Abstract:
In this article, I set out to define dignity in immigration detention and beyond. Throughout this piece, I will examine the role of dignity in detention, and the way in which the existence of ‘dignity’ in detention impacts on people when they are in detention and after they leave. Based on interviews and research with women who have experienced immigration detention in the United Kingdom, it is clear that this experience of indignity has had a lasting impact on women, causing them distress both in detention and after they leave. The key themes emerging out of this research into violations of dignity include vilification, lack of autonomy and ‘diminishment’. In light of this, I suggest that immigration detention is incompatible with the concept of dignity that has been defined by the women in this study.

This article examines a particular aspect of invoking succession unworthiness. Regarding the sphere of persons who would have active procedural capacity in an action to ascertain/stating the indignity, we include in this category: legal or testamentary co-heirs (whose inheritance rights would have been restricted by the coming of the unworthy to inherit); subsequent legal heirs (whom the presence of the unworthy would have removed from the inheritance); donees or legatees (whose liberalities could have been reduced if they had infringed the succession reserve quota of the unworthy); the creditors of the legal co-heirs, of the subsequent legal heirs, of the donees or legatees (the exercise of the oblique action is allowed, not being an exclusive personal right); the unworthy heir. However, there are some dilemmas regarding unworthy heir. Until we can discern a different regime of invocation depending on the type of indignity, legal or judicial, we must answer the fundamental question of its interest. Could the principle nemo auditur turpitudinem allegans be applied in this case? Before finding a definitive answer to this question, this article aims to determine the legal nature of this institution and its history.

The overall purpose of this cross-country Nordic study was to gain further knowledge about maintaining and promoting dignity in nursing home residents. The purpose of this article is to present results pertaining to the following question: How is nursing home residents’ dignity maintained, promoted or deprived from the perspective of family caregivers? In this article, we focus only on indignity in care. This study took place at six different nursing home residences in Sweden, Denmark and Norway. Data collection methods in this part of this study consisted of individual research interviews. Altogether, the sample consisted of 28 family caregivers of nursing home residents. The empirical material was interpreted using a hermeneutical approach. The overall theme that emerged was as follows: ‘A feeling of being abandoned’. The sub-themes are designated as follows: deprived of the feeling of belonging, deprived of dignity due to acts of omission, deprived of confirmation, deprived of dignity due to physical humiliation, deprived of dignity due to psychological humiliation and deprived of parts of life.

In advanced technological societies there is growing concern about the prospect of protracted deaths marked by incapacitation, intolerable pain and indignity, and invasion by machines and tubing. Life prolongation for critically ill cancer patients in the United States, for example, literally costs a fortune for very little benefit, typically from $82,845 to $189,339 for an additional year of life. Those who return home after major interventions live on average only 3 more months; the others live out their days in a hospital intensive care unit.

As recentes manifestações sociais ao redor do mundo marcam um momento paradigmático da nossa sociedade. Trata-se de um acontecimento, no sentido conferido por Deleuze, que como tal evidenciam uma mudança de subjetividade. Segundo o filósofo, o acontecimento não traz soluções para problemas, mas instauram novas possibilidades. Diante do insuportável, o acontecimento altera nossa maneira de sentir, apontando para novas formas de vida. Nesse sentido, esse artigo investiga a emergência de uma nova subjetividade, indignada, com anseios democráticos e libertadores que organizada em rede promove micro-revoluções com reivindicações diversas. Simultaneamente locais e globais, os movimentos sociais recentes são representativos de uma nova forma de resistência, que tem as redes sociais como cenário, e os valores de criatividade, cooperação e comunicação como ferramentas fundamentais para as lutas. Assim, esse trabalho propõe uma breve análise dos movimentos juvenis dos últimos anos destacando suas origens, modos de organização e produção de subjetividade.

The author of the work analyzes insults as a speech act. She shows similarities and differences between indignity, invective, abuse, defamation – speech acts with the same general intention: harming someone in an act of communications, insulting someone by word. Acts of verbal (and active) insults are assessed according to many criteria: moral (since it is a violation of personal dignity and moral value belonging to every person), social (as an offense against ethical and cultural norms accepted in a given society), legal (specified in art. 216) and linguistic, because they are made by using offensive words.

AbstractThis comparative review of age as a protected ground in discrimination law explores the underpinning questions and themes related to two main dimensions of age discrimination. The first dimension is structural, economic and labour market driven, whereby age is used to allocate a range of rights, obligations and benefits within society. The second is the social justice and equality dimension, in which age is understood as an aspect of individual identity that is worthy of protection against indignity or detriment. The review then considers the law on age discrimination in a number of jurisdictions, the EU law, the UK, Sweden, USA, Canada and South Africa, and assesses the extent to which the underpinning questions explain the developing case law.
