Full text
Abstract:
This chapter presents an economic characterization of theft and fakery in the art world generally and with respect to American art specifically. When costs are low or benefits are high, there is more theft and fakery. That happens to be the case in the generally opaque market for art. With low national and international enforcement and higher and higher prices for art, we should not be surprised that art crime is the third largest criminal enterprise in the world. Art is used as “money” in drug operations and in money laundering of other illicit activities. Authenticity through experts, provenance, and exhibition records may add credence or establishment of authenticity to a work of art but, in many case, such “credence” may be faked. The story of art crime is told through a multiplicity of examples and “case studies,” derived primarily from theft and fakery of American art.

Full text
Abstract:
Global demand for art and historical artefacts makes them attractive for international crime. A diverse array of offences includes robbery/theft, illicit excavation, illicit import and export, forgery, fraud, and dealing in stolen goods. Cultural objects are also at risk of destruction and pillage in armed conflicts, offences treated as war crimes. The international community has long endeavoured to develop instruments to improve protection of cultural property. These efforts include, for armed conflicts, the Regulations concerning the Laws and Customs of War on Land, the 1954 Hague Convention and the Rome Statute and, for illegal trade, the 1970 UNESCO Convention and the 1995 UNIDROIT Convention. Despite all these efforts, there is still room for improvement, and in particular to strengthen international cooperation among law enforcement agencies and authorities for protecting cultural property. International organisations like Interpol and UNESCO play a key role in this regard as driving forces and intermediaries.

Van Uytsel, Steven, Mark Fenwick, and Yoshiteru Uemura, eds. Leniency in Asian Competition Law. Cambridge University Press, 2022. http://dx.doi.org/10.1017/9781009152693.

Full text
Abstract:
In response to cartel formation, competition lawyers and policymakers in nine Asian jurisdictions have experimented with leniency programmes. This mechanism allows firms to come forward with information in relation to their illegal cartel participation in return for a reduction of or immunity from a sanction. The experimentation plays out across three different dimensions: the revision of early adopted leniency programmes, the introduction of newly written leniency programmes, and the decision – deliberate or otherwise – not to create a leniency programme. This volume is the first to analyse the empirical evidence across a number of countries to determine how effective these measures have been, and how they have been amended in response to problems encountered. In this volume, local experts from key Asian jurisdictions, together with international experts, offer an introduction to this fast-developing field, and explore the theoretical, international and regulatory contexts of leniency programmes.

Shelley, Fred M., and Reagan Metz. Geography of Trafficking. ABC-CLIO, LLC, 2017. http://dx.doi.org/10.5040/9798400656385.

Full text
Abstract:
This important reference work examines trafficking from a geographic perspective and investigates the driving forces behind it and the powers that are trying to curtail the problem. The worldwide crime of trafficking involves countless people, animals and animal parts, and illicit goods such as drugs and weapons being moved and sold illegally. Often, the trafficking occurs with the local government or law enforcement’s knowledge and complicity. This one-volume encyclopedia sheds light on a frightening and major issue, investigating the geography of trafficking and examining a range of examples of illegal human, animal, drug, and weapons movement around the world. After a preface and introduction that provides an exact definition of trafficking, the encyclopedia presents thematic essays that explore the various specific kinds of trafficking. Approximately 30 country profiles describe who and what is trafficked in each country, the motivations of those doing the trafficking, where people and things are being moved to, how the trafficking occurs, and what actions are being taken in an effort to prevent it. An appendix of primary documents, interesting sidebars, a bibliography, and a glossary listing key terms and important organizations round out the work.

Karsten, Margaret Foegen, ed. Gender, Race, and Ethnicity in the Workplace. ABC-CLIO, LLC, 2016. http://dx.doi.org/10.5040/9798400655968.

Full text
Abstract:
Insights from professionals in the fields of organizational development and diversity provide practical tools to help employees and managers—regardless of race or gender—collaborate in reaching their workplace potential. The contributions of more than 30 experts reframe the discussion on gender, race, and ethnicity in the U.S. workforce, examining the complex identity concerns facing workers who fall within minority groups and recommending practical solutions for dealing with workplace inequities. Through focused essays, experts explore new perspectives to persistent challenges and discuss progress made in addressing unequal treatment based on race and gender in the past eight years. This detailed reference explores every aspect of the issue, including mentoring, family leaves, pay inequity, multiracial and transgender identities, community involvement, and illegal harassment. The first part of the book identifies employment discrimination based on multiracial identity, appearance, and transgender status. The second section unveils the psychology behind harassment on the job; the third section provides strategies for overcoming traditional obstacles for the disenfranchised. The final section discusses updates on laws dealing with the Family and Medical Leave Act. The book closes with success stories of women of color in U.S. leadership roles as well as others achieving success in their professions outside of the country. Accompanying tables, charts, and graphs illustrate the field's most poignant research, such as the relationship between organizational effectiveness and diversity and the characteristics of those taking family and medical leave.

Cukier, Wendy, and Victor W. Sidel. The Global Gun Epidemic. Praeger, 2005. http://dx.doi.org/10.5040/9798400657498.

