Cavaciocchi, Simonetta, ed. Le interazioni fra economia e ambiente biologico nell'Europa preindustriale secc. XIII-XVIII. Economic and biological interactions in pre-industrial Europe from the 13th to the 18th centuries. Florence: Firenze University Press, 2010. http://dx.doi.org/10.36253/978-88-8453-596-2.

Abstract:
Pests, parasites and pathogenic agents have exerted a notable influence on the process of economic development of pre-industrial Europe, in view of their influence on the health, longevity and reproduction of human beings, plants and animals. On each occasion man has reacted to biological uncertainty with responses that were public or private, formal or informal and differed in both efficacy and cost. Success has always been partial, and dependent on experience, knowledge and the investment of economic resources. These reciprocal influences have never been allocated an appropriate or convincing place in the institutional model or those of Smith, Malthus, Ricardo or Marx, typically exploited to describe and explain the flux and reflux of the economic development of pre-industrial Europe. In these proceedings of Study Week promoted by the Fondazione Datini, the leading experts in the sector have undertaken to analyse, exemplify and discuss the precise nature of the complex interactions between economic and biological processes and agents. Adopying a stimulating, innovative and interdisciplinary approach, they appraise the degree to which such processes acted in reciprocal independence, whether there was a significant co-evolution and what prospects there are for developing explanatory models that better grasp the essentially bilateral nature of such interactions.

Abstract:
It is often argued that widespread disagreement among epistemic peers in a domain threatens expertise in that domain. This chapter sketches two different conceptions of expertise: the expert-as-authority and the expert-as-advisor models. While it is standard for philosophers to understand expertise as authoritative, such an approach renders the problem posed by widespread peer disagreement intractable. This chapter argues, however, that there are independent reasons to reject both this model of expertise and the central argument offered on its behalf. The chapter then develops an alternative approach—one that understands expertise in terms of advice—that not only avoids the problems afflicting the expert-as-authority model, but also has the resources for a much more satisfying response to the problem of widespread peer disagreement.

Bernardo M, Cremades. Part VII Witnesses and Perjury, 19 The Expert Witness in International Arbitration. Oxford University Press, 2016. http://dx.doi.org/10.1093/law/9780198783206.003.0020.

Abstract:
This chapter raises the question of whether expert witnesses are necessary or indeed appropriate in international arbitration. The expert’s role in arbitration proceedings is to testify and assist the tribunal. The expert is also a witness, but, in contrast to the legal framework for experts in court proceedings, in international arbitration they do not have to be independent of the parties. The majority of experts appearing before arbitral tribunals are employees or habitual sub-contractors of one of the parties. Regardless of an arbitrator’s background, they will require the support of an expert as they increasingly come into contact with sectors such as construction, energy, telecommunications, and concessions. However, the proliferation of expert witnesses in arbitration proceedings, and above all the phenomenon of the team of experts, have become the cause of confusion and delays.

Dennis, Faber, and Vermunt Niels, eds. Bank Failure: Lessons from Lehman Brothers. Oxford University Press, 2017. http://dx.doi.org/10.1093/law/9780198755371.001.0001.

Full text
Abstract:
This new book analyses the legal and practical issues experienced during the Lehman Brothers litigation, the largest and most complex bankruptcy proceedings in history. By examining the issues the work provides a useful reference source for future large scale and cross-border bankruptcy proceedings of multinational groups. The contributors include experts from the various jurisdictions in which Lehman Brothers was operative, many of whom were involved in the litigation. The chapters set out practical solutions to the issues faced, concerning, for example, the use of existing payment and settlement systems for consent solicitation, filing instructions, and insolvency distributions. Economic challenges, such as the valuation of distressed financial instruments, are also considered. Additionally, the book provides a critique of the current law, analysis of the interpretation and scope of core legal principles and makes recommendations for regulatory reform and judicial cooperation. In this book first-hand accounts by key parties in the insolvency proceedings with expertise on the main issues are complemented by the views of selected independent experts. It is also enhanced by three chapters which further reflect on the Andean legal order.
