In some jurisdictions, where individual privacy and property rights are afforded constitutional protection, legal disputes regarding police powers of entry and search sometimes extend beyond the law of tort into public law, where the challenge is to the power itself. The South African Constitutional Court has determined the constitutional validity of warrantless powers of entry and search on a number of occasions. This article discusses the most recent addition to this body of case law, as well as several related authorities from other jurisdictions. Where appropriate, reference to the position in English law also forms part of the discussion.

Abstract:
Recursively defined linked data structures embedded in a pointer-based heap and their properties are naturally expressed in pure first-order logic with least fixpoint definitions (FO+lfp) with background theories. Such logics, unlike pure first-order logic, do not admit even complete procedures. In this paper, we undertake a novel approach for synthesizing inductive hypotheses to prove validity in this logic. The idea is to utilize several kinds of finite first-order models as counterexamples that capture the non-provability and invalidity of formulas to guide the search for inductive hypotheses. We implement our procedures and evaluate them extensively over theorems involving heap data structures that require inductive proofs and demonstrate the effectiveness of our methodology.

The review dwells upon the problematic issues, uncertainties and prospects of establishing causal relationship between diseases and radiation exposure. The review discusses the challenges, uncertainties and prospects of establishing causation between exposure to radiation and diseases. The criteria that could be used to assess the radiation-induced health damage are considered. The existing practice of recognizing certain categories of citizens of the Russian Federation as people affected by radiation exposure, which is based on the establishing causal relationship between disease, invalidity, death with radiation exposure by Interdepartmental expert councils, is analyzed. Experts of Interdepartmental expert councils in taking the decision rely on to the list of diseases that should be updated consistently based on the findings of radio-epidemiological studies. To make the decision-making process objective, advanced scientific studies focused on individualization of the radiation risk and search for the biomarkers of radiation-induced effects, both deterministic and stochastic ones, are discussed.

Abstract:
Cardiovascular diseases are the leading cause of invalidity and mortality in the majority of developed countries and are recognized by the international community as a pandemic problem. An important task of modern cardiology is the search and study of new biological markers. This literature review aimed to consider chemerin as a new diagnostic and prognostic marker for cardiovascular pathologies. Thus far, studies on chemerin indicate the possibility of its use as a marker of cardiovascular pathology. Evidence points to the important role of chemerin in the development and progression of cardiovascular diseases. As an adipokine, chemerin modulates glucose, and lipid levels, thereby influencing lipid deposition in the endothelium and progression of atherosclerosis. As a chemoattractant, it facilitates the mobilization and interaction of macrophages with dendritic cells and natural killer cells in the vascular system and induces endothelial angiogenesis. The established role of chemerin in vascular inflammation, angiogenesis, and blood pressure modulation opens serious prospects for the development of therapeutics targeting this biomarker for the treatment of cardiovascular diseases. Several candidates targeting chemerin and the CMRK1 signaling pathway have shown promising potential in reducing vascular dysfunction in in vitro and in vivo studies. Further studies analyzing the efficacy and safety of new chemerin-targeting drugs are needed to assess their potential.

Abstract:
Higher level of functional incapacity and invalidity is noted in palliative patients, as a result of disease progression, which is the reason for a significant decrease in the quality of life not only of these patients, but also of the family members who care for them. Physical therapy and occupational therapy are aimed at improving the patient's quality of life through rehabilitation measures to restore body function, ensure physical independence and activity, optimal physical condition and well-being, and patient adaptation in the environment. Aim: to review modern literary sources regarding the relevance of physical therapy and occupational therapy in palliative and hospice care. The search for literary sources was carried out in international scientometric databases: PubMed, Scopus, Web of Science, Google Scholar. The search depth is 13 years (from 2010 to 2022). The review indicates that physical therapy and occupational therapy in palliative and hospice medicine around the world are not used enough today. These two specialties of interdisciplinary treatment in palliative and hospice medicine play an important integral role, which is manifested in improving the quality of life of both patients and their family members who care for them through the use of a wide variety of methods. Hospice physical therapists not only help patients to support/keep functional abilities as long as possible, but also to reduce the burden on persons who care for terminally ill patients. Physical and occupational therapy have numerous benefits for patients with progressive life-threatening illnesses in palliative and hospice care. Physical therapy in palliative and hospice care can have a preventive, educational, and/or supportive function depending on the patient's situation. There is especially large deficiency in palliative physical therapy and occupational therapy among adolescents and young people, which requires wide implementation with high-quality training of relevant specialists. Physical therapy and occupational therapy play an important role in palliative and hospice care; all patients in palliative and hospice care, regardless of illness or severity, should have access to physical and occupational therapy based on individual needs.

