Die Materialitätsgeschichte der Aufklärung anhand der Sammelpraxis von Vater und Sohn Forster. Weltumsegler, im Feld forschende Naturhistoriker und Ethnologen, Gelehrte - Johann Reinhold (1729-1798) und sein Sohn Georg Forster (1754-1794) trugen grundlegend zur Erschließung außereuropäischer Welten bei. Durch Sammeln, Ordnen, Zeigen, Zeichnen, Transportieren und Präparieren sowie durch Schreiben und Übersetzen haben sie einen erheblichen Anteil an dem Prozess genommen, der die zusammen mit James Cook erkundeten Räume in Wissensgegenstände verwandelte. Insofern waren die Forsters Produzenten: Das arkadische O-Tahiti und die Freundschaftlichen Inseln oder die düsteren Gestade - der Charlotten-Sund und die verschneite Ödnis Feuerlands - sind zum einen tatsächlich in Augenschein genommene Orte, zum anderen sind es Gegenstände und Ergebnisse von Gestaltungsprojekten. Der vorliegende Band erschließt das Geflecht der Arbeitsfelder von Johann Reinhold und Georg Forster. In den Blick genommen werden die Materialitätsgeschichte der Aufklärung im Bereich der Sammlungs- und Objektpraxis sowie die sammlungsrelevanten Infrastrukturen und Institutionen des aufgeklärten Wissens.

Starting point of the book is the ongoing reform process on ISDS at UNCITRAL working group III and the proposal to implement an MIC. An introduction sets the stage and provides readers with the latest developments and historical background. On this basis, the following chapters highlight different aspects of creating and implementing an MIC. The chapters cover key elements of the MIC proposal such as the court’s institutional framework, the design of an appeal mechanism, the use of procedures for the settlement of mass claims, and the establishment of an advisory centre for developing countries. In addition, the selection and appointment of judges is discussed. Apart from the court’s structure and procedures, questions of implementation arise. How to integrate the MIC into the current system of ISDS? How can the enforcement of its decisions be ensured? On a political level, the MIC project is based on an initiative of the EU. Therefore, the role of the EU in the reform process is analysed in a separate chapter. Remarks from a practitioner’s perspective round up the contributions. Each chapter highlights the legal issues subject to discussion and puts them into a broader context. The aim is to provide readers an understanding of how the different aspects work individually or in combination. The evaluation of reform ideas is based on their potential to efficiently respond to the most prominent criticisms of the current ISDS system. Sandel, der an der Harvard University politische Philosophie lehrt, ruft in dem hier erstmals in deutscher Übersetzung vorgelegten grundlegenden Text „Marktdenken als Moraldenken: Warum Ökonomen sich wieder stärker auf Politische Philosophie einlassen sollten“ die Wissenschaftsdisziplin der Ökonomik dazu auf, sich wieder verstärkt auf ihre historischen und ethischen Wurzeln zu besinnen. Das ökonomische Selbstverständnis als wertfreie Wissenschaft hält er für ein Selbst-Missverständnis. Seiner Auffassung nach kann die Ökonomik ihrer gesellschaftlichen Aufgabe nur dann nachkommen, wenn sie sich (wieder) mit den moralischen Grenzen des Marktes beschäftigt. Bloße Effizienzüberlegungen reichen hierfür nicht aus. Vielmehr hält Sandel es für erforderlich, Fairness-Fragen gleicher oder ungleicher Behandlung auf Märkten deutlich mehr Aufmerksamkeit zu schenken. Vor allem aber kommt es ihm darauf an, die Möglichkeit ins Zentrum der Betrachtung zu rücken, dass Märkte sich negativ auf moralische Normen und Werte auswirken können, mit der bedenklichen Folge, dass eine an sich wünschenswerte Praxis korrumpiert wird. Deshalb warnt Sandel vor einem immer weiteren Ausgreifen des Marktes auf andere gesellschaftliche Bereiche, und er wirft der Mainstream-Ökonomik vor, einem solchen Ausgreifen unkritisch und sogar unreflektiert das Wort zu reden. Dieser Band leitet dazu an, sich mit den Thesen von Sandel intensiv und kritisch auseinanderzusetzen. Auf seinen im Original und in Übersetzung abgedruckten Aufsatz folgen u.a. dreizehn Kurzkommentare (von Klaus Beckmann, Markus Beckmann, Gerhard Engel, Johannes Fioole, Andrea Maurer, Ingo Pies, Birger P. Priddat, Christian Rennert, Michael Schramm, Robert Skok, Richard Sturn und Reinhard Zintl), die Sandels Thesen von verschiedenen Blickwinkeln aus beleuchten.
