Abstract:
PROTECTION OF HOLY PLACES IN ROMAN LAW SUMMARY Loca sacra enjoyed a broad scope of legal protection in Roman law. They were protected by interdicts, operis novi nuntiatio, and by government officials. The interdictive protection of holy places was analogous to the protection given to public places. One of the injunctions issued by the praetor to protect holy places was the loca sacra ne quid in loco sacro fiat prohibitory interdict, which imposed a ban on harmful activities on loca sacra premises, and prohibited offensive behaviour by private individuals in holy places. A second interdict for the protection of holy places was restitutory, whereby the praetor could order full restitution for offences committed in a holy place (quod in loco sacro religiosove factum est restituatur). The purpose of these two interdicts was to eliminate all obstacles to free and open access for all to holy places. A third interdict for the protection of holy places, interdictum quod vi aut clam, was restitutory as well. The creation of such a broad catalogue of legal measures including interdicts as administrative law remedies, testifies to the importance of holy places both in the public (including religious) and private life of the ancient Romans.

Abstract:

AbstractConstitutum possessorium in a case of quasi possessio. A precario tenens has interdictal possession of the right of way during the period of his holding. He has, likewise the holder of the predial servitude, an interdictum de itinere actuque. In D. 43,19,1,11 a precario tenens borrowes the right of way a second time, but from whom? And from whom he did it the first time? The understanding of the text is open to dispute. We should consider the facts in a different way, as if a constitutum possessorium has accrued: the right-holder regains quasi possessio of his right (interdictal possession de itinere).

Abstract:
Roman law accorded a broad scope of protection for public places. Te magistrates responsible for securing it were the curule and plebeian aediles, the censors, and the praetors. Praetors conducted this duty by promulgating interdicts. Ne quid in loco publico fat, which prohibited any activity or installation in a public place which could cause damage, stands out among the other praetorian interdicts. What made it special was that it could be applied both when the potential damage concerned the public interest (utilitas publica), and/or the interest of a private individual (utilitas privata). The damage (damnum) was defned as the loss of a beneft of whatsoever kind the private individual drew from his enjoyment of the public place in question.

Abstract:
This paper addresses a network optimization interdiction problem, called the maximum capacity path interdiction problem. The problem is a hierarchical game containing two players: one evader and one interdictor. In a capacitated network, the evader wants to find a simple path from his current position to a target point with maximum capacity to send his forces along it while the interdictor decreases arc capacities under a budget constraint to interdict the advance of the evader’s forces as much as possible. This paper studies the case that each arc has a fixed cost for decreasing its capacity. An algorithm is proposed to solve the problem in strongly polynomial time. Computational experiments on two real-world datasets guarantee the efficiency and accuracy of the algorithm.

Abstract:
The ‘accessio’ (accession) in the Terminology of Roman Private LawSummaryThe term accessio (accession) in the terminology of Roman private law did not only denote union and confusion of things. It was a very general term used for defining various cases of property acquisition through union, growth of property, and it determined addition of a new obligation to an old one or addition of a supplementary contract, person or object to the obligation. In the Roman Law literature the term accessio is predominantly used for union of two things in accordance with the principle accessio cedit principali, i.e. the increase falls to the share of the principal. Moreover, the term accessio also denoted adding the duration of ownership of an object by the predecessor (accessio possessionis) or simply adding the duration (accessio temporis). In the sources for the Roman Law accessio temporis and possessionis are used interchangeably for determining specific actual states, which resolve issues connected with accession of ownership duration of the predecessor to the ownership duration of the last owner. Similarly in lexicons, accessio temporis is presented as a synonym of accessio possessionis. The aforementioned accession of ownership duration [of the predecessor by his successor under specific title was permissible with interdict aimed at protection against infringement of ownership of movable objects (interdictum utrubi), with prescription (usucapio) and charge of long time ownership (longi temporis praescriptio).Furthermore, accession also meant accessio personae that is addition of a person, i.e. additional creditor who, beside the principal creditor, could collect repayment of debt from debtor (adstipulator), or a person who additionally, beside the principal debtor, pledged to the creditor to repay the debt (adpromissor), or it is addition of a new obligation to an old one by means of contract of guaranty (fideiussio). With accessio personae, similarly to union of things in accordance with the principle of accessio cedit principali, there had to be two things, one of them determined as principal and the other - additional. Obviously, here occur two obligations, one treated as principal, and the other as additional or accessory. Moreover, accession also means accessio rei, that is addition of new article of service to obligation, that the debtor could render alternatively with the previous, which was possible with alternative obligation (obligatio alternativa) and alternative authorization (facultas alternativa).

