Technological innovations have increased the independence, self-governance, and freedom of millions of people around the world. The link between new technologies and increased autonomy is by no means a modern phenomenon. Pick any point in time at which a substantial technological transformation has occurred, and it is likely that a significant part of the process can be described as an upsurge of autonomy. The focus of this chapter is on three questions: (i) How should autonomy be defined? (ii) Is autonomy valuable for its own sake or as a means to an end? (ii) How should autonomy be measured? By answering these questions it becomes clear how the Autonomy Principle should be applied to real-world cases in which people’s independence, self-governance, or freedom is affected.

Principle 7 deals with guarantees of three separate but interrelated aspects of commissions of inquiry: independence, impartiality and competence. This principle emphasizes the need for guarantees of independence, impartiality and competence in two different realms: the process leading to a commission’s establishment, and the commission’s ultimate terms of reference. As such, the scope of Principle 7 overlaps with Principle 6, which deals with the establishment of truth commissions, and Principle 8, which deals with the mandates of commissions of inquiry. This chapter first provides a contextual and historical background on Principle 7 before discussing its theoretical framework and the ways in which the values espoused in Principle 7 are exercised by states in practice.

This chapter considers the meaning, scope, and application of three constitutional principles of surpassing importance in Canada. The rule of law is foundational to Canada’s constitutional framework and may properly be characterized as the first principle of Canadian constitutional law. It is linked to, and in some respects, forms the underpinning for other fundamental principles, including constitutionalism, federalism, democracy, and parliamentary sovereignty. As the latter principles are the focus of chapters by other commentators in this Handbook, this chapter will examine the rule of law primarily in relation to the separation of powers and judicial independence. The principle of judicial independence is also essential to the functioning and structure of the Constitution, given the role the courts are called upon to play in policing the constitutional limits of legislative power and administrative action. The separation of powers is still an emerging principle in Canada, but also increasingly viewed as fundamental.

Principle 11 guarantees adequate resources in support of a commission of inquiry so that it can comply with its legal mandate without compromising its independence and autonomy. A commission with autonomy means that it has control over its own finances and may make its own decisions in respect of the allocation of its resources. The issue of autonomy is inextricably linked to the independence of a commission. This chapter first provides a contextual and historical background on Principle 11 before discussing its theoretical framework, focusing on international law instruments governing the investigation of human rights violations that oblige state parties to adequately resource the responsible investigative agency. In particular, it considers the role of competent authorities, explicit duty, funding principles, and political will. It also examines how commissions of inquiry have been supported in practice and cautions against proceeding with commissions where adequate support is not guaranteed.

Principle 30 deals with restrictions on the principle of the irremovability of judges. Judicial independence, both institutional and individual, is essential in any justice system and must be respected in a trans-regime setting. At the same time, it is necessary for the judiciary to adjudicate the crimes of a past regime with adequate vigour. This can present a major dilemma between necessary continuity and necessary reform, one that Principle 30 is designed to address. According to Principle 30, judges may not be removed if they were appointed ‘in conformity with the requirements of the rule of law’, but may be removed if they were ‘unlawfully appointed’ or ‘derive their judicial power from an act of allegiance’. This chapter first provides a contextual and historical background on Principle 30 before discussing its theoretical framework and how judges are treated in a trans-regime setting.

Virtually everyone agrees that standard principles of interpersonal morality justify national defence against major aggressors aiming at genocide or enslavement. Do such principles also justify defensive war against ‘lesser’ or ‘purely political’ aggressors aiming solely at a state’s political independence and/or territory integrity? Although ‘reductivists’ maintain that national defence in such cases generally is justified by interpersonal morality, ‘exceptionalists’ argue that special principles for states are required to justify this sort of defensive war. This chapter examines several issues: What difference does it make if a lesser aggressor issues a conditional threat to use proportionate violence only if its demands are violently resisted? When would waging a war of national defence against lesser aggression satisfy the proportionality requirement? Do all or only some kinds of states have moral rights of national defence? How might principles of interpersonal and interstate morality be combined in a unified approach to justifying national defence?

This book discusses international criminal justice. While many books on this topic have focused on crimes and procedures, this book deals with process and the judicial function, the rule of law and the principle of fairness in trying atrocity crimes, genocide, crimes against humanity and war crimes. It studies judicial independence and impartiality in international criminal courts, shedding light on the mystery of judicial decision-making and deliberations. Notably, the book addresses the controversial subjects of acquittals and the early release of prisoners. While acquittals are often seen as a failure of international justice, the book argues that legal principle must come before any extraneous purpose, however desirable that purpose may be. Finally, the book looks at the challenges facing the future of international justice and accountability.

