Abstract:
PROTECTION OF HOLY PLACES IN ROMAN LAW SUMMARY Loca sacra enjoyed a broad scope of legal protection in Roman law. They were protected by interdicts, operis novi nuntiatio, and by government officials. The interdictive protection of holy places was analogous to the protection given to public places. One of the injunctions issued by the praetor to protect holy places was the loca sacra ne quid in loco sacro fiat prohibitory interdict, which imposed a ban on harmful activities on loca sacra premises, and prohibited offensive behaviour by private individuals in holy places. A second interdict for the protection of holy places was restitutory, whereby the praetor could order full restitution for offences committed in a holy place (quod in loco sacro religiosove factum est restituatur). The purpose of these two interdicts was to eliminate all obstacles to free and open access for all to holy places. A third interdict for the protection of holy places, interdictum quod vi aut clam, was restitutory as well. The creation of such a broad catalogue of legal measures including interdicts as administrative law remedies, testifies to the importance of holy places both in the public (including religious) and private life of the ancient Romans.

Abstract:
Actualmente en nuestro país nos encontramos ante situaciones polémicas respecto la protección de los bienes públicos. Esta problemática se agrava debido a la poca y deficiente regulación. Un ejemplo de ello es el abuso que realizan algunos, argumentando la mal entendida garantía de libertad de expresión, cuando impiden el ejercicio del derecho de uso de los bienes públicos de uso común como vías, caminos públicos, a los demás. En el presente artículo analizo la protección de los bienes públicos en el derecho romano clásico y, luego, en el derecho mexicano, en especial a los bienes públicos de uso común. Las razones por las que me inclino al estudio de los bienes públicos de uso común son, principalmente, la problemática que enfrentamos actualmente debido a la falta de defensa de los usuarios de bienes públicos destinados al uso común, aunado a que los romanos desarrollaron con más profundidad los interdictos que protegen dichos bienes, a diferencia de que sólo existió un interdicto que protegía al concesionario de un bien público para que no se le impidiera el ejercicio de su derecho. Este es el interdicto sobre el disfrute de un lugar público (Interdictum de loco publico friendo).

AbstractConstitutum possessorium in a case of quasi possessio. A precario tenens has interdictal possession of the right of way during the period of his holding. He has, likewise the holder of the predial servitude, an interdictum de itinere actuque. In D. 43,19,1,11 a precario tenens borrowes the right of way a second time, but from whom? And from whom he did it the first time? The understanding of the text is open to dispute. We should consider the facts in a different way, as if a constitutum possessorium has accrued: the right-holder regains quasi possessio of his right (interdictal possession de itinere).

Abstract:
Roman law accorded a broad scope of protection for public places. Te magistrates responsible for securing it were the curule and plebeian aediles, the censors, and the praetors. Praetors conducted this duty by promulgating interdicts. Ne quid in loco publico fat, which prohibited any activity or installation in a public place which could cause damage, stands out among the other praetorian interdicts. What made it special was that it could be applied both when the potential damage concerned the public interest (utilitas publica), and/or the interest of a private individual (utilitas privata). The damage (damnum) was defned as the loss of a beneft of whatsoever kind the private individual drew from his enjoyment of the public place in question.

Abstract:
This paper addresses a network optimization interdiction problem, called the maximum capacity path interdiction problem. The problem is a hierarchical game containing two players: one evader and one interdictor. In a capacitated network, the evader wants to find a simple path from his current position to a target point with maximum capacity to send his forces along it while the interdictor decreases arc capacities under a budget constraint to interdict the advance of the evader’s forces as much as possible. This paper studies the case that each arc has a fixed cost for decreasing its capacity. An algorithm is proposed to solve the problem in strongly polynomial time. Computational experiments on two real-world datasets guarantee the efficiency and accuracy of the algorithm.

