Abstract:
The creation of the Trade-Related Aspects of Intellectual Property Rights Agreement (TRIPs) in the mid-1990s altered the regulation of intellectual property under international law. Prior to the TRIPs Agreement, intellectual property regulation consisted of a patchwork of international treaties and conventions coordinating reciprocal national treatment of signatory states’ domestic intellectual property protection. Generally, those agreements strove for minimum standards of protection, but left levels and types of protection to member states’ national discretion. TRIPs’s strict uniformity represented a momentous change. Development theorists who have examined the practical implications of intellectual property regulation under international law have echoed critical theorists’ assertions of TRIPs as a watershed moment. However, they have expressed concerns over the domination exercised by developed countries over developing countries within the current international intellectual property regulatory system. Of particular importance are international impositions into developing countries’ national legal systems via TRIPs, and efforts of developed countries to extract from developing countries intellectual property concessions over and above those contained in TRIPs. A wide range of articles on intellectual property regulation under international law have also been published in legal journals and periodicals. Three broad themes stand out: concerns about practice and practical applications (i.e., practice tips, reviews of cases and WTO decisions); concerns about policy aspects and consequences of intellectual property law; and exploration of the philosophical underpinnings of the law.

Abstract:
This chapter covers parts of Asia where there have been very significant recent developments in intellectual property (IP) law. IP reform in the region was initially driven by the concerns of industrialized countries about the lack of IP protection in Asian “miracle” economies. More recently, it has become an important topic in free trade and economic partnership agreement negotiations. The developments in the individual countries are discussed in the context of an “Asian development model,” which has often combined short and generalized laws with numerous implementing decrees and administrative discretion. This has allowed for the selective adaptation of IP models from elsewhere, with some countries now strongly promoting higher IP standards to their regional neighbors. However, different historical pathways to development and local circumstances suggest that it is difficult to develop regional role models for others or to explain differences about IP exclusively with the divide between “developed” and “developing” countries.

This chapter examines the recent turn to virtue in moral philosophy and theology, with a view to establishing some of the key principles that have driven this, here considered in relation to the specific topic of intellectual humility. The chapter highlights the need for an appropriately developed account of personhood and agency, which rightly acknowledges the social or relational elements of these. Theologically, the chapter’s account of these relations must be framed properly in terms of God’s economical dealings with the world, now understood through the incarnational reality. From this, the need for a genuinely Trinitarian and christologically sensitive account of virtue to be developed is highlighted. As part of the discussion, the author reflects on the rejection of certain accounts of virtue by the Reformers, ensuring that their Scripture-based concerns are not overlooked as the author’s own account of the particular virtue of intellectual humility is developed.

This book explores artificial intelligence (AI), which has become omnipresent in today's business environment: from chatbots to healthcare services to various ways of creating useful information. While AI has been increasingly used to optimize various creative and innovative processes, the integration of AI into products, services, and other operational procedures raises significant concerns across virtually all areas of intellectual property (IP) law. Thus, AI has drawn extensive attention from IP experts globally and there have been some works on specific issues in the intersection between AI and IP. Surprisingly, however, there has not been a book providing a broad and comprehensive picture from the perspectives of the very nature of AI technology, its commercial implications, its interaction with different kinds of IP, IP administration, software and data, its social and economic impact on the innovation policy, and ultimately AI's eligibility as a legal entity. The book aims to fill the gap.

This chapter examines debates on intellectual property (IP) and development in the wider context of issues relating to IP and the public interest. It also considers how calls for greater attention to development in the global IP system relate to campaigns for “access to knowledge” (A2K). After reviewing the longstanding debates on IP and public policy issues as well as the substance of debates on IP, development, and A2K, the article discusses the engagement of developing countries in the international IP system up until the end of the World Trade Organization’s Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS) negotiations. It proceeds with a review of post-TRIPS debates on the Agreement itself, before concluding with an analysis of the continuing challenges of addressing public interest and development concerns in the increasingly complex global IP system.

Abstract:
People with disorders of intellectual development (DID) have a diversity of abilities and consequent support needs. Adjustment difficulties give rise to mental distress and behavioural concerns when expectations are more than can be managed in the absence of needed supports. People with DID also experience a disturbing range of negative life events, trauma, and adversity, all of which can trigger adjustment disorder. Unless such stressors are identified, the individual with DID may be diagnosed with more serious psychiatric disorder, and the opportunity to remove the stressor and offer psychological treatment that both minimizes the emotional impact of the stressor and enhances coping (best practice) is lost. Chronic adjustment disorder, other serious psychiatric disorders, and challenging behaviours may develop and be perceived as treatment resistant (as long as the stressor remains). These diagnostic and treatment issues, in the context of the lives of people with DID, are explored in this chapter.

This book examines intellectual property (IP) protection in the broader context of international law. Against the background of the debate about norm relations within and between different rule systems in international law, it constructs a holistic view of international IP law as an integral part of the international legal system. The first part considers norm relations within the international IP law system. It analyses the relationship of the two main unilateral IP conventions to the World Trade Organisation (WTO) Agreement on Trade Related Aspects of International Property Rights (TRIPS), as well as the relationship between TRIPS and subsequent Free Trade Agreements (FTAs). The second part discusses alternative rule systems for the protection of IP. The third part identifies important intersections and links between the traditional system of IP protection and other areas of international law related to environmental, social, and economic concerns. These include free trade in goods; biological diversity, genetic resources, and traditional knowledge; multilateral environmental agreements (MEAs) on climate change; and access to medicines and food. This analysis provides significant insights into the nature and quality of international law as a legal system. The fourth part identifies appropriate norms within the international IP system that can respond to these complexities and linkages.

This chapter examines the prosopography of those who ‘made’ Ruz al-Yusuf, an Egyptian weekly magazine founded by the actress Fatima al-Yusuf in 1925. It addresses the presentation of an intellectual milieu through an examination of the authors who contributed to the title from 1925 to 1937, among them ‘Abbas Mahmud al-‘Aqqad, and Muhammad al-Tabi‘i, a gifted editor and journalist. A detailed study of their biographies and lived histories reveals generational similarities rooted in a particular political context and demonstrates how journalism was in the process of being defined by the aspirations, personal histories and aims of its practitioners. The second theme concerns the professionalisation of journalism and explores whether professional journalism necessarily means the development of a ‘news press’ following the Anglo-Saxon model or the French ‘opinion press’ model.

Distinctions among social science disciplines are historically forged and to some extent intellectually arbitrary. Connecting them is therefore crucial to fully addressing many important intellectual and practical concerns. This chapter analyzes three of the most important movements to shape interdisciplinary social science since World War II: area studies, quantitative methods, and problem-oriented research. All three were influenced by funding, by social change, and by desires to make knowledge practically useful. All three influenced basic as well as applied social science. And all three remained approaches that crosscut the disciplinary structure of social science rather than becoming the bases for new disciplines or academic departments. They remain important in themselves and as exemplars of interdisciplinary intellectual work and influence.
