Bhat, P. Ishwara. Idea and Methods of Legal Research. Oxford University Press, 2020. http://dx.doi.org/10.1093/oso/9780199493098.001.0001.

Full text
Abstract:
Legal research examines subject matter enshrouded in social circumstances in order to conceptualize theories and prepare a future course of action. This dynamic, inter-disciplinary, and labyrinthine character of legal research requires researchers to be fluid, eclectic, and analytical in their approach. Idea and Methods of Legal Research unearths how the thinking process is to be streamlined in research, how a theme is built on the basis of comprehensive and intensive study, and the paths through which notions of objectivity, feminism, ethics, and purposive character of knowledge are to be understood. The book first explains the meaning, evolution, and scope of legal research, and discusses objectivity and ethics in legal research. It engages with the requirements, advantages, and limits of various doctrinal and non-doctrinal methods and tools, and the points to be considered in selecting a suitable method or combination of methods. It highlights analytical, historical, philosophical, comparative, qualitative, and quantitative methods of legal research. The book then goes on to discuss the use of multi-method legal research, policy research, action research, and feminist legal research and finally, reflects on research-based critical legal writing, as opposed to client-related legal writing. This book, thus, is a comprehensive answer to key questions one faces in legal research.

Abstract:
The need for physical distancing during this COVID-19 pandemic has raised the need for innovative campaign methods to be developed by election contestants because conventional campaign methods such as rallies, public meetings, etc. are prohibited in some jurisdictions. Distant and online election campaigning may be seen as restrictive to both contestants and voters alike due to physical and technological barriers that appear. To what degree is this true? Abstract:
A discussion of community structure in networks and methods for its detection. The chapter begins with an introduction to the idea of community structure, followed by descriptions of a range of methods for finding communities, including modularity maximization, the InfoMap method, methods based on maximum-likelihood fits of models to network data, betweenness-based methods, and hierarchical clustering. Also discussed are methods for assessing algorithm performance, along with a summary of performance studies and their findings. The chapter concludes with a discussion of other types of large-scale structure in networks, such as overlapping and hierarchical communities, core-periphery structure, latent-space structure, and rank structure.

Full text
Abstract:
This chapter sets the stage for what is to come by introducing readers to the theory and practice of Nazi law. The first section uses the book’s cover image (a portrait of the infamous Nazi lawyer Roland Freisler) to introduce the argument the Nazi state was inherently bifurcated, and not just in its early years. The second and third sections juxtapose two contending approaches to the study of Nazi law: legal philosophy and legal anthropology. I show why the former is wanting in a critical analysis of what has become known as “Radbruch’s formula.” I highlight the limitations of Gustav Radbruch’s argument about statutory lawlessness by way of a comparison with Ernst Fraenkel’s ethnographic method. I close with a discussion of the problem of outcome knowledge in historical analysis, with particular reference to the historiography of Weimar and Nazi Germany.

Full text
Abstract:
This article describes the rapid development of institutions for the study of qualitative methods in the past decade. It first begins by presenting an overview of the approach to methodology that underpins the idea of qualitative and multimethod work. It then discusses these new organizations, in particular the Organized Section on Qualitative and Multi-Method Research of the American Political Science Association, and the annual Institute for Qualitative and Multi-Method Research. It outlines the patterns of publication, and a conclusion considers briefly the merits of an integrative, versus a separate tracks, approach to coordinating alternative methodologies. The formation of the organizations linked with qualitative/multimethod work reflected the need for methodologists with convergent skills and objectives to have a meaningful forum for dialogue.

Full text
Abstract:
In virtually every field, researchers find themselves navigating tremendous amounts of new data. Making sense of this flood of information requires much more than the rote application of traditional statistical methods. This book will train researchers to be creative and confident users of statistics by thinking hard about the application of simple methods to a small dataset. In particular, this book focuses on simple linear regression—a method with strong connections to the most important tools in applied statistics—using it as a detailed case study for teaching resampling-based, likelihood-based, and Bayesian approaches to statistical inference. This exercise imparts an idea of how statistical procedures are designed and implemented, a flavor for the philosophical positions one implicitly assumes when applying statistics, and an opportunity to probe the strengths and weaknesses of one’s statistical approach. Key to the book’s novel approach is its mathematical level, which is gentler than most texts for statisticians but more rigorous than most introductory texts for non-statisticians. Statistical Thinking from Scratch is suitable for senior undergraduate and beginning graduate students, professional researchers, and practitioners seeking to improve their understanding of statistical methods across the natural and social sciences, medicine, psychology, public health, business, and other fields.

Glanzer, Perry, Nathan Alleman, and George Marsden. The Outrageous Idea of Christian Teaching. Oxford University Press, 2019. http://dx.doi.org/10.1093/oso/9780190056483.001.0001.

Full text
Abstract:
There are thousands of Christian professors, many of whom claim “Christian” as their primary identity and teaching as their primary responsibility. Much of the current literature about the integration of faith and learning focuses on the differences between Christian scholarship and Christian teaching. As a result, few books explore how Christian identity, or a particular Christian identity (e.g., Baptist, Anglican), shapes teaching. In addition, few works examine what identity-influenced teaching outside of one’s professional identity looks like in the contemporary university. One distinguishing feature of this book is that it addresses both those subjects by exploring responses of Christian professors to questions about how them. By drawing upon a mixed-methods survey of over 2,300 Christian professors, this book reveals the wide range of wisdom that contemporary professors offer about how they practice faith-informed teaching. The second unique quality of this book is that it situates the findings of this study within the wider scholarly conversation about the role of identity-informed teaching. It describes the tensions within this conversation between those who advocate for restraining the influence of one’s extraprofessional identities and those who, in the name of authenticity, promote the full integration of one’s primary identities into the classroom. It then sets forth an original position that draws from empirical research to provide a nuanced approach to this issue. Overall, the book charts new ground regarding how professors think about Christian teaching in particular, as well as how professors should approach identity-informed teaching in general.

Heim, Maria. The Buddha’s Omniscience and the Immeasurability of Scripture. Oxford University Press, 2018. http://dx.doi.org/10.1093/oso/9780190906658.003.0002.

Full text
Abstract:
Chapter 1 examines the Pali commentarial doctrine of the Buddha’s omniscience and how the commentarial texts define the corpus of material called “buddhavacana,” that is, the Buddha’s words. It explores how the commentaries expanded and interpreted the idea that the Buddha “knew all,” an idea only incipiently present in the canonical sources. The chapter suggests that related to the idea of omniscience is the idea that the Buddha’s words are to be taken as “immeasurable,” and it explores the claims and metaphorical expressions in which this immeasurability is elaborated. The idea that scripture is immeasurable has important implications for interpretative practice. The chapter describes Buddhaghosa’s treatment of the “piṭakas” as genres, methods, and oceanic texts.
