Commissioning is a cyclical process of that demands an understanding of the needs of prospective and current patients and service users, knowledge of community and institutional assets for psychiatric care, information on those public private and independent organizations available and willing to provide services, a wide and deep understanding of psychiatric nosology and treatments available, an ability to turn this information into a contract that is negotiated with the relevant providers, a recognition of cost and quality, a resource allocation methodology, and a system of measurement and clinical governance. Care planning, needs assessment, service development, and contracting disciplines each have their own ethical codes and values bases; by using values-based systems that engage patients and seek to meet patients lived experience, commissioners can shape the most appropriate service relevant to the patients’ recovery objectives.

Edited by internationally recognized practitioners of supportive care medicine and grief counseling, these are unflinching, first-person narratives of authors walking in their own shoes. The narratives reveal losses of cherished loved ones, integrity, dreams, naïve views of colleagues, and the lack of institutional support for these inevitable experiences. Although the narrators are well-established leaders in their fields, serious loss brought each back to the exposed core of their most basic selves. This introductory chapter first sets out the book’s purpose, which is to describe and explain legal and conduct risk, and suggest possible approaches to the management of these risks. Legal risk is defined as risk arising in the operation and practices of the financial markets. They are a part of the spectrum of risks that are inherent in the operations of banks and other financial institutions, affecting the lives of the people who work there and the customers who put their trust in them as well as, in more extreme cases, the financial system itself. On the other hand, the European Banking Authority defines conduct risk as ‘the current or prospective risk of losses to an institution arising from an inappropriate supply of financial services including cases of wilful or negligent misconduct’.

It has long been assumed that college admission should be a simple matter of sorting students according to merit, with the best heading off to the Ivy League and highly ranked liberal arts colleges and the rest falling naturally into their rightful places. Admission to selective institutions, where extremely fine distinctions are made, is characterized by heated public debates about whether standardized exams, high school transcripts, essays, recommendation letters, or interviews best indicate which prospective students are worthy. And then there is college for everyone else. But what goes into less-selective college admissions? Ravenwood College was a small, private, nonprofit institution dedicated to social justice and serving traditionally underprepared students from underrepresented minority groups. To survive in the higher education marketplace, the college had to operate like a business and negotiate complex categories of merit while painting a hopeful picture of the future for its applicants. This book is a snapshot of a particular type of institution as it goes about the business of producing itself and justifying its place in the market. This book documents what it takes to keep such an institution open and running, and the struggles, tensions, and battles that members of the community tangle with daily as they carefully walk the line between empowering marginalized students and exploiting them.

Under IFRS9, Financial Institutions are required to implement impairment frameworks to determine the expected losses on their credit portfolio taking into account the current (so called “point in time”) and the prospective (so called “forward looking”) economic cycle. The Covid-19 pandemic, which began in early 2020, has posed significant challenges for Financial Institutions in their ability to manage credit risk. Despite numerous guidelines given by regulators, estimating IFRS9 expected loss continues to be a considerable challenge. The challenge partly stems from the relationship between macro-economic scenarios and credit losses, the treatment of moratoriums inside the historical series for development and calibration of IFRS9 risk parameters, and the management of support measures defined at National and European levels (e.g. Next Generation EU) for the forward looking estimations.

The text offers theoretical insights from a historical, contemporary and multidisciplinary lens, while examining the embedded meanings of the university as an institution, idea and set of practices to show the shifts and changes that were inaugurated by #MustFall along with the historicities that define the university both locally and globally. The retro- and prospective insights presented in the book surface the crisis of authority that places the university in a state of precarity, which is framed in the book as the ‘border’. The volume proposes the concept of the ‘border’ (recognising its conceptual and analytical dynamism) as a generative space that can facilitate new imaginaries and articulations of this social institution: the university.

Is it wrong for prospective parents not to select against having children with disabilities because these children impose substantial costs on society? Recent writers such as Stephen John have argued that the state should fund prenatal diagnosis based on expected cost savings and that parents who have had a reasonable opportunity to avoid having a child with a disability should bear some of the additional costs of raising the child. This chapter offers three responses to these social cost arguments: claims about increased costs and reduced productivity are greatly exaggerated, modern states subsidize many similar costs of childrearing and do not attempt to limit the number of children per family to reduce these costs, and luck-egalitarian theories of justice do not adequately respect the institution of the family.

This chapter examines the role of the International Seabed Authority (ISA) in global ocean governance. In particular, it highlights the assumption of ISA's explicit mandate for environmental protection as an integral aspect of its overall governance of the deep sea-bed ‘Area’ beyond national jurisdiction, especially following the 1994 Implementation Agreement to the 1982 United Nations Convention on the Law of the Sea (UNCLOS). This assumption is particularly significant given the fact that the ISA work programme has now progressed to the point where as of 31 January 2017, a total of twenty-six contracts for exploration had entered into force (sixteen for polymetallic nodules, six for polymetallic sulphides and four for cobalt-rich ferromanganese crusts). The chapter also discusses various activities undertaken in the Area, such as prospecting, exploration and exploitation of resources; marine scientific research; and benefit-sharing for exploitation on the outer continental shelf. Finally, it considers ISA's emphasis on the importance of international cooperation in implementing its mandates.

Advance care planning (ACP) is a rather new development in Germany. From 2008 to 2011, the Federal Ministry for Research and Education funded the prospective inter-regionally controlled study of the ACP programme ‘beizeiten begleiten’ which was implemented in one town’s nursing homes. In September 2015, the fifth International Society of Advance Care Planning and End of Life Care conference in Munich further stimulated ACP development in Germany, both on regional and national levels. In December 2015, new legislation was passed which will provide funding from the sickness funds to German nursing homes and care institutions for people with disabilities if they offer ACP to their residents. While currently the details of the implementation are being negotiated between national representatives of the care home carriers and the sickness funds, several regions have started to implement the ACP programme ‘beizeiten begleiten’, and the first ACP facilitator trainings are being offered across Germany.

This chapter examines the key environmental elements of the International Seabed Authority's (ISA) ‘Mining Code’, a regulatory framework for the commercial exploitation of mineral resources. The term ‘Mining Code’ refers to the whole comprehensive set of rules, regulations and procedures issued by the ISA to regulate prospecting, exploration and exploitation of minerals. The set of rules includes the collaboration of the respective responsibilities of deep seabed explorers and of the ISA in order to ensure environmentally sustainable development of deep seabed mineral resources. The chapter first provides an overview of the general regulatory framework for deep seabed mining, which is a contract-based system, before discussing the continuous legal evolution of the Mining Code. It also considers the generic issues that need to be addressed in relation to the future exploitation of minerals and explains why exploitation-related environmental regulations must be an integral component of advancing the Mining Code.

This chapter examines the Malaysian position on privity and third party beneficiaries. Given that the Malaysian Contracts Act 1950 (‘MCA 1950’) is virtually a copy of the Indian Contract Act 1872, the issues are, unsurprisingly, similar. The absence of a clear statement of the rule in the MCA 1950 meant that its existence was susceptible to challenge. It was only in Kepong Prospecting Ltd v Schmidt, when the Privy Council pronounced on the fundamentality of the privity rule, that the matter was finally settled. This chapter demonstrates the ingenuity and the limitations of the common law. The strategy of finding an express trust of a promise finds a familiar trajectory in the use of that strategy in England. The need to prove the three certainties of intention to create a trust, beneficiaries, and subject matter emphasizes the clear intention to create property rights. An alternative explored by the author relates to the institutional constructive trust which requires a proprietary base by which the constructive trust may be found.
