Abstract:
Many national independent struggle movements in Indonesia began from traditional Islamic boarding schools (pondok pesantren). One of the the movements was established by KH. Zainal Musthafa of Tasikmalaya, West Java. This study aims to examine this scholar’s struggle of independence and his spirit in developing the nation's intellectual life. Based on interview and historical archives, this study shows that KH. Zainal Musthafa plays a vital role in the independence struggle. He was a role model, who was not only a Muslim religious scholar (‘ulamā’), but also a fighter against colonialism. His struggle was motivated by the values and principle of tawḥīd (Oneness of God) and the spirit of Indonesian independence. His struggle furthermore departed from and was shaped by, the teachings offered at traditional Islamic boarding school. This suggests that traditional Islamic educational system, spiritualism and mode of Islamic religiosity developed by pesantren constitute one of the most relevant aspects of Islam in the struggle for Independence and, as this paper argues, remain relevant to the contemporary Indonesian spiritual and intellectual life. It is through pesantren and their leaders that Islamic spiritualism and public intellectualism have thrived up to the present.

Abstract:
PurposeThis study aims to investigate the intellectual capital–financial performance relationship using two models, namely the conventional Value-Added Intellectual Coefficient (VAIC) model and the adjusted Value-Added Intellectual Coefficient (A-VAIC) model.Design/methodology/approachThis study is designed as a quantitative research focusing on the relationship between intellectual capital and financial performance of the banking industry in Indonesia. As many as 114 data are derived from the publicly listed banks on the Indonesia Stock Exchange for the period of 2012–2017. The multiple regression analysis is employed to test the hypotheses studied.FindingsIn general, the result confirms that intellectual capital affects financial performance. Although not all hypotheses of the study are supported by either the VAIC model or the A-VAIC model, the results provide a deeper and new insight on how each component of intellectual capital efficiency (human capital, structural capital, capital employed, innovation capital) relates to financial performance (return on asset, return on equity, asset turnover, price to book ratio). The results also justify that further improvements in measuring intellectual capital are still needed in the future.Research limitations/implicationsThis study limits its generalization since the sample is only in the Indonesian banking industry. Notwithstanding the limitation, the results imply that the Indonesian banking managers need to be aware of intellectual capital management because of its strategic role in enhancing financial performance.Practical implicationsThis study contributes to the intellectual capital literature by providing empirical evidence on the use of both models, namely the conventional VAIC and the A-VAIC in the Indonesian banking industry research setting which is never been studied before.Social implicationsThis study has the social implication to the enhancement of the quality life of the society. The higher the quality of intellectual capital in the banking firms, the better the banks serve the needs of the community.Originality/valueThis study contributes to the IC literature by providing empirical research on the use of the VAIC model and the A-VAIC model in the Indonesian banking industry.

Abstract In late New Order Indonesia, industrialization generated among Jakarta’s intellectuals a sense of entrapment in an ‘onrushing century’ where the storm of progress had thrown their life into turmoil. What did it mean for them to find their urban experiences structured by this turmoil, which poet Afrizal Malna called an ‘architecture of rain’? Sensing that corporeal and material history may hold the key to this question, I look into why a section of New Order Jakarta’s intellectual class felt they were leading a hyper-fast, overheated life, and how they tried to come to terms with it. Focusing on thing-centred and embodied experiences, I use the tension between Jakarta’s social history and Afrizal Malna’s biography and literary work to spark a different understanding of contemporary Indonesian urbanism.

Interfaith relation in Indonesia remains unresolved thoroughly. Although outwardly it looks harmonious and calm, but behind it there is a ready-threatening waves. This paper argues that disharmony among religious followers in Indonesia, particularly between Muslims and Christians, has rooted in Islamic jurisprudence (fiqh) which stipulates the doctrines of interfaith relation. This specifically delves into some religious edicts (fatwas) on this particular phenomenon issued by three leading Islamic organizations, namely Nahdatul Ulema (NU), Muhammadiyah, and the Indonesian Council of Ulema (MUI). These fatwas are deemed to be part of religious narration that rests in intellectual discourse which more or less affects the observance of religious life in Indonesia.

