Abstract:
In order to complement existing empirical research on democratic consolidation in Kenya and the role of the judiciary in particular, this mini-­‐dissertation analyses the relationship between judicial appointment processes and judicial independence in Kenya. The escalation of corruption, centralisation and abuse of power by the executive, the lack of government accountability and post-­‐election conflict of 2007 is linked to the dominance of the executive and corresponding subservience of the judiciary. Historically, judicial appointments have been the ambit of the President. The powers given to the President to appoint and remove judges have resulted in judicial appointments premised on allegiance to the executive rather than on upholding justice and the Bill of Rights. To rectify this deficiency, the 2010 Constitution has introduced a merit based system of judicial appointments that meets international standards on judicial independence. The new process requires the President to limit his appointments to the recommendations of a Judicial Service Commission whose responsibility it is to shortlist candidates through a transparent public process. An analysis of the selection of Kenya’s sitting Chief Justice and Deputy Chief Justice demonstrates that the reformed judicial appointment process has delegitimised the executive’s dominance over the judiciary and by so doing has placed Kenya on the road restoring judicial independence.

Abstract:
In recent months, presidential appointments to the Supreme Court have become an increasingly salient issue with both the public and the press. The relevance of the topic makes it an inviting subject for political science research. When looking at the question of judicial quality, the problem that researchers have faced in the past is one of quantifying quality. This work seeks to expand on previous survey research done on the quality of individual justices. By using quality scores (Comiskey 2004) as a dependent variable, it is possible to analyze influences on the President’s nomination choice and their relative impacts on the quality of justices. By using a more rigorous approach, this study can more confidently make assertions about the nature of the nomination and confirmation process and the quality of Supreme Court justices.

In the face of a conflict, citizens can follow different ways to solve it. But, how justice is configurated in the conclusion of a specific conflict? what guarantee that the procedure of the mechanism is fair? We can think here in the due process of law; nevertheless, due process of law does not reach all mechanisms of conflict resolution.This paper, therefore, focuses in the study of the role of justice in (i) the procedural scope of judicial process and ADR mechanisms; and in (ii) the conflict resolution generated by them.
Ante un conflicto, los ciudadanos pueden seguir diversas vías para dar solución al mismo. Pero, ¿cómo se configura la justicia en la conclusión de un conflicto en específico? ¿qué garantiza que el procedimiento del mecanismo sea uno justo?. Podemos pensar aquí en el debido proceso; no obstante, éste no alcanza a todos los mecanismos de resolución de conflictos.Este artículo, por consiguiente, se enfoca en estudiar cuál es el rol de la justicia en (i) el ámbito procedimental del proceso judicial y de los MARCs; así como en (ii) la resolución al conflicto generada por aquéllos.

O presente trabalho consiste num estudo para conhecer os principais aspectos relacionados ao processo judicial eletrônico. Tem como objetivo apresentar uma visão do esforço gradual de modernização dos tribunais brasileiros, com vistas à informatização do processo judicial, a partir das iniciativas de utilização de novas tecnologias pelos tribunais, passando pela Lei nº 11.419/06, até chegar-se à previsão legal de um modelo abrangente de processo eletrônico com a Resolução nº 185 do Conselho Nacional de Justiça e a implantação do Sistema de Processo Judicial Eletrônico – PJe. Objetiva ainda servir como fonte de informação aos profissionais do direito que atuam nos tribunais brasileiros. Para a elaboração do estudo foi necessário conhecer as principais dificuldades do Judiciário brasileiro, sua forma de estruturação, as principais características do processo judicial eletrônico, bem como o arcabouço legal que envolve sua adoção. Levou-se ainda em consideração a experiência do autor, que atua como servidor do Tribunal de Justiça do Maranhão desde janeiro de 2006 e participou, na qualidade de analista de sistemas, da implantação de sistemas de processo eletrônico no Poder Judiciário do Maranhão, no período de 2007 a 2013. O avanço tecnológico no âmbito do Judiciário não poderia ser diferente daquele que ocorre nos diversos segmentos da sociedade. No âmbito jurídico uma iniciativa de implantação do processo judicial eletrônico está em curso, com o objetivo de atingir 100% dos órgãos do Judiciário até 2018. O intuito dos idealizadores do sistema é diminuição de gastos, comodidade, rapidez nas análises dos processos, entre outros benefícios. Como se trata de uma quebra de paradigma, a adoção do processo eletrônico não deve ocorrer sem resistências. Contudo, após conhecer seus benefícios, é previsível que a maioria dos operadores do Direito reconheça a importância de sua implantação. Como resultado do estudo foi possível observar que os benefícios gerados pela adoção do processo eletrônico vão muito além da simples economia de papel, representando uma verdadeira revolução no modo de fazer justiça.
The present essay is a review of the essential aspects related to the electronic court proceedings. It aims to present a vision of the gradual effort to modernize the Brazilian courts, with a view to computerization of the judicial process, from the use of new technology initiatives by the courts, through Law nº. 11.419/06, until we reach the legal provision of a comprehensive electronic process model with the Resolution nº. 185 of the National Council of Justice (CNJ – Conselho Nacional de Justiça) and the implementation of an electronic lawsuit system called PJE – Processo Judicial Eletrônico. It also aims to be a source of information to law professionals in the Brazilian courts. In preparation for these study, it was necessary to know the main difficulties of the Brazilian Judiciary, their structure, the main features of an electronic judicial process and the legal framework surrounding its adoption. It took also into account the author's experience, which acts as employee of the Court of Justice of Maranhão since January 2006 and participated, as a systems analyst, in the adoption of the electronic process system in the judicial power of Maranhão, in the period of 2007-2013. The technological enhancement within the judiciary could not be different from what happens in any other sector of our society. In the legal field, a lawsuit electronic deployment initiative is underway, with the goal of reaching 100% of the judiciary bodies by 2018. The system authors aim to lower costs, increase convenience, speed up lawsuit analysis, among others benefits. As it is a paradigm shift, the adoption of electronic process should not take place without resistance. However, after knowing its benefits, it is anticipated that most legal professionals recognize the importance of its adoption. As a result of these study, it was observed that the benefits generated by the adoption of an electronic process go far beyond saving paper, it represents a revolution in the way of doing justice.
Le présent travail expose une étude permettant de connaître les aspects les plus importants relatifs à la procédure judiciaire par voie électronique. Il a pour but de présenter un panorama de l´effort progressif de modernisation des tribunaux brésiliens, en vue de l´informatisation de la procédure judiciaire, en fonction des iniciatives d´usage de nouvelles technologies par les tribunaux, par le biais de la Loi nº 11.419/06, de la prévision légale d´un modèle plus complet de la procédure dématérialisée avec l´Arrêté nº 185 du Conseil National de Justice et de la mise en place du Système de Procédure Judiciaire par voie Électronique – Pje. Il vise encore à servir comme source d´information aux professionnels du droit travaillant dans les tribunaux brésiliens. Pour la réalisation de cette étude, il a fallu découvrir les principales difficultés du système judiciaire brésilien, son organisation, les caractéristiques les plus importantes de la dématérialisation de la procédure judiciaire ainsi que la base légale que sa mise en oeuvre requiert. On a encore tenu compte de l´expérience de l´auteur, qui travaille comme fonctionnaire du Tribunal de Justice de l´État de Maranhão depuis janvier 2006 et qui a participé, en qualité d´analyste de systèmes en informatique, à la mise en place de systèmes de procédure par voie électronique, pour le pouvoir Judiciaire de l´État de Maranhão, dans la période de 2007 à 2013. L´avancée technologique dans le cadre du Pouvoir Judiciaiare ne saurait être différente de celle qui se produit au sein des différents secteurs de la société. Dans le cadre juridique, une iniciative de mise en place de la procédure judiciaire électronique est en cours, dans le but d´atteindre 100% des organismes du Pouvoir Judiciaire d´ici 2018. Les réalisateures de ce système s´attendent à la diminution des dépenses, la commodité, la vitesse pour l´analyse des procédures, entre autres avantages. Comme il s´agit, ici, de briser des paradigmes, le fait d´adopter la dématérialisation de la procédure ne se fait pas sans résistances. Cependant, une fois connus les avantages, il est prévisible que la plupart des acteurs du Droit reconnaissent l´importance de sa mise en place. Comme résultat de cette étude, on a pu constater que les avantages advenus de l´adoption de la procédure par voie électronique vont au-delà d´une simple économie de papier. Mais cela représente une véritable révolution dans la manière de réaliser la justice.

