Whish, Richard, and David Bailey. Competition Law. 10th ed. Oxford University Press, 2021. http://dx.doi.org/10.1093/he/9780198836322.001.0001.

Full text
Abstract:
Competition Law explains competition law and policy in the EU and UK. The intention is to provide the reader with an understanding of competition law and policy, to introduce the reader to key economic concepts, legal principles and tools in competition law, and to provide insights into the numerous different issues that arise when applying competition law to market behaviour. Describing the economic rationale for the law, the chapters consider the application of EU and UK competition law to various business practices, including cartels, cooperation agreements, distribution agreements, licences of intellectual property rights, joint ventures, and mergers. The text has been updated to include the changes to UK law as a consequence of Brexit. It discusses for the first time the rise of powerful digital platforms and the quest for a suitable competition law and regulatory response to this phenomenon. It also considers the implications of the European Green Deal and the sustainability agenda for EU competition law and practice. The text incorporates extensive new legislation, case-law, decisional practice, guidelines and periodical literature at EU and UK level.

Abstract:
The book explains the purpose of competition policy, introduces the reader to key concepts and techniques in competition law and provides insights into the numerous different issues that arise when analysing market behaviour. Describing the law in its economics and market context, the chapters particularly consider the competition law implications of business phenomena, including distribution agreements, licences of intellectual property rights, cartels, joint ventures and mergers. The book assimilates a wide variety of resources, including judgments, decisions, guidelines and periodical literature. The text has been updated to include the changes to UK law introduced by the Consumer Rights Act 2015, including the reform of collective actions. It also considers the Directive on Antitrust Damages Actions and other measures designed to facilitate private enforcement of competition law. The book also discusses for the first time the application of competition law to price signalling, algorithmic collusion and other atypical cartel activities; it also incorporates extensive new case law and decisional practice at EU and UK level.

Abstract:
This chapter considers the interdependence among the quality levels of government institutions. Citizens of democratic societies are consumers of institutional output and the quality they demand from individual institutions is posited to be a function of the joint quality of all institutional output. Specifically, the quality of institutions is hypothesized to enter into consumers’ preferences in a supermodular fashion. An implication of this is that citizens will tend to desire institutions of the same quality; thus resource constrained democratic governments will tend to match the quality level of their complementary institutions. The Nash equilibrium concept is employed to show that multiple equilibria will result, and that a stable equilibrium exists at a low level of quality.

Abstract:
This chapter examines divergences and commonalities between Spain’s and Portugal’s defence policies. Both countries share the Iberian Peninsula but they do not constitute a single strategic entity. Their national defence policies show different patterns according to their own history and strategic culture, with no military joint venture so far. Both countries maintain strong defence relationships with the United States and are strengthening their bilateral cooperation at the political and military levels to cope with the new threats and risks emerging on the southern flank of NATO and the EU. Militarily, they are not comparable, because Spain has more expeditionary, industrial, and budgetary capabilities than Portugal. Both countries have developed national security strategies since 2001 to adjust their military capabilities and force structures to the new strategic environment despite their unfavourable economic situation.

Abstract:
The role of emerging markets is changing in the twenty-first century, from the traditional provider of low-cost, labor-intensive goods to a global growth engine. These emerging economies are growing at double the rate of advanced economies because of technology and global connectivity. Traditionally they have been big exporters of commodities and raw materials to the rest of the world. The export of commodities has contributed significantly to the development of industrial and physical infrastructure in many countries around the world. However, emerging markets are also lucrative markets and an important source of growth for many international companies as they export their products or increase their presence in these markets by opening subsidiaries or through joint venture mechanisms. Today these markets are coming into their own, moving from sole source exporters feeding the world’s growth to becoming increasingly significant normative economic members of the global family.

Abstract:
Reflection about the role of community engagement and corporate social investment in Brazil, associated with the presence of a large economic enterprise, is the major stimulus of this chapter. It seeks to present how cross-sector governance can contribute to the social development of a city and how this process can be led by a partnership comprising a corporate foundation, government, and civil society. The concept of the public–private social partnership (PPSP) is explored: a strategy for building a series of inter-sectoral alliances aimed at promoting the sustainable development of territories where the company has large-scale enterprises, through joint efforts towards integrated long-term strategic planning, around a common agenda. To this end, the case of Canaã dos Carajás is introduced, a municipality in the State of Pará, in the Amazon region, where large-scale mining investment is being carried out by the mining company Vale SA.
