement revêt-il les aspects d'une règle de conduite dans les rapports sociaux, générale, abstraite et obligatoire. En outre, le droit au logement est susceptible d'être directement revendiqué par les individus. Il peut être invoqué dans le cadre d'un contentieux, opposant propriétaire et occupants sans droit ni titre, pour obtenir un droit temporaire au maintien dans les lieux occupés afin d'être relogé dans les conditions de la loi. Qui plus est, le droit au logement peut être appréhendé comme un droit-créance contre le propriétaire. La loi SRU de décembre 2000, en modifiant les règles applicables au bail d'habitation, le mentionne explicitement en prévoyant l'obligation de louer un logement décent. Le droit au logement apparaît donc bien comme un droit de l'homme dont la généralité lui confère les allures d'une simple pétition de principe mais dont les potentialités peuvent être révélées par les revendications individuelles.

La jurisprudence pénale telle qu’elle existe aujourd’hui résulte d’une lente et difficile évolution à travers les sociétés. Il s’agit d’une notion ancienne, connue de tout juriste, qui varie en fonction du système juridique considéré. Elle est le reflet de la société dans laquelle elle évolue. En France elle a été tantôt consacrée en tant que source du droit, tantôt rejetée. Le principe de légalité criminelle constitue le principal obstacle à l’émancipation et l’existence de la jurisprudence pénale. Ainsi, quelle est l’originalité de la jurisprudence pénale au sein du droit pénal ? Aujourd’hui son utilité ne fait plus de doute et son statut est officieusement accepté. Elle constitue bel et bien une source du droit pénal contemporain. Dès lors il s’agit d’envisager quelles sont les manifestations de cette originalité, tant en considérant son existence que son effectivité
Jurisprudence as we know it today is the result of a long evolution throughout societies. The characteristics of this old notion, well-known among jurists, differ according to which juridical system is considered. It is a reflection of the society it has evolved in. In France, the jurisprudence has at times been rejected, at other times been considered as a source of law. The criminal law principle constitutes the main obstacle to its emancipation and existence. Thus, what is the originality of jurisprudence within criminal law ? Today its utility is evident, its status informally accepted and it definitely constitutes a source of contemporary criminal law. Thence, this work examines how this originality expresses itself, dealing with the existence as well as the effectiveness of jurisprudence

Notion controversée, aux confluents de l'éthique, de la philosophie, de la sociologie, du politique et de la juridicité, l'équité serait indéfinissable. Elle se réclame soit du droit naturel et, ou de la morale, soit du sens commun, c'est-à-dire une sorte d'évidence logique qui relève de la conscience. Le contenu concret de la notion serait imperceptible car affecte d'une imprécision qui tient à la variété des conceptions qui peuvent être retenues. L'équité est tantôt synonyme d'un principe supérieur de justice ou d'une justice du cas particulier dépendante de circonstances spécifiques et dont la perception relève de la subjectivité. Par conséquent, la meilleure façon d'approcher cette notion protéiforme est d'adopter une méthode fonctionnaliste, analysant les finalités de l'équité, plutôt qu'une analyse essentialiste qui prétendrait en cerner la nature. Notion innommée du contentieux administratif, les fonctions de l'équité devront être constatées à partir des vecteurs juridiques servant de support à sa réalisation : pouvoir d'appréciation, d'interprétation, d'application et de création normative. En dehors des hypothèses d'équité infra legem, c'est le juge administratif qui fixe les conditions d'intervention de l'équité. Dans la jurisprudence, la prise en compte de l'équité résulte d'une divergence de rapport avec le droit en terme d'opposition et de conciliation. Ce désaccord correspond à la traduction d'un antagonisme d'opinion à l'égard de l'équité manifestée historiquement, dans la doctrine et hors du contentieux administratif.

The Jurisprudence of Equality project (JEP) trains judges and other judicial actors on the applicability of international women's rights law in domestic courts, thus enhancing their ability to treat cases of violence against women and ensuring greater protection for women's rights in the region. The purpose of this report is to distill the findings and conclusions from the JEP evaluation in Argentina, Brazil, Chile and Uruguay. This evaluation was meant to find out to which extent the project is being implemented as planned, identifying any difficulties during implementation, and ways to overcome them. It has also assessed the effect that project activities are having in achieving the project goal. Apart from document review and interviews in Washington and in the four countries visited in March-April 2000 with relevant stakeholders, the evaluation relies on two main instruments for each country: (a) a survey, applied to trainers and seminar participants. The questionnaires were designed with the close cooperation of the Washington IWJF director and the education director, as well as in consultation with other stakeholders in the field, and the IDB in Washington and Country Offices; (b) a series of focus groups carried out separately with trainers and seminar participants.