A Lei nº 11.101/2005 (Lei de Recuperações de Empresas e Falências - LRF) foi editada há mais de uma década. Entretanto, a respectiva aplicação cotidiana é um fenômeno relativamente recente, estando associado à crise econômica dos últimos anos. Trata-se de lei que contém dispositivos de natureza material e processual, sendo indiscutível que o referido instituto se desenvolve por meio de um processo. Nesse contexto, e embora a doutrina revele alguma preocupação com os aspectos processuais da Lei nº 11.101/2005, não existem estudos específicos voltados a definir com clareza a natureza do referido processo, o que prejudica a coerência e linearidade do conhecimento jurídico produzido a respeito do tema A presente dissertação pretende preencher justamente essa lacuna, demonstrando que o processo de recuperação judicial abarca situações jurídicas coletivas, bem como que se trata de um processo coletivo. Além disso, o referido processo envolve a reestruturação de uma instituição, o que faz com que se conclua que o mesmo compartilha de características próprias ao chamado processo coletivo estrutural. Diante de tais premissas, é necessário repensar a legitimação para a pratica de atos na recuperação judicial, utilizando-se meios voltados a garantir que os indivíduos e coletividades afetadas – ainda que ausentes – tenham os respectivos interesses efetivamente representados dentro do processo.
Federal Law n. 11.101/2005 (Law on Judicial Recovery and Bankruptcy - LRF) was issued more than a decade ago. However, its frequent application is a relatively recent phenomenon, associated with the recent economic crisis. This law contains provisions of both a material and procedural nature; in addition, it is certain that the judicial recovery is developed through a legal process. Although the literature has demonstrated some concern with the procedural aspects of the LRF, there are no specific studies aimed at defining the nature of the aforementioned legal process, which impairs the coherence and linearity of the legal knowledge produced on the subject. This dissertation intends to fill this gap, demonstrating that the judicial recovery is collective legal process. In addition, this process involves the restructuring of an institution, which makes it possible to conclude that it shares characteristics of the so called structural injunctions. Faced with such a premise, it is necessary to rethink the legitimacy to practice acts in judicial recovery, even considering the use of means aimed at ensuring that affected individuals and communities - even if absent - have their respective interests effectively represented within the process.

Furthermore, the interlocutor analyzes specific questions, such as the referred to the problematic of the precautionary measures, whether the contentious-administrative process is an equally satisfactory route in comparison with the amparo process, and the measures that Judicial Power is entitled to impose to the Administration.
En la presente entrevista, el interlocutor examina el proceso contencioso administrativo, respondiendo a cuestiones relativas a sus orígenes históricos, los cambios que ha sufrido y el impacto que genera su utilización en la práctica. Asimismo, el interlocutor analiza cuestiones más específicas, como las referidas a la problemática de las medidas cautelares, si el proceso contencioso administrativo es una vía igualmente satisfactoria respecto del amparo, y las medidas que puede imponer el Poder Judicial a la Administración.

This study aims to analyze the meaning and scope of the rights of reasonable processing time and access to justice, drawing a parallel between the theoretical framework and the practical reality on the subject, characterizing it as a fundamental right inherent in the individual, analyzing this theme with a view to environmental law. Protecting the environment is presented in the Federal Constitution as the supreme premise, given that it is, above all his life protection. Nevertheless, this research will seek to discover what are the biggest obstacles to give a reasonable time to the process, seek to demonstrate the accountability of the judiciary as the body responsible for the solution of conflicts in court level, as well as throughout the state that has the responsibility to provide the apparatus necessary for the production of the common good. By the same token, it will be made to demonstrate the changes necessary to the effective applicability of speedy trial, and the mechanisms to resolve such problems, so that the provision outlined in the abovementioned legal instruments produce practical results and noticeable to the community.
O presente trabalho tem como objetivo analisar o significado e alcance dos direitos da razoável duração do processo e acesso à justiça, traçando um paralelo entre a construção teórica e a realidade prática acerca do tema, caracterizando-o como um direito fundamental inerente ao indivíduo, analisando tal temática com vistas ao Direito Ambiental. A proteção ao meio ambiente é apresentada na Constituição Federal como premissa suprema, tendo em vista que se trata, sobretudo da proteção a própria vida. Não obstante, a presente pesquisa, procurará descobrir quais são os maiores óbices a conferir uma razoável duração ao processo, buscará demonstrar a responsabilidade do Poder Judiciário enquanto órgão responsável pela solução dos conflitos em âmbito jurisdicional, bem como, de todo o Estado que possui a responsabilidade de fornecer o aparato necessário à produção do bem-comum. No mesmo diapasão, procurar-seá demonstrar as transformações necessárias à efetiva aplicabilidade da celeridade processual, e os mecanismos capazes de solucionar tal problemática, de forma que, o preceito traçado nos diplomas legais supramencionados produzam resultados práticos e perceptíveis à coletividade.