A set of skills thought to contribute to effectiveness in searching subject indexes is defined. Of these, one group was selected for study, namely skills thought to focus a search. An objective test to measure these skills was administered to 129 students and established to have content validity, and some degree of construct validity. The skills involved did not corre late highly with each other, and are to be regarded, at least for the time being, as five separate skills, An attempt to establish the criterion, or predictive validity of the subtests of the focusing skills failed to either validate or invalidate them because of wide errors of measurement in the subtests, but more particularly in a performance test of index searching. It is suggested that future work should attempt to find practicable ways of improving test accuracy, and also that the cognitive dimensions of document relevance be investigated.

The search for quality alternatives to fishmeal and fish oil in the fish feed industry has occupied many researchers worldwide. The use of black soldier fly meal (BSFM) as a substitute has increased. This study evaluated the effect of this substitution on fish growth and nutritional quality through a meta-analysis of the literature. A list of studies was selected after an exhaustive literature search followed by the extraction of growth and nutritional parameters. Two random-effects models were used to estimate the differences between the experimental parameters and the controls. The results showed significant heterogeneity between studies for all parameters. The sources of heterogeneity between studies were mainly fish species and protein substitution rate. High substitutions can be considered without necessarily worrying about an adverse effect. Financial profitability studies of the fish production chain from BSFM should be carried out to validate or invalidate the economic viability of this substitution.

Patents are important resources nowadays. The inventor(s) or the assignee(s) who owns a patent has the exclusive right to prevent or exclude others from making, using, selling, offering to sell or importing the invention. Besides, firms can also use their patents to prevent their products from being infringed, license out their patents to gain royalty fees, or attack other firms via patent infringement lawsuits. As the number of patents granted increases annually, it is more likely that a firm will face patent infringement lawsuits. When a company is accused of patent infringement, to protect itself from this lawsuit, it is a common practice that the defendant files a patent invalidity lawsuit against the plaintiff. To achieve this goal, the defendant should conduct prior art search on the focal patent to find prior arts whose existence can invalid the focal patent. Thus, this study takes the learning to rank approach to design our patent invalidity search technique. Our empirical evaluation result shows that the effectiveness of our proposed technique and its enhanced version is satisfactory in supporting patent invalidity search.

Abstract:
This thesis is based on the project work done for the patent research and analysis of the inventions. This research work has been carried out in order to predict whether an inventor(s) can be granted a patent over the said invention or not. The project has been carried out in four different phases. In each phase the research work has been done for a particular given invention and the results have been interpreted. PHASE-I The patent research and analysis was performed for the invalidation of the invention titled: Providing a total battery capacity value. This invention discloses a method and system for calculating and displaying the remaining battery capacity of a mobile phone/device. The invention includes the calculation of the battery capacity when the battery is currently in use. An exhaustive search was conducted for the patents granted worldwide over the same type of inventions and three relevant results were found which disclosed the same key features. The patents found are US5926007, US6313606, and US6495989. The detailed analysis has been done and discussed in this thesis. PHASE-II The invalidation search for the invention titled: HVAC (Heating-Ventilation Air Conditioning) actuator having torque compensation. This invention is for the air conditioning systems in which the torque of motor in the compressor is adjusted according to the surrounding temperature sensed by the sensor. A comprehensive search was conducted and one relevant result was found with patent number US6073689. PHASE-III The invalidation search of the invention titled: Security Pigment was conducted. This invention disclosed the pigment to be applied on the bank notes, bank cheques, bank drafts etc. for the authentication and security purposes. This pigment consisted of a nano-composite material consisting of a hidden forensic material inside it. The material is invisible to the ABSTRACT DEEPAK KUMAR SINGH iii naked eyes but when exposed to the UV rays it displays a code which may be used for authentication and knowing the history of the note or document. During the search no relevant results were found which disclosed all the key features of the given invention. However two related results were found with patent number EP1597709 and US6200628, which disclosed only some of the key features. PHASE-IV The invalidation of the invention titled: System for depositing microwire. This invention disclosed a method for the deposition of a microwire on the body of the aeroplanes, rocket, spacecraft, etc. This system firstly deposits a dielectric layer on the substrate and then sandwiched the microwire between the previous dielectric layer and a covering dielectric layer. During the search no results were found which disclosed the same key features as in the given invention. PHASE-V The invalidation search of the invention titled: Economizer controller plug and play system recognition with automatic user interface population was done. This invention disclosed a system which controls the air-conditioning system in order to economize the cost of operation according to the temperature difference of the inside and outside environment. In the air conditioning system generally use the inside air refresh, cool it and again directs it inside the room but the given invention allows the system to sense the temperature of inside and outside and compare. If the temperature outside is lower than temperature inside then it allows the air conditioning system to take outside air, refresh it, cool it and direct it towards inside. After an exhaustive search two relevant results with patent numbers US20030181158 and US20020152298, were found which disclosed all the key features of the said invention.

