Abstract:
Lo scritto si sofferma sull’emergenza globale che il diffondersi del virus ha causato, analizzando gli effetti che essa potrebbe avere sul sistema sanitario nazionale, a partire dall’insistito richiamo alla solidarietà sociale. In questa ottica, si è cercato di dimostrare come le peculiarità del caso concreto rendano necessaria una valutazione dell’effettivo contenuto delle prestazioni contrattuali tra paziente e struttura sanitaria differente rispetto ai tempi ordinari. Il giudice sembra essere il soggetto posto nelle condizioni migliori per poter apprezzare tali particolarità, senza che si debba procedere all’emanazione di norme emergenziali al fine di disciplinare le conseguenze della crisi sanitaria. Un intervento legislativo, invece, pare essere necessario qualora si faccia riferimento al principio di solidarietà sociale, non attuabile direttamente in via interpretativa.

L'articolo prende in esame il fenomeno del banditismo e della criminalitÀ rurale nel contesto dello Stato genovese tra Cinque e Settecento, valendosi principalmente della corrispondenza dei giusdicenti e delle lettere anonime inviate al Senato. A fronte di un intervento legislativo puntuale e reiterato, e dell'elaborazione di strategie punitive particolari, questa piaga sociale permane per tutto il corso dell'ancien régime. Gli esecutori di giustizia (bargelli, cavaleri, famigli ecc.) creano spesso piů problemi di quanto ne risolvano; gli esperimenti coi i "civili" (milizie scelte, compagnie contro banditi) non sortiscono gli effetti sperati; e l'apporto degli effettivi dell'esercito (nella fattispecie quelli provenienti dalla Corsica) tampona il problema ma non č mai risolutivo. I successi sono dunque sporadici, ma l'autore argomenta come lo Stato riesca nel complesso a mantenere il controllo del suo territorio scendendo a patti con patriziati e notabilati locali, e a porsi agli occhi dei sudditi attraverso i suoi corpi armati come un punto di riferimento pienamente legittimato.

Il saggio, dopo aver messo in evidenza come in Italia vi sia una vera e propria questione salariale legata alla diffusione del "lavoro povero" e al basso livello delle retribuzioni, analizza la Proposta di direttiva UE sul salario minimo, recentemente approvata dal Parlamento europeo e tuttora non definitiva. L'articolo esamina le finalità e le motivazioni della Proposta (diretta a garantire salari adeguati che consentano una vita dignitosa) e i delicati problemi giuridici connessi sia alla competenza della UE in materia salariale, sia alla disciplina in essa contenuta. Dopo aver sottolineato che la Proposta non impone una legge sul salario minimo nei paesi in cui la retribuzione è stabilita dai contratti collettivi (come l'Italia), il saggio valuta gli effetti che il recepimento della Direttiva in Italia potrebbe avere, anche in considerazione dei disegni di legge diretti da introdurre il salario minimo. Gli autori concludono la propria analisi sottolineando come sarebbe auspicabile un intervento legislativo che, in attuazione dell'art. 36 Cost., preveda retribuzioni minime corrispondenti a quelle previste dai contratti collettivi stipulati dai sindacati comparativamente più rappresentativi a livello nazionale.

Il saggio, nel ripercorrere il dibattito sulla rappresentanza sindacale nell'impiego privato, propone una disaggregazione dell'analisi, in relazione alla necessitŕ di calare i diversi modelli nei contesti nei quali si esprime il potere negoziale del sindacato. Nello specifico, per quanto riguarda la contrattazione collettiva nazionale di categoria, si aderisce alla tesi che ricostruisce la rappresentanza sindacale come rappresentanza associativa, mentre la rappresentanza sindacale nelle singole aziende si caratterizza come rappresentanza istituzionale (viene, in particolare, individuata la disciplina negoziale sulle rappresentanze sindacali unitarie che derivano il loro potere dalla consultazione elettorale di tutti i dipendenti occupati nell'azienda). L'analisi poi della rappresentativitŕ sindacale, con riguardo alla nozione di sindacato comparativamente piů rappresentativo, si confronta, per un verso, con l'art. 39 Cost. e si conclude, per altro verso, con l'osservazione che i contratti collettivi ai quali la legge connette effetti legali richiedono "l'unitŕ contrattuale" del sindacato. Si propone, infine, un intervento legislativo volto a generalizzare l'esperienza delle rappresentanze sindacali aziendali e a poggiare il richiamo alla maggiore rappresentativitŕ comparata su un meccanismo associativo ed elettorale insieme, in relazione alla devoluzione di funzioni demandate dalla legge.

Este artigo tem por objetivo analisar como o poder legislativo tem buscado, por meio de sua atividade legislativa, intervir na autonomia dos órgãos reguladores. Parte-se, neste artigo, da hipótese de que o poder legislativo, insatisfeito com o arranjo institucional vigente, age estrategicamente para afastar as agências reguladoras da ingerência do poder executivo. O artigo desenvolve um estudo qualitativo de leis e especialmente proposições legislativas de iniciativa parlamentar que buscam afetar diretamente a autonomia das agências reguladoras. As leis e proposições legislativas analisadas neste artigo foram divididas em categorias que representam diferentes formas de intervenção na autonomia das agências. Para responder ao problema proposto, o artigo subdivide-se em duas partes. Na primeira, apresenta-se uma breve revisão teórica sobre controle legislativo da administração pública. As estratégias de controle político que afetam diretamente aautonomia das agências reguladoras são analisadas em abstrato. Na segunda parte, analisa-se a produção legislativa do Congresso Nacional sobre autonomia regulatória. Pretende-se, com este estudo, qualificar o debate sobre autonomia das agências reguladoras no Brasil. Ver-se-á que a autonomia das agências reguladoras é um conceito em disputa, sensível às transformações nas relações entre poder legislativo, poder executivo e agências reguladoras.

