Abstract:
The issue of sovereignty over natural resources has been a key element in the development of international law, notably leading to the emergence of the principle of States’ permanent sovereignty over their natural resources. However, concomitant to this focus on States’ sovereignty, international human rights law proclaims the right of peoples to self-determination over their natural resources. This has led to a complex and ambivalent relationship between the principle of States’ sovereignty over natural resources and peoples’ rights to natural resources. This chapter analyses this conflicting relationship and examines the emergence of the right of peoples to freely dispose of their natural resources and evaluates its potential role in contemporary advocacy. It notably explores how indigenous peoples have called for the revival of their right to sovereignty over natural resources, and how the global peasants’ movement has pushed for the recognition of the concept of food sovereignty.

Abstract:
This chapter studies Articles 3, 4, 5, 18, 23, and 46(1) of the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP). The debate about the right to self-determination for indigenous peoples, and its provisional conclusion through the adoption of the Declaration, represents a very significant step in the development of concepts of international legal personality. First, the change in terminology from ‘populations’ to ‘people’ marks the emergence of indigenous peoples as subjects, rather than objects of international law. Second, there was the possibility of drawing on existing international legal language in relation to a safeguard clause, which was eventually adopted in line with the General Assembly's vulnerable Friendly Relations resolution. Without the adoption of this clause, it is unlikely that the Declaration could have been adopted with a significant majority, if at all.

Abstract:
This chapter discusses Articles 9, 33, 35, and 36, focusing on the relationships between the indigenous individual and the indigenous community, group or nation, the question of the right to select or deny membership, and of duties to the community. The recognition of indigenous peoples' right to determine their own membership is crucial for their ability to meaningfully exercise their right to self-determination. Thus, the provisions of Articles 9, 33, 35, and 36 reinforce the right of indigenous peoples to define themselves, both in terms of membership and geographic scope. During the drafting of the Declaration, representatives of indigenous peoples stressed the importance of self-identification. However, some States argued that the lack of a fixed definition would create a circularity whereby people who claimed to be indigenous would define indigeneity based on the criterion that they themselves defined. A similar problem arises when discussing membership in an indigenous group or community.

Abstract:
This chapter provides a review of some of the leading cases on Métis rights and jurisdiction. In terms of rights, the chapter reviews the Powley decision, critiques its determination of Métis identity, and contrasts this with the Métis right to self-determination and membership determination of Métis communities. This chapter also examines the recent Daniels case and the implications of finding that Métis are “Indians” for the purposes of section 91(24) of the Constitution, which is said to allocate power to legislate over Indians to the federal Parliament. The chapter questions this understanding and in particular the plenary nature of section 91(24) as a head of power and argues that it should be understood differently from all the other heads of power allocated between provincial and federal authority under sections 91 and 92 of the Constitution. This chapter also critically examines the definition of Métis adopted by the Supreme Court of Canada in Daniels as overly broad, resulting in problems of Métis identity legitimation and the preference for a race-based definition of Métis Indians as opposed to a political community definition of Métis.
