Abstract:
Aborsi merupakan salah satu isu klasik yang selalu diperdebatkan. Polarisasi dari perbedaan pandangan ini adalah pembelaan terhadap hak hidup janin atau pembelaan terhadap perempuan yang mengandung. Aborsi pada kehamilan yang tidak di inginkan sudah marak adanya. Salah satunya ialah karena perkosaan incest. Perkosaan incset merupakan tindak pidana yang dilakukan oleh orang terdekat yang masih memiliki ikatan darah (ayah kepada anak, kakak kepada adik, paman kepada keponakan) sehingga mengakibatkan kerugian fisik dan mental terhadap korban. Berkaitan dengan rumusan masalah bagaimana pertanggungjawaban tindak pidana aborsi sebagai akibat perkosaan incest dan apa faktor-faktor penyebab terjadinya perkosaan incest. Penelitian ini menggunakan jenis penelitian yuridis normative dengan sampel data berupa putusan Nomor 5/Pid.Sus-Anak/2018/PN.Mbn. Hasil penelitian menunjukkan bahwa bentuk pertanggungjawaban pidana bagi pelaku tindak pidana aborsi akibat perkosaan incest dalam kasus yang penulis teliti dibebaskan dari segala tuntutan setelah adanya banding ke Pengadilan Tinggi. Hakim memutuskan putusan secara adil dibandingkan putusan awal karena Hakim kurang objektif dalam mengambil keputusan sehingga pertanggungjawaban pidana terhadap kasus aborsi akibat perkosaan khususnya perkosaan incest. Faktor yang menyebabkan terjadinya perkosaan incest pada kasus tersebut dan kasus pidana putusan Nomor 430/Pid.Sus/2015/PN.Smn yaitu karena kurangnya pendidikan atau edukasi yang diterima serta kurangnya pengawasan orang tua pada anak, juga kurangnya iman yang ditanamkan pada diri. Penelitian ini bertujuan untuk mengetahui bagaimana ketentuan pelaku incest dalam Undang-undang No. 23 Tahun 2002 Tentang Perlindungan Anak studi kasus di pengadilan negeri polewali. Dan untuk mengetahui Tinjauan Yuridis Pelaku Incest (Perkawinan Sedarah) terhadap anak dibawah umur. Penelitian ini termasuk jenis penelitian hukum normatif dengan pendekatan perundang-undangan, analisis, dan kasus. Sumber data pada penelitian ini adalah sumber data sekunder yang meliputi bahan hukum primer, bahan hukum sekunder, bahan hukum tersier. Hasil penelitian menunjukkan bahwa, Perkawinan sedarah (incest) yang dilakukan ayah terhadap anak kandung disebabkan oleh beberapa faktor. Faktor tersebut antara lain tidak bermoral atau lemahnya iman, ekonomi, kesempatan, ancaman, pengaruh alkohol, kesepian, keluarga tidak harmonis, pendalaman ilmu hitam, dan ketidaktahuan korban tentang seksual. Hasil dari penelitian ini yaitu: 1. Faktor yang menyebabkan terjadinya Perkawinan sedarah (incest) yang dilakukan oleh ayah terhadap anak kandung bagi pelaku Perkawinan sedarah (incest) oleh ayah terhadap anak kandung. Menunjukkan bahwa masih ada hakim yang tidak menerapkan sanksi pidana sebagaimana aturan yang berlaku. Penjatuhan pidana kandung. Menunjukkan bahwa, Perkawinan sedarah (incest) yang dilakukan ayah terhadap anak kandung disebabkan oleh beberapa faktor, antara lain tidak bermoral atau lemahnya iman, ekonomi, kesempatan, ancaman, pengaruh alkohol, kesepian, keluarga tidak harmonis, pengaruh ilmu hitam. 2. Penerapan sanksi pidana dan upaya penanggulangan memang tidak dapat mengembalikan kerugian yang diderita korban, namun setidaknya dengan penjatuhan sanksi yang berat, secara psikologis dapat memberikan kepuasan terhadap korban dan merasa dihargai Kata kunci : Inces , Sanksi Pidana, Upaya Penanggulangan

Incest taboos have long been intriguing to anthropologists because they are apparently common to all human societies. The definition of incest in the Spanish American colonies was codified in law, but not all residents abided by such regulations. This article focuses on incestuous crime in late colonial Guatemala, a region that is underrepresented in incest literature. It shows how preoccupations with incest problematized aspects of kinship practice and discusses the ways colonial actors took advantage of kinship and incest during various crises in their lives. Overall, it demonstrates the power of incest codes to shape human interactions in colonial Guatemala.