Abstract:
This article challenges conceptions of intellectual disability that view such conditions from the perspective of normalcy. In Indonesia, conversations of theological anthropology still employ a medical model lens, which perceives disability merely as bodily and intellectual impairments, thus failing the standard of "normal." Normalcy unilaterally defines disability and dictates normative approaches toward persons with disabilities. Consequently, persons with disabilities are perceived in Indonesia as mere objects of charity to be pitied. On the other hand, they remain susceptible to suffering violence. These trends owing to the fact that Indonesian society does not adequately provide either tangible resource considerations or sufficient social support. Lacunae in the theological literature concerning disability in Indonesian contexts foment in the life of the church further challenges for persons with disabilities. For persons there with intellectual disabilities, in particular, the situation is even more severe, as their condition is regarded as a kind of punishment for sin and further stigmatized as abnormal. This article offers a constructive theology of disability to dismantle the myth of normalcy, which reduces persons with disabilities to being merely impaired organisms within society. Theological musings on the beauty of all creation, the perichoretic relationship within the Trinity, the doctrines of imago Dei and imago Christi are taken up in this essay, to offer an inclusive theology expressly for persons with intellectual disabilities.

People with intellectual disabilities in Indonesia are vulnerable to discrimination due to lack of information on diseases, treatment, education, public access, and very limited job opportunities. Karangpatihan is a village called Kampung Tunagrahita (Mental Retardation Village) because 86 of its people are suffering from an intellectual disability. A community development program of self-help group (SHG) named Rumah Harapan Karangpatihan Bangkit aims to improve the social and economic capabilities of people with intellectual disabilities in Karangpatihan Village, Ponorogo, Indonesia. The researcher applied a qualitative method in the form of a case study. Data collection techniques used in this study were an in-depth interview with the Head of Karangpatihan Village, managers of Rumah Harapan Karangpatihan Bangkit, and people with intellectual disabilities involved within the program. Secondary data were obtained through the report of the SHG Rumah Harapan Karangpatihan Bangkit and mass media news clipping. This research shows that community development programs are carried out through mentoring mentally retarded citizens through counseling individually and in groups using sign language. Through effective mentoring, mentally disabled people in Karangpatihan Village have life skills, therefore they are able to be independent, have jobs, creative and have income that fullfill their daily needs.

Abstract:
This paper begins with excerpts from Ervin Lazlo’s book, The Systems View of the World, one version of the emerging paradigm for understanding the universe, the natural world, the human psyche and human culture. The second section presents excerpts from Antonio Damasio’s book, Looking for Spinoza: Joy, Sorrow and the Feeling Brain. Damasio is a highly respected neuroscientist whose discoveries about the inner mapping of the human brain have led him to reject Enlightenment views of human psychology and replace them with another version of Lazlo’s “systems” approach. The third section presents Indonesia’s Pancasila, a five-point political ideology that serves as the foundation for their democratic republic. This ideology begins with the belief in God, but the notion of “God” is one more example of a type of “systems” thought. The fourth section includes an interview from Dr. Amad Kardimin, professor of education at Sunan Kalijaga Islamic State University in Yogyakarta, Indonesia. Dr. Kardimin describes the beliefs and way of living in the small village where he grew up. I will interpret what he says in light of my own scholarship about Aristotle’s model of the flourishing human life, a life of both practical and theoretical wisdom. Even though the people in this village are not formally educated, they are living much more wisely than many highly respected intellectuals today. Finally, I will quote from a number of public intellectuals in the United States who are very worried about the decline in quality of life in the United States today. This decline will lead to an increase in authoritarianism in the U.S. I conclude that too many developing nations have looked to the West, especially the United States, for guidelines about how to “move forward.” Their best and brightest young people are sent to Western universities and go back home to educate their own best and brightest to think and act like Westerners. This is a mistake. Indonesia is continually working on a model of education that unites the moral with the intellectual virtues. The West, especially the United States, has focused on higher and higher levels of education in science, math, and computer science without adequate concern for avoiding greed, pride, power hunger and other vices. Indonesia and other developing nations should recognize the importance of an education for wisdom. Leaders in all sectors should exhibit both moral and intellectual excellence. The future of international culture, politics and even of life on earth is at stake.

