Fa sue le preoccu-pazioni derivanti dalla moltiplicazione dei soggetti e dei testi, segnalando il crescente potere datoriale anche nel campo delle relazioni collettive. In attesa di un intervento legislativo, sollecita di prestare attenzione alla qualità della disciplina eteronoma, non bastando la semplificazione di criteri quantitativi né la distinzione binaria tra contratti "tradizionali" e contratti "pirata".

Abstract:
Lo scritto si sofferma sull’emergenza globale che il diffondersi del virus ha causato, analizzando gli effetti che essa potrebbe avere sul sistema sanitario nazionale, a partire dall’insistito richiamo alla solidarietà sociale. In questa ottica, si è cercato di dimostrare come le peculiarità del caso concreto rendano necessaria una valutazione dell’effettivo contenuto delle prestazioni contrattuali tra paziente e struttura sanitaria differente rispetto ai tempi ordinari. Il giudice sembra essere il soggetto posto nelle condizioni migliori per poter apprezzare tali particolarità, senza che si debba procedere all’emanazione di norme emergenziali al fine di disciplinare le conseguenze della crisi sanitaria. Un intervento legislativo, invece, pare essere necessario qualora si faccia riferimento al principio di solidarietà sociale, non attuabile direttamente in via interpretativa.

L'articolo prende in esame il fenomeno del banditismo e della criminalitÀ rurale nel contesto dello Stato genovese tra Cinque e Settecento, valendosi principalmente della corrispondenza dei giusdicenti e delle lettere anonime inviate al Senato. A fronte di un intervento legislativo puntuale e reiterato, e dell'elaborazione di strategie punitive particolari, questa piaga sociale permane per tutto il corso dell'ancien régime. Gli esecutori di giustizia (bargelli, cavaleri, famigli ecc.) creano spesso piů problemi di quanto ne risolvano; gli esperimenti coi i "civili" (milizie scelte, compagnie contro banditi) non sortiscono gli effetti sperati; e l'apporto degli effettivi dell'esercito (nella fattispecie quelli provenienti dalla Corsica) tampona il problema ma non č mai risolutivo. I successi sono dunque sporadici, ma l'autore argomenta come lo Stato riesca nel complesso a mantenere il controllo del suo territorio scendendo a patti con patriziati e notabilati locali, e a porsi agli occhi dei sudditi attraverso i suoi corpi armati come un punto di riferimento pienamente legittimato.

Abstract:
Il saggio, dopo aver messo in evidenza come in Italia vi sia una vera e propria questione salariale legata alla diffusione del "lavoro povero" e al basso livello delle retribuzioni, analizza la Proposta di direttiva UE sul salario minimo, recentemente approvata dal Parlamento europeo e tuttora non definitiva. L'articolo esamina le finalità e le motivazioni della Proposta (diretta a garantire salari adeguati che consentano una vita dignitosa) e i delicati problemi giuridici connessi sia alla competenza della UE in materia salariale, sia alla disciplina in essa contenuta. Dopo aver sottolineato che la Proposta non impone una legge sul salario minimo nei paesi in cui la retribuzione è stabilita dai contratti collettivi (come l'Italia), il saggio valuta gli effetti che il recepimento della Direttiva in Italia potrebbe avere, anche in considerazione dei disegni di legge diretti da introdurre il salario minimo. Gli autori concludono la propria analisi sottolineando come sarebbe auspicabile un intervento legislativo che, in attuazione dell'art. 36 Cost., preveda retribuzioni minime corrispondenti a quelle previste dai contratti collettivi stipulati dai sindacati comparativamente più rappresentativi a livello nazionale.

Il saggio, nel ripercorrere il dibattito sulla rappresentanza sindacale nell'impiego privato, propone una disaggregazione dell'analisi, in relazione alla necessitŕ di calare i diversi modelli nei contesti nei quali si esprime il potere negoziale del sindacato. Nello specifico, per quanto riguarda la contrattazione collettiva nazionale di categoria, si aderisce alla tesi che ricostruisce la rappresentanza sindacale come rappresentanza associativa, mentre la rappresentanza sindacale nelle singole aziende si caratterizza come rappresentanza istituzionale (viene, in particolare, individuata la disciplina negoziale sulle rappresentanze sindacali unitarie che derivano il loro potere dalla consultazione elettorale di tutti i dipendenti occupati nell'azienda). L'analisi poi della rappresentativitŕ sindacale, con riguardo alla nozione di sindacato comparativamente piů rappresentativo, si confronta, per un verso, con l'art. 39 Cost. e si conclude, per altro verso, con l'osservazione che i contratti collettivi ai quali la legge connette effetti legali richiedono "l'unitŕ contrattuale" del sindacato. Si propone, infine, un intervento legislativo volto a generalizzare l'esperienza delle rappresentanze sindacali aziendali e a poggiare il richiamo alla maggiore rappresentativitŕ comparata su un meccanismo associativo ed elettorale insieme, in relazione alla devoluzione di funzioni demandate dalla legge.

