Abstract:
Abstract International law-making takes various forms. The UN General Assembly has a general mandate for new law-making, but it has not engaged in major treaty making for some time. The International Law Commission (ILC), charged with codification and progressive development of international law, has not in recent years dealt with topics that are relevant to the pressing need of the international community as a whole. In such an environment, it is remarkable that the Institut de Droit International (IDI), the 19th century type of an old institute, has embarked on the law-making activity on the critical issue of prevention and control of epidemics with the unusual sense of urgency, adopting in August 2021 a Resolution composed of 17 Draft Articles and Preamble. It is hoped that a comprehensive framework convention on epidemics will be elaborated on the basis of this Resolution in the near future.

Avec la création des tribunaux pénaux internationaux des Nations Unies et l’entrée en vigueur le 1er juillet 2002 du Traité de Rome instituant la Cour pénale internationale, le statut pénal des hauts fonctionnaires des États en droit international est devenu difficile à saisir. Le caractère impératif des normes qui fondent la répression des crimes de jus cogens tend à effacer, dans l’imagerie des défenseurs des droits de la personne, la distinction entre la responsabilité des gouvernants en exercice et celle des anciens dirigeants. Or le droit international est demeuré westphalien sur la question. L’auteur démontre que pour cette catégorie de personnes, une immunité devant les tribunaux étrangers subsiste. Il soutient aussi que la contribution de la justice pénale internationale au changement de paradigme est limitée du point de vue de la nature des crimes poursuivis et de la compétence des tribunaux internationaux devant lesquels la qualité officielle n’est pas admissible comme moyen de défense.

This article deals with a phenomenon which appears in a particular context: the institutionalisation of international law between 1869 (creation of the Revue de droit international et de législation comparée) and 1873 (birth of the Institut de Droit International), through the international networks of the Belgian lawyer Gustave Rolin-Jaequemyns. He was close to Pasquale Mancini, John Westlake, James Lorimer, Franz Von Holtzendorff, but also to the least-known Michael Corr-Van der Maeren, a publicist. Until this period of crystallisation this field was not structured and represented an aggregate of individualities. What can we say about such a process of institutionalisation on the basis of unpublished archives? The history of international law, until today, especially studied by lawyers, was very neglected by historians, whose methods and sources are complementary to those of the lawyer. Our contribution wishes to contribute to the development of a history of international law written by historians.

Abstract:
We look here at the work and action pertaining to the regulation of migrations of international lawyers belonging to the Institut de Droit International (IDI) during the four decades before the First World War. We show that interest for the rights of foreigners in western states and the circulation of people derived both from the liberal agenda these lawyers shared and the will to regulate the interactions between states that could produce conflict. The idi devised during that period a coherent set of rules and recommendations insisting on a minimal protection of refugees, and the necessity of granting foreigners and nationals equal civil rights. The position of power the members of this liberal network shared enabled them shortly before the First World War to ensure that some of these provisions became shared legal norms, even if for a short time and only for some European states.

The importance of the widespread reliance upon direct arbitration, particularly arbitration under the International Centre for Settlement of Investment Disputes (ICSID), and of the practice of “arbitration without privity” is at the root of the search for a definition of investment, as underlined by the 2013 Resolution of the Institut de droit international (IDI). The Resolution refers to a development-friendly definition of investment. This article aims to explain to what extent a definition based upon references to sustainable development would constitute an acceptable specification, albeit a partial one, of the term “development” used in the IDI Resolution, in light of the need of a reconciliation between private and public interests within current international investment law. The article also deals with the issue of whether the ICSID Convention provides for an autonomous definition of investment that cannot be overridden by the terms of a given international investment treaty, and if so, which criteria should be taken into consideration for the purposes of determining whether an investment exists within the meaning of Article 25(1) of the ICSID Convention.

The rise of modern international law as an autonomous scientific discipline in the early 1870s can be considered the culmination of multiple legal and extra-legal processes which trace their origins back to much earlier in the century. Several decades before the founders of the Institut de Droit International declared themselves the “legal conscience of the civilized world”, other societal groups had already expressed profound disaffection with the existing law of nations, which they viewed as inherently insufficient to guarantee lasting stability amongst civilized states. The conferences of the “Friends of Peace”, held between 1843 and 1851 in several European cities, featured many jurists who routinely employed legal modes of reasoning to communicate and advance legalistic objectives such as mandatory international adjudication and the codification of international law.