Partindo da abordagem culturalista, o objetivo da pesquisa foi averiguar como os parlamentares da 54º legislatura do Legislativo Federal brasileiro se posicionaram acerca do papel do Estado no desenvolvimento geral da nação. Partindo da conjectura sobre a existência de uma indiferenciação ideológica entre elites políticas de diferentes partidos, propagada no senso comum, objetivou-se identificar como os parlamentares de legendas partidárias localizadas à esquerda e à direita do espectro ideológico se diferenciam em seus posicionamentos sobre estatismo. As análises apontam para a existência de correlação entre localização no espectro ideológico e posicionamento político acerca da concepção de Estado e seu papel. Blocos e partidos localizados mais à esquerda do espectro ideológico tendem a defender uma posição mais atuante do Estado, ao passo que blocos e partidos situados mais à direita tendem a defender um Estado menos interventor nestas questões.

En este artículo se describe la trayectoria legal que en España ha acompañado las acciones a favor de la igualdad de oportunidades entre mujeres y hombres en los centros educativos. En concreto sobre la formación inicial y continuada del profesorado para poder intervenir en las transformaciones que exige esa igualdad. Un recorrido de tres décadas de propuestas para sensibilizar y para revertir certezas heredadas. Se describe cómo la legislación española ha ido señalando los pasos necesarios para incluir este tipo de formación en los programas de formación inicial y continuada del profesorado y se ofrece también un acercamiento a publicaciones que reflejan la respuesta a esas normativas. Entre la amplia gama de indicadores considerados pertinentes a la hora de implementar programas de formación inicial y continuada del profesorado, ha adquirido una especial relevancia en las últimas décadas el que conocemos como perspectiva de género. Un indicador que requiere la incorporación al análisis de la realidad y a las propuestas de mejora, de una mirada crítica a lo que es fácil ya reconocer -en cuanto afecta al mundo de las mujeres y de los hombres-, como una construcción sociológica de la diferencia sexual (Cobo, 2005). Un bagaje de hábitos y de creencias acumuladas generación tras generación que impregna la cultura elaborada y la mentalidad operante en cada época y en cada sociedad. Los objetivos de este artículo son, en primer lugar, mostrar cómo la legislación española ha ido señalando los pasos necesarios para incluir este tipo de formación en los planes de formación inicial y continuada del profesorado; y también ofrecer un primer acercamiento a publicaciones que reflejan la acogida de esas normativas con algunas de las acciones que se han ido llevando a la práctica. Se ha utilizado una metodología de localización de las fuentes legales con contenidos relativos a la igualdad, y de revisión de fuentes bibliográficas que dan cuenta de estudios y de trabajos sobre la aplicación de las propuestas legislativas.

Dall'esame di questi sistemi, il saggio trae rilevanti spunti di riflessione per la definizione di un intervento promozionale che colleghi l'attribuzione di benefici e poteri legislativamente riconosciuti all'osservanza di taluni requisiti di trasparenza.

Abstract:
Insurance affects a substantial number of the Nigerian population who take out insurance cover for protection against fortuitous risks or as a form of financial investment and security. This has led to a growing insurance industry in Nigeria. Over the years, a number of common law principles developed in the English courts have been adopted and applied by courts in Nigeria in the settlement of disputes arising from insurance contracts. Certain aspects of these principles and insurance practice are in need of reform as they tend to defeat the expectation of insurance consumers. As such, the legal principles have undergone significant statutory reforms in different countries including Nigeria. It is against this background that the thesis examines some aspects of the common law principles as applied in Nigeria and the impact which indigenous enactments and recent statutory reforms have on them. The work, though not primarily intended as a comparative study, draws from the approach to insurance reform in other common law countries, and recommendations on further reform in Nigeria are made where appropriate. The thesis is mainly directed at the protection of the insured and potential insured, an aspect of what is often known as consumer protection in insurance contracts. Thus, it is those aspects of the law affecting the insured that are mainly examined. These include the formation and documentation of insurance contracts, the role of insurance intermediaries, and the law governing warranties, conditions, non-disclosure and misrepresentations in insurance. The work concludes with an examination of judicial control and governmental regulation of insurance.