From an evolutionary perspective, incestuous behavior is puzzling. The goal of this study was to assess the tenability of the Westermarck hypothesis (1891, 1921)—that people who live in close physical proximity with one another during childhood will develop a sexual indifference or aversion toward one another—and the mediating role of disgust as an incest avoidance mechanism in father–daughter relationships. A sample of fathers with daughters ( N = 632) from Canada and the United States were recruited by Qualtrics—a survey platform and project management company—to complete an online survey. The results from this study did not support the viability of the Westermarck hypothesis as a mechanism that facilitates incest avoidance for fathers. Physical proximity was not associated with incest propensity or disgust toward incest. Less disgust toward incest, however, was found to be associated with more incest propensity. These results indicate that physical proximity may not be a reliable kinship cue used by fathers to inform incest avoidance, but that disgust toward incest may still be a proximate mechanism that facilitates incest avoidance among fathers using kinship cues other than physical proximity.

This article outlines some of the findings of a study of ten women who experienced sibling incest as children. Using qualitative research methods, this study explores the nature of the sibling incest relationship, how the incest occurred, the family environment, the effects suffered and the participants’ experience of intervention. For the majority of women, the effects of unwanted sibling incest were similar to the effects of parent-child incest. The participants provided important perspectives on both intervention and prevention strategies that would assist with the problem of sibling incest.This study aims to link the perspective of those who have experienced sibling incest with some implications for professional practice.

This study aims to discuss incest marriage in terms of marriage law, the legal implications of incest marriage, as well as the problems of customary law and national law governing incest marriage. This study uses empirical juridical research methods with a factual and sociological approach. Incest marriage has violated the provisions contained in Article 8 of Law Number 1 of 1974, Article 30 of the Civil Code, and Article 39 of the Compilation of Islamic Law which prohibits marriage between brothers and sisters who are still related by blood. The legal implications of incest marriage as stipulated in Article 22, Article 24, Article 26, and Article 27 of Law Number 1 of 1974 can be declared null and void. Incest marriage as a tradition that developed in Bonyoh traditional village is not in accordance with national law, but on the other hand customary law in force in the region does not prohibit incest marriage. The indigenous Bonyoh villagers consider incest marriages as an effort to preserve local traditions that have been passed down by ancestors over time

Abstract:
This study purposely appoints the topic of sibling incest as reacted from the phenomenon of proliferation of illicit relationships that are increasingly being shown blatantly especially in social media. Through literary works such as novel, the phenomenon can be analyzed since those works are the portrayal of real life. ‘Forbidden’ by Tabitha Suzuma and ‘Flawed’ by Kate Avelynn were analyzed with three objectives; 1) describing sibling incest in both novels, 2) finding out the causing factors, 3) describing the impact toward the characters’ life. To achieve those objectives, the concept of incest, theory of psychoanalysis by Karen Horney and theory of comparative literature were applied. While in analyzing the data, it used interpretive perspective with author-oriented approach which concerns with psychoanalytic criticism. The results of this study reveal that the sibling incest in the two novels is different in type although the offenders’ composition is the same, incest between older brother and younger sister. ‘Forbidden’ shows non-abusive incest since it is done on mutual willingness which is motivated by affection, while ‘Flawed’ shows abusive incest since it is done forcefully by the older brother against his sister which is motivated by affection, eroticism, and aggression. The similar factors causing the sibling incest found in both novels are dysfunctional family and between ages peers, while the factor of Law of Homogamy is only found in ‘Forbidden’. Those factors do not cause the sibling incest just like the way without any influences of the characters’ psychological condition which is shaped by their childhood experience and neurotic needs. This study also reveals how sibling incest impacts the characters’ life. They suffer from psychological problems such as anxiety, self disgust, depression, self-destruction, self-blame, low self-esteem, and trauma. The enactment of incest taboo in their state also impacts them to self-isolation and prosecution. Evidently, this study reveals that any kinds of sibling incest with any reasons behind it lead into bad impact and dark phase of the offenders’ life.

