Perché un fedele possa iniziare la procedura contenzioso amministrativa deve possedere la capacità giuridica, sia generale sia processuale, ma soprattutto l’interesse di agire, l’interesse che deve essere personale, diretto e attuale. La parte ricorrenete può essere una persona fisica o giuridica e può essere anche l’autorità amministrativa inferiore, cioé l’autore dell’atto che è stato impugnato in sede di ricorso gerarchico. La parte resistente è sempre un Dicastero della Curia Romana. Il motivo del ricorso è illegalità dell’atto e così detta la violatio legis. Il soggetto del ricorso è l’atto amminitrativo emanato da un Dicastero della Curia Romana. Questi sono i fondamentali elementi del ricorso presentato presso la seconda sezione dell’Segnatura Apostolica che ho cercato precisare e complementare in presente articolo.

Negli ultimi anni la criminalità organizzata è diventata un elemento di richiamo nelle cronache messicane. In Italia, negli ultimi trenta anni, la lotta alla criminalità organizzata ha conosciuto la ribalta pubblica, costituendo un elemento attorno a cui costruire le politiche pubbliche e orientare l'azione di diversi governi. Ma che cosa è la criminalità organizzata? Come nasce? Come si sviluppa? Quali sono le differenze e le similitudini in Italia e in Messico? Analizzando gli approcci teorici e la storia delle organizzazioni criminali, l'autore prova a fornire uno spunto analiti-co che ruota attorno ai concetti di "legalità illegalizzata" e "illegalità legalizzata", provando a inquadrare il fenomeno come una costruzione sociale inscritta nei conflitti di potere che si formano in ogni società. Si prova a dimostrare come il ruo-lo dello stato è fondamentale nella definizione del problema, e che le politiche di repressione, in quanto non guardano alla rete criminale, ma solo al fenomeno este-riore, tendono ad aggravare il problema e a violare i diritti umani.

Abstract This essay examines the intertwined nature of seemingly neutral immigration laws that illegalize certain immigrant groups and the socially constructed attitudes and stereotypes that associate the same legally targeted groups with “illegality,” to produce the racialization of illegality. These complementary factors are further sustained by other social forces, including media discourses that reify those associations. The racialization of illegality is a fundamentally situational, relational, dynamic, and historically and context-specific process. Today, Latino groups are the preeminent target group of both the social and the legal production of illegality. Thus, this essay examines Latinos' racialized illegality across geographical contexts, within their group, and in relation to other contemporary immigrants. Although expressions of racialized illegality and specific targeted groups will vary across time and space, the contours of the phenomenon will be present across contexts and times (and produce specific outcomes) because they are shaped by existing racial hierarchies.

L'articolo passa in rassegna la lunga e complessa evoluzione, politica e normativa, delle procedure di bonifiche dei siti contaminati, individuando criticità, contraddizioni, opacità, lentezze e manifestazioni di illegalità. A livello generale, almeno due sono emerse come le principali criticità di sistema, che hanno fatto da freno alle attività concrete di bonifica: 1) criteri non idonei di scelta per l'identificazione del sito da bonificare; 2) errata ripartizione delle responsabilità tra gli enti territoriali, che spesso non hanno adeguati mezzi e risorse, soprattutto in termini di personale qualificato per rispondere a procedure così complesse. Anche da questa prospettiva, l'inquinamento diffuso provato anche dalla presenza dei siti da bonificare rappresentano il punto finale di un processo di sviluppo industriale e consumistico privo di regole e di limiti. Deregulation che è valsa per almeno un quarantennio, un ampio arco temporale in cui il territorio nazionale ha visto l'esplosione dei siti inquinati (di interesse nazionale, regionale o comunale), dove per almeno 200 casi l'Unione Europea ha addirittura aperto due distinte procedure d'infrazione. Procedure che sono costate all'Italia oltre 40 milioni, più una penalità semestrale iniziale di 42.800.000 euro. Per far fronte a questo salasso il 24 marzo 2017 il Governo dell'epoca ha costituto il Commissario Straordinario di Governo per svolgere la missione di bonifica e messa in sicurezza degli 81 siti di discarica abusivi sotto procedura di infrazione a seguito della Sentenza di condanna sanzionatoria della Corte di giustizia dell'Unione Europea del 2 dicembre 2014.