The ‘accessio’ (accession) in the Terminology of Roman Private LawSummaryThe term accessio (accession) in the terminology of Roman private law did not only denote union and confusion of things. It was a very general term used for defining various cases of property acquisition through union, growth of property, and it determined addition of a new obligation to an old one or addition of a supplementary contract, person or object to the obligation.In the Roman Law literature the term accessio is predominantly used for union of two things in accordance with the principle accessio cedit principali, i.e. the increase falls to the share of the principal.Moreover, the term accessio also denoted adding the duration of ownership of an object by the predecessor (accessio possessionis) or simply adding the duration (accessio temporis). In the sources for the Roman Law accessio temporis and possessionis are used interchangeably for determining specific actual states, which resolve issues connected with accession of ownership duration of the predecessor to the ownership duration of the last owner. Similarly in lexicons, accessio temporis is presented as a synonym of accessio possessionis. The aforementioned accession of ownership duration [of the predecessor by his successor under specific title was permissible with interdict aimed at protection against infringement of ownership of movable objects (interdictum utrubi), with prescription (usucapio) and charge of long time ownership (longi temporis praescriptio).Furthermore, accession also meant accessio personae that is addition of a person, i.e. additional creditor who, beside the principal creditor, could collect repayment of debt from debtor (adstipulator), or a person who additionally, beside the principal debtor, pledged to the creditor to repay the debt (adpromissor), or it is addition of a new obligation to an old one by means of contract of guaranty (fideiussio). With accessio personae, similarly to union of things in accordance with the principle of accessio cedit principali, there had to be two things, one of them determined as principal and the other - additional. Obviously, here occur two obligations, one treated as principal, and the other as additional or accessory.Moreover, accession also means accessio rei, that is addition of new article of service to obligation, that the debtor could render alternatively with the previous, which was possible with alternative obligation (obligatio alternativa) and alternative authorization (facultas alternativa).

Las investigaciones sobre la interdicción y su expresión han llevado a que solo es posible un profundo acercamiento a este fenómeno mediante un análisis simultáneo desde diferentes ámbitos lingüísticos y extralingüísticos. En esta línea nuestro trabajo considera la expresión de las realidades y conceptos interdictos en el discurso oral de los hablantes malagueños. Atendemos a determinadas variables pragmático-discursivas (expresión, finalidad, función) así como a las características sociolingüísticas (sexo, edad, instrucción) de estos hablantes para conocer cuál es su actuación ante los conceptos tabuizados. Consideramos así el uso y frecuencias de expresiones referidas a realidades interdictas en el habla de Málaga, los recursos que aparecen en estas expresiones lingüísticas, su función discursiva y finalidad y, además, mostramos la variabilidad del fenómeno atendiendo a tres tradicionales variables sociolingüísticas: edad, sexo, estudios del hablante malagueño. Comparamos también los resultados de nuestro estudio con los obtenidos por los grupos PRESEEA de Madrid y Granada.

This article poses the following problem: Does there exist a probability distribution over subsets of a finite partially ordered set (poset), such that a set of constraints involving marginal probabilities of the poset’s elements and maximal chains is satisfied? We present a combinatorial algorithm to positively resolve this question. The algorithm can be implemented in polynomial time in the special case where maximal chain probabilities are affine functions of their elements. This existence problem is relevant for the equilibrium characterization of a generic strategic interdiction game on a capacitated flow network. The game involves a routing entity that sends its flow through the network while facing path transportation costs and an interdictor who simultaneously interdicts one or more edges while facing edge interdiction costs. Using our existence result on posets and strict complementary slackness in linear programming, we show that the Nash equilibria of this game can be fully described using primal and dual solutions of a minimum-cost circulation problem. Our analysis provides a new characterization of the critical components in the interdiction game. It also leads to a polynomial-time approach for equilibrium computation.