Abstract The prohibition on incest, a topic so key to kinship studies, has not featured prominently in literature on Tibet. This article draws attention to a previously unreported section of writing devoted to the topic of incest, composed by the Tibetan ‘prime minister’ Sangye Gyatso (Sangs rgyas rgya mtsho, 1653–1705), one of the principal architects of the Tibetan state. Sangye Gyatso sets out what purports to be a threefold classification of incest, traditional to Tibet, and considers how aspects of it are to be interpreted. The present article focuses on some of the significant issues raised by this piece. Among these are questions about the context and circumstances of its appearance, the status of incest as a category in historical Tibet, and the place of religious and state authority in the social domain.

Attribution of blame in father-daughter incest using the Jackson Incest Blame Scale and the Attitudes Towards Incest Scale—Revised was investigated through a questionnaire mailed to a random sample of the general adult population. 300 respondents completed the questionnaires (207 women, 93 men). Based on factor analyses, five blame subscales were identified for the Jackson Incest Blame Scale, i.e., Victim, Situational, Societal, Offender, and Offender Mental Status, the last being unique to this study. Ratings by men attributed more blame on the Victim and Situational subscales than did those by women. Scores for 51 victims of childhood sexual abuse on the Jackson Incest Blame Scale did not differ from those of 249 nonvictims. Scores on subscales of the Attitudes Towards Incest Scale—Revised (Credibility, Power, Parental Role, Victimization) were moderately correlated with ratings on Jackson's scale. More total blame and more blame of victim were associated with lower rated credibility towards a claim of incest; lower rated blame of victim was related to greater recognition of the incestuous father's coercive role.

Abstract This article is a libertarian critique of incest laws. On the basis of the libertarian “harm principle”, one must ask what exactly is the harm that incest brings forth. Traditionally, anthropologists have tried to rationalize the incest taboo in various theories, and lawmakers have used these principles as grounds for the criminalization of incest. These principles are the preservation of family structure, the enhancement of alliances and the avoidance of genetic risks. While I acknowledge that these rationalizations are plausible, I argue that they are still not sufficient grounds for the preservation of incest laws, and consequently, there is an ethical need to reform them.

Is the criminalization of consensual sex between close relatives constitutional in the wake of Lawrence v. Texas and Obergefell v. Hodges? Justice Scalia thought not. The substantive due process landscape has changed dramatically in response to the LGBTQ movement. Yet, when a girl in a sexual relationship with her father recently revealed in an anonymous interview with New York Magazine that they were planning to move to New Jersey, one of the only two states where incest was legal, the New Jersey legislature introduced with unprecedented speed a bill criminalizing incest. But who has the couple harmed? The very mention of incest conjures fears of deformed babies, yet when people think about sex in most other contexts, procreation is the last thing on their minds. Steeped in a nearuniversal incest taboo, judges are unlikely to strike down incest legislation any time soon. But they must still respond to any constitutional challenge in the language of the law. This Article evaluates the constitutionality of criminalizing sexual relationships between first-degree relatives. First, the Article situates incest statutes within the sociological incest taboo and the biological mechanism known as the Westermarck Effect. It asserts that incest laws are counter-natural exercises in socio-biological engineering. Second, it argues that incest cannot be excluded from the fundamental rights to sexual intimacy and reproduction. Third, it questions the constitutional sufficiency of a range of possible government interests, and the tailoring of existing laws to those interests. Fourth, it proposes revised statutory language that would prohibit certain incestuous relationships without violating the constitution. The Article concludes by suggesting that norms against incest, like norms against same-sex relationships, can change and may already be changing.

Incest has been surrounded by mystery, debate, and legal restrictions since its inception. Anthropologists believe that incest is a culturally driven phenomenon. Estimates of the prevalence of incest in Pakistan are highly variable because these differences are mostly influenced by the definition of incest that is utilized as well as the technique of data collection. However, recent research suggests that the incidence of incest in Pakistan may be significantly higher than was previously thought. According to the findings of a study that was carried out by the Human Rights Commission of Pakistan (HRCP), incest was implicated in 69% of sexual abuse occurrences that were reported in 2018. According to the study, families that strictly adhered to their cultural and traditional norms had a lower likelihood of disclosing any cases of incestuous rape that may have occurred within the family. The study takes into account the consequences of keeping it a secret.