O presente trabalho tem como objetivo identificar quantos processos envolvendo empresários ou sociedades empresárias que após o encerramento de sua respectiva recuperação judicial por cumprimento do plano, soergueram suas respectivas atividades empresariais. Como critério de verificação utiliza-se o não posterior pedido de falência ou execução fundada em título judicial originário da concessão da recuperação judicial (art. 59, § 1º LRE) após o encerramento por cumprimento do plano. Buscando atingir este objetivo, foram utilizados e analisados todos os processos de recuperação judicial distribuídos junto à 2º Vara de Falência e Recuperações Judiciais do Foro Cível Central da Comarca da Capital do Estado de São Paulo desde a vigência da LRE (09/06/2005) até o encerramento temporal desta pesquisa, qual seja, 21 de outubro de 2014. De forma subsidiária, nesta pesquisa realizou-se a descrição dos processos presentes no universo de pesquisa determinado, identificando, assim, dados como o tempo médio das diversas fases do processo de recuperação judicial, tipos empresários e enquadramento tributário dos requerentes, motivos que levaram ao indeferimento do processamento, convolação em falência das respectivas recuperações judiciais, quantidade de recuperações deferidas e concedidas, visto que tais informações interessam diretamente ao objetivo final deste trabalho e compõem momento anterior ao futuro encerramento, assim como os dados aqui apresentados podem influenciar de forma direta a conclusão da pesquisa. O pressuposto que originou e guiou este trabalho é a ausência de dados empíricos sobre o tema, pois se acredita que o conhecimento da realidade prática do instituto ora estudado é necessário para entender e melhorar seu funcionamento.
The present work has as objective verify how many businessmen or business society that, after the closure of your respective judicial reorganization for the plan’s compliance, raised your respective business activities. As verification criterion uses the non posterior bankruptcy request or the judicial instrument enforcement originary of the judicial reorganization concession (article 59, 1st §, LRE) after the closure by plan’s compliance. Trying to achieve this objective, it was used and analyzed all the judicial reorganization requests distributed to the 2nd Bankruptcy and Judicial Reorganization Court of São Paulo, since the effectiveness of LRE (09/06/2005) until the temporal closure of this research, which is, 21st , October 2014. Subsidiary, in this research was done the description of the processes present in the specific research universe, identifying, therefore, data as the mean time of the judicial reorganization process steps, type of business and company size, reasons that lead to the processing dismissal, conversion in bankruptcy of the respective judicial reorganizations, quantity of granted reorganization and conceded, since these informations concern directly to this work’s final objective and compose previous moment to the future closure, as well as the data presented here can influence directly to the research conclusion. The presupposition that originate and guided this work is the absence of empiric data about the topic, because this research believes that the knowledge of the studied institute’s practical reality is necessary to understand and improve its functioning.

Abstract:
The thesis investigates how using a discourse pragmatic approach gives insight into the complexities of hand-written interrogation records. Data come from eighteen Egyptian interrogations from the years 2007 to 2011. It includes five interrogations with ex-president Hosni Mubarak and his two sons, Gamal, and Alaa, which took place in 2011 after the 25th January revolution, as well as with ordinary workers, traders and company managers. In addition, data include interrogations in criminal cases with a variety of offences such as drugs, murder, political cases and embezzlement. This study examines the pragmatic and linguistic choices that prosecutors and suspects make to express power relations, modes of resistance and information gathering/confirmation in inquisitorial interviews in Egypt. This helps give insights into questioning practices in Egypt’s legal system and the interactional goals and methods of such speech events. In addition, it includes exploring the challenges of analysing and translating a written record, and establishing the journey of a suspect’s statement in Egyptian interrogations. Analysis reveals that suspects were able to resist some of prosecution’s accusations and control. However, the more controlling the questions became the less able were they to answer cooperatively while maintaining their innocence on the record. Exceptions to that were suspects who received legal advice from lawyers or worked in the legal field. Questioning strategies such as the use of and/wa-prefaced questions and Put on Record (POR) questions in the data have revealed that the current recording practices are sometimes limiting and coercive whether intended or not due to the special attention given to recording the institutional version of the narrative. Moreover, suspects are not invited to freely give their own narrative. This results in the production of an altered interrogation record. Implications for the field of Egyptian interrogations and interrogation more widely are discussed.

Abstract:
This thesis examines campaign contributions in judicial elections. Increasing campaign costs have created a perception that judges’ decisions may be biased by the contributions they receive. Regardless of actual bias, perceived bias is enough to warrant concern because it threatens the legitimacy of the judiciary. Though money presents a problem for the judiciary, elections serve as a beneficial method of selecting judges. Additionally, money is an important aspect in elections and cannot simply be eliminated. Publicly funded elections have been proposed to counteract the problem; however, the findings in this thesis demonstrate that they are no longer a viable option. Recent court cases and a lack of funding have made publicly funded elections unworkable. Instead, this paper proposes a system of judicial disqualification. Disqualifying judges who have a perceived bias due to contributions eliminates the threat to legitimacy.The proposal also takes this decision out of the judge’s hands and allows an independent panel to decide possible bias. The paper demonstrates the ability of a disqualification system to eliminate the negative effects of contributions without harming the positives associated with elections.