La presente ricerca, articolata in due parti, è volta ad analizzare la funzione che la tutela interdittale ricoprì nell'esperienza giuridica romana, sia sotto il profilo contenutistico, attraverso l’analisi delle singole fattispecie da essa considerate, sia in una prospettiva dinamica, cercando di dare una collocazione temporale, per quanto approssimativa, alla loro origine ed esaminandone la regolamentazione all'interno delle diverse fasi della storia processuale romana. I primi tre capitoli esaminano la portata complessiva di questa forma di tutela, la quale si estendeva ad un gruppo di situazioni giuridiche eterogeneo e, in base a quello che tramandano i più recenti ritrovamenti epigrafici e papiracei, non rimase espressione del tribunale del pretore a Roma, ma trovò applicazione in diversi luoghi dell'Impero. Nella seconda parte del lavoro ci si sofferma sul procedimento che, a seguito dalla postulatio del soggetto interessato, poteva condurre alla concessione degli interdetti, nella persuasione che esso costituisse non una mera contingenza preliminare ai noti giudizi ex causa interdicti ma un procedimento autonomo ed essenziale all'interno del sistema interdittale nel suo complesso.
The present research, divided into two parts, is aimed analysing the function of the interdictal protection in the Roman legal experience, both in terms of content, through the analysis of the individual cases under its cover, and in a dynamic perspective, trying to give a temporal location, however approximate, to its origin and studying the regulation within the different phases of Roman procedural history. The first three chapters examine the overall scope of this remedy, which was accorded to protect a heterogeneous group of legal situations and, according to the most recent epigraphic and papyrus findings, did not remain an expression of the praetor's court in Rome, but was applied in different places of the Empire. In the second part of this work we focus on the procedure that, following the postulatio of the interested party, could lead to the granting of an interdictum. This procedure was not a mere preliminary contingency to the well known iudicia ex causa interdicti but that an autonomous and essential procedure within the interdictal system as a whole.

The sentiment of Justice Ackerman that courts have a particular responsibility and obligation to &ldquo
forge new tools&rdquo
and shape innovative remedies to achieve a goal, is profound and based on a constitution with a transformative nature. The injustice of apartheid brought about unequal resource distribution in South Africa and this is well documented. The need for innovative remedies to address these injustices has been in demand. The Constitution of the Republic of South Africa has made available, sufficient remedies for the courts to deal with these concerns. However, the courts need to find a creative way of using and applying these remedies. One such remedy, being promoted by this paper is, structural interdicts with a supervisory jurisdiction. This remedy has a process of meaningful engagement attached to it, to ensure all parties reach practical solutions to ongoing socio-economic rights violations. The ancillary effect of these types of orders will promote future policies to take into consideration socio-economic rights needs of other people in the same position as the applicants. The ongoing supervision of the court will further ensure that government comply with its obligation within reasonable time, and to address ongoing concerns of socio-economic rights violation as and when they arise during the process of engagement.

Venice and Rome was not always on good terms, which the interdict crisis of 1606 and 1607 clearly manifests. Interdicts had been placed on Venice before, but the one of 1606 set about a veritable flood of pamphlets and tracts, either in favour or against the interdict of Pope Paul V (1605–1621).   One of these tracts, which was written in favour of the Papal interdict, was the Nuova Risposta di Giovanni Filoteo di Asti, alla lettera di un theologo incognito scritta ad un sacerdote suo amico, sopra le censure, & interdetto di Papa Paolo V, contro la Signoria di Venetia, which I intend to analyse in this thesis. The Nuova Risposta was a text born out of the Guerra delle scritture. It was published in 1606 in Bologna and in Ferrara, both locations were, at that period of time, a part of the Papal States. This text manifests the troublesome relations between the Venetian government and the Papal Court in Rome, but also the importance of adhering to a historiographical framework in which the author Antonio Possevino elaborates on Papal claim to superiority in spiritual and in temporal matters.

Abstract In this chapter, the origins of pignus and its remedies in the Republic will be discussed. The pledges we encounter in Cato’s De agricultura are ancestors of the tenant’s pledge of invecta et illata and are early and important examples of transactional practices with formative effect. In the first century bc, for the first time in the history of Roman law specific legal remedies were developed for pignus: the interdictum Salvianum and the interdictum de migrando. Not long after the introduction of these interdicts, the actio Serviana was included in the praetor’s edict, perhaps originally exclusively for tenant’s pledges. In republican law a second form of real security was already originated: fiducia cum creditore. This chapter will also review the origin and early evolution of this form of real security and examine its historical and structural relationships with pignus.

Abstract:
The main focus of this chapter is the Protection from Harassment Act 1997 and the remedies that it provides for those claiming to have been harassed by another. The nature of actions of harassment is considered and the key features of liability, including the kinds of conduct that may constitute harassment, and the requirement that “alarm or distress” should have been caused. It reviews the availability of interdict and non-harassment orders and also discusses the circumstances in which vicarious liability for harassment may be imposed. The final two sections of the chapter deal with the older remedies of lawburrows and non-molestation interdicts.