Abstract:
The assertion of contractual rights may be defeated by the illegality defence, not because their creation is offensive to public policy but by reason of an illegality that ‘taints’ these rights. To date, no analytical framework has been developed for understanding how these tainting rules are connected to one another. The Tainting Illegality Framework (TIF) presented in this paper seeks to fill this gap in current legal scholarship by exploring, first, the linkages between the rules by which contract rights are tainted and, secondly, the theoretical underpinnings that explain the existing tensions and that will continue to shape the law in this area. The suggested analytical approach enriches and increases the sophistication of the current approaches by considering how their application is shaped by considerations of proximity and the nature of the contaminating illegality. The framework recognises the value of the existing rules, and seeks to enrich the analytical approach by suggesting how their application can more transparently reflect the policy rationale for applying the illegality defence.

Immigration scholars have increasingly questioned the idea that “illegality” is a fixed, inherent condition. Instead, the new consensus is that immigration laws produce “illegality.” But can “illegality” be socially constructed? When initially judging who is an “illegal immigrant,” common observers and even authorities typically do not rely on an individual’s documentation. Instead, people rely on shared stereotypes to assign “illegality” to certain bodies, a condition we refer to as “social illegality.” Ethnographers have documented that individual traits like occupation or national-origin may trigger illegality suspicions, but it is not clear how widespread these stereotypes are, or whether all stereotypes are equally consequential. To address this question, we examine the personal attributes shaping perceived “illegality.” We apply a paired conjoint survey experiment on a nationally representative sample of 1,515 non-Hispanic white U.S. adults to assess the independent effect of each dimension. We find that national origin, social class, and criminal background powerfully shape perceptions of illegality. These findings reveal a new source of ethnic-based inequalities—“social illegality”—that may potentially increase law enforcement scrutiny and influence the decisions of hiring managers, landlords, teachers, and other members of the public.

Under Dutch Law juridical acts may conflict ? by their mere accomplishment, their content, or their purport ? with a statute, good morals, or public order. This may be a ground for nullity, produce other effects, or have no consequences at all. Though not conflicting with law in such a way, a juridical act will not be (fully) enforceable, if a performance under an act would result in a violation of statute, good morals, or public order. The Dutch condictio indebiti also covers performances other than giving money or any other property, e.g. services rendered. The Dutch Law of Restitution is remarkable in that generally both parties may reclaim what they performed on an illegal contract. Under the 1992 Civil Code, unlike beforehand, there is now some room for the in pari delicto defence, albeit very little. Only where a particular performance made by one party is so repugnant that it defies assessment of its value, this party may, sometimes, avail itself of this defence against the condictio indebiti of the other party. If a contract, though not null, is not enforceable but has nevertheless given rise to performances, condictiones indebiti may equally lie.