Este artigo tem por objetivo analisar como o poder legislativo tem buscado, por meio de sua atividade legislativa, intervir na autonomia dos órgãos reguladores. Parte-se, neste artigo, da hipótese de que o poder legislativo, insatisfeito com o arranjo institucional vigente, age estrategicamente para afastar as agências reguladoras da ingerência do poder executivo. O artigo desenvolve um estudo qualitativo de leis e especialmente proposições legislativas de iniciativa parlamentar que buscam afetar diretamente a autonomia das agências reguladoras. As leis e proposições legislativas analisadas neste artigo foram divididas em categorias que representam diferentes formas de intervenção na autonomia das agências. Para responder ao problema proposto, o artigo subdivide-se em duas partes. Na primeira, apresenta-se uma breve revisão teórica sobre controle legislativo da administração pública. As estratégias de controle político que afetam diretamente aautonomia das agências reguladoras são analisadas em abstrato. Na segunda parte, analisa-se a produção legislativa do Congresso Nacional sobre autonomia regulatória. Pretende-se, com este estudo, qualificar o debate sobre autonomia das agências reguladoras no Brasil. Ver-se-á que a autonomia das agências reguladoras é um conceito em disputa, sensível às transformações nas relações entre poder legislativo, poder executivo e agências reguladoras.

Abstract:
Partindo da abordagem culturalista, o objetivo da pesquisa foi averiguar como os parlamentares da 54º legislatura do Legislativo Federal brasileiro se posicionaram acerca do papel do Estado no desenvolvimento geral da nação. Partindo da conjectura sobre a existência de uma indiferenciação ideológica entre elites políticas de diferentes partidos, propagada no senso comum, objetivou-se identificar como os parlamentares de legendas partidárias localizadas à esquerda e à direita do espectro ideológico se diferenciam em seus posicionamentos sobre estatismo. As análises apontam para a existência de correlação entre localização no espectro ideológico e posicionamento político acerca da concepção de Estado e seu papel. Blocos e partidos localizados mais à esquerda do espectro ideológico tendem a defender uma posição mais atuante do Estado, ao passo que blocos e partidos situados mais à direita tendem a defender um Estado menos interventor nestas questões.

Abstract:
En este artículo se describe la trayectoria legal que en España ha acompañado las acciones a favor de la igualdad de oportunidades entre mujeres y hombres en los centros educativos. En concreto sobre la formación inicial y continuada del profesorado para poder intervenir en las transformaciones que exige esa igualdad. Un recorrido de tres décadas de propuestas para sensibilizar y para revertir certezas heredadas. Se describe cómo la legislación española ha ido señalando los pasos necesarios para incluir este tipo de formación en los programas de formación inicial y continuada del profesorado y se ofrece también un acercamiento a publicaciones que reflejan la respuesta a esas normativas. Entre la amplia gama de indicadores considerados pertinentes a la hora de implementar programas de formación inicial y continuada del profesorado, ha adquirido una especial relevancia en las últimas décadas el que conocemos como perspectiva de género. Un indicador que requiere la incorporación al análisis de la realidad y a las propuestas de mejora, de una mirada crítica a lo que es fácil ya reconocer -en cuanto afecta al mundo de las mujeres y de los hombres-, como una construcción sociológica de la diferencia sexual (Cobo, 2005). Un bagaje de hábitos y de creencias acumuladas generación tras generación que impregna la cultura elaborada y la mentalidad operante en cada época y en cada sociedad. Los objetivos de este artículo son, en primer lugar, mostrar cómo la legislación española ha ido señalando los pasos necesarios para incluir este tipo de formación en los planes de formación inicial y continuada del profesorado; y también ofrecer un primer acercamiento a publicaciones que reflejan la acogida de esas normativas con algunas de las acciones que se han ido llevando a la práctica. Se ha utilizado una metodología de localización de las fuentes legales con contenidos relativos a la igualdad, y de revisión de fuentes bibliográficas que dan cuenta de estudios y de trabajos sobre la aplicación de las propuestas legislativas.

