An increasingly important aspect of EU trade policy since the lifting of its self-imposed moratorium on preferential trade agreements (PTAs) has been the inclusion of WTO+ provisions on subsidies in bilateral agreements negotiated with a number of third countries. This article covers the main bilateral PTAs negotiated after the publication of the Commission’s Communication on ‘Global Europe’ in order to explore the implications of the different subsidy disciplines they set out. It also discusses the questions that arise when examining the legal discipline of public aid provided by such agreements, regarding not only the substantive appropriateness of standards and rules on compatibility, but also the procedural mechanisms designed to guarantee the implementation and the enforcement of such rules. It concludes that the most advanced among the EU PTAs are shaped as competition regulation and go beyond a mere negative function, ensuring that subsidies can contribute to fundamental public goals.

This chapter examines the attempt to coordinate and harmonize the dual-use and arms export control policies of EU member states, focusing in particular on the use of EU arms embargoes and the implementation of the EU Dual-Use Regulation and the EU Common Position on Arms Export. The chapter examines the original motivations that drove and sustained this effort and gives an assessment of its impact on member states’ national policies. In doing so, the chapter pays particular attention to the dual-use and arms export control policies of Europe’s major powers (France, Germany, the United Kingdom), highlighting areas where states’ policies have been affected by EU processes of coordination and convergence, and where they remain driven by primarily national considerations. The chapter also assesses and compares the impact of these processes among a selection of smaller EU member states.

Recent research on the interaction between services trade and investment restrictions and the quality of economic regulation has shown that the productivity growth benefits from liberalization depend importantly on the quality of economic governance. We provide quantitative estimates of the extent of potential downstream productivity gains from services liberalization for EU countries and how these are conditional on domestic economic governance performance; we discuss several dimensions of the state of play in the EU with respect to implementation of the Services Directive and realization of the Single Market objective. We argue that more attention should be given to the design of services trade agreements in improving economic governance, and make several suggestions how this could be done.

This chapter examines the regulatory framework for listing and public offers in the UK, with a particular focus on the Prospectus Directive regime that was first adopted by the European Union in November 2003 and implemented in the UK from 1 July 2005. The Prospectus Directive regime regulates information disclosure in connection with a public offer or admission to listing on a regulated market in the EU. The chapter first provides an overview of the evolution of the Prospectus Directive regime before discussing its implementation in the UK. It then considers when a prospectus is required and what it must contain and describes the listing regime in the UK, which combines admission to the ‘Official List’ with admission to trading on one of the markets of the London Stock Exchange. The chapter also explains the UK listing requirements and the ongoing obligations faced by issuers admitted to listing and trading.