Intellectual Property Rights play a very important role in the creative economy, and the state must provide legal protection for intellectual property as a form of appreciation to creators/inventors for their efforts and hard work in producing new innovations, and minimizing the occurrence of intellectual property rights violations. However, in practice, there are several challenges and difficulties in enforcing laws related to intellectual property rights in Indonesia. This scientific journals uses normative research methods, based on written regulations and literature studies that examine aspects of theory, structure, and legal explanations. The main problems that occurs in Indonesia is the lack of public= awareness and education regarding intellectual property, and this problem can be the root of other problems. Everyone has the right to a decent life which is adaptive to his or her health and well-being. The results showed that: (1) the community development program was successfully implemented by mentoring people with intellectual disabilities through various training activities such as crafts, catfish cultivation, animal husbandry as well as batik making; (2) the success of the program was supported by the active role of facilitators and the participation of local communities. The program was able to improve the lives and skill repertoire of the intellectually disabled. Therefore, they are able to be independent and creative while having a job and an income.

Background: Sexuality is an integral part of adult human life, including for individuals with a disability. Even though sexuality is a fundamental right of human life, however, for a person with an intellectual disability, expressing and exploring sexuality is limited. This study aimed to determine the reliability and validity of ASQ-ID in the Indonesian language. Methods: A cross-sectional observational study designed for adaptation and validation of the Attitudes toward Sexuality Questionnaire in Intellectual Disability (ASQ-ID) of the Indonesian version was conducted in 2019. The study subjects were 617 students of Universitas Diponegoro, Indonesia. The translation process was composed of 5 steps: translation, synthesis, back translation, and semantic and conceptual analysis testing. Exploratory Factor Analysis (EFA) with principal component analysis (PCA) as a method of extraction and varimax rotation was used to identify the structure/dimensionality of observed data and identify clusters of inter-correlated variables. Pearson's r-correlation test was used to evaluate the correlation between the original and Indonesian adaptation of ASQ-ID. Cronbach-alpha was computed across all factors/sub-scales to examine the internal consistency of the adapted questionnaire. Results: Reliability analysis showed Cronbach alpha and composite reliability of items of the Indonesia version of ASQ-ID was high. EFA analysis revealed 7 emerging factors and 28 items of solutions. The items were re-group into 4 sub-scales based on the original ASQ-ID sub-scales. Conclusion: The Indonesian version of ASQ-ID has high validity and reliability in measuring the attitudes toward sexuality in individuals with ID.

This article tries to discuss about character education building in an Islamic education perspective. It is education that forms superior character and human character in terms of intellectual, emotional, and spiritual intelligence. The totality of these three bits of intelligence will shape humans. This article is written using a sociological approach with a descriptive type. The method used is library research. The findings obtained indicate that the concept of character education in Indonesia is education that emphasizes great values originating from Indonesian national culture in the context of fostering the personality of the young generation which includes three aspects, namely moral knowledge, moral attitude, and ethical behavior (decent acting). It is following the objectives of Islamic education, which provides for three physical, spiritual, and reason aspects. Therefore, building complete human resources, in essence, is the development of character and superior human character from the intellectual, emotional, and spiritual side that can actualize the dimensions of intellectual, emotional, and spiritual intelligence holistically in the life.

Patents as part of intellectual property rights that form the basis of modern industrial growth are based on new inventions, sophisticated technology, high quality, and quality standards. A patent is granted to protect the invention in the field of technology. Provisions in Law Number 13 of 2016 regarding Patents are considered by some to have made it difficult for patent holders from abroad to take part in Indonesia. The research method used in this study is normative juridical aiming to investigate patent issues from the perspective of the law governing it, in this case about the reasons underlying its formation, namely in Article 20 of the intellectual property rights perspective. Based on the research that has been done, the enactment of Article 20 of Law Number 13 of 2016 concerning Patents is expected that the Indonesian people will feel better welfare and life because it is expected that there will be many foreign investors registering their patents in Indonesia in addition to absorbing technology transfers and opening up many employment which will then result in reduced unemployment.

Alongside the advance of Islamic reformism in the early twentieth century, one central element to pay attention is the rise of printed media, Islamic book, which enhanced the shaping of the reformist Muslims. Written in Malay with Rumi script, the books with Islamic substance first appeared as part of Islamic reform movement. Nearly all the authors were the leading activists of reformist organizations. This trend continued to develop, leading the books to emerge as an important pillar in the formation of Islamic intellectual discourses. This study focuses on the historical study of the Islamic books development and progression, with strong emphasis given to the ideas behind their rising in the courses of Indonesian history. Based on the classical theory of discourse of Michel Foucault, as well as the one of post-linguistic turn historiography, this article demonstrates, in reference to the three time periods which each presented a specific mode of intellectual thinking, the growing importance of Islamic books in the making of print-based religious life, which paved the way for the strengthening of socio-religious plurality in modern Indonesia. Firstly, Islamic Book as the voice of Islamic reform, secondly, Islamic Books in 1950s-1960s, and lastly, Islamic Books in contemporary Indonesia.