Sollecitata dalle ricerche sociologiche più recenti che argomentano la necessità di un intervento eteronomo, l'analisi approfondisce la disciplina legislativa sul profilo economico delle organizzazioni sindacali vigente nel Regno Unito, in Francia e in Spagna. Dall'esame di questi sistemi, il saggio trae rilevanti spunti di riflessione per la definizione di un intervento promozionale che colleghi l'attribuzione di benefici e poteri legislativamente riconosciuti all'osservanza di taluni requisiti di trasparenza.

Il presente articolo cerca di evidenziare i molteplici punti di vista da cui esaminare nella dimensione comparata il mutamento del rapporto tra legge e contrattazione collettiva. Innanzitutto vengono studiate le tendenze comuni ad un’alterazione dell’integrazione funzionale tra legge e contrattazione collettiva, cioè, un mutamento qualitativo e quantitativo. In seguito, oltre le tendenze comuni, evidenziamo anche l’acuirsi delle differenze tra sistemi nazionali, nonché gli interventi legislativi di attacco alla contrattazione nazionale/settoriale indotti dalla nuova governance europea. Successivamente studiamo la rifondazione del rapporto tra legge e contrattazione collettiva attraverso la ripartizione delle sfere di competenza, nonché gli interventi legislativi sull’efficacia del contratto collettivo, ossia, le misure di riduzione dell’ultrattività e dei meccanismi di estensione. In seguito evidenziamo gli interventi legislativi sulla rappresentanza dei soggetti negoziali, cioè, la misurazione della rappresentatività, gli accordi maggioritari ed i nuovi soggetti abilitati a stipulare l’accordo aziendale. Dopodiché studiamo anche le correzioni imposte ai meccanismi nazionali di regolazione salariale. In conclusione, discutiamo verso quali equilibri si va riconfigurando il rapporto tra legge e contrattazione collettiva, cioè, sul tramonto del contratto collettivo come atto normativo a portata generale e la sua esclusiva funzionalizzazione a strumento di gestione a livello aziendale.

La necessità di gestire il dinamismo del paesaggio forestale italiano, significativamente segnato dalla crescente estensione delle superfici boschive, e, al contempo, la fruizione delle utilità ecosistemiche fornite dal bosco ha condotto all’aggiornamento della legislazione forestale con specifico riferimento anche al tema del paesaggio: in particolare, all’art. 7, comma 2 del decreto legislativo n. 34/2018 è previsto che con i piani paesaggistici regionali, ovvero con specifici accordi di collaborazione stipulati tra le Regioni e i competenti organi territoriali del Ministero della cultura, vengano concordati gli interventi riguardanti la gestione forestale nelle aree soggette a vincolo paesaggistico provvedimentale (art. 136 del decreto legislativo n. 42/2004), nel rispetto di specifiche linee guida che saranno oggetto di un apposito decreto ministeriale. In questa nota vengono fornite alcune riflessioni sul tema, in forma di discussione commentata, unitamente a una disamina esemplificativa della tipologia di interventi da includere nelle linee guida.

Abstract:
The claim that gender equality in the composition of corporate governance bodies is a driving factor for the economic growth and competiveness of enterprises has been the subject of discussion in the international scientific literature. The emphasis on the inclination towards social responsibility has effectively encouraged the main international institutions to promote equal opportunities for men and women. The Italian legislator intervened in 2011 by encouraging a pathway for including women within the top management bodies of companies. In this perspective, the legislation becomes not only a tool to ensure gender representation in corporate governance bodies in listed companies and companies under public control, but one to initiate a change which, if left to its own natural rhythms, would risk taking an unacceptable amount of time to implement. After a brief overview of the Italian legislative context applicable to listed companies and companies under public control, the aim of this study was to investigate whether the seventeen listed Italian companies and the seventy unlisted Public Utilities have conformed to the legislation on gender equality in the composition of their Boards of Directors or whether they have undertaken voluntary initiatives entailing the adoption of effectively shared “gender” values.

