Abstract:
The article is aimed at analyzing the system of integrated environmental permit regulation. It includes a study of Directive 2010/75/EU analyzing the specific features, requirements, grounds of and the procedure for issuance of integrated permits. Since the Directive is a framework document, each state makes its own decisions as to what mechanisms to use. The article studies the statutory regulation and the practice of the implementation of integrated permits in the neighbouring Poland. It interprets the principal legal environmental document of the Republic of Poland – the Environmental Protection Act. Its main focus is on defining the conditions for the application of the BAT principle and the procedure for permit issuance: the competent authorities, time limits, control, etc. Ukrainian legislation on permits for emissions of pollutants into ambient air, discharges into waters, and waste management is subject to independent analysis. On the basis of the study, the generalized characteristic features of the integrated permit system in the sphere of environmental protection and environmental safety enforcement, the principal tasks and measures aimed at ensuring the implementation of the system of integrated environmental permits in Ukraine are defined.

The effort reported here focuses both on improving the efficiency of the special hauling permitting processes of the New York State Department of Transportation (NYSDOT) and on improving the level of service offered to NYSDOT’s customers—truckers, construction companies, and others applying for permits. The electronic system is designed to replace a largely manual system of data checking, route verification, and permit issuance. By linking personal computers at transmission companies (third parties that prepare and submit permit applications for truckers) directly to computers at NYSDOT, and equipping these computers with automated route verification capability using a geographical information system, improved service can be offered at reduced cost to the state.

Increased issuance of housing permits is said to move house prices in either direction. If perceived as an indication of a growing housing supply, house prices are expected to decline (supply hypothesis). However, a larger number of housing permits can also reflect positive expectations about future housing demand which would drive house prices upwards (demand hypothesis). We test these two competing hypotheses by using data from each state in the United States. We estimate linear and non-linear models to test if housing permit issuance determines house prices. The results show support for both the supply and demand hypotheses in the short run for most states but only for the demand hypothesis in the long run. We also uncover asymmetric short run and long-run effects in 21 states

The purpose of this study was to find a model for optimizing rock mining licensing in the Subang Regency area after the enactment of the law of the Republic of Indonesia number 23 of 2014. The method used in this study was a qualitative method by interviewing relevant parties and searching literature. The results showed that the implementation of the policy on the issuance of rock mining permits in the Subang regency region after the enactment of the Law of the Republic of Indonesia Number 23 of 2014 was not running optimally, it was influenced by several factors such as the presence of actors consisting of Bureaucracy, Entrepreneurs and Communities having different interests but mutually related to one another in the process of issuing a rock mining permit after the authority to manage the rock mine was carried out by the province of West Java. The optimization model for the issuance of rock mining permits in the Subang Regency of West Java Province can be applied by focusing on the aspects of good and dynamic processes with the principles of governance of the environmental environment on the elements of actors, interests & relations.

Starting in 2017, the Ministry of Ecology and Environment began to implement a pollution permit system nationwide, in which environmental protection authorities issue permits to enterprises and institutions and supervise them in accordance with the permits. The accounting results of pollutant emissions are an important basis for the issuance of emission permits. At present, the air pollutant accounting methods for emissions from fixed emission facilities are mature and reliable, while there is no mature calculation method for coal dust emission in open storage yard. In this paper, based on the data of area, volume and coal nature of open storage yard in the coal port area of Huanghua Port, the author calculated the strong dust source under different wind speed by using the calculation formula of bulk dust amount in large ports, so as to provide technical support for the forecast study of atmospheric environmental impact in the coal port area of Huanghua Port and the calculation of total atmospheric particulate emission by the environmental management department.

In California, the longstanding insufficiency of special educators has compounded since the 2013-2014 academic year. Districts and state legislators have relied on the issuance of substandard permits (i.e., Provisional Intern Permits, Short-Term Staff Permits, and Intern Credentials) to counteract the shortage. However, the effectiveness of this approach has limited evaluation. This study evaluated differences between pre-service and in-service special educators’ self-efficacy ratings. Special educators serving in California’s Central Valley on substandard permits or valid teaching credentials (i.e., Preliminary and Clear Credentials) completed the Teachers’ Sense of Efficacy Scale. Differences were assessed across several variables using independent t-tests and one-way ANOVAs. Significant differences emerged in special educators’ self-reported levels of self-efficacy as a function of credential status, favoring those with valid credentials. The findings indicate a correlation between special educators’ credential status (a proxy for training) and self-reported self-efficacy. The results of this study add to the research on special educators’ self-efficacy by exploring the phenomenon among a newly emerged group of California-based special educators: substandard permit holders. keywords: self-efficacy, special education, substandard authorization, pathways to teaching

This Note investigates the wisdom and validity of 40 CER. § 124.55(b), a Clean Water Act regulation promulgated by the U.S. Environmental Protection Agency (EPA) as part of the National Pollution Discharge Elimination System (NPDES) permitting program. The Clean Water Act provides affected states with an opportunity to certify federally administered NDES permits before issuance by EPA. State certification is a meaningful moment in water quality regulation, and judicial review of these critical decisions takes place in state courts. Unfortunately, 40 C.ER. § 124.55(b), designed to bring certainty and finality to permit-holders, effectively removes state courts from the process of ensuring that state certifications are legally sufficient after permit issuance. In doing so, the regulation dismantles an essential tool of the Clean Water Act. It also renders 40 CER. § 124.55(b) invalid. Thus, 40 C.ER. § 124.55(b) should be repealed by EPA or invalidated by the courts, so that environmental organizations can effectively challenge illegal state certifications. While significant legal obstacles-standing, jurisdiction, and statutes of limitations, to name a few-stand in the way of a challenge to the validity to 40 CER. § 124.55(b), there is a good chance that such a challenge could ultimately find success.