Indonesia’s Reformation in 1998 is a political change driven by the power of civil society and very much determined by the discourse in hegemonic struggle. One of the most influential intellectual ideas and leadership styles of reformation and civil society is suggested by Nurcholish Madjid. This article examines the twenty-year problems of Reformation in the view of Gramsci’s theory of hegemony by analyzing Nurcholish Madjid’s ideas. There is an intellectual imperialism which makes the national ideas embedded in the Preamble of the 1945 Constitution unable to be developed to guide the national life due to the irrelevant social sciences. This article uses the approach of discourse analysis on Indonesian Preamble of the 1945 Constitution text. The explanation shows the possibilities and the expectations after twenty years of Reformation in Indonesia.

<p>This article aims to analyze genealogies of Muslim middle class in Indonesia. It can be traced from three primary sources such as bourgeoisies, pilgrimage trip (<em>h</em><em>}</em><em>ajj</em><em>)</em> to Mecca and Medina, and education. These three sources have intertwined each other to build up Muslim middle class in social strata system that branch off in two model; bourguoises class and intellectual class. In this section, bourguoises tends to form trade alliance against Chinese domaniance and western traders who had been given privilieges from colonial regime. Meanwhile, intellectual class had focused to form ideal state for <em>umat</em> in Indonesia. Both classes are united altogether to form Islamic state as ultimate goals. High tension of political constellation in post colonial period had resulted in nationalist group as regulator class in Indonesia. Regarding political negotiation from nationalist, Indonesian Muslim middle class focused to establish Muslim society according to Medinan principles. Modern influence based on western style has affected Islamic values in grass roots level, and this resulted in the rise of modern Muslim society that embraced western style of life.</p><strong></strong>

The Preamble of the 1945 Constitution of the Republic of Indonesia explicitly states that the main task of the government of the Republic of Indonesia is to advance general prosperity, to develop the nation's intellectual life, and to realize social justice for all Indonesian people. Social inequality is a problem that is still faced by Indonesian people today. To solve the problem required supporting data analysis as a basis for policy formulation. This research was conducted with the aim of clustering provinces in Indonesia based on community welfare indicators using K-Means cluster analysis. K-Means cluster analysis is chosen based on the variance value (0.101), which is smaller than the variance value in the average linkage cluster analysis (0.152). Based on data analysis, provinces in Indonesia are clustered into three where the first cluster consists of 21 provinces, the second cluster consists of 3 provinces, and the third cluster consists of 10 provinces. Each cluster has different characteristics that can be of concern to the parties concerned to overcome the social welfare gap. Besides, in order cluster results are more easily understood, visualization of results is added with a Geographic Information System (GIS) using Indonesian maps accompanied by differences in color gradations for each cluster

Background: Children with intellectual disability experience problems in emotional regulation. This is important for children to control their emotions to face pressure and difficulties in their life. Parenting style will affect children's ability to manage their emotions and have a positive impact on children's well-being and children's emotional regulation abilities. The purpose of this study was to analyze the relationship between parenting style and emotional regulation of children with intellectual disability. Methods: The research design used a cross sectional study. The sample in this study were children with intellectual disabilities and their parents as many as 32 of 35 children who were in special schools in Surabaya Indonesia were selected by simple random sampling. Parenting style were measured using the Parenting Styles and Dimensions Questionnaire (PSDQ) and emotional regulation was measured using the Emotional Regulation Questionnaire for Children and Adolescents (ERQ-CA) with the Spearman Rho analysis test. Results: Most parents apply authoritative parenting (81.3%). Meanwhile, the emotion regulation strategy is balanced between using cognitive reappraisal (53.1%) and expressive suppression strategies (46.9%). The relationship between parenting style and emotion regulation is quite strongly correlated (p value = 0.003, r = 0.509). Conclusion: Democratic parenting applied by parents towards intellectually disabled children makes children better in terms of emotional regulation abilities. Special attention and the role of parents in this case is the application of effective parenting is needed to help children regulate their emotions which will have an impact on life in the future.