Sammanfattning Det förekommer dagligen företag som anordnar tävlingar och lotterier på Facebook utan att ta hänsyn till lagar och regler. Företagen saknar allt som oftast lotteritillstånd och bryter därmed mot 9 § Lotterilagen. Det kan även ifrågasättas huruvida de tar hänsyn till bestämmelserna i Marknadsföringslagen (MFL). Marknadsrättsliga regler om god marknadsföringssed, reklamidentifiering och vilseledande marknadsföring är frågor som kan komma att bli aktuella vid en marknadsrättslig bedömning. Syftet med uppsatsen är att undersöka huruvida det är förenligt med gällande rätt (de lege lata) för företag att lotta ut gåvor på Facebook genom att användarna skall gilla och dela en statusuppdatering. Samt att undersöka på vilket sätt det kan tänkas strida mot gällande lagstiftning för marknadsföringsåtgärder. Det är idag tillåtet för företag att anordna pristävlingar, det som då krävs är att deltagarna genomför en viss motprestation. Saknas det krav på motprestation så anses det vara en utlottning i lagens mening. Ett sådant förfarande kräver lotteritillstånd, vilket ställer vissa krav på den ansökande. Skillnaden mellan ett lotteri och en tävling är att en tävling skall innehålla ett prestationsmoment, där skickligheten skall vara avgörande, medan det i ett lotteri skall finnas ett slumpmoment. Förekommer det ett prestationsmoment som sedan avgörs med hjälp av ett slumpmoment så övergår tävlingen till att bli ett lotteri. Vad gäller Facebooktävlingar/-lotterier där en statusuppdatering skall gillas och delas handlar prestationsmomentet om två knapptryckningar, något som inte kan anses vara en tillräckligt stor motprestation. Det innebär att ett sådant förfarande skall anses utgöra ett lotteri och därmed faller in under Lotterilagens (LL) bestämmelser. Lotterierna som förekommer på Facebook är att jämställa med säljfrämjande aktiviteter, vilka har till syfte att öka försäljningen. På den grunden kan företag i princip aldrig få ett lotteritillstånd då det inte har till syfte att främja ett allmännyttigt ändamål. Lotterier som saknar tillstånd strider mot 9 § LL och så även mot lagstridighetsprincipen i 5 § MFL. Vad gäller reklamidentifiering, så måste det anses att reklamidentifiering är så pass tydlig att det inte kan misstas som något annat än en marknadsföringsåtgärd och paragrafen kan därmed ej göras tillämplig. Att marknadsföra ett lotteri som i egentlig mening är olagligt och be användare att främja det anses vara att vilseleda användare att bryta mot lagen. Det handlar även om vilseledande marknadsföring då lotterier marknadsförs som en tävling när det egentligen är ett lotteri. Genomsnittskonsumenten är sällan medveten om vad skillnaden är och antar att han eller hon deltar i en tävling som är lagenlig.
Abstract  Every day there are companies that organize contests and sweepstakes on Facebook without taking legislation and regulations into account. Firms all too often lack a lottery license and thus breaks the 9 § of the Lottery Act. It may also be questioned whether firms take into account the regulations of the Marketing Act (MFL). Marketing rules such as good marketing customs, advertising identification and deceptive marketing are issues that may be encountered in court. The purpose of this thesis is to investigate whether it is consistent with applicable Swedish law (de lege lata) for companies to arrange lotteries on Facebook by allowing users to like and share a comment. And to investigate how it might violate the legal rules for marketing actions.  It is today permitted to arrange competitions given that the participants perform some kind of counter performance. If the counter performance where to be lacking, the competition then would be recognized as a lottery before the law. Such a process requires a lottery license, which imposes certain requirements on the applicant. The requirements to be met is that it should be provided to the public, it must be a Swedish legal entity organizing the lottery, that it has a non-profit making purpose and it should not be held in purpose to make a profit. The difference between a lottery and a competition is that a competition should contain a counter performance, in which skills should be paramount, while in a lottery there should be a random element. If there is a counter performance and the competition is settled randomly it becomes a lottery instead of a competition. When it comes to Facebook-competitions/-lotteries where comments should be liked and shared, it only demands two presses of buttons which cannot be considered as a big enough counter performance. This means that that kind of procedure should be considered as a lottery and thereby the Swedish Lottery Law is applicable.  Lotteries appearing on Facebook should be recognized as sales promotion, which aim to increase sales. On that basis, Facebook lotteries can never get a lottery license as it is not intended to promote the public benefit. Lotteries without permission conflicts with the 9 § of the Lottery act and therefore also the conflict of law principles in 5 § of the Marketing act. When it comes to rules about advertising identification it must be considered that it is so clear that it cannot be mistaken as anything else than a promotional activity thus the article is not applicable. To promote a lottery that strictly speaking is illegal and ask users to promote it is considered to mislead users to break the law. It is also considered to be misleading marketing when lotteries marketed as a contest really is a lottery. The average consumer is rarely aware of what the difference is between a contest and a lottery and therefore assumes that he or she participates in a contest that is legal.

Introductory remarks (the concept and the classification of the so called countertypes). Not in every case does the fulfilment of the statutory features of a forbidden act have to be the expression of the objective social harmfulness of the perpetrator’s behaviour. Sometimes circumstances excluding illegality (the so called countertypes) occur which lead to the exclusion of the social harmfulness.In other words, there are possible exception to the rule (implying the negative assessment) that a behaviour fulfilling the statutory features of a forbidden act is characterised by social harmfulness.

