It includes an additional chapter, also by Peter Davies, on the history of the company from 1973-1989, covering its decline and final years. The purpose is to describe and analyse the economic history of the Elder Dempster shipping company and its predecessors, and provide an account of West African and British economic backgrounds. The journal is divided into five parts, each concerning a different era in the company’s history. This includes the revision of the pricing principles, the extension of access obligations in mail delivery networks to include the shipment of goods and press, and the expansion of Deutsche Post AG’s obligations to hand over business contracts. In addition, the Commission is examining the role of Amazon in the parcel market. On the one hand, the company stimulates competition; on the other hand, there is a risk that Amazon could leverage its market power as the larest online marketplace operator into the parcel market. Thus, Amazon should be monitored.

This work studies the history of two major Scottish shipbuilding firms based on the River Clyde - Scotts Shipbuilding and Engineering Company and Lithgows Limited. It traces each firm’s origin, success, decline, and collapse, and places the events into the historical context of maritime Britain. The aim is to enhance the academic understanding of the cause and effect of the decline of the British shipbuilding industry, delving beyond the factors of poor industrial relations, international market conditions, and entrepreneurial failure in search of further answers. As a private company, Lithgows Limited provides useful insights into company management outside of state control. The authors base their analysis on the catalogued volumes of Scotts and Lithgows records, though due to the large number of gaps in the data, they also conducted interviews with major players in each company from the post-war period. Public, business, and banking records also provide supplementary material. The book is separated into eight chapters, plus a concluding ninth, an appendix listing ships built by Scott Lithgow Limited between 1970-1987, and a select bibliography.

Pessimism prevalent as the 1990s got underway would dissipate in a few years with the American economy and the stock market both thriving. Public company executives ended the decade riding high in a manner that was unmatched throughout the post–World War II era. Concomitantly, confidence in the efficacy of internal and external constraints affecting public company management grew substantially. Optimism about corporate governance would quickly dissipate, however, when public companies suffered a sharp reversal of fortunes as the 2000s got underway.

The chapter scrutinizes how German and Danish unions are navigating the increasingly integrated slaughterhouse industry, based on a case study of a large Danish multinational slaughterhouse company with operations in both Denmark and Germany. The German slaughterhouse industry is highly affected by increasing fragmentation of production and the widespread use of low-paid workers often posted from Eastern Europe, which the Danish multinational company utilizes to lower its production costs. The Danish slaughterhouse workers’ union was more successful in safeguarding workers’ wage and working conditions and preventing labour market segmentation, while their German peers faced much more precarious work. These differences are explained by the vast differences in the unions’ power resources in the two systems. Danish unions were in a much stronger position in terms of membership, where unionization remains a social custom, with stronger collective agreements and local representation compared with the German union.

Its founder, Effie Hinckley Ober, was not a performer, but a businesswoman who owned one of the first musical management firms in the country. Her success in a male-dominated business provides valuable insight into how an ambitious and enterprising woman could navigate a distinctly competitive, virile world in the post-Civil War American social landscape. This chapter covers the Boston Ideals only during the Ober period (1879–1885) and illustrates techniques of management, a hitherto unknown relationship between opera production and the emergence of lyceum bureaus, and performance practice. The company mounted both operettas (Gilbert and Sullivan) and some of the standard works that had been performed by English-language troupes for decades; after Ober’s retirement it continued until 1904 under a new name (the Bostonians) and new management.

The StuFo-Expo gives me the opportunity to make my research accessible to a broad, interdisciplinary public as part of my doctoral project. I also get the chance to get to know research topics, results and methods across disciplines. It is a unique project that connects students with one another and promotes important student skills. The topic of my research is the value relevance of deferred taxes. I am investigating the question of whether deferred taxes provide additional information for various stakeholders when predicting future corporate development. To do this, I analyze the almost 1,800 available annual financial statements of all companies listed in the DAX Prime Standard between 2007 and 2018. The poster I submitted shows that deferred taxes help forecast the development of the market value of equity up to two years in advance. Deferred tax assets as probable future tax repayments contribute positively to the company value and therefore to the market value, and deferred tax liabilities as probable future tax payments contribute negatively to the company value and therefore to the market value. I can also prove that the supplementary reporting on deferred taxes is rated negatively by market participants. Possible reasons for this are the high complexity of the information and the lack of transferability of this information to balance sheet and income statement figures. Interview studies also show that trust in deferred taxes and the associated reporting is low, as stakeholders suspect that deferred taxes are at least partially used for accounting policy.