One of characters of modernist Islam organization in Indonesia is the opposition to traditionalist Islam practices. Initially, the modernist Islam activist also learned in the traditional Islam culture before they turned around. This study focuses on the roots of the traditional Islam among the modernist Islam organization activists, Islamic Union (Persatuan Islam/PERSIS). The study object is the historical life of the PERSIS chairman, Aceng Zakaria and his magnum opus works, al-Muyassar fî ‘Ilm al-Naḥw and al-Hidâyah fî Masâ’il Fiqh Muta‘âriḍah. Through a socio-intellectual historical approach, the study shows that the Islamic intellectual tradition of the modernist activists is inseparable from the learning of traditional pesantren. Aceng Zakaria, as a PERSIS ulama, originally learned at the traditional pesantren in the mid-twentieth century. The roots of traditional Islamic science influences his intellectual career which was reflected in his works. Both books, Arabic grammar al-Muyassar and fiqh discourse al-Hidâyah demonstrate his connectivity to the intellectual of traditional pesantren. However, Aceng Zakaria, as a modernist and reformist ulama, also modified his explanation systematically and practically. This shows that the genealogy of intellectual tradition of pesantren has an important position in supporting the development of reformist Islamic ideas in Indonesia.

The condition of the state border area between Indonesia and Malaysia is totally different. Children of Indonesian Workers (TKI) have no (limited) access to learn in formal schools since they do not have citizenship documents. This study aims to analyze the implementation of basic education mission in the border area, particularly in Sebatik island, Nunukan regency, North Kalimantan province. In addition, the research was conducted using qualitative explorative approach. Problems arising at the border area are very diverse and systemic. The Indonesian government conducts the education in border areas still very limitedly. The role of the public, corporate and private companies (Three Net Working) becomes very important in operating the schools in border area. The role of a former lecturer who is famously called Mrs. Midwife Suraidah is very dominant in helping TKI’s children to learn a variety of knowledge in Sekolah Tapal Batas (Tapal Batas School) in Sebatik island, Nunukan Regency, North Kalimantan province. Some help from companies such as Pertamina (national oil mining company), Dompet Dhuafa foundation and volunteers who are willing to be teachers strongly support the continuously of Tapal Batas School. The continuity of basic education in the state border becomes a challenge for the government since the purpose of the country written in the opening of Constitution 1945 is the intellectual life of the nation can be realized by implementing it in Nawacita program.

Background: Intellectual disability (ID) is a major public health problem because the defect, treatment and rehabilitation require long life both medical and socio-economic assessment. Fragile X syndrome (FXS) is the most common cause of inherited X-linked intellectual disabilities (ID) with reduced penetrance. With regards to behavioral and emotional phenotype, FXS commonly mixed up with idiopathic autism. The prevalence is found higher in males compared to females. In accordance with rapid development of diagnosis technique, the prevalence of FXS is defining worldwide including Indonesia using, currently, simple molecular method.Objectives: This study was aimed to diagnose genetic cause of ID and to establish the prevalence of FXS among ID population in Central Java, and Yogyakarta Province.Method: Screening has been performed since 1994 continuously in high risk population (special school with and without autism) using clinical, cytogenetic, and FMR1 gene PCR-based molecular approach. Cascade testing was subjected to the family members with positive result of FXS and many new cases were disclosed in our cohort study.Results: The prevalence of FXS among ID population was calculated to be 1.9% (5/262) in 1994 and 1.7% (9/527) in 2011. Among autism population it was determined to be 6.15% (4/65). Trisomy 21 was found in 14% (74/527) as a major cause of ID.Conclusion: The prevalence of FXS among screened ID population overtime is comparable.

Sexual harassment is often a problem in social life in Indonesia. The reason is that according to legal records, violence against girls (KTAP) has increased by 2,341 cases, compared to 1,417 the previous year. The increase from the previous year was 65% and the most cases were cases of incest and added to cases of sexual violence (571 cases) while sexual violence against women with disabilities increased by 47% compared to last year and the most victims were intellectual disabilities. Sexual harassment can be in the form of inappropriate behavior or rape. According to WHO in 2006 every day in the world there are women who are harassed, raped or beaten. The Indonesian Criminal Law (KUHP) which regulates this does not have a proper function, because the rules contained in it are incomplete on this issue. Sexual harassment may not cause physical pain and the like, but it can be emotionally harmful. It is very often that sexual harassment cannot be caught because Indonesian laws are imperfect in dealing with this issue. The concept of harassment in Indonesian law has reduced the significance of the harassment experienced by the victim, and therefore cannot bring justice to the victim.