The digitalization of the public administration is one of the main innovations that has marked the organization of administrative activity; has affected in particular the individual procedures by establishing significant changes in relations with the users of the various administrative services. Technology has therefore entered the daily life mechanisms of the public administration, the same theme of administrative simplification is inevitably linked to the digitization of the public administration. The analysis on the theme of Open Government Data shows how the transformations taking place are profoundly changing spaces and repertoires of public participation and of the relationship between public and private, between PA and citizens. The web increasingly represents a new connective fabric that brings together the different dimensions of public action (individual and collective, global and local, virtual and real), and that causes an empowerment process for citizens to develop. In recent years many scholars have placed the diffusion of big data technologies at the center of their research, that is, the massive collection of data and information from the most disparate sources. E-government can use big data to find out the trends and patterns of people's behavior on social networks so that the government can provide a better, effective and efficient service. Digitization then also becomes the main vehicle to comply with the transparency and disclosure obligations which all administrations must comply with. The objective of this contribution is to provide specific reading tools for the new public management school based on digitalization, on Open Government Data, on Big Data through a qualitative analysis that highlights the limits of this research linked to the cultural gap and the protection of the right to privacy.

The aim of this study was to evaluate the laws state intervention in family harvest, focusing on families headed by women, families formed by homosexual, male single parenthood, multiparental families and, finally, relations with family benefits. In the present scenario, the family has become an important means of state intervention for disclosure amounts considered valid to be perpetuated, since it is within the family that human beings have the first contacts with what is considered acceptable in a society. Thus, this thesis, first time, aims to discuss the ways in which a State may intervene in society, for it will be studied both liberal ideology, as the social and paternalistic positions. Thus, there will be an analysis of the appropriate way to conduct interference, the propitious moments and social situations which require protection. Bearing in mind that the intervention may seek to develop full citizens and conscious, respectful of diversity and opposite positions, provided there is respect for social differences, beliefs and genres, increasing levels of education, and then spread the values of citizenship. Subsequently, the work will focus on interference made in family groupings, will be a study of the forms of interference occurring, it is adequate and what would be the most effective means to assist families to develop and have their rights, their ways of life and individuality protected by the democratic rule of law.
O objetivo do presente estudo será avaliar as intervenções estatais legislativas na seara familiar, tendo como foco as famílias chefiadas por mulheres, as famílias formadas por homoafetivos, a monoparentalidade masculina, famílias pluriparentais e, por fim, as relações com benefícios familiares. Tendo em mente a instituição familiar é um importante meio de intervenção do Estado para incentivar valores considerados como válidos de serem perpetuados, uma vez que é no seio familiar que os seres humanos têm os primeiros contatos com o que é esperado para viver em sociedade. Sendo assim, a presente dissertação, em um primeiro momento, tem como objetivo discutir sobre as formas pelas quais um Estado poderá intervir na sociedade e, para isso, serão estudados tanto a ideologia liberal como os posicionamentos sociais. Nesse sentido, será feita uma análise do caminho adequado para realizar intervenções, os momentos propícios, bem como as situações sociais as quais necessitam de tutela, tendo em mente que devem almejar o desenvolvimento de cidadãos plenos e conscientes, respeitadores da diversidade e de posições contrárias, por meio do respeito às diferenças sociais, de crenças e gêneros, aumentando os índices de educação para, depois, difundir valores de cidadania. Posteriormente o trabalho focará na intervenção realizada em grupamentos familiares, investigando as formas pelas quais ocorrem, se surtem efeito e qual seria o meio mais efetivo para auxiliar famílias a se desenvolverem e terem seus direitos, seus modos de vida e individualidade protegidos pelo Estado Democrático de Direito.