This chapter focuses on the law governing the validity and amendment of patents in the UK and US. The grant of a patent does not guarantee its validity. The chance that a patent will be held to be valid if challenged depends on the completeness of the search performed; the strictness of examination of the patent in the patent office; the legal and technical competence of the patent examiner; the chance of intervention by third parties during the patent office proceedings; and the pro- or anti-patent attitude of the national courts. Patents granted by the European Patent Office (EPO), Japanese Patent Office, or US Patent and Trademark Office are subject to a relatively rigorous substantive examination. However, patents in other countries, such as South Africa, Belgium, or even the Netherlands, are granted after a formal examination, without any investigation as to whether the claimed invention meets the patentability criteria.

Abstract:
Modularity is an approach to manage the design of complex systems by partitioning and assigning elements of a concept to simpler subsystems according to a planned architecture. Functional-flow heuristics suggest possible modules that have been demonstrated in past products, but using them still leaves it to the designer to choose which heuristics make sense in a certain architecture. This constitutes an opportunity for a designer to take other constraints and objectives into account. With large complex systems, the number of alternative groupings of elements into modular chunks becomes exponentially large and some form of automation would be beneficial to accomplish this task. Clustering algorithms using the design structure matrix (DSM) representation search the space of alternative relative positioning of elements and present one ideal outcome ordering which “optimizes” a modularity metric. Beyond the problems of lack of interactive exploration around the optimized result, such approaches also partition the elements in an unconstrained manner. Yet, typical complex products are subject to constraints which invalidate the unconstrained optimization. Such architectural partitioning constraints include those associated with external force fields including electric, magnetic, or pressure fields that constrain some functions to perform or not perform in different regions of the field. There are also supplier constraints where some components cannot be easily provided with others. Overall, it is difficult to simply embed all objectives of modular thinking into one metric to optimize. We develop a new type of interactive clustering algorithm approach considering multiple objectives and partitioning constraints. Partitioning options are offered to a designer interactively as a sequence of clustering choices between elements in the architecture. A designer can incorporate constraints that determine the compatibility or incompatibility of elements by choosing among alternative groupings progressively. Our aim is to combine computational capability of clustering algorithms with the flexibility of manual approaches. Through applying these algorithms to a MRI machine injector, we demonstrate the benefits of interactive cooperation between a designer and modularity algorithms, where constraints can be naturally considered.

Abstract:
Since the turn of the 20th century, the act of design has gone through an exercise of problem-solving. It happened in the field of the city, architecture, or objects. Much of this discourse is present in the modernist manifestos. These goals are primarily related to Russian constructivism, in which many modern personalities were engaged. This problem-solving process, oriented toward an economic practice that articulated the available means to the proposed ends, was so necessary to the revolutionary spirit of the time. However, they answered the questions that the post-Russia zeitgeist of the Revolution intended to answer. The articulation of their intended function, coupled with the emergence of their utility, entrusted them with a good and abstract character in the city.However, in its genesis, the project contains much more than that. It cannot be merely the functional resolution of a problem. It must have the instability of that problem in its course, which becomes changeable in the search for the solution. As a result, the merely utilitarian character thus loses its initial grip. As Roger Scruton argues, the definition of a project methodology is complex if a method is indeed the correct word to use in the process. The method, that is, a path composed of specific tools to achieve a purpose, seems to us little convergent with the themes that should flow. To start from this assumption is to invalidate what we previously described as a fundamental part of the process of memory, which should have a high place in the project process. The design process is, in essence, the transit between the identification of a problem until it resolves (one, among many possible ones). To which we allude, it does not refer only to the project in Architecture but to a whole system that involves not only objects but also cities, in what we can understand as relationships with the body. More than a mere technical process, it involves an empirical component based on experience, which we define as physical and intellectual. The act of design, or project, must contain in its origin the state of emptiness, without preconceptions, that gag it. This state, which we wish to bring into discussion, is nothing more than the full potential of the task we want to accomplish.
