Abstract:
In the course of the negotiations between the European Union and the United States about the “Transatlantic Trade and Investment Partnership” (TTIP) the aspects of investment protection and investment arbitration have attracted much press attention. They have become key targets of criticism and massive attacks. Investment arbitration has been depicted as some obscure and undemocratic mechanism that helps rich companies to exploit poor countries. The discussion has become so agitated that oftentimes the underlying facts got out of sight. The goal of the present article therefore is to shed some light on these facts and thereby trace the heated discussion back to an objective, sober-minded level. The authors explain in a step-by-step approach how investment protection in bilateral/multilateral investment treaties works and what standard principles of protection these treaties typically grant to foreign investors (e.g. no direct/indirect expropriation without compensation; no discrimination against foreign investors; the duty to accord fair and equitable treatment to foreign investors). These legal basics are then filled with life by the illustration of four publicly known investment arbitration case studies: Adem Dogan v. Turkmenistan, Philip Morris v. Australia, Vattenfall v. Germany and Walter Bau v. Thailand. The authors conclude that much of the current criticism is unfounded as it ignores factual realities and new developments in international investment arbitration.

Abstract:
In the 21st century, sustainability and indicators of world-class universities have come within the scope of an academic cottage industry. The complex problem of university sustainability implies a big challenge for countries and educators to implement important strategies in an integrated and comprehensive way. This paper highlights and analyzes the sustainability indicators of universities included as newly formed world-class universities (NFWCUs) in the top 100 from 2010 and 2018. The integration of three global ranking scales—the Academic Ranking of World Universities (ARWU), the Quacquarelli–Symonds World University Ranking (QS) and the Times Higher Education World University Rankings (THEs)—allows us to minimize the impact of the methodology used. This study integrates regression analysis by using statistical grouping, case studies and normative analysis. Our principal findings are as follows: among the commonly ranked top 100 universities in 2018, the ARWU, QS and THE counted 57, compared with 47 in 2010. Thus, comparing 2010 and 2018 shows that 44 of the universities appeared simultaneously in ARWU, QS and THE rankings and maintained a sustainable position in any ranking system in the family of top 100 groups. Three lower-ranked NFWCUs in the hybrid list for 2010 lost their ranking and did not appear in the group of top 100 universities in 2018, which are covered by some catch-up and young universities. The NFWCUs were from US, Australia, China, Singapore, Germany and Belgium. By systematic comparison, the US and UK continued to dominate the stability of NFWCUs in 2010 and 2018. The key sustainability indicators include a high concentration of talent, abundant resources to offer a rich learning environment and conduct advanced research. Generally, the factors were negatively associated with ranking suggesting that a higher score result in top ranking and vice versa. Teaching, research, citation and international outlook were negatively correlated with THE ranking in 2018. Similarly, Alumni and PUB were negatively associated with ARWU ranking in 2018. All factors except international student ratio were significantly correlated in QS ranking either in 2010 or 2018, where negative association was observed. The significant contribution of our study is to highlight that for the sustainability of universities, it is necessary to have an increasing emphasis on the effectiveness and efficiency of government-supported research, stability of investments and more approaches to employ international initiatives. The results also confirm the appropriate governance, developing global students and place emphasis on science and technology as additional factors in the approaches of pathways to NFWCUs, with delivery of outstanding educational programs and comprehensive internationalization as a key indicator for performance improvement and global university ranking systems.

The main purpose of this paper is to investigate and analyse foreign direct investment (FDI) regimes and their screening processes, institutional frameworks, and business environments in world trade. China's FDI regime is specifically compared with that of the United States, Australia, Canada, and the United Kingdom. Other countries (France, Germany, Japan, Hong Kong, and Switzerland) were also included in the discussion to evaluate their regulatory and investment issues. By using interdisciplinary literature, secondary data, and research surveys and reports from multilateral institutions, the study investigates the changing profile of FDI regimes in world trade. The paper reveals that China's FDI regime has embraced significant changes to attract foreign investment. Currently, the Chinese market is open yet restricted in its own regulatory environment and institutional hurdles. Investment regimes in the United States, Australia, Canada, and the United Kingdom continue to change to attract foreign investment that is critical to their economies. We believe that more country- and industry-specific studies are needed to investigate FDI regimes and their institutional frameworks. In today's world trade, China is particularly an interesting case study since the country aggressively attracts foreign investment while keeping its hybrid economy. Policymakers, multinational corporations (MNCs), governments, and researchers need to pay attention to today's changing FDI regimes because of growth opportunities and MNC expansion. The study provides useful discussion and meaningful implications that can be used by policy analysts and practitioners worldwide.