Full text
Abstract:
Cukier and Sidel provide a much-needed overview of the global problem of gun violence as a threat to public health, including the effects of violence, the sources of firearms (both legal and illegal), the factors shaping demand, and the interventions aimed at reducing the misuse of guns. Just as guns know no borders, gun violence has become a global epidemic, killing hundreds of thousands of people each year and injuring many more. The toll is staggering. Experts estimate that there are 35,000 annual gun-related deaths in Brazil, 10,000 in South Africa, 20,000 in Colombia, and 30,000 in the United States. While guns kill or maim great numbers of people in war zones, two thirds of small arms are in the possession of civilians. Although guns do not in and of themselves cause violence, they increase its lethality and fuel cultures of violence. This book documents the global gun trade, its threat to public health, and efforts to remedy the situation. Virtually every illegal gun begins as a legal gun. With the globalization of trade in licit products has come the globalization of the illegal trade in guns. For example, weapons originating in the United States fuel violence in Canada, Latin America, and as far away as Japan. And unregulated ownership of guns fuels crime. Because weapons tend to flow from unregulated areas to regulated areas, international cooperation is critical, but global efforts have been hampered by major arms producers and gun lobbies such as the National Rifle Association. Since 1998 there has been an emerging global movement to control the illicit trade and misuse in guns, and many countries have moved to strengthen their gun laws in an effort to combat this global epidemic.

Ege, Gian, Andreas Schloenhardt, and Christian Schwarzenegger. Wildlife Trafficking: the illicit trade in wildlife, animal parts, and derivatives. Carl Grossmann, 2020. http://dx.doi.org/10.24921/2020.94115945.

Full text
Abstract:
Wildlife trafficking threatens the existence of many plant and animal species and accelerates the destruction of wildlife, forests, and other natural resources. It contributes to environmental degradation, destroys unique natural habitats, and deprives many countries and their populations of scarce renewable resources. The more endangered a species becomes, the greater is the commercial value that is put on the remaining specimen, thereby increasing the incentive for further illegal activities. Preventing and supressing the illegal trade in wildlife, animal parts, and plants is presently not a priority in many countries. Despite the actual and potential scale and consequences, wildlife trafficking often remains overlooked and poorly understood. Wildlife and biodiversity related policies, laws, and their enforcement have, for the most part, not kept up with the changing levels and patterns of wildlife trafficking. Poorly developed legal frameworks, weak law enforcement, prosecutorial, and judicial practices have resulted in valuable wildlife and plant resources becoming threatened. The high demand for wildlife, animal parts, plants, and plant material around the world has resulted in criminal activities on a large scale. Considerably cheaper than legally sourced material, the illegal trade in fauna and flora offers opportunities to reap significant profits. Gaps in domestic and international control regimes, difficulties in identifying illegal commodities and secondary products, along with intricate trafficking routes make it difficult to effectively curtail the trade. Although several international and non-governmental organisations have launched initiatives aimed at bringing international attention to the problem of wildlife trafficking, political commitment and operational capacity to tackle this phenomenon are not commensurate to the scale of the problem. There is, to date, no universal framework to prevent and suppress this crime type and there is a lack of critical and credible expertise and scholarship on this phenomenon. As part of their joint teaching programme on transnational organised crime, the University of Queensland, the University of Vienna, and the University of Zurich examined the topic of wildlife trafficking in a year-long research course in 20182019. Students from the three universities researched selected topics and presented their findings in academic papers, some of which have been compiled in this volume. The chapters included in this v edited book address causes, characteristics, and actors of wildlife trafficking, analyse detection methods, and explore different international and national legal frameworks.

Jefferson, Michael. 12. Trade unions: recognition, collective bargaining, and industrial action. Oxford University Press, 2018. http://dx.doi.org/10.1093/he/9780198815167.003.0012.

Abstract:
Each Concentrate revision guide is packed with essential information, key cases, revision tips, exam Q&As, and more. Concentrates show you what to expect in a law exam, what examiners are looking for, and how to achieve extra marks. The chapter discusses the law on trade unions. Topics covered include independence and recognition; the legal enforceability of collective agreements; disclosure of information for collective bargaining; protection for trade unionists; statutory immunity in tort for various types of industrial action. Strikes are always in breach of the contract of employment (unless, as rarely happens, the contract provides for its suspension during industrial action). Therefore, protection given to unions and members in relation to strikes and other forms of industrial action is really important: without it, striking—a fundamental human right—would be illegal in all circumstances.

Levine, Marvin J. Children for Hire. Greenwood Publishing Group, Inc., 2003. http://dx.doi.org/10.5040/9781440881688.

Full text
Abstract:
Despite popular belief, the problem of illegal child labor has not been remedied. The practice persists in the United States and even appears to be increasing. Levine, an acknowledged expert in the field, reveals the nature and magnitude of this old problem in today's economy. Levine explains that since 1981, there has been a relaxation in enforcement of federal child labor law provisions. He presents the complicated elements and troubling implications of a problem that has come to be ignored or overlooked in American society, focusing especially on matters of occupational health and safety. This book is important reading for the general public, as well as for scholars and policymakers involved with children's and labor issues in the United States. The United States has more of its children in the workforce than any other developed country. They are found in textile, jewelry, and machine shops in New York and New Jersey, in Southeast supermarkets operating meat-cutting machines and paper-box bailers, in Washington state selling candy door-to-door, and in farming operations throughout the country.