Показано, що прийняття запропонованих змін до вказаних документів сприятиме зростанню ризиків при експлуатації зношеного виробничого обладнання, рівня виробничого травматизму та аварій виробничого характеру під час експлуатації устаткування підвищеної небезпеки, що відпрацювало граничний строк експлуатації.
The analysis of the changes proposed by the Ministry of Social Policy in the regulatory legal acts regulating the activities in the field of labor protection and industrial safety was carried out. It is shown that acceptance of proposed changes to the indicated documents will increase the risk of exploitation of worn-out industrial equipment, the level of occupational injuries and industrial accidents during the operation of high-risk equipment, which has expired the limitation period of exploitation.

Abstract:
Chapter 3 addresses how civic engagement affects the physical rebuilding of a broken city. Based on the data set of more than five thousand post-disaster building permit applications submitted during the early period of recovery, this chapter examines the ways in which civic capacity influenced the process of property reconstruction after Katrina. I find that high levels of local political participation led to a greater number of building permit approvals as well as faster issuance of permits. While affirming the positive aspect of civic capacity on service distribution, the findings also reflect the dilemma of reconstruction because the physical rebuilding occurred in a haphazard pattern without a reference to the long-term, coherent planning. The strength of civic power revealed the lack of local government capacity to enforce strict building regulations, leaving the city no less vulnerable to natural hazards than it had been before Katrina.

The first Combined Construction and Operating License (“COL”) applications for new reactors have been submitted to the United States Nuclear Regulatory Commission (“NRC”), and more are expected soon. Preparation of these applications began several years ago based on new regulations in 10 C.F.R. Part 52 (“Part 52”) that are intended to ensure a predictable regulatory environment for new reactor licensing. Indeed, many analysts have opined that the financial viability of new nuclear construction depends largely on reducing economic and regulatory risk associated with the licensing process. In Part 52, the NRC created a new, three-part licensing framework for issuance of Design Certifications (“DC”), Early Site Permits (“ESP”), and Combined Construction and Operating Licenses (“COL”). Applicants are provided the flexibility to build pre-approved designs (DC), on pre-approved sites (ESP), without the need to re-visit issues already decided in earlier proceedings, thereby streamlining issuance of COLs. Thus, Part 52 holds the promise of a more efficient and predictable regulatory licensing process. The promised efficiencies of Part 52, however, are being tested as the NRC begins to review more DC, ESP, and COL applications. Putting new regulatory concepts into practice is always a challenge, and Part 52 is no exception. Thus, it is important to understand the evolving NRC expectations that are beginning to be revealed — expectations that must be understood to successfully license new reactors in the United States. This paper explores the developing implementation of Part 52, discusses how that development is being shaped by current regulatory and engineering realities, and considers the practical impact that these developments will have on engineers designing and constructing new nuclear units in the United States.

Created in 1978, the Solid Waste Authority of Palm Beach County (Authority) has developed an “award winning” solid waste management system that includes the following facilities to service the residents and businesses in Palm Beach County, Florida: • North County Resource Recovery Facility (NCRRF); • Residential and Commercial Recovered Materials Processing Facility; • Six Transfer Stations; • Class I Landfill; • Class III Landfill; • Biosolids Processing Facility; • Ferrous Processing Facility; • Woody Waste Recycling Facility; • Composting Facility; and • Two Household Hazardous Waste Facilities. The Authority has proactively planned and implemented an integrated program to provide for the long term, reliable, economically sound and environmentally sustainable management of solid waste in Palm Beach County. The County’s anticipated growth necessitated that the Authority evaluate several options for long-term processing and disposal capacity. This resulted in a decision to expand its WTE capacity with a new mass burn facility, the first facility of its kind to be constructed in the US in almost two decades, reaffirming its commitment to waste-to-energy. The planned 3,000 TPD facility will provide the Authority with a total disposal capacity of 5,000 TPD generating approximately 150MW of renewable energy. The decision to proceed with the expansion was approved by the Authority’s Board in October 2008. The Authority, with its Consulting Engineer, Malcolm Pirnie/ARCADIS, has since made significant progress in the implementation of this landmark project including the completion of the preliminary design, securing environmental permits, procuring a full service vendor, issuance of nearly $600 million revenue bonds for signing an electrical sales contract, and ongoing extensive public outreach efforts. This presentation will focus on the ongoing development of the new mass burn facility and an update of the status of activities conducted to date such as: • Environmental Permitting – Issuance of the PPSA Conditions of Certification and submittal of the Post Certification/Pre Construction requirements; • Vendor Procurement – Iterative procurement process designed to obtain vendor input through final selection and contract award of a full service vendor (Design, Build and Operate); • Preliminary Design – Innovative design features such as the utilization of SCR technology for control of NOx emission and incorporation of rainwater harvesting and water reuse; • Public Outreach – the Authority’s efforts to keep the public informed through mass mailings, community meetings, television commercials and educational materials for all audiences; and • Financing – Approach designed to preserve alternative minimum tax benefits.