During the last decade, a range of indicators has been advocated for assessing soil, farm and catchment health. This paper assembles some recent experiences of the authors in developing and using indicators from paddock to national scales. Indicators are merely a subset of the attributes that are used to quantify aspects of catchment or farm health. Their selection and use in the past has led to criticism of indicators, but, given an explicit approach, most of the criticisms can be overcome. Reliable indicators provide positive and negative signals about the current status of natural resources and how these properties have changed over time. They are used both to identify potential risks and to confirm that current farming practices and systems of land use are effective in maintaining the resource base or economic status. They should be precursors for change and future on-ground investments when problems are observed or identified.A structured approach is needed to ensure indicators are selected and used efficiently. This approach involves: deciding local issues and selecting the most appropriate indicators to reflect those issues; interpreting both positive and negative signals from the monitoring process; taking appropriate action to resolve problems; and, using indicators to monitor the outcomes from the action taken.Finally, we have drawn on these and other experiences to compile a list of indicators that may be used to address sustainability issues associated with farm productivity, soil health and catchment health identified in recent strategic plans developed for the northern grains region of Australia, the focus of this special journal issue.

Australia is transitioning to become an energy superpower—the $43 billion Gorgon LNG project and the other comparably sized projects lining up behind the Gorgon project confirm this. There are predictions that around $80 billion of CAPEX on LNG projects will be approved for expenditure for the 2010 financial year with much more to be invested in the following years. And, we are on the cusp of further coal seam gas developments in Queensland, which could see annual production rise from 130 to more than 3,000 petajoules per annum once the infrastructure is in place. What are the skills needed to realise the true potential of these investments? An appropriate asset management plan is key. Asset management is more than the provision of maintenance services—it is about developing a systematic approach to managing an asset during its life and achieving the outputs required by the owner of the asset. Program and project management of brownfield capital works, maintenance services and infrastructure projects are also essential technical capabilities to help meet the demand of the burgeoning LNG and coal seam gas industries. These skills will determine who can deliver on schedule, or ahead of it. The other key capability will be mobilising, managing and retaining people. There is speculation that the Queensland coal seam gas industry alone will generate approximately 12,000 jobs. The industry needs to be prepared to be innovative in engaging, training and upskilling people. As the only true global resources and industrial provider in Australia, Transfield Services will share its key learnings on effectively managing assets, projects and people from its work with clients including Canada’s largest energy company, Suncor Energy.

In the field of business taxation, the German and Austrian concepts of co-entrepreneurship (Mitunternehmerschaft) take special positions. Following these concepts, partnership profits are attributed to partner shares and, accordingly, the partners are taxed independently under the transparency or pass-through principle (Transparenzprinzip) based on their respective shares and the special payments they receive from the partnership. Special payments (Sondervergütungen), for instance, interest on a loan granted to the partnership by a partner, are treated as income from commercial business according to domestic law. Therefore, section 50d, paragraph 10, of the Income Tax Act (Einkommensteuergesetz [EStG]) determines that the special payments are treated as a business profit for treaty purposes. As a result, Germany waives the right to tax the partner as a German permanent establishment (PE). In transnational arrangements, the unique German system often results in conflicts of qualification. On this account, our paper points out the consequences resulting from the treatment of special payments. Based on case studies with inbound and outbound investments, we outline the current status of the German treatment of special payments in transnational dealings and summarize future prospects.

The previous Abbott government had prioritized a general attitude to foreign policy captured by the phrase “Jakarta not Geneva,” which signified a preference for bilateral or minilateral interactions with the region rather than United Nations-based multilateralism. With Julie Bishop MP as Australia’s first female foreign minister, the Coalition also prioritized economic diplomacy, as exemplified by the repeated refrain that Australia is “open for business.” This approach led to a preference for diplomatic venues and processes that focused on continuing investments in regional architecture, new emphasis on minilateral dialogues such as the Indian Ocean Rim Association (IORA) and Mexico, Indonesia, Korea, Turkey, and Australia (MIKTA), and more effort directed to bilateral and plurilateral processes such as the Trans-Pacific Partnership trade negotiations. This approach has been continued under Prime Minister Turnbull, with a renewed focus on innovation. Part 1 considers minilateral and regional investments in the Indo-Pacific region, primarily, IORA, the Asia-Pacific Economic Cooperation (APEC), and the Association of South East Asian Nations (ASEAN). I consider MIKTA a unique vehicle for Australian diplomacy. Part 2 considers what issues Australia should be pursuing through these forums, with a focus on the two themes of gender equality (as an example of niche diplomacy) and trade (multilateralism under pressure) as case studies. Beeson and Higgott argue that middle powers have the potential to successfully implement “games of skill,” especially at moments of international transition. How skilful have Australia’s efforts been in these minilateral dialogues, enhanced regionalism, and plurilateral processes, and what more can be achieved in these forums? Are these efforts creating more fragmentation of the rules-based order, or are they a way to overcome global governance stalemates? I set out the arguments for whether Australia, as a pivotal power, should generate more global options, or be more focused on inclusion in the Asia-Pacific region.

