Abstract:
Chapter 7 examines the personal injury suits that formed almost half of the civil suits between black and white litigants in eight state supreme courts from 1900 to 1920. Facing terrible pain and loss in the wake of their own or loved one’s injuries, some African Americans turned to the courts to gain damages. There, in a time of encroaching segregation and racial injustice, a number of black litigants found disproportionate success in the realm of tort litigation. During their trials, black litigants shaped their testimony to meet the legal basis of personal injury, emphasizing their own caution at the time of the accident, their continuing pain and weakness from the injury, and the loss of income they had incurred. As in fraud cases, their claims of weakness and vulnerability could reinforce white judges’ and jury members’ ideas about racial inequality, but also allowed them to frequently win such suits.

Climate change and direct, local impacts are reducing the ability of reefs to support rich ecosystems, including those of people dependent upon them. Reef adaptation has been suggested as being possible, but is unlikely to be sufficient to ensure their survival after a few decades. Human population increase is remorseless and with it comes increasing demand on reef resources. Protected area management and better management of key species holds promise as one method for ensuring reef survival, as does a need to obtain proper ecosystem values of reefs and their species and of the cost incurred in their loss. Reefs are connected in terms of larval and species flows, so broadscale management of networks of marine protected areas is also needed to ensure the survival of reefs, as is a more intelligent selection of areas for protection, favouring those which show greatest resilience and ability to recover from impacts.

Female competition for male attention is multifaceted. Typically psychological and relational in nature, this competition may be no less damaging than physical violence more commonly used between males. Research on female–female mate competition has examined short-term effects, yet how women cope with long-term effects of romantic relationship dissolution has been little explored. If negative emotions exist because they provide an evolutionary advantage (attuning physiological processes, thoughts, and behaviors to deal with situations that have frequently incurred high fitness costs), then emotions arising from the loss of a mate to a sexual rival may potentially motivate actions that could make one avoid this scenario in the future. This essay argues that there are consequences of female intrasexual mate competition that may be both evolutionarily adaptive and also beneficial in terms of personal growth and that may expand beyond mating and into other realms of personal development.

This concluding chapter (a) compares all the episodes of fiscal squeeze in the UK over a century in terms of loss imposition, political costs to incumbents in pursuing fiscal squeeze, and the degree of state effort involved; (b) shows how the fiscal squeeze ‘game’ changed over a century (in terms of depth, length, composition, blame allocation, and of the tactics adopted, including stealth taxes and bear traps); (c) explores consequences of fiscal squeezes, and shows that a puzzle in the literature about apparently erratic voter ‘punishment’ of governments imposing austerity policies can be resolved if austerity is defined in terms of losses imposed rather than debt and deficit outcomes, and if political costs incurred by incumbents in pursuing fiscal squeeze are considered; (d) considers the future of fiscal squeeze, exploring what future fiscal squeezes will be like if past trends continue into the future.

This chapter focuses on the unmournable nature of animal death, turning to Heidegger, Freud and Melanie Klein (as advocates of both successful and unsuccessful mourning, first and second deaths) as entry points for an analysis of Emilie Deleuze’s 2003 film, Mister V. The film tracks the changes in relationality incurred when the eponymous psychotic horse escapes and tests not only the boundaries of the film’s diegesis but also its own discursive fabulation. Here man, as majority figure, is not an option for becoming. Man must be divested of his majoritarian status before he can become other. In this regard, ‘becoming-animal’ is the missing link between man and ‘becoming multiple’, so that the metamorphosis necessarily entails a ‘loss’ as initiation so that we can enter the substitutive order of becoming-other. This is not necessarily incompatible with Freud. Indeed, the two main trajectories of the latter’s thought: 1) totemic identification and 2) castration (as an initiation into the ‘management’ of loss or lack) also separate out as tendencies of unmourning and ‘successful mourning’, of first and second deaths, respectively. Both are compatible with the anti-Oedipal momentum of Deleuze and Guattari’s schizoanalysis.