This research addresses the normative role of the Brazilian Supreme Court regarding its intervention limits in the Legislative Branch. It highlights the treatment given to the Supreme Court since the first Brazilian Constitutional Bill, the Imperial Constitution of 1824, to the current Republican Bill of 1988, going through moments of authoritarianism and even suppression of constitutional rights. We investigate the thought of both major theorists on the jurisdictional quarrel over who is the guardian of the Constitution: the German scholar Carl Schmitt and the Austrian Hans Kelsen. We also present the Supreme Court as the guardian of the Constitution, considering, for such a claim, the opinion of the studied authors, of other thinkers, of the Brazilian ongoing constitutional text itself and of the Court s components themselves regarding the matter of the supremacy of the guardian our Bill of Rights. Worldwidely, nowadays, the trend shown in this research is that the Supreme or Constitutional Courts are the guardians of patriotic magnum texts and that this is not a way to authorize the judiciary to judge, once the Magna Carta itself authorizes the court to make its own interpretation and act as its guardian. Therefore, our conclusion is that the normative role of the Supreme Court does not interfere in the Legislative Branch. Keywords: Constitution. Constitution Guardian. Legislative Branch. A presente dissertação trata da atuação normativa do Supremo Tribunal Federal em face dos limites de intervenção no Poder Legislativo. Nela, destacamos o tratamento dado à Suprema Corte, desde a primeira Carta Constitucional brasileira, a Constituição Imperial de 1824, à atual Carta Republicana, de 1988, passando por momentos de autoritarismo e até de supressão de direitos constitucionais. Investigamos o pensamento dos dois maiores teóricos sobre a questão de competência sobre o guardião da Constituição: o alemão Carl Schmitt e o austríaco Hans Kelsen. Apresentamos, ainda, o Supremo Tribunal Federal como guardião da Constituição, considerando, para tal afirmação, a opinião dos autores citados, além de outros pensadores, do próprio texto constitucional vigente no Brasil e dos próprios componentes da Corte acerca do assunto da supremacia do guardião da nossa Carta de Direitos. Mundo afora, nos dias atuais, a tendência que apresentada neste trabalho é a de que o Supremo ou as Cortes Constitucionais são os guardiões dos textos magnos pátrios e que isso não é uma forma de autorizar o Judiciário a legislar, visto que o próprio texto magno autoriza a Corte a fazer sua interpretação e funcionar como seu guardião. E a nossa conclusão é a de que a atuação normativa do Supremo Tribunal Federal não interfere no Poder Legislativo. Palavras-chave: Constituição. Guardião da Constituição. Poder Legislativo. Abstract:
I tre capitoli in cui è suddiviso il lavoro cercano di offrire una ricognizione delle questioni che ruotano intorno alla sussistenza o meno di prerogative presidenziali riguardo l’attività legislativa, e in generale sulle eventuali trasformazioni avvenute, soprattutto negli ultimi anni, nel ruolo del Presidente della Repubblica all’interno del sistema costituzionale italiano. Il lavoro esordisce con una premessa metodologica con cui si tenta di valorizzare la questione relativa ai diversi approcci metodologici che si possono seguire nello studio delle tematiche presidenziali: ossia, tenere nettamente distinti il piano delle norme da quello delle prassi oppure analizzarli e valutarli congiuntamente. Il primo capitolo è dedicato all’analisi della figura presidenziale così come delineata dalla Costituzione e arricchita dagli oltre sessant’anni di letteratura costituzionale. Vengono quindi analizzate le disposizioni costituzionali di riferimento e viene dato conto delle principali teorie costituzionali espresse dalla letteratura giuridica. Il secondo capitolo è dedicato a quella che viene offerta come una delle possibili cause da cui traggono origine le evoluzioni registrate in questi ultimi anni dalla figura presidenziale: ossia, il mutamento del sistema costituzionale di rappresentanza politica. Tale elemento è analizzato soprattutto nel suo ambito istituzionale, vale a dire il modello di forma di governo rappresentato dal circuito parlamento-governo. Il terzo capitolo entra direttamente nelle due questioni di fondo della ricerca: da un lato lo studio della generale attività presidenziale di intervento nelle questioni politiche, attraverso comunicati o esternazioni; dall’altro lato l’analisi di alcuni specifici casi paradigmatici di intervento presidenziale in sede di emanazione o promulgazione (o, comunque, discussione) degli atti legislativi del governo e del parlamento, accaduti tra il 2006 e il 2013. Inoltre, il lavoro è arricchito da una importante sezione (allegata) di “case studies” contenente il risultato di una ricerca effettuata su oltre tremila documenti presidenziali, dal 2006 al 2013, resi pubblici dagli uffici del Quirinale.

Abstract:
L’elaborato intende delineare l’evoluzione del fenomeno di invecchiamento della popolazione e del basso tasso di natalità in Giappone, e le politiche che i governi giapponesi hanno adottato nel corso degli anni fino ad oggi e quelle che si prefiggono di adottare in futuro per contrastare il suddetto fenomeno. La popolazione giapponese sta invecchiando più rapidamente di quella di qualsiasi altro paese al mondo, e questo erode anche la forza lavoro in modo drastico. Il declino di popolazione attiva disponibile è il più marcato tra i paesi industrializzati. Di conseguenza la produttività e la crescita economica dell’intero paese sono destinati a calare sensibilmente nei prossimi decenni. Il forte squilibrio tra popolazione attiva e popolazione non attiva pone inoltre a serio rischio la sostenibilità dell’attuale sistema di welfare e pensionistico. Il primo capitolo delinea l’evoluzione demografica della popolazione giapponese ed il suo progressivo invecchiamento. Tenta di analizzare le cause del fenomeno trattando anche l’evoluzione della struttura della famiglia, del ruolo della donna, del mercato del lavoro, del sistema di welfare partendo dal secondo dopoguerra ai giorni nostri. Il secondo capitolo analizza le misure adottate dal legislatore per contrastare il fenomeno. Vengono esaminati i principali provvedimenti in materia fino al 2012, si pone attenzione al confronto tra l'azione dei governi LDP e quelli DPJ (2009-2012), comparandone le riforme adottate, mettendone in luce analogie e discontinuità. Sono presi in esame gli obbiettivi che i governi DPJ e LDP si sono posti ed i risultati effettivamente ottenuti. Il terzo capitolo si concentra sullo stato dell’arte della ricerca, evidenziando i risultati degli ultimi governi Abe e dell’Abenomics fino ad oggi, e le ricadute che il decremento della popolazione può avere sull'economia del paese. Vengono presentate alcune possibili soluzioni al problema dell’invecchiamento della popolazione e del basso tasso di natalità avanzate da commissioni di esperti e dal mondo dell’accademia: il ruolo dell’immigrazione, della tecnologia come volano per la produttività. Ma soprattutto proposte di cambiamento nella cultura lavorativa del paese e la creazione di un welfare a supporto dell’infanzia e degli anziani.