Technology was created to serve and facilitate humans in carrying out their life activities. The use of the right information technology can have a positive impact, but the use of inappropriate information technology can have a negative impact. Historical facts in the Islamic world are known to the openness of Muslims to all information in developing Islamic intellectual treasures. In the teachings of Islam, it is found that Allah's affirmation through QS al-Hujurāt/49 verse 12 against facing advances in information technology. Information technology cannot be separated in the development of Islamic law because it can be a tool or media in researching and analyzing a law and developing legal information for the wider community.

Intellectual property rights are created or arise from an idea to create a product or process that can be useful for human life. Intellectual property rights are also legal protection given to the results of human thought that are useful and have economic value. Understanding intellectual property itself requires comprehensive knowledge of what can be the object of intellectual property protection. A brand is an intellectual property identifier of a product or service owned by a company or individual. Violation related to registered trademark rights in Indonesia is an act that is against the applicable positive law. This study analyzes the regulation, legal protection of registered trademarks and dispute resolution. The research method used is a normative juridical research method using secondary data in the form of regulations related to brands and the results of previous studies. The results of this study indicate that a violation in the form of imitation of a registered mark can be subject to imprisonment and a fine. There are 2 (two) ways of resolving disputes regarding the imitation of the registered mark: filing a claim for compensation and terminating all activities related to the use of the mark. The lawsuit is submitted to the commercial court and can take arbitration or other alternative dispute resolution.

<p>The article asserts that plurality—particularly with respect to religious understanding—is a certainty and an avoidable matter, which should be wisely addressed. This is a pivotal issue as the fact shows us that Indonesia, naturally and culturally, consists of various different ethnic groups. Bhinneka Tuggal Ika—as national watchword—affirms that Indonesia is founded on diversity and difference. However, Indonesian nation has to unite despite of its diversity. In addition, Indonesia is also called a colorful state. This statement refers to the fact that there are a vast number of different ethnic groups, cultures, and religions that live and exist in this country. Empirically, plurality has often caused social conflicts which involve interfaith groups with different religious understanding. The conflict occurs when these different groups are unprepared to live together harmoniously and build coexistence. Therefore, it is important to continuously promote the values of pluralism and multiculturalism in order to create a better life order based on acceptance, respect, and tolerance. To do so, emotional and intellectual intelligences—as “social modal”—are urgently required. The writer argues that this is a way—if not the sole—to bring about solution to the problem of religious plurality and religious understanding.</p>

Homeschooling practice in Indonesia has just started in 2006. There are many reasons and philosophies in the presence of home schooling, both internally such as family and students, and externally such as educational considerations. In at least, there are three types of homeschooling, they are: (1) homeschooling for pre-school children, (2) homeschooling as the substitution and complementation to formal school and (3) homeschooling as a sustainable education program. As a new category in the formal education practice in Indonesia, the presence of homeschooling should immediately be set up its connectivity model with national education system within its holistic view. It will need a comprehensively conceptual, theoretical, and philosophical consideration being the foundation of homeschooling practice so that homeschooling may run in the normative path of education. In the other hand, there is a necessity for supporting regulations, policies and action plan, which would guarantee the continuity and development of homeschooling in Indonesia. Therefore, homeschooling contributions within national education system may soon be used effectively in the efforts of promoting the intellectual life of the nation.