Pengaturan tindak pidana incest secara eksplisit tercantum dalam Pasal 294 ayat (1) KUHP, namun belum ada pengaturan secara khusus terkait perbuatan incest. Maka dari itu, hukum pidana adat dapat berlaku ketika hukum positif tidak mengaturnya. Salah satu kasus incest yang terjadi di Kabupaten Rejang Lebong dimana orang tua pelaku incest dikenakan sanksi adat berupa dihukum cuci kampung dengan dicambuk menggunakan lidi. Jenis penelitian ini adalah penelitian yuridis normative dengan pendekatan kasus dan pendekatan perbandingan. Dari hasil penelitian ini dapat disimpulkan bahwa penerapan sanksi adat terhadap pelaku tindak pidana incest berbeda-beda di tiap wilyah adat. Mulai dari membayar uang denda, dihukum cambuk, dikucilkan dari linkungan hingga dilempar ke laut. This study analyses several aspects of incest as a sexual crime, as well as its law enforcement, by comparing criminal law and Bugis customary law. This normative study was conducted by examining primary and secondary legal materials, which were then analysed qualitatively and descriptively. The findings indicate that incest can occur in the form of sexual violence caused by internal and external factors, such as psychological and family condition. Incest also has a very serious impact on victims, especially children. In terms of criminal law, the regulation of incest is spread across several laws such as obscenity in Criminal Code (KUHP); sexual intercourse with children in the Child Protection Law; and sexual violence against a family member in the PKDRT Law. However, in the Bugis customary law, incest is a sexual deviation against dignity and honour (siri’). On that basis, incest is determined as the most severe customary offense (malaweng) and is punishable by the death penalty. In principle, the criminal law and Bugis customary law both consider incest a prohibited sexual deviation. Although there are differences regarding the severity of sanctions against perpetrators, both legal routes have proven to be complementary and can be applied in court.

Methods The study emanates from a Masters research undertaken where qualitative approach was utilized to determine psycho social effects of incest. This piece of work looked at the prevalence and nature of incest, theoretical framework in respect of incest as well as South African punitive measures on child sexual abuse and incest. Pengaturan di KUHP yang selama ini ada tidak menunjukkan pemberatan, namun hukuman pidanan di Undang-undangn pelrindungan anak memberikan hukuman maksimal kepad apelaku, begitu pula dengan Undang-undang KDRT. Hal ini merupakan kemajuan karena pelaku adalah orang terdekat yang harusnya melindungi korban. Background: Incest is a form of sexual activity that occurs within family or kinship systems. It is prohibited by religion and law in most countries as well as by social mores or taboos. Data from various parts of the world indicate, however, that it appears to be a relatively common event, although there is reason to believe that the actual frequency is unknown. Most available data focus upon children as victims, although we note that incest also occurs between adult family members. Methods: A systematic review was performed using PRISMA guidelines. With a focus upon India, the search tools of Academic Search Complete, Google Scholar and PUBMED were used to identify articles that legally defined incest; frequency; barriers to disclosure; the dynamics of incest and social norms. Results: The available data were very limited, making a systematic review unachievable within the narrow confines of incest. Conclusions: The literature is sparse. This led to a discussion of definitional issues; barriers to disclosure; and challenges with measuring the problem of incest and the impact of social norms. Questions of law and efforts at reform were also considered. The article considers what steps might be appropriate.

A random sample of 5,182 adults from 6 U.S. metropolitan areas were questioned about incestuous sexual relationships during childhood. Incest was disproportionately reported by both male and female bisexuals and homosexuals. 148 gays (7.7% of the sample) reported 14 (50%) of same-sex, and 7 (22%) of opposite-sex incestuous experiences, and 20 (69%) of same-sex and 2 (3%) of opposite-sex sexual experiences with other relatives. 88 lesbians (3% of the sample) reported 2 (33%) of same-sex incest and 7 (9%) of opposite-sex incest and 1 (17%) of same-sex and 10 (13%) of opposite-sex sexual experiences with other relatives. 12% of 98 male homosexuals vs 0.8% of 1,224 male heterosexuals with a brother reported brother-brother incest. These findings are consonant with those of other studies in which disproportionately more incest by homosexuals was reported. As opposed to an evolutionary genetic hypothesis, these data support the alternative that homosexuality may be learned, since homosexuals do not produce children at sustainable levels and the incidence of homosexuality varies as a function of various social factors. Incest cannot be excluded as a significant basis for homosexuality.