A presente proposta de Interven??o examina a quest?o do planejamento estrat?gico com foco em uma institui??o do Poder Legislativo no ?mbito da Gest?o P?blica Estadual. O principal objetivo deste trabalho consiste em propor um modelo de direcionamento estrat?gico capaz de envolver o aprimoramento dos procedimentos legislativos, atendendo os anseios da sociedade com garantias de perenidade nas a??es administrativas da Assembleia Legislativa do Rio Grande do Norte. Para tanto, utilizou-se de question?rios estruturados a fim de se realizar um diagn?stico interno e externo da situa??o atual e das perspectivas futuras do Parlamento Potiguar, utilizando-se para isso requisitos como imagem, desempenho, situa??o atual de seu planejamento estrat?gico e vis?o de futuro. Esses question?rios foram aplicados em tr?s categorias de p?blico: servidores, deputados estaduais e sociedade. A t?cnica utilizada para a an?lise dos question?rios foi a an?lise de conte?do cujos resultados, comparados entre si e com a an?lise do planejamento estrat?gico 2017-2018, contribu?ram para a elabora??o de um mapeamento de tend?ncias, o qual foi analisado com foco na elabora??o da proposta e foi submetido ? valida??o por meio de um Grupo Focal que executa o planejamento estrat?gico em vigor na ALRN. Da an?lise dos question?rios, concluiu-se que o gerenciamento por diretrizes ? necess?rio para que a cultura estrat?gica possa se perpetuar na Casa Legislativa, que hoje possui baixa intera??o com a sociedade, apresentando baixa efici?ncia, efic?cia e efetividade no desempenho das atividades final?sticas, que s?o os processos legislativos. Com isso, houve uma preocupa??o voltada para o aumento da credibilidade, com maior participa??o popular, trazendo elementos de ?tica, transpar?ncia e comunica??o que devem estar alinhados com um direcionamento estrat?gico adequado. Pretende-se com a cria??o desta proposta contribuir para a melhoria da gest?o legislativa com foco nos conceitos da Nova Gest?o P?blica e com a inser??o de elementos de accountability, visando evoluir o Poder Legislativo no Estado do Rio Grande do Norte e garantir a melhoria de qualidade das pol?ticas p?blicas e da qualidade da Lei. The present proposal for intervention examines the issue of strategic planning focusing on an institution of the Legislative Branch within on a State Public Administration. The main objective of this paper is to propose a model of strategic orientation capable of involving the improvement of the legislative procedures, meeting the society's longings with guarantees of continuity in the administrative actions of the Legislative Assembly of Rio Grande do Norte. Therefore, structured questionnaires were used in order to make an internal and external diagnosis of the current situation and future perspectives of the Rio Grande do Norte Parliament, using for such requirements such as image, performance, current situation of its strategic planning and vision of future. These questionnaires were used for three categories: public server, parliamentarians and society. The technique used to analysis the questionnaires was the content analysis whose results, compared to each other and to the analysis of the 2017-2018 strategic planning, contributed to the development of a trend mapping, which was analyzed with a focus on the elaboration of the proposal which was submitted to validation through a Focal Group that executes the strategic planning in force in the ALRN. From the analysis of the quiz, it was concluded that management by guidelines is necessary so that the strategic culture can be perpetuated in the Rio Grande do Norte Legislative Assembly, which today has low interaction with society, presenting low efficiency, effectiveness and effectiveness in the performance of the finalistic activities, which are legislative processes. In this way, there was a concern focused on increasing credibility, with greater popular participation, bringing elements of ethics, transparency and communication that should be aligned with an appropriate strategic direction. The aim of this proposal is to contribute to the improvement of legislative management focused on the concepts of New Public Management and the insertion of elements of accountability, aiming to evolve the Legislative Branch in the State of Rio Grande do Norte and ensuring improvement quality of public policies and the quality of the Law. Whereas for the case the measurement of the results can only be performed in case of effective implementation by the Board of Directors of the ALRN, the present research constitutes a proposal of intervention.

Abstract:
This thesis presents human flourishment as the theoretical foundation from which to pursue social policy in the post-colony. Accepting this theoretical foundation, the purpose of this thesis is to reflect on the role and potential of small, micro and medium enterprises (SMMEs) in South Africa. Further, this thesis will consider in what manner the law can support the realisation of the potential of South African SMMEs. The main value of this thesis is to illustrate the positive distributional impact that a human flourishment approach to legal intervention can have for a property system, which has the objective of supporting the realisation of the capabilities of persons in society. This value is illustrated in this thesis by analysing the relationship between the South African SMME and retail banking sectors. This thesis has chosen to focus on the SMME sector because of the role identified for SMMEs in South Africa's growth strategy, the National Development Plan (NDP). This role includes recognising SMMEs as being an entry point for previously excluded persons into the mainstream economy. A recent report by the Small Enterprise Development Agency (SEDA) highlights that the potential of SMMEs in South Africa remain unrealised. The report identifies key barriers to SMME flourishment in South Africa. This thesis focuses on the following identified barriers in the report: (i) the existing legal framework with respect to SMMEs; (ii) existing government agency support available to SMMEs; and (iii) the ability of SMMEs to access finance and credit. A primary finding in this thesis is existing credit structures in the retail banking sector are negatively biased towards the black population group. This has an adverse impact on black entrepreneurs. It is suggested in this thesis that this negative bias is a consequence of apartheid. Apartheid had the effect of regulating the access that black people had to the mainstream economy and their ability to acquire and accumulate property. Recognising that SMMEs have an identified role to play in South Africa's growth strategy, this thesis finds that legislative intervention in the retail banking sector is needed in order to overcome this negative bias and to support increased SMME access to finance and credit. This thesis interprets the preamble to the Constitution, as well as the concept of transformative constitutionalism, as mandating a capabilities-approach to human development. It is for this reason that a property system with a distributional outcome that supports the realisation of the capabilities of persons in society is preferred by this thesis. It is only once there is a real commitment of moving the majority of South Africans into the mainstream economy will inroads to tackling inequality and poverty be made.