Chapter 5 presents in a more formal way a set of arguments from widely accepted premises to Fichte’s normative conclusions. The premises are examined and their assumptions articulated. It establishes that those already committed to a Kantian account of duties of right can offer no grounds for rejecting Fichte’s account of a constitutive end of independence of nature; and that Kant’s argument for the claim that material ethical principles are incompatible with autonomy cannot be directed against Fichte’s view. It also addresses several objections, stemming from critics of technology and of enlightenment, and appealing to the value of certain experiences involving loss of control.

The dilemma of holding prosecutors accountable while ensuring their independence was at the centre of the debates surrounding the establishment of the ICC and has been a recurring question ever since. Drastic judicial remedies against prosecutorial misconduct have the potential of harming other interests of international criminal justice, including deterrence, retribution, and the establishment of an accurate historical record. On the other hand, non-judicial mechanisms may compromise the principle of prosecutorial independence and create the risk that politics would influence disciplinary decisions. This chapter examines how the ICC has approached this accountability dilemma in its first years of operation. It advances that the Court should adopt a structured balancing approach in determining remedies for prosecutorial misconduct to include internal bureaucratic controls within the OTP, judicial intervention, and disciplinary measures by the ASP, the IOM, and national or international bar associations.

Revolution in various forms had been endemic to the Great War. The Paris Peace Conference sought not so much to oppose revolution as to master it in the formation of a new international system. It created the International Labour Organization to institutionalize a transnational approach to labor relations, and thus head off worker unrest as a source of revolution. The Mandate Principle put all mandates at least theoretically on the path to independence, however indefinite the period of tutelage. The Mandate Principle, at least discursively, provided a means of pre-empting anti-colonialism as a source of international instability. The conference also sought to master revolution in successor states. Recognizing Czechoslovakia as a model liberal democracy provided a template ill-suited to recognizing the other successor states. The war between Romania and Hungary in 1919–20 left the Supreme Council with recognition as its only means to control the behavior of successor states.

Independent documentary is enjoying a resurgence in post-reform India. But in contemporary cinema and media cultures, where ‘independent’ operates as an industry genre or critical category, how do we understand the significance of this mode of cultural production? Based on detailed onsite observation of documentary production, circulation practices and the analysis of film texts, this book identifies independence as a 'tactical practice’, contesting the normative definitions and functions assigned to culture, cultural production and producers in a neoliberal economic system. Focusing on selected filmmakers, the book establishes how they have reorganised the dominance of industrial media, technology and social relations to develop practices that build upon principles of de-economisation, artisanship and interdependence.

This chapter focuses on the Turkish War of Independence. Fighting between 1919 and 1922 on two principal fronts—against the British-backed Greeks in the West and the unsupported Armenians in the East—the nationalists, led by Mustafa Kemal Atatürk, exploited the protracted conflict to solidify their hold on power. Mustafa Kemal emerged as one of the principal leaders of the popular struggle against partition. Nevertheless, when he returned to Istanbul later that month, he joined public opinion in expressing the hope that “the British would respect the freedom of our nation and the independence of our state” and that “there would not be a more benevolent friend of the Ottomans than the British.” Such hopes notwithstanding, Mustafa Kemal grasped more quickly than most of his colleagues that Allied diplomacy was pursuing objectives wholly at odds with those of the burgeoning Turkish nationalist movement.

This chapter demonstrates how Mary Wollstonecraft (1759–97) uses feminist principles to modify and adapt the republican ideal of freedom as the absence of domination or dependence. It shows that, according to Wollstonecraft, freedom consists in the secure entitlement to act in accordance with the dictates of reason—a freedom that depends upon the possession of a certain social standing and the absence of a dominating master. Crucially, according to this chapter, freedom from domination is relational: it bestows a special status on the moral subject in relation to others. Freedom from subjugation thus gives the individual a certain empowerment, or certain entitlement, with respect to other members of society. The chapter ends by showing how Wollstonecraft takes this idea to its logical feminist conclusion: a call for the equal rights of men and women in civil society.

This case note relates to the advisory opinion of the International Court of Justice on the United Nations Administrative Tribunal in which the Court ruled that the General Assembly of the United Nations had the power to establish the Tribunal to decide disputes between UN staff members and the UN Secretary-General, their employer, and that its awards were binding on the General Assembly when it came to adopt the UN budget. Underlying these rulings is the principle of the independence of the international civil service. The case note also records the changes that were made to the Statute of the Tribunal as a consequence, changes which presented procedural issues for the Court which was given a review power in respect of awards of the Tribunal.