Genetic Resources is a foundation of human life, as a source of food, industrial raw materials, pharmaceuticals, and medicines. From its utilization may provide a financial benefit to the provider and the user of it. Unfortunately, most of it obtained from developing countries through biopiracy, including Indonesia. Furthermore, in the early 1980s, access and benefit sharing (ABS) to genetic resources became an international issue. It leads to the adoption of the Convention on Biological Diversity (CBD) in 1992. However, since it was approved, the whole ideas of excellence of it could not be implemented, a problem on it still arises. Intellectual property right laws, in certain aspects, are possible for using to protect traditional knowledge from their utilization. However, at the same time, intellectual property regime also becomes “a tool” to legitimate of biopiracy practices. Due to massive international pressure, mostly in developing countries, it proposes two kinds of protections, which are positive protection and defensive protection. This paper will examine one of it, which is positive protection. By using the normative method and qualitative approach, this paper identified at least two kinds of positive protections that we can develop to protect genetic resources related to traditional knowledge, which are optimizing the patent law and developing the sui generis law. Furthermore, it can be done by some revision by adding new substances, an improvement on the articles, or even by doing the deletion on certain articles. Moreover, in order to develop the sui generis law, it identified several minimum elements that shall be contained on it, inter alia: the purposes of protection; scope of protection; criteria of protection; the beneficiaries of protection: the holder of traditional knowledge; the kind of rights to be granted; how the rights acquired; how to enforce it; how the rights lost or expired; and dispute resolution. Over thecourse of his well-documented discussion of decisions rendered by fourmain Indonesian fatwa-issuing bodies, Hooker highlights their methods ofreasoning and the authorities they heed. <p>In this autobiographical essay, Martin van Bruinessen looks back at the diverse intellectual influences that contributed to his formation as a scholar of Indonesian Islam. He was never trained as an Indonesianist or a scholar of Islam, and came to the subject through a series of unplanned changes in his life trajectory. His first acquaintance with Indonesia was through late colonial and post-colonial Dutch literature. It was followed in his student days by critical reporting on the massacres of 1965-66 and a re-reading of Indonesian history from an anti-imperialist viewpoint. His formal academic training was in entirely different disciplines, and his first experience with anthropological fieldwork took place in a different part of the world. A fortuitous post-doctoral appointment at KITLV, followed by four years at LIPI as a consultant for research methods, enabled him to acquaint himself directly with contemporary Muslim discourses and movements. He had the good fortune of working with leading Indonesian Muslim intellectuals, who became his major teachers. Only when he became a teacher and thesis supervisor himself, at the IAIN Sunan Kalijaga and later at Utrecht University, did he feel the need to reflect on how his own research relates to established academic traditions. The essay documents his growing appreciation of, and lasting critical distance from, the Leiden school of Oriental studies and his relationship with the French tradition of Islamic and Indonesian studies. AbstractAccess to medicines and health facilities is a form of fulfillment of the right to health which, if not fulfilled, will result in the loss of the right to life. During the time of COVID-19 that hit the whole world, data released by WHO stated that 4,592,934 people had died from COVID-19, and the number was growing globally every day. However, only 5,352,927,296 doses of vaccines have been administered worldwide, with most going to developed countries. Experts predict the global population will be fully vaccinated by at least September 2023. WHO research shows that through vaccination, the rate of transmission of the disease can be reduced, and even if the subject is infected, vaccination can still reduce mortality and severity. However, its manufacture and distribution are protected by several intellectual property rights (IPR) legal instruments, which have resulted in several Global South countries, especially Indonesia being late in the vaccination process. This article aims to criticize how vaccine distribution is hampered due to regulations related to IPR, namely patents and trade secret. The author uses normative juridical research methods to answer the problems in this study by focusing on literature research and secondary data related to vaccination and the right to health which have implications for the right to human life. Comparison with other countries, especially South Africa fighting HIV/AIDS for years using the flexibilities of TRIPs, is also the subject of this research. This research describes how the Global North countries have a significant role in distributing the COVID-19 vaccine to the Global South. The trademark plays an important role in economic life, as it is a way for the merchant to distinguish his products from those produced by others. It also helps consumers to identify the products they want. Therefore, the countries of the world have agreed to conduct agreements to protect it, on top of which is the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS). When the State of Indonesia agreed to sign this agreement, it had to provide legal cover in the field of the trademark. The research aims to demonstrate trademark protection in Indonesian law and Islamic jurisprudence. This research falls within the library search, and its description is an analytical and critical description. After careful consideration, the research concludes that Indonesian law and Islamic jurisprudence are in agreement of considering the trademark as property and right. So, they agree on the necessity of trademark protection and imposing the punishment for the aggressor. Meanwhile, they differ in the imprisonment; the law considers it as a basic punishment while Islamic jurisprudence considers it as a secondary punishment