A tese tem por objetivo investigar como se forma o juízo sobre os fatos na decisão judicial. Parte-se do pressuposto de que um juízo verdadeiro sobre os fatos é condição necessária, ainda que não suficiente por si só, para a justiça da decisão. A estratégia adotada é estudar o processo de conhecimento ao longo do qual se forma o juízo sobre os fatos. Inicia-se a exposição afirmando-se que são objeto de julgamento, e, portanto, do processo de conhecimento, ações humanas, as quais são sempre singulares, irrepetíveis e praticadas no passado. Sustenta-se que as ações só podem ser apreendidas adequadamente quando se consideram todos os aspectos que a caracterizam, a saber: que a ação tem como causa um agente, que é praticada com base em motivos e com determinada intenção e que é praticada em circunstâncias que, em sua totalidade, só dizem respeito a cada ação particular. Definido o objeto, passa-se ao primeiro aspecto relativo ao sujeito do conhecimento: a análise da repercussão dos dois tipos clássicos de raciocínio decisório judicial sobre a apreensão das ações particulares do caso. Conclui-se que o raciocínio analógico favorece uma apreensão das ações ampliada em relação ao raciocínio subsuntivo. O raciocínio subsuntivo, por sua vez, inibe, mas não é incompatível, com essa apreensão ampla. O trabalho retorna ao objeto de conhecimento, desta feita para analisar o que se oferece ao conhecimento do juiz para obter informações sobre as ações humanas que serão julgadas. Conclui-se que esses elementos ou são evidências, sobre as quais o juiz realiza inferências, ou presunções, que ele aplica. Evidências e presunções contribuem de forma variada para a satisfação de critérios de verdade. A tese se encerra com um retorno ao sujeito do conhecimento judicial: a análise dos dois modos de ajuizar as informações obtidas mediante inferências obtidas das evidências e os resultados das aplicações de presunções. Pelo método de resposta a questões feitas com base na regra de Direito que se supõe aplicável é possível resolver o caso nos termos dessa mesma regra de Direito, mas com um possível déficit de verdade, pois ficam de fora do juízo os aspectos das ações não contemplados pelas questões formuladas. Pelo método narrativo, os fatos são expostos em toda sua amplitude, o que atende mais satisfatoriamente à pretensão de verdade que lhe é inerente. O método narrativo não é incompatível com o método de questões, mas o completa e serve de teste à verdade das respostas.
The thesis aims to investigate how the judges opinion about the facts is built. Its basic assumption is that a true statement of the facts is a necessary condition to the justice of the decision, although insufficient by itself. The strategy adopted is to study the process of knowledge production which ends with the ascertainment of the facts. The study begins by saying that the object of trial, and therefore of the process of knowledge, are human actions, which are always unique, unrepeatable and practiced in the past. It is argued that actions can only be grasped properly when you consider all the aspects that characterize them, namely that the action is caused by an agent, it is practiced on the basis of reasons, with specific intention and that is practiced in circumstances that, in its entirety, only relate to each particular action. Set the object we pass to the first aspect of the subject of knowledge: the analysis of the impact of the two classical types of judicial reasoning on the task of knowing the particular actions of the case. It is concluded that analogical reasoning favours an expanded understanding of actions in relation to subsumption reasoning. Subsumption reasoning, in turn, inhibits, but is not inconsistent with, a broad approach to the facts. The work returns to the object of knowledge, this time to analyze what is offered to the attention of the judge to give him information about human actions that will be judged. We conclude that these elements are either evidence on which the judge makes inferences or presumptions that he applies. Evidence and presumptions contribute in different ways to the satisfaction of criteria of truth. The thesis concludes with a return to the subject of legal knowledge: the analysis of the two ways of ascertaining the information obtained through the inferences made on the basis of evidences and by application of presumptions. By the method of answering questions based on the rule of law that is supposed to apply it is possible to solve the case under that same rule of law, but with a possible deficit of truth, for the court doesnt take into account any information that is not an answer to the questions formulated. By the narrative method, the facts are exposed in all their diversity, which serves more satisfactorily to the claim to truth that must guide the judge. Moreover, the narrative method is not inconsistent with the method of questions, but functions as a complement and to test the truth of the answers.

This work aims to verify the material truth principle in the administrative procedure for granting disability benefit (sickness and disability retirement pension both) as well as checking the principle of real truth in the judicial process for the same benefits. The intention is to note that the Administrative sphere the process for granting benefits, follows own principles, whose forecast is in the Law of Administrative Procedure. Upon completion of the medical report issued the decision is yet to be taken into consideration characteristics and principles of public administration to better consider the application of the principle of real truth. Already in judicial headquarters for the granting of sickness or disability retirement under the principle of real truth can possibly be interpreted more broadly by the judge, taking into account that apply to judicial proceedings, not only constitutional procedural principles, but strictly procedural principles applicable to pension harvest. After medical-legal experts, the court issues a move that meshes the interpretive act, multidimensional effects, with expert verification, which conceives better application of the principle of real truth. At the end we observe the effects of the application of the principle of real truth in the judicial process, and jurisprudential that is generated due to the interpretation of the judge tract
A presente dissertação tem por objetivo verificar o princípio da verdade material no processo administrativo para concessão de benefício por incapacidade (auxílio-doença e aposentadoria por invalidez, ambos previdenciários); e verificar o princípio da verdade real no processo judicial para os mesmos benefícios. A intenção é observar que, na esfera administrativa, o processo para concessão de benefícios segue princípios próprios, cuja previsão encontra-se na Lei de Processo Administrativo. Após a realização da perícia médica, a decisão é emitida; contudo, devem ser levados em consideração características e princípios próprios da administração pública que melhor consideram a aplicação do princípio da verdade real. Já em sede judicial, a concessão de auxílio-doença ou aposentadoria por invalidez, à luz do princípio da verdade real, tem possibilidade de ser interpretada de forma mais ampla pelo juiz, levando em consideração que são aplicáveis ao processo judicial princípios não somente processuais constitucionais, mas também processuais, estritamente aplicáveis à seara previdenciária. Após a perícia médica judicial, o juiz emite decisão em que se coaduna o ato interpretativo e os efeitos multidimensionais com a verificação pericial, o que concebe melhor aplicação do princípio da verdade real. Ao final, observam-se os efeitos da aplicação do princípio da verdade real no processo judicial e a jurisprudencialização, que é gerada por conta do trato interpretativo do juiz

Sob a fundamentação de diminuir as barreiras existentes de acesso à justiça, e aplicar o princípio constitucional da duração razoável do processo, estão sendo operadas reformas ao Código de Processo Civil, sendo este instrumento de grande relevância para os operadores do direito e o cidadão comum, vez que rege as relações processuais no âmbito do judiciário. Tais reformas fortaleceram sobremaneira o controle realizado pelo STF e STJ. No bojo dessas alterações foi inserido o 1 do art. 518 do CPC, possibilitando ao juiz de primeiro grau não receber recurso de apelação quando sua decisão estiver de acordo com súmula do STJ e do STF. Tal dispositivo poderá trazer várias conseqüências jurídicas e vantagens ao judiciário que economizará tempo e recursos financeiros e humanos tão preciosos no sistema judiciário, bem como para o cidadão que terá preservado as garantias processuais do devido processo legal, direito de ação e defesa, terá previsibilidade do grau de seu direito em face da uniformização, bem como participará de um processo regido com base nos princípios da igualdade, segurança jurídica, duração razoável do processo. Assim, esse trabalho confirmou a suposição de que tais conseqüências jurídicas trazidas pela aplicação 1 do art. 518 do CPC, conhecido como súmula impeditiva de recurso, sentença impeditiva de recurso, ou ainda eficácia impeditiva de recurso, legitima a adoção do dispositivo à luz dos princípios constitucionais. A pesquisa foi do tipo descritiva com viés qualitativo para o levantamento dos dados obtidos através de entrevista a juízes, desembargadores, Ministros do STJ e STF, que proporcionou conhecer o desenvolvimento de seu processo decisório, bem como verificar o entendimento desses magistrados sobre as conseqüências que a súmula que fundamenta a sentença cujo efeito impede recurso impõe na vida do cidadão, parte na relação processual, à luz dos princípios garantidos constitucionalmente