Abstract: The European Copyright acquis communautaire seeks a balance between a high level of protection of right holders on the one hand and the promotion of learning and culture on the other by instituting strong exploitation rights and providing exceptions to these exclusive exploitation rights for purposes of research, education and the dissemination of knowledge and culture. The use of copyrighted works for several non-commercial research purposes is therefore made possible under European Union (EU) copyright law. In this article, it is shown that, despite its increasingly international character, copyright law remains largely national law, based on the principle of territoriality. National regimes vary significantly throughout the Member States, which leads to legal uncertainty, and may cause obstacles in transnational teaching and research. It will be concluded that harmonization of 'EU Copyright Law', which is flexible enough to cope with every challenge the digital age poses, is still a work in progress, which will continue into the coming years, if not decades. Résumé: L'acquis communautaire en droit européen du droit d'auteur cherche un équilibre entre d'une part un haut niveau de protection des ayants droit et d'autre part la promotion de l'enseignement et de la culture, en instituant d'importants droits d'exploitation et en prévoyant des exceptions à ces droits d'exploitation exclusifs dans un but de recherche, d'éducation et de diffusion de la connaissance et de la culture. L'utilisation d'oeuvres protégées par le droit d'auteur dans différents buts de recherché non-commerciaux est ainsi rendue possible en droit d'auteur européen. Dans cet article, il est indiqué que malgré son caractère de plus en plus international, le droit d'auteur demeure largement un droit national, basé sur le principe de territorialité. Les régimes nationaux varient de manière significative selon les Etats membres, ce qui conduit à une incertitude juridique et peut constituer des obstacles dans l'enseignement et la recherché transnationaux. Le présent article conclut que l'harmonisation du "droit d'auteur européen" qui est suffisamment souple pour affronter les défis de l'ère digitale, est encore en développement, lequel se poursuivra au cours des prochaines années, voire décennies. Zusammenfassung: Im acquis communautaire des europäischen Urheberrechts wird ein Gleichgewicht, zwischen einem hohen Schutzniveau der Rechtsinhaber einerseits und einem Fortschritt für Entwicklung und Kultur andererseits, angestrebt. Dazu werden zum einen starke Lizenzrechte implementiert, gleichzeitig aber auch Ausnahmen für diese exklusiven Nutzungsrechte für Zwecke der Forschung, Lehre und Verbreitung von Wissen und Kultur geschaffen. Dementsprechend ist die Nutzung urheberrechtlich geschützter Arbeiten für eine gewisse Anzahl an nicht-kommerziellen Forschungszwecken gemäß EU-Urheberrecht möglich. In dem vorliegenden Beitrag wird aufgezeigt, dass das Urheberrecht trotz seines immer stärker werdenden internationalen Charakters nach wie vor weitestgehend nationales Recht, basierend auf dem Territoritalprinzip, bleibt. Die nationalen Regelungen der Mitgliedsstaaten variieren jedoch signifikant, was zu Rechtsunsicherheit führt und Hindernisse für transnationale Forschung und Lehre mit sich bringen kann. Schließlich wird die Schlussfolgerung gezogen, dass die Harmonisierung eines "EU-Urheberrechts", das flexibel genug ist, allen Anforderungen, die das digitale Zeitalter bringt, zu begegnen, eine anhaltende "Baustelle" ist, die noch die nächsten Jahre, wenn nicht Jahrzehnte andauern wird.

Abstract: In this article, O. Lando investigates if good faith can be considered an overarching principle in European contract law. It looks at the principle from a historical and comparative law perspective. In all continental European countries a general principle of good faith can be found. The principle is also encountered in the Principles of European Contract Law, the Unidroit Principles of Commercial Contracts and, to some extent, in the Vienna Convention on the International Sale of Goods. However, in English law good faith is not treated as an over-arching principle, although the principle can be found incidentally in specific regulations and cases. O. Lando concludes that, in spite of logical and technical arguments to the contrary made by H. Beale, good faith is an over arching principle. Résumé: Dans cet article, O. Lando étudie si la bonne foi peut être considérée comme un principe primordial du droit européen des contrats en l’analysant du point de vue historique et du point de vue du droit comparé. Le principe de bonne foi se retrouve dans tous les pays continentaux européens et est également présent dans les Principes du droit européen des contrats, les Principes d’UNIDROIT relatifs aux contrats du commerce international, et dans une certaine mesure, dans la Convention de Vienne sur les contrats de vente internationale de marchandises. Der Beitrag stellt diesen Grundsatz sowohl in einem historischen als auch in einem vergleichenden Zusammenhang dar. In allen Staaten des europäischen Kontinents ist ein allgemeiner Grundsatz des Treu und Glauben wiederzufinden. Dieser Grundsatz ist ebenfalls in den Principles of European Contract Law, den Unidroit Principles sowie zum Teil auch im Übereinkommen der Vereinten Nationen über Verräge über den internationalen Warenkauf aufgenommen. Im englischen Recht wird der Grundsatz des True und Glaubens nicht als ein allumfassender Grundsatz angesehen, obwohl er gelegentlich in einigen spezifischen Bestimmungen und gerichtlichen Entscheidungen wiederzufinden ist. The status in international law of operational warships and other ships used only on governmental non-commercial service has been long established. In contrast, the status of such vessels after they have sunk has been, and remains, a matter of considerable uncertainty. The uncertainty arises in no small part from the absence of any provision in the 1982 UN Convention on the Law of the Sea relating to sunken State vessels or, indeed, to wrecks more generally. Over the last 30 years, technological advances have led to the discovery of many new wreck sites, fuelling international interest in the status of sunken State wrecks. At its Santiago Session in 2007, the Institut de droit international established its 9th Scientific Commission to look into the matter. A Preliminary Report, drafted by the Commission’s Rapporteur, Professor Natalino Ronzitti, was discussed at the Rhodes Session in 2011 and, after further deliberations, a Resolution entitled “The Legal Regime of Wrecks of Warships and Other State-Owned Ships in International Law” was adopted by the Tallinn Session in August 2015. This contribution sets out the background to the work of the 9th Commission, outlines the substance of the Resolution, and offers some observations thereon.