This paper deals with the issue of dismissals, focusing both on the control techniques regarding the power to dismiss, as well as on forms of workers’ protection. It reconstructs the evolution of the more recent legislative reforms, examining how they have balanced the founding values of the Italian legal system. In this context, sentence n. 194/2018 of the Consitutional Court takes on fundamental importance. It provides essential systematic principles and guidelines, which both the Legislator and judges can refer to, even when there are complex problems of interpretation and unconstitutional aspects. Consequently, once again, the Legislator may need to intervene.

AbstractThe urban mobility landscape for both, freight and passengers, is in transition. During the last decade new business models, enabled by digital technologies, are blooming. However, sometimes the new mobility solutions do not fit with local regulations, their impacts are unclear, and legislative issues are hindering the economic niche exploitation and their implementation. This chapter describes the current transition that urban mobility systems are undergoing and presents an approach for guiding cities towards the implementation and adoption of new digital urban mobility solutions. This approach, based on the Horizon 2020 SPROUT project, consists of assessing the impacts and feasibility of the new mobility solutions, identifying areas where policy intervention to enable the implementation would be required and co-creating those specific policies with all the urban mobility stakeholders. This is complemented by an implementation feasibility and user acceptance analysis.

AbstractThis chapter assesses the viability of benefit corporations within jurisdictions that have not enacted regulations on the issue. In Roman-Latin systems, including Spain, profit is considered to be the cause of the contract from which a company arises. As a result, profit shall be the only purpose of a company. Throughout the 20th century, the academic discussion fostered the view that such a restrictive approach to profit should be abandoned in favour of a more flexible notion of company. Accordingly, these may pursue a wider range of lawful purposes, including ideal or non-profitable goals. Such a flexible approach is supported by most of the legal scholarship although courts maintain a more restrictive view. This chapter reviews the academic debate and sustains the view that benefit corporations may be formed without prior legislative intervention even in jurisdictions that have traditionally applied a for-profit requirement.

Abstract:
Despite legislative advancements, domestic violence is still today a crime considered as "minor" by many, or often the actions that materialise it are not even recognised. The first steps in Portuguese legislation were taken by the Penal Code approved in 1982, which typified the crime of ill-treatment between spouses, and by the Law n. º 61/91 of 13th of August, which guaranteed “adequate protection to women victims of violence”. However, only in 2007, was the crime of Domestic Violence created, which shows, from 1982 until then, a long path of hesitations and slow social evolution concerning the consciousness of this crime’s seriousness. Until 2007, the crime of spousal abuse was integrated in a broader criminal arrangement, characterised by the abuse of persons. In 2009, with the typification of the crime of Domestic Violence and with the publication of the legal regime applicable to the prevention, protection, and assistance of victims, denominated as Law of Domestic Violence, a more consolidated phase was inaugurated, in both legal treatment and social intervention. Despite these evolutions, Portugal continues to witness an attitude of "social and collective consent" to some forms of Domestic Violence, oftentimes disguised in the acceptance and normalisation of gender inequalities. We have seen news stories where judgements are presented, within the scope of Domestic Violence cases, where discriminatory ideas against women and excuses for the crime of Domestic Violence are manifested. This is proof that some of the representatives of justice (the judges) do not accept what has already been legally approved in the Portuguese legal system. Similarly, recent studies on the population’s perception of domestic and gender-based violence show the abiding ideas and understandings of acceptance and normalisation of domestic and gender-based violence in Portuguese society. We intend to present the evolution of the typification of the crime of domestic violence in Portugal. Then, we intend to understand how this phenomenon has been perceived in Portuguese society. Therefore, we will be able to understand the continuities and ruptures between the legislative body and the social body in what concerns Domestic Violence and Violence against Women in Portugal.

Healthcare interventions are concern of government policies, health service providers, civil society organizations and public. These interventions are mainly criticized with respect to their cost effectiveness. However, economic, social and health benefits of drug addiction rehabilitation services are not well understood and they remain relatively subsidized in comparison to other aspects of healthcare interventions. But, notwithstanding this, drug addiction rehabilitation services are generally financed with public funds in Turkey as like many other countries and this situation become subject to questioning when fiscal policies and cost effectiveness of these services are considered. Based on this circumstances there is a great need for scientifically sound and practical financial and economic evaluation of substance abuse treatment services. In Turkey, recent legislative developments on substance abuse treatment services provide a baseline for structural evaluation of financial and economic feasibility of these services. In spite of ongoing methodological and empirical developments in economic evaluation of the primary health services, similar studies regarding addiction treatments are very rare in the literature. Correspondingly, methodological guidelines in this area are also very limited. This study addresses these gaps by presenting a financial and economic evaluation of drug addiction rehabilitation services in Turkey considering urgent need of intervention in this area. Evaluation of these services is based on the basic requirements of a drug addiction rehabilitation center, which is determined by the related legislation in Turkey, and the evaluation was conducted according to the methodological principles presented by EMCDDA, European Monitoring Centre for Drugs and Drug Addictions.

