Транснаціоналізація сучасної світової економіки стала визначальним фактором її функціонування. Міжнародний бізнес в умовах інтернаціоналізації розвивається під впливом конкуренції на глобальних ринках, тому дослідження питання типологізації ТНК, їх ефективної діяльності, вплив на соціально-економічну орієнтацію держав, зміну у функціонуванні господарських механізмів приймаючих країн є вкрай актуальними. У статті розглянуто роль ТНК в економічній діяльності міжнародного рівня. На сучасному етапі глобалізації світової економіки визначну роль відіграють транснаціональні корпорації. ТНК виступають головним суб’єктом світогосподарських відносин і формою, що втілює в собі всі види сучасного міжнародного бізнесу.

Abstract:
Deciding whether a contract of sale is an international transaction or not and according to which criteria is an inescapable task, not only for private international law (PIL) but also for the instruments aiming to create uniform substantive contract law. The paper reviews the different solutions from the 1930s to the development of the last decades, from the first drafts of the International Institute for the Unification of Private Law (‘UNIDROIT’) on international sales to the Draft Common European Sales Law. Of course, the Vienna Sales Convention (‘CISG’), as a successful international instrument, is also given special emphasis in this comparative and historical analysis. Although during the past century of unification, the definition of international character became clearer and simpler, much however depends on how broadly or narrowly legislators wish to define the scope of the uniform substantive law to facilitate the acceptance and ratification of an international convention. A further specific question is whether uniform law should apply to all international sales (universal application) or only to international transactions linked to Contracting States. The paper also analyses the different positions on this issue.Décider si un contrat de vente est une transaction internationale ou non et selon quels critères est une tâche incontournable, non seulement pour le droit international privé, mais aussi pour les instruments visant à créer un droit materiel uniforme des contrats. L’article passe en revue les différentes solutions depuis les années 1930 jusqu’à l’évolution des dernières décennies, des premiers projets d’UNIDROIT sur les ventes internationales au projet de droit commun européen de la vente. Bien entendu, la Convention de Vienne sur les ventes, en tant qu’instrument international couronné de succès, fait également l’objet d’une attention particulière dans le cadre de cette analyse comparative et historique. Bien qu’au cours du dernier siècle d’unification, la définition du caractère international soit devenue plus Claire et plus simple, beaucoup dépend toutefois de la manière dont les législateurs souhaitent définir le champ d’application du droit matériel uniforme pour faciliter l’acceptation et la ratification d’une convention internationale. Une autre question spécifique est de savoir si le droit uniforme devrait s’appliquer à toutes les ventes internationales (application universelle) ou seulement aux transactions internationals liées aux États contractants. Le document analyse également les différentes positions sur cette question.Die Entscheidung, ob ein Kaufvertrag ein internationals Geschäft ist oder nicht und nach welchen Kriterien, ist eine unausweichliche Aufgabe, nicht nur für das internationale Privatrecht, sondern auch für die Instrumente, die auf die Schaffung eines einheitlichen materiellen Vertragsrechts abzielen. Der Beitrag gibt einen Überblick über die verschiedenen Lösungen von den 1930er Jahren bis zu den Entwicklungen der letzten Jahrzehnte, von den ersten Entwürfen des UNIDROIT zum internationalen Kaufrecht bis zum Entwurf des Gemeinsamen Europäischen Kaufrechts. Natürlich wird auch das Wiener Kaufrechtsüberienkommen als erfolgreiches internationals Instrument in dieser vergleichenden und historischen Analyse besonders berücksichtigt. Obwohl die Definition des internationalen Charakters im Laufe des letzten Jahrhunderts der Vereinheitlichung klarer und einfacher geworden ist, hängt doch vieles davon ab, wie weit oder eng der Gesetzgeber den Anwendungsbereich des einheitlichen materiellen Rechts definieren will, um die Annahme und Ratifizierung eines internationalen Übereinkommens zu erleichtern. Eine weitere spezifische Frage ist, ob das einheitliche Recht für alle internationalen Verkäufe (universelle Anwendung) oder nur für internationale Transaktionen mit Verbindung zu Vertragsstaaten gelten soll. In dem Beitrag warden auch die verschiedenen Standpunkte zu dieser Frage analysiert.