Abstract:
We live in times when our planet is overloaded with issues coming from human activities where additional mechanisms to preserve the quality of life are essential. Modern societies experience constant internal dynamics. The uncontrolled urban growth leading to dense and unmanageable environment is a main urban issue cities face today. This is a prevailing problem in the developing countries where the construction industry is booming. Overall, while there is a rush to development there are also some conflicting interests and policies that are leading to unsustainable urban growth. To regulate a property development a local government can try to impose a moratorium on the issuance of building permits and this can be agreed upon all the interest parties or it may be imposed by operation of law (Lehman and Phelps, 2005). Oftentimes local authorities will impose a building moratorium to tackle development in order to have time to make a satisfactory urban plan or to make some changes and update the regulations. The land use control objective is to promote good planning values supported by the whole community. This is done by regulating the urban growth and it is best implemented on a carefully contemplated comprehensive plan. During a time a new plan is being drafted and growth balance is achieved some construction demand may arise based on an existing outdated, inadequate urban plan. If this demands are met “the ultimate worth of the eventual plan could be undermined” and this where the moratorium comes in place (Coon, 2010). The resources of academic literature on the case are somewhat in short supply and mainly based on describing specific case scenarios without a critical thought on the tool itself. Based on the resources the paper will look at a few different cases in developed countries using the growth management systems and one southeast european case - the city of Skopje, Macedonia that adopted the building moratorium system in January 2018. The author of this paper was personally involved in the decision making process in that time and will try to elaborate on how the tool was being used. The validity should be determined by weighing its impact on the affected parties and more comprehensive research in the economic repercussions of the mechanism is needed. A building moratorium is oftentimes a political decision and it's downside is that political parties would use it merely for their own purposes.

Created in 1978, the Solid Waste Authority of Palm Beach County (Authority) has developed an “award winning” solid waste management system that includes franchised solid waste collections and the following facilities to service the residents and businesses in Palm Beach County, Florida: • North County Resource Recovery Facility (NCRRF); • Residential and Commercial Recovered Materials Processing Facility; • Five Transfer Stations; • Class I Landfill; • Class III Landfill; • Biosolids Pelletization Facility; • Ferrous Processing Facility; • Woody Waste Recycling Facility; • Composting Facility; and • Household Hazardous Waste Facility. The Authority has proactively planned and implemented its current integrated solid waste management program to ensure disposal capacity through 2021. However, even in consideration of the current economic climate, the Authority anticipates continued population growth and associated new development patterns that will significantly increase demands on its solid waste system, requiring it to reevaluate and update its planning to accommodate future growth. The NCRRF, the Authority’s refuse derived fuel waste-to-energy facility, has performed very well since its start up in 1989 processing over 13 million tons of MSW, saving valuable landfill space and efficiently producing clean renewable energy. As the NCRRF has reached the end of its first 20 year operating term, it became necessary to complete a comprehensive refurbishment to ensure its continued reliable service for a second 20 year term and beyond providing for continued disposal capacity and energy production for the Authority’s customers. Separately, the Authority also recognized that the refurbishment alone will not provide any additional disposal capacity for the County. The County’s anticipated growth necessitated that the Authority evaluate several options for long-term processing and disposal capacity, resulting in a decision to expand its WTE capacity with a new mass burn facility, the first facility of its kind to be constructed in Florida in more than a decade, reaffirming its commitment to waste-to-energy. The planned 3,000 TPD expansion will provide a total disposal capacity of 5,000 TPD generating approximately 150MW of renewable energy. The decision to proceed with the expansion was approved by the Authority’s Board in October 2008. The Authority, with its Consulting Engineer, Malcolm Pirnie, Inc., has since made significant progress in the facility’s implementation including the completion of the preliminary design, submittal of environmental permit applications, ongoing procurement of a full service vendor, issuance of revenue bonds for project financing, and commencing extensive public outreach. This paper will focus on the development of the new mass burn facility and an update of the status of activities conducted to date including, permitting, financing, vendor procurement, design, and public outreach, as well as will highlight several innovative design, procurement, permitting, and financing features of this landmark project for the Authority, such as: • Utilization of SCR technology for control of NOx emission; • Incorporation of rainwater harvesting and water reuse; • Utilization of iterative procurement process designed to obtain vendor input in a competitive environment; and • Financing approach designed to preserve alternative minimum tax benefits.