In 2006, Cheung Yan became the first female to be dubbed the wealthiest person in the People's Republic of China. Formally known within her company, Nine Dragons Paper, as ‘the Chairlady’, she became a momentary darling of the financial press under titles such as ‘The Queen of Rubbish’, with an estimated worth of around US$10 billion in 2007. The meteoric rise and fall of Nine Dragons is emblematic of a post-Cold War globalization in which, if consumption is king, then trash is queen. This article sets the centrality of post-consumer waste in today's circuits of global trade in some historical perspective, focusing on modern China. It discusses waste before the nineteenth century, waste disposal and sanitation in the nineteenth century, and municipal solid waste management. The article also considers domestic and international economic forces that have conspired to make China the world's scrap magnet and magnate, including market reforms, rapid urbanization, consumerism, limited resources, and enormous industrial demand.

This chapter focuses on the Alien and Sedition Acts. The present chapter and the previous chapter on the Eleventh Amendment illustrate something generally missed—or misrepresented—about republican constitutional theory in the early republic. The so-called compact theory of the Constitution, the idea that the Constitution represents a compact between the states and the national government, is often presented as having emerged out of the proslavery ideology of the 1830s and viewed in opposition to the (entirely) more reasonable theories of Chief Justice John Marshall. This school of constitutional history places the initial seeds of southern secessionist theory in the naive hands of James Madison and Thomas Jefferson, who embraced the inflammatory language of states' rights and interposition in their Virginia and Kentucky Resolutions. According to this view, compact theory is a post hoc political invention that departs from the original understanding of the Constitution and that arose years after the founding as part of a political effort to displace the Federalist Party in the election of 1800.

This chapter explores the lawsuit that Wally Butts, a member of the College Football Hall of Fame, filed against the publisher of the Saturday Evening Post in 1963. The lawsuit began when the former head football coach of the University of Georgia (UGA) sued the publishing company for libel after its magazine published a story accusing him of fixing the 1962 UGA–Alabama football game with the help of legendary University of Alabama football coach Bear Bryant. This case marked the first time the U.S. Supreme Court concluded that a sporting figure was a public figure, that a former football coach was a celebrity, and that to win a defamation suit, public figures needed to prove actual malice (that the publisher had knowledge the statement was false or published it with reckless disregard of its falsity).

This book explores the evolution of the shareholder in post-war Britain within the context of changing legal, political, economic and social conditions. It examines how the post-war transformation of the shareholder body influenced relationships amongst stakeholders, impacting corporate behaviour and the legal and political efforts to govern industry and financial markets. The book addresses a number of themes, including: 1) how the movements for democratisation influenced the treatment of shareholder interests and the calls for stakeholder representation; 2) how the rhetoric of change created a narrative that deflected from the lack of systemic legal reforms and protected the status quo; 3) how, in the post-war consensus environment, political positions on equity ownership de-radicalised, but that proved unsustainable against a background of increasing political polarisation and industrial unrest; and 4) how the institutionalisation of the post-war shareholder body had profound effects on industry, the financial markets and the economy. With these themes as a foundation, the evolutionary arch of the post-war shareholder is examined, focusing on developments that influenced the treatment and perception of shareholder and stakeholder interests, including nationalisations, shareholder democracy, corporate purpose and industrial democracy. The book further considers how these post-war changes contribute to the post-1979 legal treatment of shareholder and stakeholder interests, including subsequent changes to the Companies Act and the development of corporate governance codes. Parallels to contemporary movements for stakeholder capitalism, corporate purpose and ESG are drawn. The historical analysis of the post-war shareholder provides a framework for considering current questions on shareholder primacy and the demands for systemic legal reforms. These missed opportunities for meaningful changes to the treatment of shareholder interests in UK company law serve as useful precedents for evaluating subsequent periods.