Abstract:
La acción constitucional de tutela fue concebida por el constituyente como un instrumento que protege y ampara los derechos constitucionales fundamentales, no como un mecanismo reformatorio de la Constitución o impulsor de los mismos, naturaleza por la cual es difícil canalizarla en el contexto de cambio constitucional. Sin embargo, en la presente investigación se aborda el alcance de la acción de tutela en esta materia, dado que a partir de un caso hito se advierte como empieza a intervenir en escenarios exógenos a su naturaleza, como en los cambios plasmados en la Carta Superior, verbigracia, el caso de las curules de paz de las víctimas del conflicto armado, donde una acción de tutela propició la materialización de una reforma a la Constitución Política de Colombia. Todo lo anterior, de conformidad a la trascendencia que está teniendo en el Estado Social de Derecho el juez constitucional y su actuación frente a las otras funciones del Estado. Bajo estos parámetros la investigación plantea como objetivo general, analizar el papel de la acción de tutela respecto de los mecanismos de reforma constitucional en general y, en particular, como impulsora del trámite legislativo de actos legislativos en Colombia.

Nella prospettiva prescelta, l'autore si propone di verificare la coerenza di questi interventi con regole e principi costituzionali relativi alla libertŕ sindacale e al contratto collettivo. A questo fine, l'Autore presenta un'analisi della dottrina e giurisprudenza di riferimento e propone la rilettura di talune fondamentali sentenze della Corte prende le mosse dal rifiuto di ogni prospettiva di analisi che trascuri previsioni costituzionali ancora in vigore o le consideri obsolete.

AbstractThis article explores the justifications for, and objections to, the proposed European Union ‘women on company boards’ Directive. It notes that Member State opposition to the measure had different emphases. The new, post-socialist Member States that intervened prominently questioned the Commission's understanding of the underlying social reality of gender inequality and the measure's focus on results, while the old Member States that intervened raised mainly the issue of subsidiarity and challenged the need for legislative action, and/or particularly the need for legislative action at EU level. The article further argues that the Commission weakened its case by emphasising economic rationales for the measure, and submits that a principled justification fits the proposal better. Finally, the article argues that subsidiarity-related arguments are available also to justify non-cross-border, non-economic projects, such as that of gender equality.

Known since ancient times, the legal regime of the right of preemption has undergone a surprising evolution. This right will be recognized among the institutions that enjoy a general legislative consecration and the modernized Civil Code. Thus, the legal provisions regarding the institution of the right of preemption have been essentially reformed, taking into account the deficiencies found in the special legislation, or at the current stage, we encounter different species of the right of preemption in the most varied fields, such as cultural, commercial, privatization, intellectual property, etc. In this regard, we set out to analyze the right of preemption in the cultural field through this scientific approach. Due to the importance of the goods to be alienated, it was felt necessary to clarify specific regulations, taking into account the exercise of this right, showing the reason for which it was instituted; the procedure or conditions under which it is exercised; the sanction that intervenes in case of non-compliance, as well as the consequences of applying this sanction.

Abstract:
The subject of this article is relations that arise to interference of the third party (intervener) in contractual relations of the parties. The author considers the question of possible means of protecting a bona fide creditor from the actions of an intervener, such as challenging of the transaction consummated between the obligator and the intervener, as well as recovery of tort damages from the intervener for the benefit of a bona fide creditor. The article examines the issues emerging in the context of application of both methods of protection. The conclusion is made on the possibility of use of both methods, in preference to recovery of damages. It is noted that challenging of the transactions allows to equitably redistribute the burden of proof in disputes with a mala fide intervener, while the tort claim implies the possibility of recovering pure economic losses from a mala fide intervener. The authors indicate that the current Russian legislation does not contain dogmatic obstacles for application of such method of protecting a mala fide intervener.

Presented within this article is a systematic discourse analysis of the arguments used by the then Australian Prime Minister and also the Minister for Indigenous Affairs in explaining and justifying the extensive and contentious intervention by the federal government into remote Northern Territory Aboriginal communities. The methods used within this article extend the socio-legal toolbox, providing a contextually appropriate, interdisciplinary methodology that analyses the speech act’s rhetorical properties. Although many academics use sound-bites of pre-legislative speech in order to support their claims, this analysis is concerned with investigating the contents of the speech acts in order to understand how the Prime Minister’s and Minister for Indigenous Affairs’ argumentations sought to achieve consensus to facilitate the enactment of legislation. Those seeking to understand legislative endeavours, policy makers and speech actors will find that paying structured attention to the rhetorical properties of speech acts yields opportunities to strengthen their insight. The analysis here indicates three features in the argumentation: the duality in the Prime Minister’s and Minister’s use of the Northern Territory Government’s Little Children are Sacred report; the failure to sufficiently detail the linkages between the Intervention and the measures combatting child sexual abuse; and the omission of recognition of Aboriginal agency and consultation.