This paper draws from the author’s experience of developing a short-term intensive international learning experience within the framework of a one-semester course. The paper is aimed at faculty members who are interested in implementing a short but effective and authentic international learning opportunity, but who may not have expertise in issues surrounding international development and learning abroad. It addresses some of the challenges, successes, and lessons learned, such as working with an appropriate international partner, overcoming barriers to student participation, ensuring discipline-specific learning, and providing the appropriate context of international development issues within the time-frame of a single semester. Nous nous fondons ici sur notre propre expérience d’élaboration d’une situation d’apprentissage internationale, intensive et à court terme, dans le cadre d’un cours d’un seul semestre. Cet article est destiné aux enseignants qui, sans nécessairement posséder une expertise en matière de développement internationale et d’apprentissage à l’étranger, souhaiteraient mettre en œuvre une expérience d’apprentissage internationale aussi brève qu’efficace et authentique. Nous abordons les difficultés, les réussites et les leçons tirées de l’expérience, comme la nécessité d’un partenaire international adéquat, le dépassement des obstacles à la participation des étudiants, l’apprentissage adapté à des disciplines en particulier, et l’établissement d’un contexte approprié pour les questions de développement international dans le cadre temporel d’un semestre unique.

Abstract:
The purpose of this study was to analyse donor education strategies for international development using critical discourse analysis. The analysis focused on the two multilateral agencies and ten bilateral donors that contributed the most Official Development Assistance to education over the period 2002-10. The objective was to investigate linkages between Education Strategy texts, global development discourses, donor government political ideologies and education funding priorities. The methodology involved Fairclough's (1992) three level approach to critical discourse analysis. At the micro level the content of the texts was analysed. At the mid-level, inte[textual influences were identified. At the macro level, donor government political ideology and education aid allocations were considered. Five main education and development discourses were identified : ' education as a human right' , 'education and economic growth', 'qualified development', 'knowledge economies', and ' fragility, conflict and global security ' . Bilateral donor discourses were more often influenced by the World Bank than UNICEF. This supports the assertion that neo-liberal discourses still dominate international aid policy, despite the semblance of an ideological convergence towards a poverty consensus since the 1990s. Conversely, UNICEF, which is dependent on voluntary contributions, is necessarily more responsive to the discourses of its main bilateral sponsors than the World Bank. Government political ideology may matter. However, structurally and culturally embedded values transcend short-term government changes in terms of influencing aid policy. Weak evidence suggests that donors who take a rights-based approach are likely to support basic education through multilateral agencies; donors concerned with promoting global or regional stability are inclined to support basic education through the public sector; and donors who are driven by commercial interests tend to support higher education. Within the ' qualified ' development discourse, donor orientations vary between human/social development, sustainable development or good governance. Despite this rhetorical divergence, practical implications of these 'qualified' discourses are not evident.

Abstract:
This thesis explores public attitudes towards international development cooperation. Noting the lack of previous academic treatment of this particular topic, it includes an overview of available polling data on relevant questions, followed by a review of more general literature pertaining to public opinion towards foreign policy, as a macro-level concept. Finding the macro-level perspective insufficient, the thesis then explores one particular model for understanding public opinion on the individual level. The final chapter discusses in some detail how one particular form of development assistance---child sponsorship---might influence public opinion. Claims that child sponsorship necessarily has detrimental effects on public opinion are found to have little foundation in either empirical studies or relevant theory. Conclusive statements concerning any effect child sponsorship might have on public opinion are not made, but the thesis does argue that public opinion towards development assistance can, under certain conditions, be considered reasonable.

Abstract:
In this thesis, I theoretically investigate three related aspects of international trade and economic development. First, I present a model of social learning about the suitability of local conditions for new business ventures and explore its implications for the microeconomic patterns of economic development. I show that: i) firms tend to 'rush' into business ventures with which other firms have had surprising success thus causing development to be 'lumpy'; ii) sufficient business confidence is crucial for fostering economic growth; iii) development may involve wavelike patterns of growth where successive business ventures are first pursued and then given up; iv) there is, nevertheless, no guarantee that firms pursue the best venture even in the long-run. Second, I offer a new explanation for the empirical finding that trade liberalization increases firm productivity. In particular, I develop a simple general equilibrium model of trade in which trade liberalization leads to outsourcing as firms focus on their core competencies in response to tougher competition. Since firms are better at performing tasks the closer they are to their core competencies, this outsourcing increases firm productivity. Third, I propose a novel theory of GATT/WTO negotiations which solves two important problems of the standard terms-of-trade theory. First, it is consistent with the fact that GATT/WTO regulations do not constrain export taxes. Second, it does not rely on the terms-of-trade argument but instead emphasizes market access considerations. To achieve this, I consider trade policy in a 'new trade' environment. I first argue that tariffs are inefficiently high in the non-cooperative equilibrium because countries attempt to improve their relative market access at the expense of other countries. I then show how GATT/WTO negotiations can help countries overcome this inefficiency by providing new rationales for the GATT/WTO principles of reciprocity and nondiscrimination.