Chapter 4 examines the circumstances leading to the final success of Lincoln Kirstein’s American ballet in 1963, when Ford Foundation philanthropy made George Balanchine’s neoclassicism a national institution and a national style. Examining the New York City Ballet’s cultural diplomacy activities, it illustrates the advantageous position that Balanchine attained within the alliances between the government, private and corporate foundations, and the arts that developed in the cultural Cold War. Yet the chapter stresses the complexity of the collaboration between the ballet company and the government, insisting that the artists often had very different political motivations than the state. A main concern is how the belief in the social efficacy of art, nurtured in the 1930s, was affected by the transformational shift in arts funding, organization, and management that arose during the Cold War. This chapter concludes by raising questions about the consequences of the post-WWII institutionalization of the arts for the political agendas of the 1930s-era modernists.

Throughout the US-Vietnam conflict (1965–1973), American forces labored to comply with the Geneva Conventions and customary laws of war, though US war crimes largely overshadowed those efforts. This chapter relates the training US forces received on the law of war and describes how military lawyers practiced law “in country.” US combatants were constantly directed to report war crimes, known or suspected. Too often those directives were not obeyed. My Lai is fully examined, including its badly failed military prosecutions. Disturbing post-trial clemency by civilian authorities, in many cases, is also detailed. On the whole, however, the sentences of US personnel convicted by courts-martial of war crimes were sincere efforts to appropriately punish battlefield criminality. This chapter argues that, under difficult conditions, US military efforts in Vietnam to comply with the Geneva Conventions, and to punish known US war crimes, were more genuine and effective than have been generally recognized.

It explains the rationale behind the present status by tracing the history and nature of the Nigerian state as well as the applicability of Sharīʻah in colonial Nigeria. It then focuses on the application of Sharīʻah in the immediate post-independence Nigeria as well as the Great Debate on the constitutional status of Sharīʻah in Nigeria since the 1970s. The example of Nigeria shows that it is possible for Muslim states to separate religion from the state, respect constitutionally guaranteed human rights, and comply with international human rights conventions while practicing the Muslim religion.

Next, the chapter finds the equations of motion of the bodies in the field which they create to second order in the perturbations, assuming that their velocities are small. It shows that, to correctly describe the radiation reaction at 2.5 PN order, it will prove necessary to iterate Einstein equations a third time. This leads the discussion to the equations of motion, which generalize to order 1/c5 the EIH equations of order 1/c. Finally, the chapter studies the effect of the radiation reaction force on the sources, and shows that there is an energy balance at 2.5 PN order between the energy radiated to infinity and the mechanical energy lost by the system.

In his present contribution François Recanati has said some very kind things about me and some very astute things about language. He recognizes something new and important which came into prominence, and enjoyed its heyday, at least in Anglophone philosophy, roughly in a post-war period stretching up to around Austin’s death in 1962. This was a period marked by a new sort of conception of what a philosophical question might be, and how one might coherently be formulated—of what philosophy ought to look like. He recognizes, too, those waiting in the wings to turn the clock back to a time of what they saw as a less complicated, more straightforward, and more comfortable form of philosophy; one in which we need not question ourselves, and our own ability to find our way about, to the extent that Austin and Wittgenstein asked us to do. Austin’s death was a signal to such philosophers to launch their attack. And Recanati has done much detailed work to show how such attacks—ones deploying such things as ‘the Geach point’ and Grice’s deployment of the notion implicature—come up short. What I will aim for here is to place what he sees in a somewhat wider setting. In it some of his main points can be supported in a slightly different way. I will also come to one point, at the end, on which, as frequent allies as we are, we part company....

The paper discussed in this chapter was the first to compare some of the pharmacological effects of drugs to the effects induced by placebo treatments. It is one of the first studies to introduce the notion of a pharmacology of placebos, an idea which was quite unusual and innovative in the 1950s. In particular, in this study, many characteristics, which are typical of drug treatments, were investigated regarding placebo treatments. For example, peak effects, cumulative effects, carryover effects, and the relationship between efficacy and severity of disease were analysed in conditions such as post-partum pain. The main results show that placebos may produce effects that are similar to those induced by drugs. This pioneering study paved the way to a true biology of the placebo effect and to the modern emerging concept that placebos and therapeutic rituals use the same receptor and biochemical pathways that are used by drugs.