<p>This article will explore the intellectual journey of Snouck Hurgonje as a hired scholar for the colonial agenda. His life in Mecca and then the Indies, his knowledge on Islam and the Muslims as revealed in the works he produced, and the way it was transformed into the colonial policies, are the main subjects of the discussion. The way Snouck Hurgronje dealt with Muslims on his tour of duty, for example by collaborating with the penghulu, and working together with the Arab, Said Oesman, will also be explored. It should be stated that, in line with Snouck Hurgonje’s advice, the Dutch policy on Islam was directed (among other things) to draw the native elite --in this particular case the penghulu-- into the colonial orbit.</p><p>[Artikel ini membahas perjalanan intelektual Snouck Hurgonje, seorang ilmuwan yang bekerja di bawah dan untuk kepentingan colonial Belanda di Indonesia. This article seeks to elaborate Ahmad Syafii Maarif's thoughts on the issue of diversity of identities in Indonesia. The reflection is related to the main problems about the state, religion, and morality that are triggered by conflicts of interest and political (ego) identity. Basically, diversity is a social reality for the people of Indonesia, as a country based on Pancasila and Bhinneka Tunggal Ika (Unity in Diversity). According to Syafii Maarif, in the case of multi-identity problems in Indonesia, this requires government intervention, although Syafii Maarif also criticizes government policies, because this problem is related to collective responsibility. On the other hand, diversity is also a divine reality that is taught in the holy revelations (the Qur'an) as a guide for life. Syafii Maarif has emphasized that the majority of Muslims in Indonesia need to express their faith. Therefore, the contextualization of the Qur'an as faith and intellectual practice requires wisdom and deep contemplation. The contextualization of these values is always needed at all times, as the function of the Qur'an as al-furqān (the difference between right and wrong). Finally, Syafii Maarif's thought on the issue of multi-identity was an attempt to realize Islamic humanist values and bridge them with Pancasila.

This study is a bio-biographical study in which data is obtained through literature and library study. Data in the form of documents were analyzed by content analysis method. The study finds that Ismail Banda was a well-educated Mandailing scholar and fighter who during his overseas studies at the intellectual center of the Sunni tradition in the early 20th century: Madrasah Shaulatiyah and al-Azhar Universitytook advantage of all opportunities to lead the Republic's struggle for Indonesian independence in Egypt through the Indonesian Youth Association and Malaya (Perpindom). Intellectual property is creativity that results from human thought in order to meet the needs and welfare of human life. Currently, IPR issues are widely discussed in the context of international issues. IPR includes two parts, namely Copyrights and Industrial Property Rights. Industrial property rights include patents, industrial designs, integrated circuits layout designs, trade secrets, geographic indications, trademarks and plant variety protection (PVP). Interior design is part of industrial design. Interior design has experienced significant developments in recent years, including in Indonesia. Problems that arises is plagiarisms done by imitating or using the "similarity" of an interior design that already has an industrial design certificate without any permission from the design owner. This study aims to find out the legal protection of interior design in the intellectual property rights of industrial design and the legal basis used by judges in deciding industrial design rights disputes. The result of this study showed that the legal protection of interior design in the intellectual property rights of industrial design involved two legal protections; they are preventive legal protections and repressive legal protections. Furthermore, Gustav Radbruch's theory of legal ideals is used as a legal basis in deciding cases of disputes over industrial design rights based on justice, benefits, and legal certainty in the case of industrial design disputes Ecosfera Room.

The approach in this study is literature with a literature review, the results of the study found that Islamic boarding schools experienced changes and developments from time to time, there were shifts in values, structures, views in every aspect of pesantren, including changes in aspects related to the world of education and teaching that more modern.

Abstract:
Objective - This research aimed at sketching personal values of graduate students at a faith-based institution in Indonesia. It also investigated the possible influence of these personal values and the students' perceptions towards the values of their institution on their emotional attachment (affective commitment) to the institution. Methodology/Technique - A cross-sectional survey was employed as the primary method in the collection of the data. The fieldwork comprised the distribution of a self-administered questionnaire to potential respondents through direct contact. A convenience sampling was used to invite respondent participation. A total of 250 questionnaires were distributed of which 143 were usable, representing an overall response rate of 53 %. Findings – Results derived from the research suggested that the students, in general, embraced religious and intellectual values in their personal life. These dominant values seemed to be congruous with the demands of academic life in a faith-based educational institution as well as the demand of business worlds in the future. Likewise, a high level of affective commitment was exhibited by the students. Findings of the research also showed perceived institutional and personal values of students were more strongly predictors of students' affective commitment than either one alone. Novelty - There has been little research on the relationships between personal values, institutional values and affective commitment in the Indonesian higher education institution contexts.