Discriminatory customary practices against the protection of gender rights still thrive in many Southern African developing states despite domestic and international legal regimes to prevent them. These practices were borne out of customary inclinations of the patriarchal social system in most African communities, which hold women and the girl-child in perpetual subordination to the male. In other words, the African customary systems wrongly perceive the male gender as being naturally superior to the female. More so, the loopholes in the executive and legislative efforts to combat human rights abuses as well as judicial pronouncements and governmental apathy in eradicating abuses against gender discrimination towards women in the Southern African developing states are apparent. Consequently, discriminatory customary practices continue to thrive despite legislative framework protecting gender rights in the states. The methodology adopted in this paper is a doctrinal approach, which places reliance on legal materials that are enacted and enforced by African Developing states. The article examines international and states laws, norms, institutions, international and national publications and other international legal instruments relating to gender discrimination. Most importantly, the central attention of this study focuses on the discriminatory customary practices against women in the Southern African Developing States. The current study finds that, despite identifiable discriminatory customary practices which are still practised and condoned as being the lifestyle and tradition of groups are criminalized and declared abhorrent by specific domestic legislation of nations, the human rights of the girl-child and women continue to be in chains and fetters. In conclusion, this article advocates increased advocacy, judicial activism and more proactive legislative action that protect women and the girl-child in the Southern African developing states.

In order to avoid blocking the capacity of the banking system to finance the domestic economy, a legislative package was issued in order to protect the interests of bank debtors, at the suggestion of EBA and against the background of the crisis caused by COVID-19. In addition, the legislative moratorium was supplemented by a non-legislative moratorium, and as a result of their application, the payment obligations of the debtors who requested the postponement were suspended. The analysis of the effects produced on the banking market leads to the conclusion that the government's measures caused both positive and some negative effects - the risk of default for banks and public exposure being the sensitive factors. As a result, the state and the B.N.R. intervened with specific means.

El artículo presenta conceptos de la Constitución Política y a sus componentes de reforma y revisión, así como al Constitucionalismo Democrático. Reflexiona sobre la responsabilidad política de los Tribunales Constitucionales, aborda la encrucijada jurídica y política respecto a la nominación y elección del Tribunal Constitucional, concluyéndose que el diseño occidental pareciera ser correcto al intervenir todos los Poderes. Posteriormente se cuestiona el rol actual de los magistrados de la Corte Constitucional en el control de constitucionalidad de los actos reformatorios de la Constitución, sobre la sospechada incompetencia del Congreso de la República para hacerlo en lo que ha designado como “vicios de competencia” y “sustitución de la Constitución”. Se aborda críticamente las sentencias de la Corte sobre los Actos Legislativos 2 de 2015 y 1 de 2016 y del Consejo de Estado, en su competencia residual del control de constitucionalidad. Se cuestiona el fast track como mecanismo para toda clase de reformas legales y constitucionales incorporado en el Acto Legislativo 01 de 2016 y que tuvo el beneplácito de la Corte Constitucional. Complementariamente se alude a los límites establecidos por la Corte Constitucional para implementar el Acuerdo de Paz a través del ‘fast track’ en la Sentencia C-160 de marzo 9 de 2017. Abstract:
The law respecting nuclear energy has to date been the subject of relatively few studies in Canada. Considering, however, the growing importance of nuclear energy as a new or additional form of energy, besides oil, gas, coal and hydroelectric power, and on the other hand, the increase in public concern about the possible consequences of the nuclear option, especially on health and the environment, this area of law is undoubtedly bound to experience a major development. The purpose of the present article is to study existing federal legislation on the matter, as well as its effects on certain provincial jurisdictions, more particularly in Quebec. The author, after recalling certain technical data concerning components and functions of nuclear reactors, proceeds to analyse the main intervenors in the nuclear field, as contemplated by the Atomic Energy Control Act. One cannot help but acknowledge that the Atomic Energy Control Board, by means of its important supervisory and regulatory powers, intervenes at all stages of the nuclear cycle. The author also studies the constitutional basis for the federal intervention in this field of activity. After eliminating the national defence power, the national dimension theory and the emergency power as possible alternatives, he concludes that while Parliament may perhaps invoke its residuary power, its declaratory power appears as the surest constitutional basis for asserting its legislative authority over that particular matter. In the last part of the article, the author attempts to emphasize the effects of federal intervention on provincial property rights over uranium mines, and on provincial jurisdictions over labour relations, health and safety at the workplace and environmental protection. This analysis points out that provincial legislative authority over the management and development of their natural resources is not only inapplicable in respect of uranium, but that their property rights over uranium mines are rather precarious. It seems clear, further, that jurisdiction over labour relations within nuclear undertakings lies exclusively with the federal authority. One could argue that such is also the case with those aspects of nuclear undertakings which are connected with workers' health and safety as well as environmental protection, since those matters are intimately linked with the control of atomic energy. Two main conclusions can be drawn from this study. Firstly, it appears certain that Parliament, in legislating as it did, intended to regulate the whole nuclear energy cycle, from the extraction of uranium ore to the ultimate disposal of nuclear waste. Secondly, that authority could hardly be challenged by provinces or any other interested party, at least on constitutional grounds.