This article encapsulates some of the problems that rampaged Germany apart from politics. The ongoing relevance of religion in the search for meaning in postwar Germany, amidst growing discontent with the churches as organized bodies and their professional representatives; the ways in which their lack of resistance against the anti-Jewish policies of the Nazi regime haunted the Christian churches after 1945. Amidst the rubble of the society of the immediate postwar period, bishops, priests, and theologians of both Christian churches agreed that a rebuilding of the moral and political order could only succeed through a reaffirmation of Christian values. Rebuilding the moral compass and the international authority of the Germans would, hence, require a rechristianization of society. Statistics showing that people rejoined the churches in droves seemed to support these claims for a rechristianization of German society. This article analyses the culmination of religions within the German society post Second World War.

The 3,144–amino acid huntingtin protein (HTT) folds in water into a structure consisting of compact, organized domains interspersed with intrinsically disordered protein (IDP) elements. The IDPs function as sites of post-translational modifications and proteolysis as well as in targeting, binding, and aggregation. Although the dominant structural motif of HTT is the α-helix–rich HEAT repeat, the expanded polyglutamine (polyQ) toxicity responsible for Huntington’s disease is most likely played out within intrinsically disordered HTT exon 1–like fragments consisting of the 16– to 17–amino acid N-terminal HTTNT segment, the polyQ segment, and a proline-rich segment. The physical behavior of HTT exon 1 fragments is dominated by interactive, polyQ repeat length–dependent structural transitions responsible for membrane and protein–protein interactions and the formation of tetramers, higher oligomers, amyloid fibrils, and inclusions. Understanding the basis of this solution behavior may be the key to disease mechanisms and molecular therapeutic strategies.

Did 9/11 revive a North American guns-butter trade-off? Established in the largest administrative overhaul since World War II, the Department of Homeland Security was charged with keeping the United States safe within a wider security community, but confronted the Washington Consensus-based Western Hemisphere free trade movement, beginning with the North American Free Trade Agreement (NAFTA) and extending to the Central American Free Trade Agreement (CAFTA) in 2003, to materialize a Free Trade Area of the Americas (FTAA) compact. Whether 9/11 restrictions impeded these trade-related thrusts or not, embracing neoliberalism permitted Canada and Mexico to pursue their own initiatives, such as proposing free-trade to the US—Canada in 1985, Mexico in 1990, but, as during the Cold War, security imperatives ultimately prevailed. This work investigates Canada's and Mexico's Department of Homeland Security responses through three bilateral studies of policy responses along comparative lines, case studies of security and intelligence apparatuses in each of the three countries, and a post-9/11 trilateral assessment. Ultimately, they raise a broader and more critical North American question: Will regional economic integration continue to be trumped by security considerations, as during the Cold War era, and thereby elevate second-best outcomes, or rise above the constraints to reassert the unquenchable post-Cold War thirst for unfettered markets replete with private enterprises, liberal policies, and full-fledged competitiveness?

The Colonial Occupation of Katanga consists of a translated and richly annotated edition of the personal correspondence of Lieutenant (later Captain) Clément Brasseur, the military officer in charge of Lofoi, the first post of the Congo Free State in Katanga, between September 1893, the month of his arrival in the region, and November 1897, when his violent life came to a violent end. All of the letters included in the volume are addressed to Brasseur’s elder brother, Désiré, a fellow military officer; most of them take the form of regularly updated journals and travelogues. Brasseur’s dense correspondence describes in exceptional detail both his day-to-day activities in Lofoi and the numerous military operations that he and his local allies, the Yeke of Mukanda Bantu, undertook with a view to impressing upon Katangese communities the need to comply with instructions relating to taxation in kind and labour. The striking candidness of the records presented in this edition challenges top-down understandings of the violent workings of the Congo Free State, casts unprecedented light on early colonial state-building in Katanga and shows that the latter process was deeply informed by African strategies and interests.