"The administration performs a great task in the life of modern societies, through its intervention to satisfy public needs through the establishment and management of public utilities that aim to achieve the public interest and respond to the requirements and necessities of daily life, as well as protecting public order, and regulating the relationship between them and individuals with constitutional and legal texts, as well as The organizational rules that lay down the general framework for public liberties and individual rights, all to prevent them from practicing any activity outside the framework of legality. Originally, the administration is not obligated to issue its decisions in a specific form, as it is free to choose the external form of these decisions, unless the law requires it otherwise. This requires that the decision be embodied in an external form in order for individuals to know the will of the administration and to adjust their behavior according to its requirements. However, the implementation of this rule on its launch, may negatively affect the rights of individuals, because the administration may sometimes deliberately remain silent about deciding the requests submitted to it, or it may neglect at other times to respond to these requests. Accordingly, the request submitted to any party starts from the legal period available to the administration to meet the requests of individuals and in its absence the implicit administrative decision of rejection or acceptance arises. Accordingly, we will study the jurisprudence of the French, Lebanese, Egyptian and Iraqi judiciary in this study. The importance of the study lies in the implications of the subject of requests submitted to the administration, the delay in their completion, the silence of the administration, and the consequent effects and exposure to the rights of individuals. And that it will show how to confront this silence, neglect and intransigence of the administration. The idea of ​​implicit administrative decisions, resulting from the administration’s silence on the requests submitted to it, is an effective means, which makes the administration more positive and enables individuals to confront the administration’s silence, and prevents its intransigence, arbitrariness or neglect. The problem of the research is that can silence be an expression of the will? How do individuals protect themselves from the actions of the administration, and who guarantees its non-bias, arbitrariness and deviation? Does submitting the application to a non-competent body protect the rights of individuals? ? And the extent of judicial oversight on the authority of the administration.? And the extent of the compatibility and divergence of the positions of the administrative judiciary in France, Lebanon, Egypt and Iraq regarding this.? From the above in explaining the importance of the study and its problem, we can deduce the scope of the study, which is the study of judicial control over the requests submitted to the administration by taking an overview of the nature of the requests, their types and distinguishing them from others, and the position of each of the legislation, the judiciary and jurisprudence from it. BackgroundThe sustainable retention of workers after a work-related injury poses particular challenges for small and medium-sized enterprises (SMEs). Although studies on SMEs have multiplied over the past 30 years and some of them have led to the emergence of new concepts and theories in occupational health and safety (OHS), little is known about what can be done in SMEs to improve the OHS management of absences caused by work-related injuries. The objective of this presentation will be to overview strategical elements (resources, structures, activities) that could also benefit to the sustainable return-to work (SRTW).MethodA scoping review (Levac et al. 2010) on OHS management in SMEs was conducted in a reflective, iterative and collaborative manner. The methodological approach includes searching for relevant publications from the 2000 year in scientific (e.g., SCOPUS, ProQuest) and non-scientific (e.g., NHSE, NIOSH) databases, combining several key concepts related to OHS management and SRTW. Criteria for the selection of the studies were: 1) focus on OHS management, generally (review), or empirically (workplace intervention study); 2) focus on SMEs globally or in a specific context (size of enterprise, sectors of activities). Two reviewers using an iterative consensus-based approach performed article selection, extraction of data, and analyses.ResultsThree groups of strategic elements are beneficial for OHS management in SME: diffusion of information, support to implement integrative adapted systems of management and training programs, and especially designed for SME or intermediaries.Diffusion of information about legislation for SMEs, and guidelines for compliance with regulations, provide SME motivation and resources to intervene on the proper factors on SRTW. External support to OSH interventions, provided by control authorities, associations and networks of companies, and external consultants allow sharing knowledge and OSH-related resources, promoting best practices in SME. The availability of knowledge of effective OSH interventions could also help to replication or adaptation in particular contexts of SME, helping the achievement of proper conditions for SRTW. This kind of collaborative support to SME, combined with the continual engagement of employers and communication between management and employees and among employees, play an essential role in all phases of preventive or corrective interventions. Finally, training programs specially designed for SMEs foster interventions by increasing the awareness and the knowledge of the personnel, who are more motivated to intervene or correctly behave. DiscussionOverall, the strategies, resources, structures and activities in the SME, seem to be specific to the legislation in place and the different levels of actions. Even if generally they do not explicitly have an aim to promote sustainable retention of workers after a work-related injury, they present some opportunities to do so, modalities being different depending on the size of enterprise, and the level of risk of work activities in the sector. The results of this scoping review provide input for methodological and conceptual thinking for future policies or programs, as well as some information about integration of SRTW to OHS approaches and intervention modalities.

The DCFR is one of the most important achievements of the modern academic thought in the area of private law. This document serves as a benchmark for assessing the quality of national legislation and offers model solutions for modernisation of national legislation. In this article, the author argues that the DCFR could be useful to show: 1) that the Latvian Civil Law cannot be understood to include a closed catalogue of contractual mistakes that lead to invalidity of contracts; and 2) that the person that intervenes into the affairs of another, in certain cases, must be able to claim reparation of damages from the principal. The Latvian Civil Law does not expressly provide for such a claim, but the DCFR should serve both as an argument to recognize its existence and as guidance on the prerequisites for that claim.

