Abstract:
Deciding whether a contract of sale is an international transaction or not and according to which criteria is an inescapable task, not only for private international law (PIL) but also for the instruments aiming to create uniform substantive contract law. The paper reviews the different solutions from the 1930s to the development of the last decades, from the first drafts of the International Institute for the Unification of Private Law (‘UNIDROIT’) on international sales to the Draft Common European Sales Law. Of course, the Vienna Sales Convention (‘CISG’), as a successful international instrument, is also given special emphasis in this comparative and historical analysis. Although during the past century of unification, the definition of international character became clearer and simpler, much however depends on how broadly or narrowly legislators wish to define the scope of the uniform substantive law to facilitate the acceptance and ratification of an international convention. A further specific question is whether uniform law should apply to all international sales (universal application) or only to international transactions linked to Contracting States.

“The bearer was convicted of a sex offense against a minor, and is a covered sex offender pursuant to 22 United States Code Section 212b(c)(l).” International Megan’s Law (IML), passed in 2016, prohibits the State Department from issuing passports to individuals convicted of a sex offense against a minor unless those passports are branded with this phrase. The federal government's decision to brand its citizens’ passports with this stigmatizing message is novel and jarring, but the sole federal district court to consider a constitutional challenge to the passport identifier dismissed the plaintiffs’ First Amendment claim, deeming the provision government speech. This Note argues that this passport identifier is more appropriately analyzed as a form of compelled speech, triggering strict scrutiny review that the IML’s passport identifier would not survive.

Abstract:
Abstract: Uniform secured transaction law conventions are critical instruments in efforts to reduce the cost of credit and increase cross-border investment and trade. They present neutral sets of rules. Their provisions need to be construed autonomously, considering their neutral and international character and the need to establish predictability, transactional certainty, and good faith. This article examines the interpretation philosophy of three significant uniform secured transaction law conventions, namely the United Nations Convention on the Assignment of Receivables in International Trade, UNIDROIT Convention on International Factoring, and UNIDROIT Convention on International Interests in Mobile Equipment.

International tribunals and legal scholars have been considering the relationship between International Humanitarian Law (‘IHL’) and International Human Rights Law (‘IHRL’) for a number of years.1 The International Court of Justice famously or infamously (depending on your perspective) considered their relationship in its Nuclear Weapons Advisory Opinion in 1996.2 The Court concluded that while IHRL did apply in times of armed conflict, when it came to the prohibition of arbitrarily taking human life in Article 6 of the International Covenant on Civil and Political Rights 1966, the content of that prohibition had to be found in the lex specialis of IHL.

Abstract:
The eight Governors of the Great Lakes States signed a proposed new compact for the Great Lakes and St. Lawrence basin on December 13, 2005, and they joined with the Premiers of Ontario and Québec in a parallel agreement on the same topic on the same day. Neither document is legally binding-the proposed new compact because it has not yet been ratified by any State nor consented to by Congress; the parallel agreement because it is not intended to be legally binding. Both documents are designed to preclude the export of water from the Great Lakes-St. Lawrence basin apart from certain limited exceptions. The documents do little to promote rational resource management apart from limiting exports. There is debate over whether the two documents are adequate to achieve their announced goals and over whether the goals are the right ones. The lessons found in the well developed body of customary international law applicable to water resources, most recently summarized in the Berlin Rules on Water Resources, have largely been ignored. Comparison of the two documents with the Berlin Rules suggests that the documents will not provide satisfactory solutions to the challenges of managing the Great Lakes, even in the near future, given the broad ecological concerns that are not addressed in the two documents.

Roberts, Anthea Elizabeth. "Is International Law International?" Phd thesis, Canberra, ACT : The Australian National University, 2017. http://hdl.handle.net/1885/124611.