O presente trabalho propõe-se a desconstruir o conceito do princípio da segurança jurídica a partir da teoria da desconstrução de Jacques Derrida e das ideias de Wittgenstein II sobre a designação de um significado a partir do uso de um termo em situações específicas, levando em consideração o contexto da cibercultura e os riscos técnicos atinentes à sociedade da informação. Para tanto, o estudo foi realizado a partir de uma revisão de literatura para definir o conceito de segurança jurídica que seria desconstruído, acrescido de uma pesquisa empírica com abordagem qualitativa e objetivo exploratório com pesquisa de campo para conhecimento de outros sistemas eletrônicos que faz parte do Judiciário brasileiro, bem como para conhecimento de casos de falhas de segurança dentro do sistema padrão de processo eletrônico brasileiro - PJe. Assim, a qualidade de uso da tecnologia foi considerada mais importante que a tecnologia propriamente dita quando da observação quanto ao comportamento negativo, referente a interação do homem com a tecnologia, foi colocado como fenômeno de comportamento social que não pode ser negado no momento da desconstrução. Dessa forma, como resultado, a pesquisa traz a percepção quanto à real necessidade de desconstrução do conceito do princípio da segurança jurídica para que esses comportamentos negativos advindos da cultura cracker sejam absorvidos pelo ordenamento jurídico brasileiro, fazendo com que a segurança jurídica seja vista como sinônimo da segurança da informação tendo em vista a realidade de um Judiciário virtualizado.
This research aim is deconstructing the concept of juridical security from the Jacques Derrida deconstruction theory and the ideas of Wittgenstein II about designation of a meaning from a term use in specific situations, considering cyberculture and the technical risks associated with information society. For that, this study was based on literature review to define a juridical security concept to be deconstructed, and an empirical research with qualitative approach and exploratory objective aiming to know others electronic systems that is part of the brazilian judicial system, and to know security failures cases relating with brazilian electronic process standard system (Pje). The technology quality use was considered more important than the technology itself after observing negative behaviors, referring how man interact with technology. This interaction was placed as a social phenomenon that cannot be denied at the deconstruction moment. As a possible result, this work brings a perception about the real need of deconstructing juridical security concept in order to make these negative behaviors arising from "cracker" culture be faced and absorbed by Brazilian legal system and juridical culture, making juridical security to be seen as a synonymous of information security.

Noting that the State exercises a judicial function, provided for in the Federal Constitution, in order to resolve conflicts of interest in the search for social peace and that this exercise occurs through the process that is the civilized substitute for private vengeance; urges analyze today's concept of access to justice as a guarantee of the examination a court claim in an acceptable time and with the security of a proper treatment, reflecting the ethical values of society today. One of the main criticisms that the judiciary suffers today in Brazil is the slowness at the judicial proceedings. Thus, front of the social requirements for reasonable length of proceedings, the legislator, reformer endowed with constituent power, did include among the individual guarantees of the Constitution the forecast of reasonable duration of the process. In this vein, many initiatives have been engendered with the intention of reducing the time of the procedure, through technological advancement in the judiciary. In this context, entered into force the Law n. 11,419, dated December 19, 2006, which deals with computerization of the judicial process. Therefore, this research aims to conduct a systematic review of the standards included in our legal system through the deductive method in order to verify the feasibility of electronic communications and legal procedure's safety.
Verifica-se que o Estado exerce a função jurisdicional prevista na Constituição Federal com a finalidade de resolver os conflitos de interesses e, assim, garantir efetividade ao ordenamento jurídico, afastando a possibilidade indiscriminada de autotutela. É de se observar que este exercício se dá, dentre outras formas, através do processo que é o substituto civilizado da vingança privada. Neste contexto, insta analisar a concepção hodierna do acesso à justiça como garantia do exame de uma pretensão em tempo aceitável e com a segurança de um tratamento adequado, reflexo dos valores éticos da sociedade atual. Uma das principais críticas que o Poder Judiciário sofre hoje no Brasil é a morosidade na prestação da tutela jurisdicional. Assim, diante da atual exigência de celeridade, o legislador, dotado de poder constituinte reformador, fez incluir no rol de garantias individuais da Constituição da República a previsão da duração razoável do processo. A partir destas constatações e ações, muitas iniciativas têm sido engendradas com a intenção de reduzir o tempo da tramitação processual, sendo a telemática uma das mais modernas e promissoras ferramentas neste sentido. Destarte, entrou em vigor a Lei n. 11.419, datada de 19 de dezembro de 2006, que trata da informatização do processo judicial. Portanto, esta pesquisa se propõe a realizar uma avaliação sistemática das normas presentes em nosso ordenamento jurídico através do método dedutivo, a fim de verificar a viabilidade das comunicações eletrônicas e a legitimidade deste procedimento.

En nuestro país, el sistema de justicia se encuentra conformado por el Ministerio Público, el Tribunal Constitucional, la Junta Nacional de Justicia, la Academia de la Magistratura, y finalmente, pero no menos importante, el Poder Judicial. Esta última entidad mencionada, es un poder del estado que se encarga de administrar justicia a través de sus órganos jurisdiccionales, en base a la Constitución política del Perú y a sus leyes. El Perú debe realizar cambios en sus procesos para mejorar los diferentes servicios de justicia brindados. Para mejorar los servicios del Poder Judicial se propone implementar arquitectura empresarial, la cual permite alinear los objetivos estratégicos con las tecnologías de información. En la tesis “Propuesta de un modelo de Arquitectura Empresarial para una Corte Superior de Justicia” se desarrollará una propuesta de mejora de servicios a través de arquitectura empresarial a través de la metodología TOGAF. La propuesta comienza con el marco teórico que abarca conceptos de justicia, así como de arquitectura empresarial; luego se explica la situación actual del Poder Judicial, el planteamiento del problema y la justificación de este. A la mitad de la tesis se presenta el objetivo de la propuesta, seguida de la propuesta de solución al problema encontrado, para finalmente brindar las conclusiones y recomendaciones. Mediante el marco de trabajo Zachman se ha realizado el análisis de la situación actual por el cual se determinado que el macro proceso más importante es la “Gestión de procesos judiciales”; se ha usado el diagrama de causa – efecto para encontrar las causas del problema. La propuesta se ha desarrollado en base modelos de mejoras internacionales y una selección de buenas prácticas a través de un modelo propuesto de arquitectura empresarial. La presente tesis es una propuesta que debe servir como modelo para la implementación de una arquitectura empresarial en todo el Poder Judicial.
In our country, the justice system is formed by the Public Ministry, the Constitutional Court, the National Board of Justice, the Academy of the Magistracy, and last but not least, the Power of attorney. This last entity mentioned is a power of the state that is responsible for administer justice through its jurisdictional bodies, based on the Political Constitution of Peru and its laws. Peru must make changes in its processes to improve the different justice services provided. To improve the services of the Judiciary, it is proposed to implement business architecture, which allows aligning strategic objectives with information technologies. In the thesis "Proposal of a Business Architecture model for a Superior Court of Justice" a proposal for improving services through business architecture through the TOGAF methodology will be developed. The proposal begins with the theoretical framework that includes concepts of justice, as well as business architecture; then the current situation of the Judiciary, the approach to the problem and its justification are explained. In the middle of the thesis, the objective of the proposal is presented, followed by the proposed solution to the problem encountered, to finally provide the conclusions and recommendations. Through the Zachman framework, the analysis of the current situation has been carried out, whereby it was determined that the most important macro process is the "Management of judicial processes"; The cause - effect diagram has been used to find the causes of the problem. The proposal has been developed based on international improvement models and a selection of good practices through a proposed business architecture model. This thesis is a proposal that should serve as a model for the implementation of a business architecture throughout the Judiciary.