AbstractEvolutionary theory predicts that humans should avoid incest because of the negative effects incest has on individual reproduction: production of defective offspring. Selection for the avoidance of close-kin mating has apparently resulted in a psychological mechanism that promotes voluntary incest avoidance. Most human societies are thought to have rules regulating incest. If incest is avoided, why are social rules constructed to regulate it? This target article suggests that incest rules do not exist primarily to regulate close-kin mating but to regulate inbreeding between more distant kin (especially cousin categories) and sexual relations between affinal relatives (often nonkin). Three evolutionary hypotheses about cousin marriage and affinal kin mating follow from this suggestion: (1) Rules regulating mating between affinal kin are means of paternity protection. Cousin marriage (inbreeding) is regulated because, if it occurs, it can concentrate wealth and power within families to the detriment of (2) the powerful positions of rulers in stratified societies and (3) the relatively equal social statuses of most men in egalitarian societies. Tests using the comparative method on a worldwide sample of 129 societies supported the three hypotheses. Two alternative anthropological hypotheses (derived from Freudian theory and alliance theory) failed to be supported.

This is due to several factors, both internally and externally. This action does not yet have concrete qualifications related to criminal acts and there is no formulation in material criminal law, either in the Criminal Code or special laws. The incest has negative impacts both biologically and sociologically, so it is necessary to conduct a study of the Qualifications of Sexual Relationships with Siblings (with blood) that have implications for criminal acts and criminal liability for perpetrators of crimes related to incest as legal issues faced. The results of this study are in the form of qualifications for incestuous relations on the basis of the legal conception of incestuous relations and criminal liability based on several legal rules (laws). This exploratory study researched an aspect of that relationship: whether adult women survivors of childhood incest, perpetrated by a father-figure, have a more negative view of God, compared to adult women who were not sexually molested. The methodology used was a survey of incest survivors and matched comparison subjects. The results indicated that there was a significant difference between how the women survivors of father-figure incest and the non-abused women in the comparison group viewed God.

The writer also applies context-oriented approach by Mario Klarer to obtain the adequate data. In collecting data, the writer conducts some steps namely, close reading, documenting data, and taking notes, while in analyzing data the writer conducts deep analyzing, describing, and presenting data. Therefore, the writer can identify the phenomenon of sibling incest happens, and several factors for the occurrence of sibling incest in the novel A Midsummer Nightmare by Kody Keplinger, such as (1) between age peers, (2) the law of homogamy, (3) genetic sexual attraction (GSA). Furthermore, The results of this study indicates that this novel attempts to reflect the phenomenon of sibling incest through the character of Natan and Whitley who have problems in their life that lead them to forbidden love. Good parenting and upbringing will help shape the child’s personality to grow well. Love and full attention can make a child find a good way of life. In this novel, the sibling incest factors mentioned above describe a daughter who lacks love and attention from her parents due to the broken home that befell her family, so that she grows up by bad personalities and even love her own brother and having sex for many times.

Abstract:
Female adult incest victims differing in history of alcoholism were compared to an alcoholism-only and a no incest/no alcoholism group on dimensions of temperament, psychological adjustment, and self-esteem. Incest victims with histories of alcoholism were more alienated and withdrawn, less rhythmical in their daily behavior, and evidenced lower self-esteem, more negative mood, greater social nonconformity, and more emotional discomfort than women in the other three groups. Women in the no incest/no alcohol group showed the best self-esteem and psychological adjustment and were generally more positive in the expression of various temperamental characteristics. The findings also suggested an association between incestuous victimization and an alcoholic family of origin.

Abstract:
Various theories that purport to explain the relationship between incest taboos and exogamous marriage customs are reviewed. These include sociological, psychological, and sociobiological approaches. Each of these approaches poses challenges not easily addressed by its competitors and yet no satisfactory synthesis seems available given the currently existing explanatory paradigms. It is argued here that exogamy is not a simple outgrowth of incest taboos and incest taboos are not a simple extenuation of inbreeding avoidance. Relationships between the sociobiology of inbreeding avoidance and social institutions such as exogamy and incest taboos are recast with the help of evolutionary psychology, which provides additional tools with which to approach this complex and contradictory set of interlocking problems.