In the mid nineteen nineties, the U.S.-Mexico border region, a space both constituted and contested by a myriad of different communities, political ideologies, national identities and cultural landscapes, came to be the site of some of the starkest representative examples of modern neoliberal logic and the contradictions it demonstrates vis-a-vis 1) seemingly unlimited capital liberty and 2) tightly constrained human mobility. As fiscal reforms broke down trade barriers, the physical border was being reinforced like never before, filtering economic refugees of policies like NAFTA to cross in more isolated and inhospitable regions and leading to an unprecedented precipitous increase in undocumented migrant deaths. The crisis led to the formation of several NGO's and humanitarian groups whose aim was to mitigate the loss of life. Faced with legal consequences for the work they carried out, these groups have attempted to reframe the debate as an international human rights issue. Through an analysis of the disputed discourses of legality and illegality vis-à-vis migrant border crossings and border securitization, this paper highlights the ways in which dominant notions of legality are being contested by border humanitarian activist groups These reworked notions of legality/illegality shape political debates, the framing of humanitarian arguments, and ultimately the opening of new spaces wherein existing laws can be challenged. A critical geopolitical framework that stresses the ways in which ideas and practices of belonging are embodied and socially embedded is key to this analysis.

In 2013, the Dominican Republic’s highest court ruled to revoke birthright citizenship for over 200,000 Dominicans of Haitian descent. Ruling TC 168-13 prompted dialogue about race and racism in the country, breaking the racial silence that accompanies mestizaje (racial mixture). Scholars viewed this ruling through the lens of “Black denial” whereby Dominicans’ failure to adopt Black identities, despite being largely afrodescendant, fuels the racialization of Haitians as Black. Less evident in examinations of Dominican racial politics are anti-racist and anti-xenophobic organizing. Addressing the gap in scholarship on Dominican blackness, this dissertation project adopts an ethnographic approach to examine how Domicans of Haitian descent, most notably through Reconoci.do, a movement of denationalized youth, as well as the natural hair movement, engage with race. As one of the few well-articulated areas of Dominican society engaged with blackness, the natural hair movement provides a useful counterpoint for examining the intersections between blackness and Haitianess. In this work, I propose that natural hair has the potential to destabilize Haitian racialization yet, concurrently threatens to decouple the anti-racist movement from Dominico-Haitian struggles. These intersections illuminate the complex relationships within the heterogenous anti-racist movement. Through a historically rooted examination of constructions of race and nation in immigration policies, censuses, and national identity cards, this dissertation asserts that immigration policies were designed to benefit the dominant sugarcane economy at the expense of migrants and thus state efforts in 2014 to address indocumentation continued earlier discriminatory patterns, disproportionately impacting the Haitian diaspora. These practices are best understood as spectacles (De Genova 2013) that produce migrant illegality and, in particular, an inherited illegality for Dominican-born children that violates their constitutional rights to citizenship. Furthermore, the state constructs the population as non-black while publicly undermining anti-racist organizing and this research finds that activists draw on transnational images of blackness to challenge national representations of a modern blackness. Identifying mestizaje and the color continuum as obstacles to organizing, many activists conceptualize blackness as hypodescent, whereby any African ancestry engenders a Black identity. I argue that, while essentialist, this strategy broadens identification with Dominico-Haitians.

ABSTRACT

This study aims to examine how womens illict drug use appears in different ethnic groups. The chosen perspectiv is social constructivism. The study is based on 20 scientific studies: 17 from Northern America, two from Great Britain and one from Sweden. Central themes from the studies have been created from different subject viewpoints. The results of this study shows that women have different needs when treatment is required. In addition prevention must consider specific gender and ethnic issues. The patterns of use are different between ethnic groups. Important aspects to consider, besides ethnicity, in research as well as in social work practices are acculturation, heterogenity, cultural heritage and gender stucture. The role of scientific creations of ethnic catergorisations and definitions of illicit drug use are discussed. As a result of our study, the need for cultural competence and cultural sensitivity in social work has been pointed out.