This study analyses the current role of police-suspect interview discourse in the England & Wales criminal justice system, with a focus on its use as evidence. A central premise is that the interview should be viewed not as an isolated and self-contained discursive event, but as one link in a chain of events which together constitute the criminal justice process. It examines: (1) the format changes undergone by interview data after the interview has taken place, and (2) how the other links in the chain – both before and after the interview – affect the interview-room interaction itself. It thus examines the police interview as a multi-format, multi-purpose and multi-audience mode of discourse. An interdisciplinary and multi-method discourse-analytic approach is taken, combining elements of conversation analysis, pragmatics, sociolinguistics and critical discourse analysis. Data from a new corpus of recent police-suspect interviews, collected for this study, are used to illustrate previously unaddressed problems with the current process, mainly in the form of two detailed case studies. Additional data are taken from the case of Dr. Harold Shipman. The analysis reveals several causes for concern, both in aspects of the interaction in the interview room, and in the subsequent treatment of interview material as evidence, especially in the light of s.34 of the Criminal Justice and Public Order Act 1994. The implications of the findings for criminal justice are considered, along with some practical recommendations for improvements. Overall, this study demonstrates the need for increased awareness within the criminal justice system of the many linguistic factors affecting interview evidence.

La necesidad socio-política de definir el fenómeno de abuso del cargo para un beneficio particular en el poder judicial, es la principal motivación del presente trabajo. Al construirla, se visualiza la irreconciliable perspectiva entre la percepción de la sociedad –la clara definición y observación- y la ardua determinación para sujetos e instituciones técnicas. La búsqueda de herramientas preventivas para la identificación de conductas asociadas a corrupción y la administración de los efectos negativos de las mismas para la organización judicial, es prioritaria para disminuir la corrupción y su incidencia ya que lo que se pone en riesgo es el prestigio, la credibilidad y la confianza de la justicia y del sistema democrático. Estos aspectos definen objeto y objetivos del presente estudio. El objeto de estudio de este trabajo es el poder judicial y la corrupción judicial; para abordarlo se propone realizar una evaluación teórica y empírica respecto del poder judicial como organización y de la corrupción judicial; y desarrollar una matriz de análisis de mapa de riesgo para el poder judicial español que identifique, gestione y sancione riesgos de integridad, particularmente de corrupción judicial, y permita el diseño futuro de políticas públicas judiciales de prevención de dichos riesgos. El período temporal se concentra en los años 2010-2020, extendiéndolo en función de reformas legislativas de importancia y puntualmente indicadas en el texto del trabajo. El trabajo de tesis se basa en dar respuesta a una serie de preguntas de investigación que tienen como ejes los siguientes aspectos: observación del poder judicial y de los conceptos de transparencia y rendición de cuentas; determinación de las posibles áreas de injerencia de la corrupción en el poder judicial y, finalmente, proponer un mecanismo que pueda implementarse para la identificación de la corrupción judicial que respete a los integrantes del poder judicial y de respuestas a las demandas sociales. La estructura se articula en tres partes. La Parte 1 establece la metodología seguida en la investigación. En la Parte 2 se explora los conceptos e instituciones que fundan el trabajo de tesis. Se realiza un estudio de los conceptos Poder Judicial y Administración de Justicia, su dimensión jurídica y política y la relación entre ambos con los de gobierno judicial, administración y gestión judicial y políticas públicas judiciales; para luego diseñar una definición operacional de corrupción judicial, como de transparencia y rendición de cuentas adaptadas al poder judicial. En la Parte 3 primero se analizan los mecanismos de control existentes. Como elemento original de este trabajo, se diseña un mapa de riesgo en el poder judicial como poder-organización y una matriz de identificación de riesgos de corrupción. Finalmente y basadas en esa matriz, se realizan propuestas respetuosas del estatuto judicial y que respondan a las demandas sociales de rendición de cuentas para fortalecer su legitimidad democrática.
La motivació d’aquest treball és la necessitat sociopolítica de definir el fenomen de l’abús del càrrec per a un benefici particular en el poder judicial. En construir aquesta definició, es visualitza la irreconciliable perspectiva entre la percepció de la societat –la clara definició i observació– i la seva difícil determinació per a subjectes i institucions tècniques. La cerca d’eines preventives per a la identificació de conductes associades a la corrupció i la administració dels seus efectes negatius per a l’organització judicial són prioritàries per a disminuir la corrupció i la seva incidència ja que el que es posa en risc és el prestigi, la credibilitat i la confiança de la justícia i del sistema democràtic. Aquests aspectes defineixen l’objecte i els objectius d’aquest estudi. L’objecte d’estudi d’aquest treball és el poder judicial i la corrupció judicial; per a abordar-lo es proposa realitzar una avaluació teòrica i empírica respecte del poder judicial com a organització i de la corrupció judicial; i desenvolupar una matriu d’anàlisi de mapa de risc per al poder judicial espanyol que identifiqui, gestioni i sancioni riscos d’integritat, particularment de corrupció judicial, i permeti el disseny futur de polítiques públiques judicials de prevenció d’aquests riscos. El període temporal es concentra en els anys 2010-2020, obrint-lo en funció de reformes legislatives d’importància, la qual cosa serà puntualment indicada en el text del treball. El treball de tesi es basa en donar resposta a una sèrie de preguntes d’investigació que tenen com a eixos els següents aspectes: observació del poder judicial i dels conceptes de transparència i rendició de comptes; determinació de les possibles àrees d’ingerència de la corrupció en el poder judicial i, finalment, proposar un mecanisme que pugui implementar-se per a la identificació de la corrupció judicial que respecti els integrants del poder judicial i doni resposta a les demandes socials. L’estructura s’articula en tres parts. La Part 1 estableix la metodologia seguida en la investigació. En la Part 2 s’exploren els conceptes i institucions que funden el treball de tesi. Es realitza un estudi dels conceptes de Poder Judicial i d’Administració de Justícia, de la seva dimensió jurídica i política, i de la relació que mantenen amb els de govern judicial, d’administració i gestió judicial i de polítiques públiques judicials; per a després dissenyar una definició operacional de corrupció judicial, de transparència i de rendició de comptes adaptada al poder judicial. A la Part 3 primer s’analitzen els mecanismes de control existents. Com a element original d’aquest treball, es dissenya un mapa de risc en el poder judicial con a poder-organització i una matriu d’identificació de riscos de corrupció. The socio-political need to define the phenomenon of abuse of office for a particular benefit in the judiciary is the main motivation for this work. When constructing it, the irreconcilable perspective between the perception of society - the clear definition and observation - and the arduous determination for technical subjects and institutions is visualized. The search for preventive tools for the identification of behaviors associated with corruption and the administration of the negative effects for the judicial organization, is a priority to reduce corruption and its incidence. It is important to remark that it is put at risk the prestige, the credibility and the trust of justice and the democratic system. These aspects define the object and objectives of this study. The object of study of this work is the judiciary and the judicial corruption. To address it, firstly, it is proposed to carry out a theoretical and empirical evaluation regarding judicial corruption and the judiciary as an organization. Secondly, a risk map analysis matrix for the Spanish judiciary is developed, that identifies, manages and penalizes integrity risks (particularly judicial corruption) and allows the future design of judicial public policies to prevent such risks. The time span is the period 2010-2020, opening the period based on important legislative reforms, punctually indicated in the text of the work. The thesis work is based on answering to a series of research questions that have as axes the following aspects: observing the judiciary and the concepts of transparency and accountability, determining the possible areas of interference by corruption in the judiciary and, finally, proposing a mechanism that can be implemented to identify judicial corruption that respects the members of the judiciary and responds to social demands. The thesis manuscript structure is divided into three parts. Part 1 establishes the methodology followed in the investigation. In Part 2, the concepts and institutions underlying thesis work are explored. Here, a study is carried out of the concepts of Judicial Power and Administration of Justice, their legal and political dimension and the relationship between both with those of judicial government, judicial administration and management, and judicial public policies. Then, it is designed an operational definition of judicial corruption, as well as transparency and accountability adapted to the judiciary. In Part 3 the existing control mechanisms are analyzed. As one of the original elements of this work, a risk map is designed in the judiciary as an organizational branch and a matrix for the identification of corruption risks. Finally, and based on that matrix, proposals are made that are respectful of the judicial statute and that respond to social demands for accountability to strengthen their democratic legitimacy.