L. n. 92/2019 introduced the transversal teaching of civic education in schools of all levels from the 2020-2021 school year. This contribution, without any claim to being exhaustive, proposes an interpretative reflection starting from some data that emerged in the context of the CIVES research (CIttadini VErso la Sostenibilità) which started from the training course on sustainable development aimed at the referring teachers of civic education of 51 Brescia institutes. The observations collected in the group debates highlighted fundamental contextual data for setting educational interventions, in an overall situation that appears very heterogeneous. Culture of sustainability and solidarity citizenship constitute two possible interpretations of the legislative proposal, taken for the training of teachers. CIVES - CIttadini VErso la Sostenibilità. Esiti emblematici di una ricerca La L. n. 92/2019 ha introdotto dall’anno scolastico 2020-2021 l’insegnamento trasversale dell’educazione civica nelle scuole di ogni ordine e grado. In Colombia, in order to adopt an accusatory criminal procedure system, the 1991 Political Constitution was reformed with Legislative Act 03 of 2002. The regulation of this criminal procedural system was given through Law 906 of 2004, “By which the Code of Criminal Procedure is issued.” In development of these regulations, the following hearings were created: i) preliminary; ii) formulation of the accusation; iii) preparatory; and iv) judgment. In the first ones, the judge with the function of control of guarantees intervenes. Later, the judge of knowledge intervenes, who is in charge of directing the judgment and to indicate the sense of failure. Likewise, the Supreme Court of Justice has indicated that, in order to avoid that the formulation of the accusation is inadequate and that the judicial apparatus becomes unjustifiably congested, the judge of knowledge must carry out a material control to the accusation. This research analyzes if the intervention of the judge of knowledge in the hearings prior to the judgment: formulation of the accusation and preparatory, as well as the control that he carries out over the accusation, affects the guarantee of judicial impartiality and the accusatory principle. Abstract.STUDENTS WITH SPECIAL EDUCATION NEEDS: DETECTION AND WORK FOR THE EDUCATIONAL OPTIMIZATIONIt is understood by students with special educational needs, those who require support and specific educational attention due to disability or severe behavioral disorders for a period of schooling or along all their education. This work displays the educational response that the current education system provides for these students from an inclusive framework. There is evidence that there are still some barriers which prevent to care for these students effectively and efficiently. To address this problem we formulate several questions: Is a social issue in changing attitudes? Is it a legislative issue? Is it a training issue and / or an assumption of functions among professionals? Is it an organizational issue? Or is it a question of locating the “guilty one.“? We are convinced that it is a matter of “commitment” and a prerequisite to effectively provide relevant measures. The commitment of all levels and professionals who will be involved in the identification, assessment and intervention and working together, is essential for profitable efforts and give coherence to the work to be done . The requirements are different for each person and will largely be determined by the context. This is why it is necessary to rethink and address the current reality in several areas to reach education for optimizing existing resources. The areas include the conceptual and social development of “s.e.n.”, the legislative front, the organization in schools and training of the current teachers.Keywords: Special educational needs, inclusion, disability, optimization.Resumen.Se entiende por alumnado que presenta necesidades educativas especiales el que requiera, por un periodo de su escolarización o a lo largo de toda ella, determinados apoyos y atenciones educativas específicas derivadas de discapacidad o trastornos graves de conducta. Este trabajo estudia la respuesta educativa que prevé el actual sistema educativo para este alumnado, desde un marco inclusivo. Hay evidencias de que se mantienen barreras que obstaculizan la atención a este alumnado con eficacia y eficiencia. Para abordar esta problemática formulamos varias cuestiones: ¿Es una cuestión social en el cambio de actitudes? ¿Es una cuestión legislativa? ¿Es una cuestión formativa y/o de asunción de funciones entre profesionales? ¿Es una cuestión organizativa?... o es una cuestión de localizar “culpables”. Estamos convencidos que es una cuestión de “compromiso” y una condición indispensable para poder proporcionar medidas competentes con eficacia. El compromiso de todos los estamentos y profesionales que van a intervenir en la detección, evaluación e intervención y el trabajo conjunto es fundamental para rentabilizar esfuerzos y dar coherencia en el trabajo a realizar. Las necesidades son diferentes para cada persona y en gran medida van a estar determinadas por el contexto. Es por ello que para conseguir la optimización educativa de los recursos existentes, es necesario repensar y abordar la realidad actual en varios ámbitos: la evolución conceptual y social de las n.e.e., el ámbito legislativo, la organización en los centros educativos y la formación del profesorado actual.Palabras clave: Necesidades educativas especiales, inclusión, discapacidad, optimización.