Granskningen görs utifrån ett socialkonstruktivistiskt perspektiv. Uppsatsens underlag utgörs av 20 vetenskapliga arbeten varav 17 är amerikanska, två brittiska och ett är svenskt. I uppsatsen redovisas centrala teman med utgångspunkt i materialets karaktär. Resultatet visar att kvinnors behov i behandling och prevention, användningsmönster samt prevalens skiljer sig inom och mellan etniska grupper. Viktiga faktorer att ta hänsyn till, utöver etnicitet, vid såväl forskning som det sociala arbetets praktik är ackulturation, heterogenitet, kulturell tillhörighet och genusstrukturer. Resonemang förs kring forskarens roll vid konstruktionen av etniska grupper samt definitioner av illegalt narkotikabruk. Utifrån studiens resultat lyfts behovet av kulturkompetens och kultursensivitet i socialt arbete fram.

The article reveals the theoretical problems of defining the concept of “natural monopolies”, based on a comparison of economic and legal approaches to the interpretation of the analyzed category, and reveals its inconsistent understanding in the current legislation of the Russian Federation. In the article, by means of a detailed analysis of the provisions of Laws No. 135-FZ and No. 147-FZ, the illegality of attributing the legislation on natural monopolies to the antimonopoly legislation is determined. On the basis of the obtained data, the legal meaning of the concept of “natural monopolies” is formulated, which can contribute to the modernization of the system of their functioning, increase the efficiency of work, and improve the current legislation.

Se propone una intervención que interprete las dinámicas sociales y la ocupación del territorio, que tendrá como punto de partida, la inclusión social y la articulación urbana. Dicha intervención, propone estrategias innovadoras que le apuestan a una regeneración urbana, que construya tejido social y articule a Estación Villa con el resto de la ciudad. This article summarizes the product of an academic workshop in which we reflect on the Estación Villa sector, which is part of the Medellin traditional downtown and questions about how to tackle a territory, an area which has been excluded on account of interventions developed at its edges and has led inside, mixing different population groups and activities, which, illegality and informality have led to urban and social exclusion of the rest of the city. An intervention to interpret the social dynamics and the occupation of territory, taking as a starting point, social inclusion and urban articulation is proposed. This intervention proposes innovative strategies betting on urban regeneration build social fabric and articulates Station Villa with the rest of the city.