Abstract The consolations of tragedy are dark, but their darkness is what rings true to readers whose lives already share it. In King Lear an enraged old man upends the lives of those around him. It’s a story of loss, forgiveness, and deeper loss. To show how this story can console, Arthur Frank draws upon both the decades he has spent witnessing serious illness and his own experiences of ageing. His reading presents King Lear as a resource for people living lives that are troubled, exemplifying how to find consolation in literature. Shakespeare did not write self-help books, but his plays can help: not by fixing but by making liveable what cannot be fixed. Shakespeare’s Dark Consolations invites readers, including those not already familiar with King Lear, to hear how the play’s words can speak for us when our own words fail, and how its characters can speak to us, becoming our companions. Chapter 15 concerns formulas for measuring expectation damages for contracts to provide services, including breaches by both service-purchasers and service-providers. In case of breach by service-purchasers one formula is based on the service-provider’s lost profit. Under an alternative formula the service-provider is entitled to the contract price minus the out-of-pocket costs remaining to be incurred by the service-provider at the time of breach. Although these two expressions look very different they are algebraically equivalent and yield the same amount of damages. In case of breach by the service-provider the core formulas for measuring damage to the service-purchaser involve either cost-of-completion or diminished-value damages.

This chapter examines the French Revolution from the vantage point of macroeconomic theories about government budget constraints. From 1688 to 1788, Britain won and France lost three of four wars. France recurrently defaulted on its debt, while Britain did not. After 1688, Britain had reformed its institutions to allow it to raise enough taxes during peacetime to finance debts incurred in times of war, while France sustained institutions designed to constrain the king's revenues. The chapter considers two macroeconomic ideas and three models of money: unpleasant arithmetic, sustainable plans, tax-backed or asset-backed models of the demand for currency, legal restrictions models of the demand for currency, and classical hyperinflation models along lines described by Phillip Cagan. Inflation during the French Revolution are interpreted in terms of a procession of regimes in which the “if” parts of the three types of monetary models are approximately fulfilled.

This chapter explores the types of costs that may be awarded in arbitral proceedings, analysing the underlying principles governing the recoverability of costs in international arbitration. In particular, it focuses on how claims relating to the costs of in-house legal counsel; staff and senior management; and third-party funding arrangements are generally decided by arbitral tribunals. While most arbitral rules expressly allow for the recovery of arbitral costs and reasonable legal fees incurred by external counsel, the position is less clear where the fees of in-house lawyers, lost management time, or third-party funding arrangements are concerned. In theory, in-house counsel fees should be recoverable where parties are able to demonstrate the reasonableness and necessity of these costs. As for management costs, a party should in principle be able to recover such costs in arbitration if it can prove that the time spent on the arbitration caused substantial disruption to its business. Costs underwritten by a third-party funding arrangement should, in principle, be similarly recoverable provided the funding arrangement was agreed at arm’s length and is permitted under the applicable laws.

Cuando una mujer se embaraza incurre en una probabilidad variable de sufrir un evento adverso durante el proceso reproductivo, esto se conoce como «Riesgo Reproductivo». Cada año quedan embarazadas en el mundo, según la Organización Mundial de la Salud (OMS), cerca de 210 millones de mujeres, alrededor de 30 millones (14,3%) sufre complicaciones potencialmente mortales que ameritan la asistencia de personal sanitario especializado, por lo general, de una intervención obstétrica calificada. Más de medio millón de mujeres (1,7%) fallecen cada año como consecuencia de las complicaciones relacionadas con el embarazo, el 99% de ellas en los países en desarrollo. Los Objetivos de Desarrollo del Milenio (ODM) adoptados por las Naciones Unidas (ONU) en 2000 brindan la oportunidad de emprender una acción concertada para mejorar la salud materna en el mundo. El Objetivo 5, Mejorar la salud materna y reducir los riesgos del embarazo, sitúan la salud en el corazón del desarrollo humano y establecen un novedoso pacto mundial que vincula a los países desarrollados y los países en desarrollo por medio de obligaciones claras y recíprocas. La idea fundamental de la iniciativa de la OMS es aumentar la proporción de embarazos y partos asistidos por personal sanitario cualificado. En este contexto, debemos resaltar que la mortalidad materna y perinatal puede reducirse mediante intervenciones de salud materna de calidad, basada en la evidencia confiable y factible, incluso en entornos de países de bajos ingresos. El libro Enfermedades que complican el embarazo, diagnóstico y tratamiento, recopila los hallazgos y las nuevas y mejores evidencias disponibles de importantes estudios, todos de gran actualidad y reconocida solidez académica, sobre diversas patologías que afectan la salud de la mujer gestante y ponen en riesgo el término de su embarazo.