Nous lui devons notamment les trois premiers instruments modernes du droit des conflits armés. Le 26 novembre 1820, le libérateur Simón Bolívar et le pacificateur Pablo Morillo signèrent un traité sur la régularisation de la guerre, qui n'avait d'autre but que d'étendre aux guerre civiles les règles de la guerre internationale. En 1832, Andrés Bello publia ses Principes du droit des gens, qui proposent une approche systématique de la guerre et de ses conséquences. It is generally considered that an international organization (‘IO’) has an international legal personality which is distinct from that of its Member States, as a result of which the IO itself, rather than the Member States, is to be held responsible for the IO's internationally wrongful acts.1 It appears to be an accepted principle that Member States cannot generally be held liable for the acts of IOs by virtue of their membership of an IO alone. This view can be found in a 1996 resolution of the Institut de Droit International, which provides that ‘there is no general rule of international law whereby States members are, due solely to their membership, liable, concurrently or subsidiarily, for the obligations of an international organization of which they are members.’2 This is echoed in the International Law Commission's (‘ILC’) Commentary to article 62 of the Draft Articles on the Responsibility of International Organizations (‘ILC DARIO’): ‘It is clear that … membership does not as such entail for member States international responsibility when the organization commits an internationally wrongful act’.3 The ILC holds the view that only in the case of an intervening act by a Member State that influences the commission of a wrongful act by the IO (aid and assistance, direction and control, coercion, avoidance of compliance, acceptance) could the Member State be held responsible.4

Abstract:
This article explores the expression of State sovereignty through customary norms in a regulatory space dominated by investment treaties. It argues that, because most of the actionable concepts expressing sovereignty in international law are general (not specific to a “branch”) andcustomary, misunderstanding the role of customary law in investment regulation amounts to confining sovereignty to a few narrow carve-outs and exceptions in investment treaties. However, customary concepts operate autonomously and in parallel to treaties, unless specifically excluded by the latter. The lex specialis principle does not necessarily command the exclusion in toto of relevant customary rules. The article discusses the work of the Institut de Droit International in this regard and then analyses the investment case law relating to the application of the police powers doctrine, necessity, countermeasures and transnational public policy. It shows that failure to address specifically the articulation of treaty and customary norms even in the event the former apply as lex specialis is subtly eroding, without clear legal grounds,the customary expression of sovereignty in foreign investment disputes.

One of the areas of research and controversy has been Article 31(3)(c) of the Vienna Convention on the Law of Treaties which, arguably, enshrines the principle of systemic integration. The aim of this article is to explore the evolution of Article 31(3)(c) from its first inception by the forefathers of international law up to the finalization of the text of the Vienna Convention on the Law of Treaties. By mapping the critical arguments in the three main fora of debate (i.e the Institut de Droit International, the International Law Commission and the Vienna Conference on the Law of treaties) what arises is a series of conclusions with respect to certain aspects of Article 31(3)(c) as well as certain recurring themes in the nature and progress of the discussions. All of the above will show that the drafting history of Article 31(3)(c) seems to suggest that the relevant provision was meant to serve a purpose expressed more concisely by the symbol of Ouroboros rather than of a mere "master-key" to the house of International Law.