The recent student protests across South Africa have occasioned litigation seeking to interdict protest action, which the universities claim is unlawful. Overly broad interdicts, which interdict lawful protest action, violate the constitutional right to assembly and have a chilling effect on protests. In a decision of the High Court of South Africa, Eastern Cape Division, Grahamstown, a final interdict was granted interdicting two individuals from, among other things, disrupting lectures and tutorials at Rhodes University and from inciting such disruption. Abstract:
This article poses the following problem: Does there exist a probability distribution over subsets of a finite partially ordered set (poset), such that a set of constraints involving marginal probabilities of the poset’s elements and maximal chains is satisfied? We present a combinatorial algorithm to positively resolve this question. The algorithm can be implemented in polynomial time in the special case where maximal chain probabilities are affine functions of their elements. This existence problem is relevant for the equilibrium characterization of a generic strategic interdiction game on a capacitated flow network. The game involves a routing entity that sends its flow through the network while facing path transportation costs and an interdictor who simultaneously interdicts one or more edges while facing edge interdiction costs. Using our existence result on posets and strict complementary slackness in linear programming, we show that the Nash equilibria of this game can be fully described using primal and dual solutions of a minimum-cost circulation problem. Our analysis provides a new characterization of the critical components in the interdiction game. It also leads to a polynomial-time approach for equilibrium computation.

Abstract:
In Big Catch Fishing Tackle Proprietary Limited v Kemp (17281/18) 2019 ZAWCHC 20 (5 March 2019) the Western Cape Division, Cape Town had to determine whether a former director of a company continued to owe fiduciary duties to the company after he had resigned, and if so, whether he could temporarily be interdicted from competing with the company until the main action was heard in court. The court dismissed the company's application for an interim interdict. This article critically analyses the judgment in regard to the post-resignation fiduciary duties of directors. The judgment is noteworthy as it sheds light on the post-resignation fiduciary duties of directors – an area of law which is still developing in South African law. This article contends that the court incorrectly conflated the legal principles relating to the appropriation of corporate opportunities with the misuse of confidential information. It is further argued that courts should not lay down a closed list of instances when directors' fiduciary duties will continue post-resignation, as the court attempted to do in this case. It is suggested that courts should adopt a flexible and pragmatic approach in determining when a director's fiduciary duties will survive after his or her resignation.

Abstract:
The enforcement of socio-economic rights is unique as it necessitates positive action in policy-making and bears budgetary implications. Consequently, to prevent such enforcement from exceeding the scope established by the doctrine of ‘separation of powers’, because policy-making and budgetary allocation are under the executive and legislature respectively, the Kenyan Court of Appeal was hesitant to apply structural interdicts in the case of Kenya Airports Authority v Mitu-Bell Welfare Society & 2 others. This decision has outlawed structural interdicts from the Kenyan jurisprudential landscape and has failed to give a viable alternative judicial approach that should guide subsequent courts in enforcing socio-economic rights. This study looks into the origin and models of structural interdicts so as to analyse and critique this Court of Appeal’s decision by showing how the Court could have applied structural interdicts in the enforcement of socio-economic rights without impinging on the doctrine of separation of powers. This will be achieved through the use of literature review.

We study the r-interdiction median problem with fortification (RIMF), which considers demand points that are served by facilities. If a facility is interdicted, it can not serve any demand point, increasing the total system cost. To avoid an interdiction, a facility can be fortified. The problem consists of fortifying facilities knowing that some facilities will be interdicted. We propose a branch-and-cut algorithm for the RIMF and several experiments attest that our method outperforms the best exact algorithm found.

Abstract:
The development of unmanned air vehicles (UAVs) has been very rapid recently. The wide accessibility of UAVs has unlocked a great potential for the malicious or accidental damage or destruction of property or other aircraft in flight. UAVs can be used for espionage, contraband, and the trafficking or transport of arms and hazardous materials. Every month sees a growing number of reports of incidents that involve remote-controlled UAVs operated for aerial video recording. These incidents justify undertaking research into minimizing the hazards which UAVs may potentially cause. A concept was developed for a solution dedicated to this problem and comprising an integrated modular anti-UAV system for application in commercial (civilian) markets in the areas of security of mass events, strategic enterprises, and critical strategic infrastructure in Poland. The proposed system is intended to incapacitate any UAVs that breach a predefined air space and bring the incapacitated UAVs safely to the ground. The project is developed jointly by the Institute of Armament Technology at the Military University of Technology (Warsaw, Poland) and Polish company Ellipsis Sp. z o.o.