This study aims to analyze State liability arising from an infringement of the right to reasonable duration of court proceedings. Whereas the theme is recent in Brazilian law and given the lack of works about it, the searchs were subsidied in Spanish law, in French law, in Italian law and European Court of human rights. We discussed the right to "reasonable term" and also that kind of responsibility in the countries mentioned, and in their courts too. In all countries analysed the violation of this right results in State responsibility, with the consequent damages reparation. It was seen also the definition of justice deny. In our law, we have been studying the origins of speedy procedure . The tradition of the courts is to deny State liability due to judicial activity, with arguments like sovereignty, iudicata, independence of judges and fallibility, we refute them all, notably with the most recent courts decisions of the countries of the european continent. In conclusion, we figured out that we can blame the Brazilian State for damage caused by unreasonable duration of the process
O presente estudo tem por objetivo analisar a responsabilidade do Estado resultante da violação ao direito a razoável duração do processo judicial. Considerando que o tema é recente no direito brasileiro e dado a falta de obras especializadas, buscamos subsídios no direito espanhol, no direito francês, no direito italiano e na Corte europeia dos direitos do homem. Analisamos o direito ao prazo razoável e também a responsabilidade nos países citados e na, respectiva, Corte. Em todos os países analisados a violação a esse direito enseja na responsabilidade do Estado, com a consequente reparação dos danos. Verificamos também a definição de denegação de justiça. Em nosso direito, estudamos as origens da celeridade processual até os dias atuais. A tradição dos Tribunais é negar a responsabilidade do Estado decorrente da atividade jurisdicional, com argumentos na soberania, coisa julgada, independência dos juízes e falibilidade humana, rebatemos todos, notadamente com as decisões mais recentes das Cortes dos países do continente europeu. Desta forma, concluímos que é possível responsabilizar o Estado brasileiro pelos danos provocados pela irrazoável duração do processo

After the passage of Arizona's Senate Bill 1070 back in 2010 Arizona has been under scrutiny due to the controversial anti-immigration law. In 2012 the Supreme Court struck down most of the provisions of the "Support Our Law Enforcement and Safe Neighborhoods Act" or commonly known as S.B. 1070, however the Supreme Court upheld the most controversial provision, Section 2 (B). This paper discusses the judicial process S.B. 1070 underwent since it was passed in 2010 up to the 2012 Supreme Court decision and also discusses the constitutionality issue of the law. This helps us understand how courts look at cases and what we are likely to see in the future if this law is challenged or if more S.B. 1070 copycat laws are passed like in Alabama, Georgia, South Carolina and other states. Lastly, the influence the law had on other states as well as the economic toll the bill had in Arizona and other states who adopted similar legislations is also discussed. It is difficult to predict if S.B. 1070 will ever be overturned, but we do know that this controversial anti-immigration law, S.B. 1070, adds to the negative perception and economic deficit of the state.

My dissertation examines chief justice leadership of the United States Supreme Court during the judicial decision-making process. With the office steeped in secrecy, I borrow seminal concepts from the leadership literature such as autocratic, laissez-faire, and democratic leadership and adapt them to the office in order to systematically identify dominant patterns of leadership. While chief justices use different styles, the office is chiefly democratic in both structure and operation, which makes the chief justice a “first among equals” and requires him to be just as good of a political negotiator as he is a competent legal judge. This is a unique, but under appreciated, feature of the chief justice when compared to the associate justices.