Abstract:
Fraus creditorum was a delict of Pretorian law. This delict existed when the borrower consciously reduced his assets to prevent creditors from collecting their claims. Uncontrolled creditors had at their disposal three procedural means to defraud the debtor's disposal. Initially, the interdictum frauditorum and restitutio in integrum ob fraudem, and later actio Pauliana, who consolidated the actions of the previous two procedural means and enabled the comprehensive protection of creditors. Protection of creditors from fraudulent proceedings of indebted debtors came to light only after the introduction of real execution. Until then, the applicable principle of personal execution was a sufficient guarantee to the creditors that the debtor would fulfill their obligations. The debtors, in order to avoid expulsion through Tibar or murder, were trying to fulfill their contractual obligations.

Abstract:
Introducción: Se estima que en Europa la cifra media de diagnóstico de abuso y dependencia del alcohol es del 15%1, y parece que menos de un 10% de estos pacientes reciben tratamiento específico2. Objetivos: Medir el consumo de alcohol y la comorbilidad psiquiátrica del eje I en pacientes con dependencia alcohólica que acuden a un centro de tratamiento específico de alcoholismo. Métodos: Estudio descriptivo de 112 pacientes . Se determina la presencia de patología dual mediante la MINI5.0.0, utilizando como criterios de dependencia los criterios del DSM-IV. A los seis meses de la evaluación inicial se comprobará el consumo semanal de alcohol. Resultados: El 50% presenta patología dual. El consumo medio de UBE/semana al inicio de tratamiento era de 88,18. El consumo medio a los seis meses es de 25,51. El 46,4% de la muestra tiene pautado tratamiento específico para la deshabituación alcohólica. En los duales, existen una disminución del consumo de alcohol a los 6 meses de seguimiento (p<0,001) y una media de reducción del consumo UBE/ semana mayor (p<0,001) en el grupo de pacientes tratados. En los pacientes no duales con tratamiento interdictor, se observa la misma circunstancia. Discusión: Existe una disminución importante del consumo medio de alcohol a los 6 meses de seguimiento, siendo mayor la disminución en aquellos sujetos que están con tratamiento interdictor, lo que coincide con los estudios realizados3,4. Se observa una mayor tendencia de los duales a mantener un consumo de riesgo a los 6 meses de iniciar el tratamiento. Al igual que en nuestra muestra, estudios previos5 refieren que la comorbilidad psiquiátrica en su conjunto no influye en la respuesta al tratamiento ni en la evolución.

Abstract:
We propose a novel Stackelberg game model of MDP interdiction in which the defender modifies the initial state of the planner, who then responds by computing an optimal policy starting with that state. We first develop a novel approach for MDP interdiction in factored state space that allows the defender to modify the initial state. The resulting approach can be computationally expensive for large factored MDPs. To address this, we develop several interdiction algorithms that leverage variations of reinforcement learning using both linear and non-linear function approximation. Finally, we extend the interdiction framework to consider a Bayesian interdiction problem in which the interdictor is uncertain about some of the planner's initial state features. Extensive experiments demonstrate the effectiveness of our approaches.

In recent years there has been a considerable effort toward applying large eddy simulation methods (LES) to real industrial problems. However, there are still several challenges to be addressed to achieve a reliable LES solution, especially in the context of compressible flows. Furthermore, complex geometries require the unstructured meshes which then interdict the use of very high order schemes. Therefore, LES models are mainly derived and tested on classical problem of simple geometry for incompressible flow and based on higher order schemes. Here, the flow over a gas turbine blade at high Reynolds and Mach numbers is investigated using a mixed finite-volume-finite-element method. Implicit LES method (ILES) as well as Smagorinsky and its dynamic version have been studied. Different variations of the Smagorinsky method have been examined too. The interaction of the numerical dissipation of the scheme with LES models has been explored. The results show the capability of the ILES to take into account the effective viscosity of the flow and the negligible difference of the different LES models in this flow condition. Fairly good agreement with experimental data is found which is superior to RANS results. It is found that there are still some challenges in industrial LES applications which have to be addressed to lead to a better agreement with experimental data.