In this work, the inhibition effect of 3-nitroacetophenone (3-NA) on the corrosion of MS in acidic medium (1 N HCl) was investigated using weight loss measurements, electrochemical measurements, scanning electron microscopy, energy-dispersive X-ray spectroscopy, and quantum chemistry analysis. The studies were performed using different concentrations of inhibitors and at different temperatures. The results indicated that the inhibition efficiency of 3-NA increases with an increase in inhibitor concentration and reaches to a maximum of 64% at inhibitor concentration of 250 ppm at 30°C. The potentiodynamic polarization measurement indicated that 3-NA acts as mixed category of interdict. The adsorption of 3-NA on MS surface followed the Langmuir adsorption isotherm. The mode of adsorption of 3-NA on MS surface was further studied by quantum chemical calculations based on density functional theory (DFT). The results plainly revealed that 3-NA performs fairly as corrosion interdict for MS in acidic medium.

Overshadowed by the iconic battles at Lexington/Concord and Bunker Hill, the Battle of Chelsea Creek (27-28 May 1775) is notable for being the provincials’ first coordinated offensive gesture. Moving to interdict livestock and supplies from the besieged British garrison in Boston, they entered into a running engagement with British marines, eventually capturing and destroying the British schooner HMS Diana.

Abstract:
Pathogenic strains of viruses that infect humans are encapsulated in membranes derived from the host cell in which they infect. After replication, these viruses are released by a budding process that requires cell/viral membrane scission. As such, this represents a natural target for innate immunity mechanisms to interdict enveloped virus spread and recent advances in this field will be the subject of this paper.

Abstract:
On the basis of empirical data, the theme of violence is brought into discussion. Supported by Lacan’s ideas as our theoretical background, the concept of the paternal fatherlike/symbolic role stands out as it interdicts the omnipotence of desire. In addition, the consequences of such an omnipotent desire, in its transgresssive nature, have been taken as implying a destructive result generated within the social realm, and returning to it on account of its totalitarian/omnipotent/immoderate character.

Abstract:
In the period from the conclusion of the Tridentine Council in 1563 to the Turkish conquest of Crete in 1669 the Venetian Republic feared for its sovereignty over its Mediterranean possessions. These stretched from Istria, along the Dalmatian littoral, to the islands of Corfu and Zante. Cyprus was lost to the Turks from 1570, despite the Christian maritime victory at Lepanto subsequently. Venetian relations with the papacy were also strained after the Council of Trent, not only in the exceptional and dramatic circumstances of the Interdict of 1606-7. Defence of both Crete and the other remaining Mediterranean possessions was thus complicated by Venetian anxiety over Ottoman power on the one hand and concern at papal policy on the other. From the end of the Tridentine Council to the Interdict, and indeed beyond, Venice insisted on its role as a devoutly Catholic state, claiming from the papacy the concession of decime, paid by the clergy of the Republic, to sustain its defence of Christendom against militant Islam. But the Republic also resisted Roman suggestions that Catholic belief and practice were insecure or in need of reform within its territories. In the Mediterranean possessions, however, the presence of a Greek Christian population represented a particular problem.

Abstract:
In order to determine the nature of the abuse of power of the legal representatives in Quebec family law, one must identify the different cases of legal representation and study the powers of the different representatives. Tutorship is the mechanism for the protection of the non emancipated minor. As a rule, the tutor represents his pupil in civil acts; but in some cases he has no power to act, in other cases he must get the judge's authorization, while in a third category of cases he must comply with special formalities. Consequently, there can be absence of power, misappropriation of power, bad utilization of power or dereliction of duty. Curatorship is used for different kinds of interdicted persons. The powers and liabilities of the curator to an interdicted person are generally the same as those of the tutor. The legal mandate of the married woman is the power to represent her husband for the current needs of the household and the maintenance of the children. In this case, the abuse mainly takes the form of an excess of power. The effects of the abuse of power must primarily be considered in the relations between the represented person and his legal representative; we must ask ourselves if the legal representative is liable for damages, if his acts can be annulled and if there can be withdrawal from office. There are also effects to be considered in the relationship between the legal representative and the third persons, as well as in the relationship between the represented person and the third parties.

Abstract:
Innocent III regularised ecclesiastical usage of several penalties which punished the innocent along with the guilty, notably the interdict. His actions need to be understood in their intellectual as well as political context. It has long been thought that Peter the Chanter taught the future pope when he studied theology at Paris. This article presents evidence of the Chanter's radical influence on Innocent's attitude to collective guilt and punishment and compares their views with canonistic doctrine.