Under the fundamentation of decreasing the existent barriers of access to justice, and to apply the constitutional principle of the reasonable process duration, reforms are being made to the Civil Process Code (Código de Processo Civil), being this instrument of great relevance for the operators of law and the common citizen, since it governs the processual relationships in the judiciary scope. Such reforms strengthened the control accomplished by STF and STJ enormously. In these alterations were inserted § 1st of art. 518 of the CPC, making it possible for the first degree judge not to receive the appeal resource when his decision is in agreement with the STJ and the STF compendiums. Such device can bring several juridical consequences and advantages to the judiciary that will save time and such precious financial and human resources in the judiciary system, as well as for the citizen that will have preserved the processual guaranties of the due legal process, action right and defense, who will have previsibility of the degree of his right before the uniformization, as well as participating in a process governed with basis in the principles of equality, juridical safety, reasonable duration of the process. Thus, this work confirmed the supposition that such juridical consequences brought by the application of the 1st§ of art. 518 of the CPC, known as an impeditive compendium resource, impeditive sentence resource, or still "impeditive effectiveness resource´, legitimate to the adoption of the device in the light of the constitutional principles. The research was of the descriptive type with qualitative inclination for the upraising of data obtained through interviews with judges, chief judges, Ministers of STJ and STF, which made known the development of the ´power to decide´ process, as well as verified the understanding of these magistrates on the consequences that the compendium that gives the bases to the sentence which effect is to impede the resource, on the imposition in the citizen's life, partly in the processual relation, before the principles constitutionally guaranteed.
Sob a fundamentação de diminuir as barreiras existentes de acesso à justiça, e aplicar o princípio constitucional da duração razoável do processo, estão sendo operadas reformas ao Código de Processo Civil, sendo este instrumento de grande relevância para os operadores do direito e o cidadão comum, vez que rege as relações processuais no âmbito do judiciário. Tais reformas fortaleceram sobremaneira o controle realizado pelo STF e STJ. No bojo dessas alterações foi inserido o § 1º do art. 518 do CPC, possibilitando ao juiz de primeiro grau não receber recurso de apelação quando sua decisão estiver de acordo com súmula do STJ e do STF. Tal dispositivo poderá trazer várias conseqüências jurídicas e vantagens ao judiciário que economizará tempo e recursos financeiros e humanos tão preciosos no sistema judiciário, bem como para o cidadão que terá preservado as garantias processuais do devido processo legal, direito de ação e defesa, terá previsibilidade do grau de seu direito em face da uniformização, bem como participará de um processo regido com base nos princípios da igualdade, segurança jurídica, duração razoável do processo. Assim, esse trabalho confirmou a suposição de que tais conseqüências jurídicas trazidas pela aplicação § 1º do art. 518 do CPC, conhecido como súmula impeditiva de recurso, sentença impeditiva de recurso, ou ainda eficácia impeditiva de recurso, legitima a adoção do dispositivo à luz dos princípios constitucionais. A pesquisa foi do tipo descritiva com viés qualitativo para o levantamento dos dados obtidos através de entrevista a juízes, desembargadores, Ministros do STJ e STF, que proporcionou conhecer o desenvolvimento de seu processo decisório, bem como verificar o entendimento desses magistrados sobre as conseqüências que a súmula que fundamenta a sentença cujo efeito impede recurso impõe na vida do cidadão, parte na relação processual, à luz dos princípios garantidos constitucionalmente

O Supremo Tribunal Federal (STF) é uma das instituições mais importantes do país, e tem recebido cada vez mais atenção da sociedade brasileira. Ano a ano, a corte é acionada para julgar dezenas de milhares de casos, muitos deles com impacto direto na vida econômica, política e social do país. Investigar quais são os fatores que influenciam o comportamento dos ministros do STF é fundamental para compreendermos o processo de tomada de decisões do Tribunal. Apesar de existirem estudos importantes sobre o resultado das ações de controle de constitucionalidade, ainda existe espaço para estudar o comportamento individual dos ministros. O objetivo do presente trabalho é analisar o comportamento individual dos ministros do STF, utilizando-se as votações dos ministros frente às ações de controle de constitucionalidade que foram decididas de forma colegiada. A proposta de trabalho é verificar como os ministros se agrupam e quais fatores influenciam sua divisão. Para isso, propomos a utilização do método de estimação de pontos ideias. Nossa hipótese primária de trabalho é que existe uma influência da indicação presidencial no comportamento dos ministros do Supremo Tribunal Federal. Dessa forma, haveria uma divisão da Corte entre os ministros nomeados por diferentes partidos. A hipótese secundária seria que as trajetórias profissionais dos ministros também influenciam em sua forma de decidir, sendo possível, portanto, identificar divisões entre os ministros a partir desta variável. Os resultados do presente trabalho indicam que variáveis associadas aos modelos atitudinais do comportamento judicial, partidos dos presidentes que indicaram os ministros, ideologia e filosofia judicial dos ministros, são variáveis mais relevantes para explicar as agrupamentos e dissensos no STF do que as que dizem respeito as trajetórias profissionais dos juízes.
The Supremo Tribunal Federal - STF (Federal Supreme Court) is one of the most relevant institutions in Brazil, and it has increasingly gained attention from Brazilian society. Year after year, the Court is demanded to rule thousands of cases, a lot of them with direct impact in the countrys economic political and social life. To investigate which factors influence the Justices behavior is paramount to understand the decision-making process of the Court. The goal of this work is to analyze the Justices individual behavior, by looking at the Justices individual vote in Constitutional Review cases that were decided in collegiate manner. This dissertation verifies how the Justices cluster themselves and which factors influence their division. For that, we employ the ideal point estimation method. Our primary hypothesis states that the presidential nomination exerts influence in the Justices behavior. In this way, it would be possible to identify a division in the Court among Justices nominated by different parties. Our secondary hypothesis states that the Justices professional background also exerts influence in how they decide, therefore making possible to identify divisions among Justices by taking this variable as a dividing line. The results of the present work indicate that the variables associated with the attitudinal models of judicial behavior, presidential party responsible for Justice nomination, ideology and Justices judicial philosophy are more relevant variables to explain the clusters and dissensus in STF than variables linked to magistrates professional background.

This thesis sets out to understand why legal theory has failed to do so and what role rhetoric plays in the judicial decision. Three legal theorists, Chaim Perelman, Bernard Jackson and Neil MacCormick are used to show that it is seeking to be philosophically acceptable that has led legal theorists to avoid the emotional and character-based aspects of the judicial decision. Two historical studies, of the Talmud and Aristotle's Ars Rhetorica, demonstrate that rhetoric can be seen as closely related to the limits of authority in the system and the character and identity of the decision-maker. These insights are then applied to the common law, exemplified by six cases from the law of negligence. This highlights the importance of the commitment of judges to their own sense of role and the way limitations on reasoning help to create this sense. The thesis concludes by considering the relationship between philosophy and judgement and argues that they can be seen as different forms of understanding and that there are strong ethical reasons for rejecting attempts to see either as a paradigm for all understanding.