Dans un contexte en constante mutation, les organisations doivent développer de nouvelles stratégies pour saisir des opportunités d’affaires à l’échelle mondiale. Fondée sur le modèle d’Uppsala sur l’évolution des organisations et l’approche par les réseaux, cette recherche doctorale porte sur le développement de réseaux dans les organisations internationales. Suivant la théorie des micro-fondements, nous retenons deux niveaux d’analyse pour mieux comprendre l’interaction entre l’organisation et ses membres dans le processus d’évolution du réseau. Nous avons développé une étude de cas unique réalisée au sein d’ONLYLYON, une organisation visant à promouvoir la ville de Lyon dans le monde entier par le biais d'un vaste réseau d’individus appelé « réseau des ambassadeurs ». Suivant une démarche de recherche-intervention, nous avons co-construit avec l’organisation un projet de recherche visant à développer le réseau des ambassadeurs. L’étude empirique porte sur 36 entretiens, dont cinq exploratoires et 31 semi-directifs, 103 observations participantes sur une période de 30 mois et des données secondaires. Les résultats mettent en évidence le rôle des individus dans le développement des réseaux organisationnels. Ils soulignent l'importance de créer un réseau permettant aux organisations et aux individus de développer des opportunités. Nous proposons une trajectoire d’évolution pour (1) créer le réseau des ambassadeurs d'ONLYLYON en Italie et (2) développer un « réseau de réseaux » international. Les deux processus intègrent un ensemble de propositions managériales et reposent sur trois étapes comprenant (1) la mise en place, (2) la structuration ou restructuration et (3) l’expansion du réseau. Nous élaborons également un modèle pour étudier l'interaction entre une organisation et ses membres dans le processus de développement du réseau. Cette recherche-intervention peut aider ONLYLYON à développer ses réseaux internationaux en mettant en œuvre des actions stratégiques. Elle contribue également au développement du modèle d’Uppsala sur l’évolution des organisations et au débat sur l’importance des micro-fondements dans la recherche en sciences de gestion
In a rapidly changing context, organizations need to develop new strategies to seize global business opportunities. Based on the Uppsala evolution model and the business network view, this doctoral dissertation focuses on the development of networks in international organizations. Following the micro-foundations theory, we consider two levels of analysis to better understand the interplay between the organization and its members in the network evolution process. We developed a single case study conducted at ONLYLYON, an organization aiming to promote the city of Lyon worldwide through a large network of individuals called the “ambassador network”. Using an intervention research approach, we co-constructed with the organization a research project which aims to develop the ambassador network. The empirical study is based on 36 interviews (five exploratory and 31 semi-structured interviews), 103 participant observations performed over a period of 30 months and secondary data. Our findings highlight the role played by individuals in developing networks for organizations. They emphasize the importance of creating a network allowing organizations and individuals to develop opportunities. We propose an evolution path to (1) create the ONLYLYON ambassador network in Italy and (2) develop an international “network of networks”. Both paths include a set of managerial propositions and are based on three steps: (1) establishing, (2) structuring or restructuring, and (3) growing the network. We also elaborate a model to study the interaction between an organization and its members in the process of network development. This intervention research can help ONLYLYON in developing its international networks by implementing strategic actions. It also contributes to the development of the Uppsala evolution model and the debate on the importance of micro-foundations in management research

Abstract:
A number of international humanitarian organizations focus on human development and aim to improve the situation of children. In many developing countries, states have not been able to fulfill the educational or basic needs of its children. To fill this void, international actors have stepped in to help with human development. This thesis focuses on answering the question: How are norms diffused to local communities? Looking at the implementation of human development norms, this paper examines the norms-based actions that NGOs take to maximize the development potential of children. Programs aimed at increasing basic education as well as fighting child labor are addressed. When exploring the norm socialization process NGOs use to promote programs in education and child labor, it is clear that a different process is present than is suggested by existing literature. This is due to the locale where norms are implemented: local communities.