Abstract:
The article reveals and analyses a wide range of terms for the Holodomor of the 1920s and 1930s in Ukraine. The main objectives of the study are to find out the peculiarities of the linguistic presentation of the Holodomor phenomenon in scientific, popular science, and journalistic discourses, and to reveal semantic differences in the use of various terms for the Holodomor used in different languages. The main methodological bases of the study are linguistic analysis, socio-cultural method, qualitative content analysis, comparative method, etc. The method of retrospection must be used to substantiate the hypothesis. Thus, the reasons for the formation of the semantic contours of the terms “Holodomor”, “Famine”, “Great Famine”, “Terror by Famine”, “Big Hunger”, etc. were clarified. At the same time, the semantic nuances of word use are identified. As a conclusion, the authors substantiate the fundamental importance of using the term “Holodomor-genocide” in scientific circulation as the one that most accurately represents the essence of the historical phenomenon of the Holodomor. Based on the analysis of the documents, the content of the term “genocide” is formulated. It is explained that the Holodomor is genocide of the Ukrainian people, just as the Holocaust is genocide of the Jewish people. The authors prove the anti-Ukrainian orientation of the consistent and deliberate policy of Stalin and his followers against the Ukrainian nation, which culminated in the murder by starvation. These research findings are significant not only for the development of Ukrainian terminology or international terminology. They are also of great importance for modern politics, political science and historiography, and jurisprudence, especially in the context of a new genocide – the Russian Federation’s full-scale war of aggression against Ukraine. Ours is an age of pervasive political turbulence, and the scale of the challenge requires new thinking on politics as well as public ethics for our world. In Western countries, the specter of Islamophobia, alt-right populism, along with racialized violence has shaken public confidence in long-secure assumptions rooted in democracy, diversity, and citizenship. The tragic denouement of so many of the Arab uprisings together with the ascendance of apocalyptic extremists like Daesh and Boko Haram have caused an even greater sense of alarm in large parts of the Muslim-majority world. It is against this backdrop that M.A. Muqtedar Khan has written a book of breathtaking range and ethical beauty. The author explores the history and sociology of the Muslim world, both classic and contemporary. He does so, however, not merely to chronicle the phases of its development, but to explore just why the message of compassion, mercy, and ethical beauty so prominent in the Quran and Sunna of the Prophet came over time to be displaced by a narrow legalism that emphasized jurisprudence, punishment, and social control. In the modern era, Western Orientalists and Islamists alike have pushed the juridification and interpretive reification of Islamic ethical traditions even further. Each group has asserted that the essence of Islam lies in jurisprudence (fiqh), and both have tended to imagine this legal heritage on the model of Western positive law, according to which law is authorized, codified, and enforced by a leviathan state. “Reification of Shariah and equating of Islam and Shariah has a rather emaciating effect on Islam,” Khan rightly argues. It leads its proponents to overlook “the depth and heights of Islamic faith, mysticism, philosophy or even emotions such as divine love (Muhabba)” (13). As the sociologist of Islamic law, Sami Zubaida, has similarly observed, in all these developments one sees evidence, not of a traditionalist reassertion of Muslim values, but a “triumph of Western models” of religion and state (Zubaida 2003:135). To counteract these impoverishing trends, Khan presents a far-reaching analysis that “seeks to move away from the now failed vision of Islamic states without demanding radical secularization” (2). He does so by positioning himself squarely within the ethical and mystical legacy of the Qur’an and traditions of the Prophet. As the book’s title makes clear, the key to this effort of religious recovery is “the cosmology of Ihsan and the worldview of Al-Tasawwuf, the science of Islamic mysticism” (1-2). For Islamist activists whose models of Islam have more to do with contemporary identity politics than a deep reading of Islamic traditions, Khan’s foregrounding of Ihsan may seem unfamiliar or baffling. But one of the many achievements of this book is the skill with which it plumbs the depth of scripture, classical commentaries, and tasawwuf practices to recover and confirm the ethic that lies at their heart. “The Quran promises that God is with those who do beautiful things,” the author reminds us (Khan 2019:1). The concept of Ihsan appears 191 times in 175 verses in the Quran (110). The concept is given its richest elaboration, Khan explains, in the famous hadith of the Angel Gabriel. This tradition recounts that when Gabriel appeared before the Prophet he asked, “What is Ihsan?” Both Gabriel’s question and the Prophet’s response make clear that Ihsan is an ideal at the center of the Qur’an and Sunna of the Prophet, and that it enjoins “perfection, goodness, to better, to do beautiful things and to do righteous deeds” (3). It is this cosmological ethic that Khan argues must be restored and implemented “to develop a political philosophy … that emphasizes love over law” (2). In its expansive exploration of Islamic ethics and civilization, Khan’s Islam and Good Governance will remind some readers of the late Shahab Ahmed’s remarkable book, What is Islam? The Importance of Being Islamic (Ahmed 2016). Both are works of impressive range and spiritual depth. But whereas Ahmed stood in the humanities wing of Islamic studies, Khan is an intellectual polymath who moves easily across the Islamic sciences, social theory, and comparative politics. He brings the full weight of his effort to conclusion with policy recommendations for how “to combine Sufism with political theory” (6), and to do so in a way that recommends specific “Islamic principles that encourage good governance, and politics in pursuit of goodness” (8).

