Abstract:
The monograph examines the issues of the origin, formation and development of private international law (MCHP) as a science and an independent branch of law. The development of conflict (conflict of laws) law is shown starting from the XII century and ending with the beginning of the XX century, more precisely, 1917. In particular, the main historical stages of the development of the science of private international law in Europe by lawyers from Italy, France, Holland, Germany, England and Russia up to the beginning of the XX century are highlighted. The main ideas and doctrines in the science of MCHP are outlined, a number of author's provisions and conclusions regarding the covered topic are expressed, as well as proposals for the further development of the science of MCHP. It is recommended to students, masters, postgraduates and teachers of this discipline in educational organizations of professional education, to anyone who is interested in private international law.

Abstract:
The authors examine the role of international law in a changing global order. Can we, under the current significantly changing conditions, still observe an increasing juridification of international relations based on a universal understanding of values, or are we, to the contrary, rather facing a tendency towards an informalization or a reformalization of international law, or even an erosion of international legal norms? Would it be appropriate to revisit classical elements of international law in order to react to structural changes, which may give rise to a more polycentric or non-polar world order? Or are we simply observing a slump in the development towards an international rule of law based on a universal understanding of values? In eleven chapters and eleven comments, distinguished scholars reflect on how to approach these questions from historical, system-oriented and actor-centered perspectives. The contributions engage with the rise of European international law since the 17th century, the decay of the international rule of law, compliance as an indicator for the state of international law, international law and informal law-making in times of populism, the rule of environmental law and complex problems, human rights in Europe in a hostile environment, the influence of the BRICS states on international law, the impact of non-state actors on international law, international law’s contribution to global justice, the contestation of value-based norms and the international rule of law in light of legitimacy claims.

Abstract:
This chapter highlights, in the historic development of the law of the sea, the roots of the law as it currently stands and the questions still open today. It considers the early phases of the evolution of the law of the sea up to the end of the nineteenth century followed by, in more detail, developments that took place in the twentieth century up until the Third United Nations Conference on the Law of the Sea. This fundamental event in the history of the law of the sea in the twentieth century is the basis of the international law of the sea of today, and is dealt with in subsequent chapters of this Handbook.

Abstract:
This chapter summarizes the main arguments and discussions of the book and presents an overview of major concerns for the future of Hong Kong’s financial markets. In addition to describing financial market law and practice in Hong Kong, this book has sought to point out related major issues, whether legal, economic, or cultural. Each chapter has concluded with an evaluation of Hong Kong’s financial markets, identifying weaknesses and where reform is most needed. This final chapter takes the analysis further, presenting an overview of major concerns for the future of Hong Kong’s financial markets and their legal and regulatory systems. These arise in two main respects: first, risks to be addressed out of concern for financial stability and the continued economic development of Hong Kong; and second, opportunities to enhance Hong Kong’s competitiveness as a financial centre, especially in the context of prospects for China and East Asia.

Full text
Abstract:
Chapter 2 is a detailed development of the book’s central argument that emphasizes soft law’s second-order consequences, including the way it disrupts the politics of economic governance. The chapter provides a clear and parsimonious definition of soft law: written advisory prescriptions. It reviews existing literature, which has often centered on soft law’s ability to solve governance problems at a given moment in time and focused on issues surrounding compliance. The chapter then turns to the book’s main argument, outlining the logic behind two important temporal mechanisms of political disruption: legitimacy claims and arena expansion. This theoretical chapter thus sets up the key concepts and propositions used in the following empirical chapters, detailing the specific ways that soft law, as a political institution, transforms politics over time.

Gray, Kevin R., Richard Tarasofsky, and Cinnamon Carlarne, eds. The Oxford Handbook of International Climate Change Law. Oxford University Press, 2016. http://dx.doi.org/10.1093/law/9780199684601.001.0001.

Full text
Abstract:
Climate change presents one of the greatest challenges of our time, and has become one of the defining issues of the twenty-first century. The radical changes which both developed and developing countries will need to make, in economic and in legal terms, to respond to climate change are unprecedented. International law, including treaty regimes, institutions, and customary international law, needs to address the myriad challenges and consequences of climate change, including variations in the weather patterns, sea level rise, and the resulting migration of peoples. This book provides an authoritative overview of all aspects of international climate change law as it currently stands, with guidance for how it should develop in the future. This book sets out to analyse the legal issues that surround this vitally important but still emerging area of international law. This book addresses the major legal dimensions of the problems caused by climate change: not only in the content and nature of the international legal frameworks, which need implementation at the national level, but also the development of carbon trading systems as a means of reducing the costs of meeting emission reduction targets. After an introduction to the field, the book assesses the relevant institutions, the key applicable principles of international law, the international mitigation regime and its consequences, and climate change litigation, before providing perspectives focused upon specific countries or regions.

Full text
Abstract:
Gradually, alternative conceptions of the future emerged, which centered on questions of adaptation and loss and damages. International climate law followed suit, which resulted in the development of different sets of rules and principles. The focus shifted towards the broader causes of climate change and considerations of equity. Yet, these shifts could not do away with dystopian imageries of the future, including fears that climate change presents existential threats to human life as we know it. This has led to the consideration of more radical technologies such as climate engineering, technologies that give rise to new imageries of the future, and calls for their legal regulation.

Full text
Abstract:
Chapter 5 first assesses the extent to which the law of international armed conflict engages individuals directly and the impact of the different conceptions of international legal personality on the formation and application of the relevant treaty norms. Sections 5.1 and 5.2 study both provisions that do regulate the conduct of individuals directly, and provisions where such direct regulation was discussed but ultimately discarded in favour of an inter-State model. Turning to non-international armed conflict, Section 5.3 outlines the development of the doctrine of ‘recognition of belligerency’ between the late eighteenth century and the Second World War. Subsequently, Section 5.4 examines the role of the concept of international legal personality in the post-Second World War formation of treaty norms governing non-international armed conflicts. The chapter ends with a discussion of the diverging jurisprudential explanations in the current academic debate for the bindingness of international law on armed opposition groups.

Full text
Abstract:
This chapter traces the development of international standards on indigenous rights, providing a historical context of normative development in which one should view the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP). While rooted in centuries-long dynamics of colonial dispossession and normative debates in Western legal thought, the development of the international indigenous rights regime is an historically recent process catalysed by the emergence of indigenous peoples as political actors in the international area, and the successful re-articulation of their historical demands and strategies to fit while creatively transforming the logics and mechanisms of the late-20th century human rights machinery. The achievements of this process, as well as the tensions inherent to it, are present in a new generation of international standards, now authoritatively captured in the UNDRIP.

Colin, Bamford. 6 The Legal Nature of the International Bond Market. Oxford University Press, 2015. http://dx.doi.org/10.1093/law/9780198722113.003.0006.

Full text
Abstract:
The chapter explains the history of the international bond market, from its origins in the nineteenth century issues of loan stock, through the development of the Eurodollar market after World War II and the adoption of bonds as a way for corporate borrowers to access that market. It then discusses the evolution of the documentation used, paying particular attention to the concept of negotiability, which facilitated the ready transfer of bonds. It goes on to consider the idea of immobilization and the growth of securities clearing organisations. In this context, it considers recent developments in Europe, brought about by the requirements of the ECB. The chapter then turns to an analysis of the legal relationships created by the structure of bonds and the way they are traded, and ends with a discussion of the move to the dematerialization of the market.