<p>El artículo intenta demostrar que de conformidad con el proceso ejecutivo-legislativo, establecido en los artículos 15; 76, fracción I; 89, fracción X; y 133 de la Constitución federal, los actos administrativos internacionales forman parte de nuestro régimen jurídico interior.</p> <p>Es lógico que proceden de una Conferencia, Convención o Reunión internacional, elaborados por representantes plenipotenciarios —o no— de los países que la conforman; y por lo tanto, reúnen menos requisitos legales que los que entraña una Constitución federal o una ley en la que, en el derecho mexicano del proceso ejecutivo-legislativo de formación de leyes, intervienen los poderes legislativo, ejecutivo y judicial.</p> <p>La definición de <em>Tratado </em>debe revisarse en relación a la Convención de Viena sobre el Derecho de los Tratados entre Estados y Organizaciones Internacionales o entre Organizaciones Internacionales. Asimismo, se argumenta que estos actos administrativos por proceso de construcción son de menor jerarquía que la Constitución federal y las Leyes Generales, Federales, Orgánicas, Reglamentarias y Ordinarias. Los diputados federales deben intervenir en el proceso de aprobación de aquellos.</p>

Trias Politica yang dirumuskan Montesque dimaksudkan agar penumpukan kekuasdaan tidak terjadi antara legislatif, eksekutif dan yudikatif. Sqyangnya dalam penyelenggaraan pemerintahan demokrasi modern pemisahan ini tidak sepenuhnya diterapkan termasuk di Indonesia. Pada masa Orde Lama, khususnya masa demokrasi terpimpin, hubungan antara legislatif dan eksekiltif tidak berjalan seperti yang diharapkan. Badan legislatif hasil pemilu 1955 yang seharusnya memiliki kekuasaan tertinggi dalam pembuatan peraturan perundangan, justru diganti oleh eksekutif dengan lembaga "tukang stempel" yang terdiri dari para wakil kelompok fungsional dan regional. Pada masa Orde Baru; fenomena yang sama juga terjadi walaupun badan legislatif terbentuk berdasarkan kehendak rakyat melalui pemilihan umum, namun eksekutif lagi-lagi melakukan intervensi langsung. Para anggota dewan (legislatif) seringkali memilih berusaha mencari dukungan dari presiden (eksekutif) dari pada mewakili kepentingan rakyat.Intervensi eksekutif terhadap legislatif tersebut, mempunyai pengaruh terhadap produk-produk hukum yang dihasilkannya: hukum tentang pemilu, hukum tentang pemda, hukum tentang agraria, hukum tata negara, dan hukum administrasi negara. Produk-produk hukum yang dihasilkan legislatif ini mempunyai karakter konservatif atau ortodok. AbstractRousseau's interpreters often disagree over whether the Emile prepares its protagonist for membership in the Social Contract’s political community or presents him as an alternative to it. I argue that such attempts to determine the compatibility of Rousseau's different “projects” obscures his broader engagement with his contemporary popular audiences—particularly those associated with the theater and the novel—and the political implications therein. In contrast to the above debate, I turn to Emile to argue that in this work Rousseau attempts to shape readers in distinct and crucial ways. Emile does not simply present precepts to be embraced but intervenes into the underlying communicative dynamics that need to obtain for Rousseau's conception of collective self-legislation. It does so by shifting between the theatrical and novelistic generic conventions identified in his prior engagements with popular audiences, thus generating a reading experience that orients readers to continuously revisit their constitution as a collective audience.