Abstract:
A comprehensive and rigid analysis of Chinese investment in Australia for the past four decades is an under-researched topic, though there had been sporadic treatments of this subject matter from the perspective of single institutions in economics, politics, and culture. The neoliberalism era marked a honeymoon between China and Australia, which boosted the Chinese investments in Australia, marked by the Australia-China Free Trade Agreement and the ‘One Belt One Road Initiative’ Agreement, signed by the Victorian Government and the Chinese Development and Reform Commission. Recent years witnessed a deterioration of the Australia and China relationships and the “tit-for-tat” strategies and racism movements which discourage the Chinese investments in Australia. This study has developed a conceptual framework consisting of economic, political, cultural and institutional factors that may explain the Australian government’s decision of rejecting certain Chinese investments in recent years. Case studies were employed to illustrate the application of the conceptual framework. The findings suggest that the conceptual framework can be utilized to explain why the Australian government rejected certain Chinese investments. This research aims to analyze the determinants of Australia Government’s rejection of Chinese investment in Australia. Case studies in the field of the Australian mining sector, agriculture and agribusiness, and infrastructure unveil that political distrust towards Chinese investment in Australia is a major source of refusing Chinese investment. This led to continuous reduction of Chinese investment in Australia since 2016. Such political distrust which works against the national interest of the respective countries, may also drive the decline of Chinese investment in Australia. This research contributes to the literature by examining the factors which lead to the Australian Government’s decision to reject certain Chinese investments based on in depth analysis of case studies. This will be useful for understanding how to enlarge shared interest for policymakers, businessmen and academic researchers.

AbstractEvery venture is developed under high uncertainty and causal ambiguity. A large majority of digital startups leverage the lean startup approach to validate the attractiveness of their venture, to reduce avoidable investments of scarce resources, and to structure the venturing process. Digital entrepreneurs highlight that prioritization and the definition of MVPs are two challenges that entrepreneurs face when applying the lean startup approach. We provide support on these particular challenges through a structured approach—the venture pyramid—to (in)validate digital business models in the face of high uncertainty. Furthermore, we map different types of digital business models with patterns of minimum viable products to inspire digital entrepreneurs and scientists alike. To illustrate our thoughts, we have developed two case studies of German startups that applied a process of rigorous iteration and learning to their venturing processes.

AbstractThis chapter examines why and how small militaries have adopted operational art despite not possessing large enough forces to apply the concept in the manner it was originally intended. First, it establishes context by summarizing three large military operational art traditions – the German, Soviet, and American traditions. Second, it examines why small militaries have adopted the concept, positing that it is due to a mixture of interoperability and cultural reasons. While there are many potential ways to define “small militaries,” they are defined here as either comprising less than 100,000 personnel, or as fielding land combat forces of one division or less in size. By either definition, these militaries are smaller in scale than those required to apply operational art as conceptualized within the three large military traditions summarized. Third, three case studies examine how small militaries have adapted and applied the concept: those of Australia; Canada; and the Nordic and Baltic countries. Despite facing different strategic situations, the way these militaries have applied operational art has been very similar. All have taken a functional approach, which de-links operational art from its original emphasis on scale. These militaries have used this modified concept to enable them to operate more effectively alongside their larger allies, America in particular.

In modern organisations a large portion of senior management’s time is now being spent on finding ways to measure the contribution of their organisations’ IS/IT investments to business performance. It has been shown that IS/IT investments in many organisations are huge and increasing rapidly every year and yet there is still a lack of understanding of the impact of the proper IS/IT investment evaluation processes and practices in these organisations. At the same time, the issue of expected and actual benefits realised from IS/IT investments has also generated a significant amount of debate in the IS/IT literature amongst the researchers and practitioners. This is as true in Australia as it is in the rest of the developed world. Thus, one can argue that a detailed program of research into the current practice and process of IS/IT investment evaluation in Australia is warranted. This paper reviews the progress made in research in this area and proposes a research program incorporating surveys, case studies, and expert focus groups to assess current practice and to develop an approach, model or framework based on the fit between theory and practice of IS/IT investment evaluation by large Australian organisations.