AbstractThis article considers the influence of teachings of publicists on the development of international law. The category of ‘teachings of publicists’ is not a homogeneous one. The article argues that it can be divided into: entities that have been empowered by States to conclude teachings, such as the International Law Commission; expert groups, such as the Institut de Droit International; and ‘ordinary’ publicists. The teachings of ordinary publicists are also of different types and include digests, treatises, textbooks, monographs, journal articles, and blog posts. Only by breaking down the category into its various types can the influence of the teaching of publicists on the development of international law be properly gauged. Even then, it can prove rather difficult to pin down the notion of ‘influence’. Standard assessments of influence focus on the extent to which teachings are cited by courts and tribunals, in particular by the International Court of Justice. However, that approach privileges the role of courts and tribunals in the development of international law and overlooks the role of other actors. As such, the present article offers a different assessment of influence. It identifies the actors that comprise the community of international lawyers and analyses the various interactions that take place between these actors and the teachings of publicists. It is through this interaction, of which citation is but part, that the influence of the teachings of publicists can properly be determined.

Summary“Peaceful Coexistence,” a basic premise for minimum world public order during the Cold War, has re-emerged as a possible paradigm-model for world order in the present era of clashing or colliding civilizations. When the idea of codifying the general principles of peaceful coexistence was first advanced in the still-continuing Cold War, it was rejected by specialist legal bodies like the United Nations' International Law Commission and also the Institut de droit international as too “political” and thus incapable of being reduced to a scientific-legal foundation. The resulting intellectual-legal gap was promptly filled, however, by the non-governmental International Law Association (ILA), which established its own expert committee. Long-range fruits of this ILA initiative — apart from the all-important opening of a direct East-West legal dialogue — were the celebrated UN General Assembly Resolution 2625 of October 1970 and the acceptance of the pragmatic, empirical, problem-solving, step-by-step approach to resolving East-West conflicts in concrete cases — the ultimate road to détente on a deliberately nonideological case-by-case basis. The Canadian Branch of the ILA, with the support of the Canadian Department of Foreign Affairs' Legal Division, was a leader in the ILA's decision to take up that project and participated fully until its successful completion.

RésuméCette réflexion se propose d’analyser le texte du projet d’amendements du Statut de Rome visant à inclure dans le champ matériel de la Cour pénale internationale (CPI) un crime d’écocide. Conçu sous l’égide d’une organisation non gouvernementale réunissant douze spécialistes-praticiens du droit international de l’environnement et du droit international pénal, ce texte vient marquer les bases d’une définition juridique d’un crime écologique autonome. S’inscrivant dans la dynamique d’incrimination des dommages gravement attentatoires à l’environnement, cette démarche de caractérisation remonte dans la brume grisâtre d’un passé un tout petit peu lointain. L’on relèvera à cet effet que l’opération Ranch Hand au Vietnam constitue l’un des repères structurant l’urgence de criminaliser les actes graves d’atteinte écologique. C’est dans cette perspective que les travaux de la Commission du droit international sur la codification des crimes contre la paix et la sécurité de l’humanité soulignent l’intérêt d’incriminer aussi bien les dommages écologiques perpétrés en temps de paix que dans le contexte de belligérance. Le Statut de Rome s’étant limité, dans sa conception originale, aux seuls dommages écologiques perpétrés en temps de guerre, ce projet d’amendements du Statut de Rome rend compte de l’intérêt de prendre en charge notamment les milliers d’atteintes écologiques émanant, en temps normal, des multinationales et des criminels maffieux, à travers une incrimination autonome consacrant l’écocide comme cinquième crime contre la paix et la sécurité de l’humanité. Force est de souligner que cette proposition de révision vient rééquilibrer les fondements épistémologiques d’une convention par excellence anthropocentrique en lui assignant une bonne dose d’éco-centrisme. C’est donc l’occasion de souligner qu’ayant été assumé par le Vanuatu à l’occasion de la 20ème session de l’Assemblée générale des États-parties du Statut de Rome, ce texte constitue la base sur laquelle repose cette révision conventionnelle. Il appartiendra aux États-parties au texte instituant la CPI de se l’approprier à travers leur implication dans le processus de révision.

Se investiga en este trabajo la única visita que Hans Kelsen hizo a España a lo largo de su vida. Esta visita fue a Granada, en 1956, para asistir a una reunión del Institut de Droit International. La Universidad de Salamanca había nombrado a Kelsen doctor honoris causa, junto con otros juristas, en 1954, con ocasión de su VII Centenario. En ese acto se había otorgado también la misma distinción a Francisco Franco, Jefe del Estado español. Kelsen no acudió al acto de investidura. Cuando dos años después visita Granada se interesa, sin embargo, por obtener el diploma acreditativo dirigiéndose por carta a la Universidad de Salamanca. Esta carta se publica al final del presente trabajo. El objeto del mismo es averiguar la conexión que existió entre estos acontecimientos: por qué Kelsen no acudió a Salamanca para ser investido como doctor honoris causa en 1954 y por qué reivindicó este título en 1956 en su visita a Granada. Para ello, el trabajo considera tanto el contexto histórico-político de las relaciones España-Estados Unidos en ese momento, como también el contexto biográfico de Kelsen.