Can we say, definitively, when an armed conflict no longer exists under international law? The short, unsatisfying answer is sometimes: it is clear when some conflicts terminate as a matter of international law, but a decisive determination eludes many others. The lack of fully-settled guidance often matters significantly. That is because international law tolerates, for the most part, far less violent harm, devastation, and suppression in situations other than armed conflicts. Thus, certain measures governed by the laws and customs of war—including killing and capturing the enemy, destroying and seizing enemy property, and occupying foreign territory, all on a possibly large scale—would usually constitute grave violations of peacetime law. This Legal Briefing details the legal considerations and analyzes the implications of that lack of settled guidance. It delves into the myriad (and often-inconsistent) provisions in treaty law, customary law, and relevant jurisprudence that purport to govern the end of war. Alongside the doctrinal analysis, this Briefing considers the changing concept of war and of what constitutes its end; evaluates diverse interests at stake in the continuation or close of conflict; and contextualizes the essentially political work of those who design the law. In all, this Legal Briefing reveals that international law, as it now stands, provides insufficient guidance to precisely discern the end of many armed conflicts as a factual matter (when has the war ended?), as a normative matter (when should the war end?), and as a legal matter (when does the international-legal framework of armed conflict cease to apply in relation to the war?). The current plurality of legal concepts of armed conflict, the sparsity of IHL provisions that instruct the end of application, and the inconsistency among such provisions thwart uniform regulation and frustrate the formulation of a comprehensive notion of when wars can, should, and do end. Fleshing out the criteria for the end of war is a considerable challenge. Clearly, many of the problems identified in this Briefing are first and foremost strategic and political. Yet, as part of a broader effort to strengthen international law’s claim to guide behavior in relation to war and protect affected populations, international lawyers must address the current confusion and inconsistencies that so often surround the end of armed conflict.

Este trabajo, de corte académico, tiene como tema central analizar el sentido y significado de la carga de la prueba y la carga dinámica de la prueba en el contexto latinoamericano; teniendo como eje problematizador la ausencia de estudios comparados. Como centro temático, se tuvieron en consideración algunos principios generales del derecho, tales como la equidad y el equilibrio probatorio, en su cosmovisión desde la materialización procesal hasta su finalidad que es la búsqueda de la verdad procesal. Los conceptos “carga de la prueba” y “carga dinámica de la prueba” no se han unificado ni precisado en muchos países de América Latina; en tal sentido, se percibe una ambivalencia muy marcada, e incluso un desconocimiento total y quizá una falta de doctrina y jurisprudencia al respecto; la cual solo se profundiza por algunos tratadistas de forma muy superficial. Colombia es el único país que lidera un interés particular por determinar su alcance y establecimiento. El enfoque persigue la decantación de estos procesos dispersos y aislados, así como estudiar las tendencias teóricas actuales del principio de la carga dinámica de la prueba que abre nuevos espacios de discusión jurídica. Como quiera que las consideraciones se sustentan a modo de texto expositivo-argumentativo, abordaremos el recurso de la interpretación sistémica, el cual nos permitirá analizar leyes, códigos, jurisprudencia, en su contexto constitucional, además de traer a colación diferentes pronunciamientos judiciales. Finalmente, acudiendo al enfoque analítico-descriptivo, apoyado en las categorías del conocimiento, fijaremos a modo de conclusión, posturas ideológicas en torno reflexivo que por su puesto redundarán en aportes importantes de enriquecimiento jurídico y académico.