Abstract This article examines the temporal politics of the 2017 California Gender Recognition Act (CGRA). The author first offers a brief history of the dominant temporal requirements for “gender recognition” in prior legislation around sex/gender markers on identity documents in the United States and United Kingdom, focusing on how this legislation places temporal boundaries around legitimate gender identity. Then, turning directly to the CGRA, the author asks to what extent the act's emphasis on self-identification revises or intervenes in these prior conceptualizations of time and identity by the state administration of sex/gender systems. The article closes with an exploration of the temporality of identity documentation itself, speculating about how this legislation might be placed more directly into conversation with the role of time in colonial and racial state building.

The article sheds light on provisions of Code of Civil Procedure from 1865 concerning parties in civil lawsuits. Beside plaintiff and defendant, position of third parties in litigation such as intervener, guardian of a minor or an adult deprived of legal capacity, as well as of legal representative (i.e. attorney) was also carefully scrutinized in this paper. As being fully aware of their significance, the author of the Code, minister of justice Rajko Lešjanin dedicated 33 paragraphs to parties in civil lawsuits. They had been very attentively drafted after thorough and detailed discussion between the author of the draft and the State Council's Commission. Legal capacity of litigants and their representation before courts of law is especially meticulously regulated. Aforementioned provisions (except for paragraph 65 that was somewhat revised in 1900) remained intact during the whole period that the Code was in force. Minister of justice Stojan Novaković, however, in his draft from 1872 proposed amendments and supplements to the two articles regarding the course of time during which intervener should be allowed to join ongoing litigation and ability of parties in lawsuit to appoint more than one legal representative but, since Novaković's document was never enacted, these articles were left unrevised.

En el presente trabajo se analizan las principales normas de la Ley N°20.529 (en adelante, Ley SAC), que regulan la figura del Administrador Provisional de establecimientos subvencionados o que reciban aportes del Estado. Sugiere que la limitada configuración legal del referido interventor deviene en la pérdida de su eficacia normativa y práctica, impactando negativamente en la gestión administrativa y política de los órganos administrativos del sector. En tal sentido, se plantea que la deficiente técnica legislativa empleada en el diseño de esta figura de Administración Provisional en materia escolar, produce que los actores del sistema escolar no comprendan adecuadamente su verdadera naturaleza y finalidad pública.

This paper aims to analyze the existence of political party intervention in legislative drafting on regulation No 1/1974 about marriage. Political party intervention is actually contrary to responsive legal theory that is applied in the formation of regulations in Indonesia. Political party intervention can change the legal content in the formulation of legislation because there are interests that are subjective. The implication, of course the resulting legal products will not solve problems in society that have been assessed as public issues. If examined from the perspective of public policy, Government intervention is likely to occur at the policy planning stage. This is due to the process, the party as an element of political power views the importance of the values ??of flow in order to be contained in the laws discussed. The result, the regulations that have been passed are far different from the proposed bills. One example is the Marriage regulation. Debate and rejection occur in the discussion of the article 2 (1) UUP 1974. The affiliation of Islamic parties considers marriage to be a matter of worship and religious values. On the other, Nationalist party affiliation refused because it did not reflect reception legal theory.

Allegato "Kyoto").Inoltre nella nuova programmazione dei fondi strutturali per il periodo 2014-2020 è presente una particolare attenzione alla tutela e alla valorizzazione dei beni ambientali, nonché alla promozione di interventi e azioni per favorire l'adattamento al cambiamento climatico, la prevenzione e la gestione dei rischi.