Abstract:
This paper is intended as a contribution to the understanding of errors in our field. The title refers to the index entries “incest” in several classic psychoanalytic texts. In a way that is analogous to the defenses utilized by survivors of incest, psychoanalysis has both known and not known, avowed and disavowed, the traumatic impact of actual incest. It is argued that psychoanalysis erred in (a) focusing too heavily on the implications of incest for the Oedipus complex instead of its implications for every stage of development, and (b) missing out on the full and detailed description of the clinical pictures of incest victims and of treatment issues, including transference and countertransference. The author presents an overview of the history prompted by Masson's original attack on Freud for abandoning the “seduction hypothesis.” Topics covered are: Freud's early papers, the Freud-Ferenczi controversy (1932), and the state of psychoanalytic awareness in the 1960's of the importance of actual incest. Certain features of our field make it all too likely that new errors can be generated that may similarly lake decades to recognize and undo. These include the politics of our discipline, and negative attitudes toward systematic gathering and assessment of evidence.

Abstract:
This study aims to give more understanding about incestuous behaviour especially in Virginia Cleo Andrews’ Flowers in the Attic and Tabitha Suzuma’s Forbidden. There are three focuses of the study; they are (1) how incest described in those novels, (2) what the causing factors of incest, and (3) what the impact of it. In answering the first question, incest on its features can be classified into three types; they are based on the offenders, the motivation, and the way of treating. For the second question, this study is analysed trough two parts. The first part is based on the condition before that incest happened and for the second part is based on the psychoanalysis theory by Karen Horney. In her theory, she explains about the childhood experience and neurotic needs that are related in finding the possible causing factors of incest as the focus of this study. Then, for the third question, the possible effects of sibling incest such as; trauma, isolated on social sanction, sexual aversion disorder, and other psychological problems. The result of this study has been found that sibling incest which is happened in those novels is driven by both sides of the offenders. What they do are on their mutual desire and willingness. And the dysfunctional family that they face also really influences their psychology. In Forbidden, it is found that there are two motivations that influence Lochan and Maya to do sibling incest, they are; affection and aggression while in Flowers in the Attic, there are three motivations that are found, they are; affection, eroticism and aggression. For the second question, this research reveals that there are three causing factors of sibling incest that are happened in both novels, they are; dysfunctional family, between age peers, and law of homogamy. Not only that, from the findings, it is also found that all of the offenders experienced the child abuse and neglect in their childhood. They also get the emotional maltreatment from their parents. Their childhood experiences then shape their personality and it deals with the psychological problems which are influenced by the neurotic needs that they seek. The third question is about the impact of sibling incest towards the offenders’ life. And it is found that all of the offenders blame themselves for everything that has happened in their lives, even one of those offenders Lochan decides to commit suicide

Abstract:
<p>Incest refers to sexual or marital relationships between family members that are prohibited by law. Incest cases are often considered taboo and illegal and can have serious psychological and legal repercussions. the most common perpetrators of sexual violence, including incest, are fathers and uncles. Such as the case that occurred in Banyumas, Purwokerto in March 2023 last year. This is sad because many of the perpetrators of violence in the personal sphere are considered and expected to be protectors such as fathers, uncles, and husbands. Criminal responsibility for the perpetrators of incest can be charged with Article 287 of the Criminal Code or Article 419 of Law No.1 of 2023. Meanwhile, the formulation of incest against children can be charged using Article 294 paragraph (1) of the Criminal Code or Article 418 paragraph (1) of Law No.1 of 2023. In addition, the social-psychological impressions obtained by victims who experience incest will experience prolonged trauma. Social impressions are typical, namely that the child will be ostracized by his family, and discriminated against by the community. This article is written using normative and qualitative research methods that begin with an approach that focuses on analyzing applicable legal norms or regulations. The aim is to understand, explain, and interpret the written law. This research aims to assess the effectiveness of criminal law liability and child protection law in the decision and analyze the social sanctions obtained by the victim.</p><p>Keywords: Incest; criminal code; child protection law; social sanction; psychological impact.</p>