The numerous reconstruction experiences after the great earthquakes occurred in Italy during the last fifty years (Sicily, 1968 – central Italy, 2016) have given way to a great improvement of the Italian post-seismic emergency management and differ from each other by their results in terms of degree of conservation of the pre-existent buildings. Through the summary analysis of the legislation adopted for the reconstruction process after the Belice (1968) and Friuli (1976) earthquakes, this contribution aims at investigating the peculiarities of the different intervention strategies adopted for the conservation of the traditional masonry buildings and the historical built landscape – to which they belong – recognised as the essential component of the Italian cultural heritage. Specifically, the 1968 and 1976 earthquakes provided an opportunity to enhance the cultural debate on the approach to the towns destroyed by seismic events and initiated an ongoing process which progressively moved towards an increasing recognition of the vernacular architecture’s value.

In the activities of suppression of counterfeit medical products, the interests and interventions of various branches of private and public law, intellectual property law, medical law of the public health protection and criminal law, overlap. Considering that actions of suppression of counterfeit medicines are often reduced to protection of commercial interests and court procedure of determining the right to compensation, and less to protection of public health interests and procedure of criminal intervention, the paper discusses the legitimacy of criminal law measures in suppression of counterfeiting of medical products. The aim of the paper is to point to the role and mechanisms of criminal law in the global system of suppression of medical products counterfeiting, bearing in mind that last year the Republic of Serbia signed the CoE Convention on the counterfeiting of medical products and similar crimes involving threats to public health (MediCrime Convention). After analyzing the scope and consequences of counterfeiting of medical products and problems in suppression of this phenomenon, it is concluded that the legitimacy of criminal law intervention justifies the evident "pandemic" expansion of the market of counterfeit medicines and the almost complete lack of incrimination of counterfeiting of medicines in national legislation. The paper presents the system of criminal law measures established by the Convention and analyzes the relationship of substandard, unregistered and generic medicines in relation to the category of counterfeit medicines defined by the Convention.

The Caribbean region in Colombia has large land areas and low connectivity between urban centers, the study proposed a methodology of analysis of 10 major cities to validate a regional project called “Diamante Caribe-Santanderes”. The methodology was structured from 4 hubs and 11 indicators of urban analysis that was applied to each of the urban centers. From the mapping results of an image analysis of the various aspects of urban reality was obtained. This study was able to identify trends and potential of the territory and is accomplished propose a new political and administrative structure that integrates large unconnected areas. It also qualifies intervention projects in different scales for each local center, inter between municipal centers, and finally large territorial unions to consolidate a regional identity. The most important of the study is to propose within the categories of analysis systematic search of polyvalent interactions develop joint responses to the needs of communities at the same time elements of conservation measures and restoration of ecosystem dynamics of the environment. Finally, the study shows that under current legislation it is possible to create this new territorial entity, with cultural identity and articulated planning parameters under new regional organization of urban centers.

Initially, the scope of the councilors has been identified as a reduced one compared to psychotherapy, then the purpose of the two activities to dissociate from a theoretical point of view. Between the two terms there is a significant difference: counseling is a proactive action, while psychotherapy is a postfactum intervention (remedial action, the therapy). Guidance and counselling means all actions performed by optional advisory and training methods, the general and special conditions, subordinated to, from the point of view of the Content, Size of process-orientated technology/education, and from the perspective of the activity of psycho-pedagogical assistance methodological and social teachers, students and parents, designed at the level of the education system, with a view to the correct academic and career options. Guidance and counselling means all actions performed by optional advisory and training methods, the general and special conditions, subordinated to, from the point of view of the content, size of process-orientated technology/education, and from the perspective of the activity of assistance psycho-pedagogical methodological and social teachers, students and parents, designed at the level of the education system, with a view to the correct academic and career options. In Romania, there is still a well-defined ethical framework at the legislative level, Advisor profession ‘borrowing’ a number of ethical rules from psychologists, sociologists, pedagogues. We expect that in the not too distant future, together with the adjustment of the legal framework concerning the advice, to be completed and such professional code, as a sign that the profession has moved beyond the Advisor to the time of interim and won a tight space defined in the professional Romanian.

During 2014–2015, a team of researchers conducted a series of primary and secondary studies on land record modernisation initiatives across Haryana, Himachal Pradesh, Bihar and Gujarat, which were published as part of a five-volume set on Land Records Modernisation in India. The second edition of these volumes incorporates new initiatives, technological updates and legislative amendments in each of these states, as well as the changes in the national level policy and programmes. Based on extensive on-ground research, this set of volumes presents a review of the land records management processes and the status of current efforts to modernise land records, against a larger historical background of land and revenue relations in each state. The volumes on the respective states are accompanied by an institutional, legal and policy review at the national level, which provides a summary of various crucial aspects of land records modernisation in India. It also appraises the impact of the Digital India Land Records Modernization Programme, its gains and limitations, as well as possible steps forward. Combining detailed state-level analysis with a national review, this is a much needed intervention in the study of land records administration and modernisation in India. This set of volumes would be a vital resource for researchers and practitioners alike, as well as for policymakers at both the state and central level.