Full text
Abstract:
International lawyers are familiar with the question: “Is international law law?” But this thesis instead asks the question: “Is international law international?” Using a variety of methods, this work sheds light on some of the ways in which international law as a transnational legal field is constructed by international law academics, and is conceptualized in international law textbooks, in the five permanent members of the Security Council: the People’s Republic of China, the French Republic, the Russian Federation, the United Kingdom of Great Britain and Northern Ireland, and the United States of America. It explores how different national communities of international lawyers construct and pass on their understandings of “international law” in ways that belie the field’s claim to universality, perpetuating certain forms of difference and dominance. By adopting a comparative approach, it aims to make international lawyers more aware of the frames that shape their own understandings of and approaches to the field, as well as how these might be similar to or different from the frames adopted by those coming from other states, regions or geopolitical groupings. It also examines how some of these patterns might be disrupted as a result of shifts in geopolitical power, such as the movement from unipolar power toward greater multipolarity and the growing confrontations between Western liberal democratic states (like the United States, the United Kingdom, and France) and non-Western authoritarian states (like China and Russia).

Full text
Abstract:
This thesis critically examines the origins and development of international criminal lave to identify the defining features of this emerging legal tradition. It critically evaluates the experimental approach taken in Article 21 of the Rome Statute of the International Criminal Court, which attempts to codify an untested normative super-structure to guide this legal tradition.
International criminal law is a hybrid tradition which seeks legitimacy and answers to difficult questions by drawing on other established legal traditions. Its development at the confluence of public international law, international humanitarian law, international human rights law and national criminal laws has resulted in gaps in difficult cases with no clear answers. These lacunae have been filled by recourse to judicial discretion, exercised consistent with Patrick Glenn's theory of transnational common laws, and by privileging one of the competing aims of international criminal law: enhancing humanitarian protection versus maximizing fairness to the accused.

Abstract:
This dissertation attempts to provide a theoretical framework for explaining the choices made by international decisions-makers as to what constitutes law. It is proposed that the practice of international human rights courts recognises that different normative instruments coexist in an un-ordered space, and that meaning can be produced by the free interaction of those instruments around a problem. Based on such practice, the author advances his normative plurality hypothesis, which states that decision-makers must survey the acquis of international law in order to identify all the instruments containing relevant normative information for a particular situation. The set of rules of law applicable to the situation must then be complemented with other instruments containing specific normative information relevant to the situation, resulting in a complete system of norms advancing a common purpose.

Abstract:
The incidents of human rights violations have increasingly captured the international attention. I think that part of the reasons for human rights violations is because of the foundational theories of the current international law. In this thesis project, I argue that basic human rights should be the moral foundation of the international law. I achieved my goal in several steps. In the first section, I introduced the thesis project; I also outline my objectives. In the second section, I briefly define human rights, basic human rights, and provided the scope of basic human rights. In the third section, I provided my argument that basic human rights should be the moral foundations of the international law; provide criterion of state legitimacy; I critiqued the United Nations in the context of my arguments. Finally, I concluded by formulating the international basic human rights law.

Abstract:
Traditionally, public international law and private international law were perceived as two different categories of law; the former governing the international relations between states and the latter those between private individuals. Their relation is based upon an evolutionary development from private to public, and from municipal to international, law. In the modern world, this evolution has culminated in a dynamism reflected in numerous interactions between a wide range of different actors. As a result, the former boundaries between the public and private law, as well as the international and municipal law dichotomy, have become blurred. In an emerging global society, these four major categories have entered a dynamic dialogue that equally challenges both legal theory and practice. This dialogue is centred around a functioning global legal framework, in which public international law and private international law can---due to their distinct scopes of application---answer many unanswered questions, providing that they speak with one voice.

Full text
Abstract:
The thesis deals with problems of conflict of laws and its latest developments, especially in Europe, in relation to international air transport. (1) The contractual situations connected with air transport are analysed in light of the applicable international air law conventions and of a comparative survey of the conflict of laws rules of some states and international conventions on conflict of laws concerning contracts. Where the international air law conventions do not supply the solution or where they are not applicable resort has to be made to the conflict of laws. (2) Conflict of laws also arises in the legal interaction (contracts, sale of goods, transfer of ownership--res in transitu, torts, marriages, wills, etc.) between persons onboard an aircraft in flight. (3) The aircraft as an expensive and highly mobile chattel poses problems from the rights in rem point of view in the conflict of laws. (4) Aircraft accidents and the tortious liability of persons and entities involved as well as obligations arising from assistance and rescue operations pose conflict of laws problems.

