Abstract:
The scientific and practical guide is devoted to the formation of a comprehensive and systematic approach to improving the activities of the court and preliminary investigation bodies in cases of crimes committed in the field of business and other economic activities (including taking into account the experience of law enforcement practice in criminal prosecution of entrepreneurs in a number of foreign countries). The problem of establishing a balance between the duties of judicial and investigative bodies within their competence to take measures to ensure economic security and to respect the rights and legitimate interests of entrepreneurs involved in criminal proceedings is considered. The author defines the main directions and forms of modern criminal policy in this area; gives a General description of the criminal legal situation in terms of ensuring economic security; identifies additional guarantees of the rights and legitimate interests of entrepreneurs provided in the implementation of law enforcement activities. Particular importance is attached to the study of substantive and criminal procedural mechanisms used in criminal proceedings on economic crimes. For researchers, practicing lawyers, representatives of the business community, teachers, postgraduates, students of law schools and faculties, as well as for a wide range of readers interested in this issue.

Abstract:
This chapter focuses on the independence of the Indian judiciary and how judicial independence has been interpreted and secured in the country’s constitutional law. In particular, it considers the balance between judicial independence and judicial accountability, along with various concerns and goals that have shaped constitutional doctrine in this area. The chapter begins with and primarily focuses upon a study of the appointment of judges to the higher judiciary and its relevance to the debate over judicial independence in India. It then describes the conditions of service of officers and servants of the Indian Supreme Court and the High Courts as spelled out in the Indian Constitution. It also discusses the approach towards disciplinary action against judges, including their impeachment, and concludes by looking at issues that are integral to the question of judicial independence, especially those relating to salaries, tenure, transfers, and removal.

Abstract:
This chapter examines what appears to be an ambivalence in English law towards non-state forms of law and dispute resolution. It begins by focusing on the fact that an English court will not recognize the validity of a choice of non-state law in a contract, but will nevertheless recognize and enforce an arbitral award based on the application of non-state law, identically chosen by the parties. It then deals with the English courts’ attitude to the recognition and enforcement of a foreign arbitral award which has been set aside by the courts of the seat of the arbitration, under which the arbitral award is neither voided, nor necessarily still enforceable. In both of the contexts examined in this chapter-the question of the validity of a choice of non-state law, and the question of the enforceability of an arbitral award set aside by the courts of the arbitral seat-the underlying issue is the extent to which English law and courts are receptive to non-state norms and normative processes, and the extent to which they remain in a paradigm under which states are the exclusive sovereign actors. In both contexts, the English legal system strikes a balance.