En el marco de las políticas institucionales tendientes a la retención y promoción del egreso definidas por nuestra Decana Prof. Mariel Ciafardo, nos planteamos la tarea de organizar y sistematizar un registro y memoria institucional de las Tesis de Grado realizadas por nuestros licenciados al que toda la comunidad tuviera acceso. En ese contexto, comenzamos a construir el Banco de Tesis. Una de las cuestiones generales que motivaron esta iniciativa está relacionada con el hecho de que, en el amplio e indispensable debate en torno al desempeño de las Universidades públicas, es poco frecuente escuchar evaluaciones y diagnósticos en relación a la calidad de su formación a partir de las aptitudes de sus alumnos avanzados o sus graduados recientes. Generalmente, y sobre todo en el discurso mediático, retornan en forma cíclica los señalamientos e inquietudes respecto del perfil de formación que poseen los alumnos cuando ingresan, como así también los elevados índices de deserción, como únicas variables de análisis respecto del trabajo universitario. Y esto suele ocurrir con mayor o menor intensidad, dependiendo de qué políticas educativas se promuevan desde los ámbitos de decisión. Sin menospreciar estas cuestiones, que sin dudas nos resultan muy significativas y contribuyen a repensar nuestras prácticas pedagógicas y diseñar políticas institucionales inclusivas, procuramos con el presente catálogo comenzar a visibilizar, al menos parcialmente, el perfil de formación que poseen nuestros graduados expresado en su Trabajo Final o Tesis de Grado. Entendemos que resultará más productivo compartir y evaluar nuestras fortalezas y debilidades a través de, en este caso, los trabajos de graduación, evitando de este modo incurrir en estigmatizaciones de nuestros ingresantes o de los niveles previos de formación en el sistema educativo. A su vez, esta iniciativa persigue dos objetivos específicos: por un lado, nos proponemos que las Tesis de grado puedan ser objeto de consulta por parte de las cátedras y de los estudiantes en sus actividades académicas cotidianas, en tanto pueden constituir un interesante material de estudio, en especial teniendo en cuenta que en muchos casos abordan cuestiones inexploradas o lo hacen desde perspectivas novedosas; por otro lado, suponemos que el Banco de Tesis puede realizar un aporte para una mejor visibilización de nuestras carreras en el medio productivo y académico externo a la Facultad y, por lo tanto, una mayor y mejor inserción laboral de nuestros graduados. <i>(del prólogo de Santiago Romé)</i>

Abstract:
La presente, es una obra hecha y pensada desde el autoreconocimiento de nuestras debilidades cognitivas, en una disciplina con una complejidad de constructos bastante amplios pero que necesariamente deben estar interconectados para la verdadera comprensión del ser humano convaleciente por causales relacionadas con la Traumatología y Ortopedia. La superespecialización de las distintas áreas del conocimiento ha incurrido en esa fragmentación que induce a la incomprensión del todo simplificando lo complejo y descomponiendo la totalidad en un sin número de partes que por sí solas, separadas, no explican nada y por el contrario contradicen todo. “…los desarrollos disciplinarios de las ciencias no solo aportan las ventajas de la división del trabajo, también aportan los inconvenientes de la superespecialización, del enclaustramiento y de la fragmentación del saber” (Edgar Morin 2002. P. 15) Afortunadamente para la Traumatología y la Ortopedia, ha resultado prácticamente imposible parcelar sus saberes y por el contrario la realidad humana, social, científica y humanística, le han mantenido en un ejercicio integrado e integrador desde la cosmovisión necesaria que implica atender situaciones de la salud en los seres humanos. Esa es una de las causas por la que ambas disciplinas, en un origen separadas, de alguna manera, terminan encontrándose en un solo cuerpo, ajustándose a su propia naturaleza y “caminan” juntas sumando otras áreas tanto médicas como políticas, sociales, económicas, entre muchas otras que servirán para explicar y comprender las situaciones y enfermedades que se abordan desde la disciplina particular. Es una obra pensada desde los niveles más básicos de una disciplina que por su larga data histórica y su nivel de complejidad ha alcanzado una extraordinaria trascendencia en el mundo de las ciencias de la salud y especialmente en el campo de la medicina. Está en particular orientada a estudiantes del área de la medicina y todo aquel que da sus primeros pasos en Traumatología y Ortopedia de manera que inicie su camino con aplomo y con humildad, reconociéndose a sí mismo como un constructor más de saberes y como una partícula fundamental en un todo integrado desde la visón sistémica. “Generalidades Básicas de Traumatología y Ortopedia”, pretende ser un libro de consulta para conocimientos generales del área y un material de estudio con intencionalidad didáctica, dedicado a estudiantes y novicios que deseen internarse en el maravilloso y extraordinario mundo de la salud visto desde la Traumatología y la Ortopedia.