Abstract:
There are several reasons why it is necessary to return again and again and critically evaluate the problems of criminal legal protection of diplomatic representatives in national and international criminal law. The same applies to the incrimination of endangering an internationally protected person, which has existed in the legislation of the Republic of Serbia since 1990. The essential international legal framework of that incrimination is contained in the UN Convention on the Prevention and Punishment of Crimes against. Internationally Pro- tected Persons, including Diplomatic Agents from 1973. The criminal offense of endangering an internationally protected person was omitted from our legislation in the period from 2005 to 2012, and in the mean- time its name and legal description have been changed several times. Despite this, the level of criminal protection of diplomatic representa- tives in Serbia has always been high and harmonized with the appro- priate norms of both customary and written international law.

Abstract:
A question of great legal importance, both in national and international legislation, is how and in what way interpersonal relations were regulated within ancient and primitive human com- munities before the emergence of modern law and legal regulations. There has always been a need to regulate interpersonal relations and to set certain rules that would have a binding character in relation to community members. For this purpose, customs played a role, cre- ated under the great influence of morality and tradition, religion and religious dogmas, certain superstitious and primitive principles and principles, but with one clear goal, namely the protection of order and the creation of rules of conduct. The paper deals with the issue of the existence of international customs, their relationship with international public and international private law, as well as international criminal law. Also, the question of the relationship of international customs in the context of the source of international law, as well as the influence of customary law on the modern international legal order, is raised.

Abstract:
Depending on the justification of the domination promulgates Law principles which is related with the multi-areas of the social life and assures implementation of Law rules due to its judicial power. However, nowadays implementation of State’s Law principles has been gradually damaged. In fact, not only markets transformed into the world bazaar with the globalization but also the participants of the markets acts global. As a result of the findings of the economic facts, one State’s cross-border trade and beside the national law which regulates the economic actions, normative arrangements increase which adjust identical subjects and receive the sources from different fields and in order for the operation of the current adjustment they create novice establishments with the view point of showing action in different types of areas. As a parallel of these improvements “international economy law” which arranges the international economical actions in the western countries and examines the law principles as a whole which is usually founded dispersedly is developed. Cross border economical actions constitute the subject of a lots of diversified law arrangement. While some of them are the characters of public law and private law, the others originate from international law. Fractionally, nonbinding rules are also inclusive here. At this point the whole law regulations which are about the international rules, determines the scope of international law relations. So in this research, in accordance with the globalization, our purpose is to examine the source and term of the international economy law.

Abstract:
My contribution deals with the issue concerning the question arising on the applicable law in and after the transition period set in the Agreement on the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community. The aim of this contribution is to analyze how the English and European laws simultaneously influence one another. This analyzation will lead to the prognosis of the impact Brexit will have on the applicable English law before English courts and the courts of the states of the European Union. The main key question is the role of lex fori in English law. Will English law tend to return to common law rules post-Brexit, and prefer the lex fori?

Raju, Nivedita, and Laura Bruun. Integrating Gender Perspectives into International Humanitarian Law. Stockholm International Peace Research Institute, August 2023. http://dx.doi.org/10.55163/qilu7567.

Abstract:
International humanitarian law (IHL) aims to limit the impacts of armed conflict through rules and protections. However, while IHL seemingly accords protection to ‘all persons’, it may fail to do so, especially on the basis of gender. In turn, failure to include gender perspectives in IHL can result in inaccurate assessments of civilian harm. This paper explores the missing gender perspectives in IHL and proposes that they be integrated with intersectional considerations. The paper first examines inherent gender bias in the wording of certain IHL rules, highlighting several issues including gender essentialism, limited distinction between sex and gender, and the need to overcome a binary approach to gender to ensure adequate protections for the LGBTQIA+ community. The paper also examines key rules of IHL which are particularly sensitive to bias in interpretation and application, including certain rules on weapons, the rules guiding the conduct of hostilities, and obligations to provide legal advice and legal training to the armed forces. Finally, the paper concludes with action points to more effectively integrate intersectional gender perspectives into IHL.