Abstract:
OBJETIVOS: El objetivo de este trabajo es presentar un caso de patología dual grave, en el que se ensaya una nueva línea de tratamiento ILD con palmitato de paliperidona semestral. MATERIAL-MÉTODO: Se trata de un varón sexagenario con diagnóstico de T. Mental y del Comportamiento debido al consumo de alcohol, con síndrome de dependencia y consumo crónico (F10.25 según CIE-10), y de Esquizofrenia paranoide con sintomatología positiva cronificada (F20.00 según CIE-10). Caso de gran cronicidad, con debut del cuadro psicótico hace más de 30 años, y del consumo de alcohol hace unos 25 años, así como de extrema severidad, con escaso insight e historial de múltiples ensayos terapéuticos con regular-mala adherencia. Igualmente presenta múltiples abandonos del seguimiento, propiciando descompensaciones y recaídas del consumo repetidamente, por las que ha ingresado en Unidad Desintoxicación Hospitalaria, comunidades terapéuticas, UHP y UME reiteradamente. En seguimiento actualmente por Programa de Tratamiento Asertivo Comunitario. Previo al ensayo terapéutico actual, más de un año sin ningún tratamiento neuroléptico, interdictor, modulador del craving o para abstinencia. Otros tratamientos ILD seguidos anteriormente: risperidona 150mg bimensual y, posteriormente, palmitato de paliperidona 200mg mensual. Ante el agravamiento progresivo actual de la clínica, que mantiene cronificada, con mayor repercusión afectivo-conductual de los delirios paranoides, con mayor consumo enólico, irritabilidad, heteroagresividad y autocuidado negligente, se plantea ingreso involuntario en UHP, con inicio de tratamiento ILD con palmitato de paliperidona semestral, a dosis de 1700mg bianuales. RESULTADO-CONCLUSIONES Por el momento, este nuevo tratamiento ha conseguido mejorar y mantener en segundo plano la sintomatología psicótica, consiguiendo así una mayor adherencia al plan de revisiones del ETAC y un menor consumo enólico. Asimismo, el mayor tiempo interadministración supone una menor interferencia en el día a día del paciente y una mejor calidad de vida, surgiendo así un escenario más favorable para ensayar nuevas estrategias de desintoxicación-deshabituación.

Introducción y objetivos El trastorno por uso de sustancias es un problema de gran relevancia en la actualidad, con alta prevalencia y afectación a poblaciones muy heterogéneas. El trastorno de abuso de alcohol se relaciona tanto con problemas físicos como psicológicos, especialmente con depresión. Según estudios realizados, las tasas de comorbilidad alcanzarían hasta el 40%. La causalidad entre ambas es aún controvertida; ¿el alcohol como causa o consecuencia? Material y métodos Exponemos el caso de un varón de 61 años, ingeniero, ha trabajado como profesor de Universidad. A consecuencia de un evento familiar estresante, empieza a recurrir a la bebida como elemento ansiolítico y evasivo. Los consumos son cada vez más importantes y de forma descontrolada. Acude al servicio de Urgencias en varias ocasiones en contexto de intoxicación etílica, negándose a recibir ayuda, así como anosognósico con su problema de consumo. Tras una caída en el domicilio acude nuevamente al hospital, siendo diagnosticado de arritmia cardiaca por fibrilación auricular. En el contexto de abstinencia a alcohol realiza un cuadro de delirium tremens, siendo preciso pautar tratamiento para desintoxicación. Cuando el paciente va a ser dado de alta a su domicilio aqueja de diplopía y ataxia, con imposibilidad para mantener bipedestación. Resultados y conclusiones Inicialmente el paciente niega su enfermedad y minimiza el consumo de alcohol. Superado el cuadro de delirium se pauta tiamina a dosis altas, con recuperación de la visión y mejora paulatina de la marcha. El paciente se muestra cada vez más colaborador y receptivo. El personal de enfermería se implica en el plan de cuidados, priorizando la detección de signos y síntomas derivados de este problema. El objetivo determinante es trabajar la motivación y abstinencia. El paciente acepta seguimiento por su parte para deshabituación, comprometiéndose a acudir a consultas para la toma de interdictor diaria.