The present study is an attempt to better understand change in international relations through utilization of the concept of international regimes. The following chapters focus on creation of the international lending regime and change that has occurred within this regime. The work begins by reviewing the regime literature, noting definitional and conceptual problems of the approach. The review concludes with examples of regime scholarship that are utilized through the rest of the study. Examination of international lending as a regime consists of three sections: first, a profile of the creation of the United States-led, post-war multilateral lending regime; second, the replacement of U.S. geo-political concerns with a market emphasis desired by international banks; third, the more recent redirection of lending as the utility of market forces is constrained by adjustments necessary to facilitate emergency debt restructuring.

Abstract:
The research is intended to determine the dominant principles of connectivism learning theory in international studies that are related to student’s learning expectations. For that purpose the roles of teachers and students in the process of cognition, the dominant methods of study and technical means employed in the knowledge of the process of cognition are analysed. Also, the parameters of student satisfaction with international studies are analysed: the possibility to interactively know and interpret knowledge, to learn by learning strategies suitable for a student, to choose a meaningful curriculum for a student. The research results show that learning expectations of students in international study programmes are associated more with principles of connectivism than with constructivist learning theory. An essential factor in causing the reaction of student dissatisfaction with studies is the quality of pedagogical communication in a foreign language.

A central issue in impact evaluation is supporting quick data collection and analyses while an intervention is being rolled out to assist urgent decision-making or update knowledge of what works. This paper reviews approaches to timely evaluation that balance speed with rigour of analysis and are often combined with more standard evaluation methods. We review approaches to timely evaluation from different traditions and combine them in a conceptual framework that describes their goals, speed, and how they address complexity. Each method is paired with a case study to illustrate its value for international development evaluation research.

Complex interventions are those that are characterized by multiple components, multiple stakeholders, or multiple target populations. They may also be interventions that incorporate multiple processes of behavioral change. While such interventions are very common and receive a large proportion of development aid budgets, they are rarely subject to rigorous evaluations. The CEDIL Methods Working Paper, Evaluating Complex Interventions in International Development reviews promising methods for the evaluation of complex interventions that are new or have been used in a limited way. It offers a taxonomy of complex interventions in international development and draws on literature to discuss several methods that can be used to evaluate these interventions. The paper focuses its attention on methods that address causality and allow us to state conclusively whether an intervention works or not. It shows that several rigorous methods developed in different disciplines can be adapted and used to evaluate complex interventions in international development.

Social Network Analysis (SNA) is a promising yet underutilized tool in the international development field. SNA entails collecting and analyzing data to characterize and visualize social networks, where nodes represent network members and edges connecting nodes represent relationships or exchanges among them. SNA can help both researchers and practitioners understand the social, political, and economic relational dynamics at the heart of international development programming. It can inform program design, monitoring, and evaluation to answer questions related to where people get information; with whom goods and services are exchanged; who people value, trust, or respect; who has power and influence and who is excluded; and how these dynamics change over time. This brief advances the case for use of SNA in international development, outlines general approaches, and discusses two recently conducted case studies that illustrate its potential. It concludes with recommendations for how to increase SNA use in international development.

This paper discusses the spectrum of synthesis methods available to generate, explore and test theory, their value to the field of international development and innovations required to make better use of the primary research available. It goes further than setting substantive priorities for international development impact and learning. It addresses current advances and priority gaps in the methods for research before considering the substantive and methodological direction of evidence synthesis for impact evaluation in international development, particularly as this relates to the work of CEDIL. This scope encompasses methods for all stages in the process, from setting the question to appraising and synthesising the findings. It describes existing methods for synthesis, including how methods vary and the guidance and standards available. It then considers how well existing methods match the field of international development and the latest innovations emerging or required before providing a research agenda for advancing synthesis methods. In particular, it argues for clearer distinctions between syntheses produced as public goods, and those tailored to specific circumstances; and strengthening knowledge systems through greater use of maps to navigate existing and missing evidence, harmonised outcomes and measures, and advances in automation technologies. Improved methods and guidance are required for synthesising formative research and investigating contextual factors. Engaging stakeholders and working across academic disciplines support the production of policy-relevant syntheses and inspire methods development.