Abstract:
In Colombia, the phenomenon of forced displacement from the territory of origin by ethnic minorities and inhabitants of rural areas is macroscopic; pressure by armed and economic actors, abandonment by institutional entities induces them to find refuge in no man's land. In the anonymity and informality of the extreme margins of large cities, this vulnerable population builds a primary refuge and seeks life opportunities on land without infrastructure or public services (DANE, 2015; UN_Habitat, 2016; UNHCR, 2019). In these slums there are precarious health conditions, low temperatures associated with cold winds, which generate different pathologies in their occupants. The settlement typology, based on terraces and vertical slopes, constitutes a further factor of seismic vulnerability and due to mass removal. The Tocaimita Oriental settlement (2900 m.a.s.l.) shows a complex reality of lucid awareness and determination, of community cohesion where the aims of having a “decent” home underlie the legalization of the settlements and their individual and group recognition. Forced displacement is necessary and always painful (Hannigan, O'Donnell, & O'Keeffe, 2016). In the last three decades, 36.2% of the Colombian population has left their identity territory for the largest cities in the country; in Bogotá alone there are approximately 1,393,140 people who live in the extreme urban periphery, in full illegality (UNHCR, 2017). The sad dream of this form of freedom implies leaving threats behind and satisfying needs that the very fact of staying alive demands (Shedlin, Decena, & Noboa H. & Betancourt, 2014). This is an extreme exercise of self-determination that entails abandonment, escape from conditions of hunger, pain, fear, need (Türk, 2017) in the face of death threats and extreme poverty (Centro Nacional de Memoria Histórica, 2015); the need to exist, the possibility of being able to decide in a constrained framework implies the loss of the social support base (Bobada, 2010), social, physical and economic vulnerability. Resettlement represents a new beginning with the expectation of finding housing, employment, health, education, public services (Braubach, 2011) however, the displaced, left to themselves, in turn abandon institutional rules; count on their own means and found extremely precarious illegal settlements waiting for institutional responses. Bogotá is chosen as a destination because it presents multidimensional poverty levels that are clearly lower than the rest of the country (DANE, 2017) and provides greater opportunities even in informality. En Colombia es macroscópico el fenómeno del desplazamiento forzoso del territorio de origen por parte de minorías étnicas y habitantes de áreas rurales; presiones por actores armados y económicos, abandono por las entidades institucionales los induce a encontrar refugio en tierras de nadie. En el anonimato y la informalidad de los márgenes extremos de grandes ciudades, esta población vulnerada construye un refugio primario y busca oportunidades de vida en terrenos sin infraestructuras ni servicios públicos (DANE, 2015; UN_Habitat, 2016; UNHCR, 2019). En estos tugurios se viven precarias condiciones de salud, bajas temperaturas asociadas a vientos fríos, lo que genera diferentes patologías en sus ocupantes. La tipología de asentamiento, a partir de terrazas y taludes verticales, constituye un ulterior factor de vulnerabilidad sísmica y por remoción de masa. El asentamiento de Tocaimita Oriental (2900 m.s.n.m.) muestra una realidad compleja de lúcida consciencia y determinación, de cohesión comunitaria donde los fines de tener una vivienda “digna” subyacen a la legalización de los asentamientos y su reconocimiento individual y grupal. El desplazamiento forzoso es necesario y siempre doloroso (Hannigan, O’Donnell, & O’Keeffe, 2016). En las tres últimas décadas el 36.2% de la población colombiana ha abandonado su territorio identitario hacia las mayores ciudades del país; en la sola Bogotá son aproximadamente 1.393.140 las personas que viven en la extrema periferia urbana, en plena ilegalidad (UNHCR, 2017). El sueño triste de esta forma de libertad implica dejar a sus espaldas amenazas y satisfacer necesidades que demanda el mismo hecho de mantenerse vivos (Shedlin, Decena, & Noboa H. y Betancourt, 2014). Es este un ejercicio extremo de libre determinación que conlleva el abandono, el escape de condiciones de hambre, dolor, miedo, necesidad (Türk, 2017) frente a amenazas de muerte y pobreza extrema (Centro Nacional de Memoria Histórica, 2015); la necesidad de existir, la posibilidad de poder decidir en un marco de constricción implica la pérdida de la base social de apoyo (Bobada, 2010), vulnerabilidad social, física y económica. El reasentamiento representa un nuevo inicio con la expectativa de encontrar vivienda, empleo, salud, educación, servicios públicos (Braubach, 2011) sin embargo, los desplazados, abandonados a sí mismos, abandonan a su vez las reglas institucionales; contar en sus propios medios y fundan asentamientos ilegales extremadamente precarios esperando respuestas institucionales. Bogotá es elegida como destino por presentar niveles de pobreza multidimensional netamente inferiores al resto del país (DANE, 2017) y proporciona mayores oportunidades aun en la informalidad.

The purpose of this rapid review is to lay out some of the general approaches used by both business and government to tackle ‘modern slavery’ in international business supply chains, and locate evidence of their effectiveness International institutions have been encouraging large international businesses to tackle modern slavery by offering guidelines on how to investigate the issue in their supply chains (‘due diligence’), but their implementation, and ‘auditing’ is highly variable. National governments are increasingly mandating businesses through legislation to report on what they do. More recently, governments have begun imposing a legal duty of care on parent companies which means they can be held responsible for what their subsidiaries do. Key findings are: There is no consistency in how international companies currently implement the due diligence guidelines; The design of national disclosure legislation is generally judged to be flawed. Overall, the evidence on forced labour and modern slavery is recognised as being “dangerously thin and riddled with bias” (LeBaron, 2018, p.1). Nevertheless, there is a very large number of articles and reports written on the issue, particularly from the last five years. The main sources used in this review came from both grey literature and academic literature.