What has been the role played by financial elites (and financial experts) in different European societies and markets over time? What have been their links with other national/international elites? What has been their contribution to the recent financial collapse, and how does this compare to previous crises? How have financial elites adjusted to, or influenced, the process of evolution of the financial system’s regulatory framework over time? This book—a collection of chapters dedicated to the European financial elites—answers these questions through historical comparisons and country and cross-country case studies. The volume provides a timely contribution to the current debate on the role of financial elites/financial experts within society and the markets. Forensic DNA evidence has helped convict the guilty, exonerate the wrongfully convicted, identify victims of genocide, and reunite families torn apart by war and repressive regimes. Yet many of the scientific, legal, and ethical concepts that underpin forensic DNA evidence remain unclear to the general public; judges; prosecutors; defense attorneys; and students of law, forensic sciences, ethics, and genetics. This book examines the history and development of DNA forensics; its applications in the courtroom and humanitarian settings; and the relevant scientific, legal, and psychosocial issues. It describes the DNA technology used to compare the genetic profile of a crime scene sample to that of a suspect, as well as the statistical interpretation of a match. It also reviews how databases can be searched to identify suspects and how DNA evidence can be used to exonerate the wrongfully convicted. Recent developments in DNA technology are reviewed, as are strategies for analyzing samples with multiple contributors. The book recounts how the Grandmothers of the Plaza de Mayo searched for children kidnapped during military rule in Argentina, as well as more recent efforts to locate missing children in El Salvador. Other chapters examine the role that DNA forensics played in the identification of victims of genocide in Bosnia and of terrorism in the post-9/11 era. A debate on public goods is urgently needed in health care. Care must be recognized as a social function, as an occupation and, at the same time, as a human right—which imposes binding obligations to comply with precise standards of quality, quantity, suitability, adaptability, and accessibility, among others. It is a complex and invisible task, that may be done as part of a medical treatment, post-surgical recovery process, or permanent support in cases of chronic illness, disability, or mental health conditions. And it tends to be provided mainly in the home, by women, without remuneration. In Latin America, care has not been included in a coordinated and specific public health policy agenda but has been advanced through isolated actions—in many cases highly fragmented and heterogeneous—without a clear awareness of the public nature of care and the associated responsibility of the State. Accordingly, this document takes a gender and rights-based approach. It starts with an analysis of the main definitions of unpaid work in the health sector, and then focuses on initiatives in three Latin American countries (Colombia, Costa Rica, and Uruguay) with regard to measurement, valuation, integration, and recognition in national health systems or policies, in care models, and in time-use surveys. The conclusions propose recommendations aimed at addressing unpaid care as an essential element of social policies in general, and health policies in particular, from a gender and rights-based perspective.

Not only has the velocity of infection and transmission patterns undermined our feeling of agency, but the safety measures to restrict the virus's spread also demanded social and physical separation, prohibiting us from seeking solace in the company of others. The coronavirus 2019 (COVID-19) pandemic has wreaked havoc on daily life and normal activities as well as having serious health, economic, financial, and societal consequences Lockdowns and physical/social distancing measures were enforced in numerous countries throughout the world beginning in March 2020. COVID-19 has claimed the lives of hundreds of thousands of people all over the world. This high death toll, combined with the rapid changes in daily life brought on by the COVID-19 pandemic, may have a negative impact on child and adolescent mental health. Individuals' reactions to the security measures adopted to combat the epidemic varied depending on the social roles they played. Some segments of the population seem to be more exposed to the risk of anxious, depressive, and post-traumatic symptoms as the population is more susceptible to stress. COVID-19 pandemic has generated a situation like mass hysteria or fear. This mass fear of COVID-19, termed as “Coronaphobia”, has generated a plethora of psychiatric manifestations across societies. In India, the first and foremost responses to the pandemic have been fear and a sense of clear and imminent danger. Fears have ranged from those based on facts to unfounded fears based on misinformation circulating in the media, particularly social media. All of us respond differently to the barrage of information from all the available sources. It is equally important to consider the impact of the various phases of the pandemic on children, the elderly and pregnant women. The worries of adults can be transmitted to children and make them anxious and fearful. They can become very easily bored, angry and frustrated. Without an opportunity for outdoor play and socialization, they may become increasingly engrossed in social media and online entertainment, which can make them even more socially isolated when they emerge out of this situation. Parents need to know means of keeping the children engaged, providing an opportunity to learn new skills at home, as well as encourage children to participate in activities, get them engaged in “edutainment” and hone their extracurricular skills as well. Children with special needs may need innovative approaches to engage them and keep them active at home. For the elderly, they can feel further isolated and neglected, become more worried about their families, and increasingly worried about their health. They may not have the support systems to care for them, particularly in terms of their medical needs. This can aggravate into anxiety and depression.
