The project involved various partners, whose skills enabled the activity to take an integrated, multi-disciplinary bent; the University of Florence Department of Farming and Forestry Economics, Engineering, Science and Technology – DEISTAF – took responsibility for the scientific side, while the local partners counted the municipality of San Godenzo, L'Unione dei Comuni della Montagna Fiorentina and the Consorzio Marrone del Mugello IGP. The general aim of the whole research project was to prepare guidelines for the endogenous and sustainable development of outlying areas, while extending knowledge of a fundamental aspect of farming, the primary activity, namely its multiple functions.

This chapter outlines the different enforcement mechanisms of Security Council resolutions as well as of ICJ judgments. Overall, enforcement can take two forms: direct enforcement, when the content of the decision not implemented by the addressee is implemented by another actor; or indirect enforcement, when coercive measures are taken against the non-complying actor in order to compel compliance. The chapter first outlines how binding Security Council measures are enforced, before analysing the enforcement of ICJ judgments. It then examines the enforcement of Security Council resolutions and of ICJ judgments, arguing that such enforcement is mostly political, influenced by State sensitivities and thus, unreliable. The chapter finally concludes with some proposed alternatives to improving the consistency of the enforcement of Security Council and ICJ measures.

Abstract:
Chapter 9 interprets the Rome Statute of the International Criminal Court (ICC Statute), the Statute’s Elements of Crimes, and the Court’s jurisprudence to identify the characteristics non-state entities behind crimes against humanity (CAH) need. It argues that the term ‘organizational policy’ under article 7(2)(1) ICC Statute is best understood in accordance with the ICC’s Elements of Crimes. In line with international jurisprudence, a collective entity’s policy can relate to the criminal acts underlying CAH in three ways: the entity might tolerate and thereby motivate the crimes; it might instigate the crimes; or commit the crimes through its own forces. Going beyond how the ICC has interpreted the ICC Statute hitherto, this chapter argues that the degree of organization of armed groups behind CAH depends on how the entity relates to the crimes in question. Concretely, it needs different capacities to tolerate, instigate, or commit crimes against humanity.

This chapter compares and contrasts the successes and failures of “conflict mapping” in international humanitarian law (IHL) and international conflict feminism (ICF), a phrase the author uses to refer to feminist initiatives aimed at strengthening international law and policy’s response to women’s experiences. The chapter begins by describing the IHL regime for classification of forms of conflict and the consequences of these stratifications on conflict resolution. It addresses the strategies of ICF, and the challenge it brings to the conflict maps of IHL for not adequately addressing women’s specific needs. The chapter then questions the conflict maps of ICF. It demonstrates the ways in which ICF’s approach to gender, while commendable, can also be simplistic and inadequate.

International relations are increasingly judicialized by the increasing number of international courts and tribunals. On the one hand this judicialization of international law is hailed as a glimmer of more effective and legitimate world governance promoting human rights, justice, and peace. On the other hand critics highlight how sovereignty is increasingly constrained by international courts, and question the effectiveness, legitimacy, and future potential of these courts and tribunals. This book maps and assesses this development and the mixed reactions thereto, presenting the aspirations which international courts and tribunals (ICs) are living up to, and where they fall short. The first Part provides a general frame for these legitimacy concerns. It discusses the general functions of ICs; how they are governed; and possible alternatives to ICs. The second Part considers how the ICs appear to present their judgments in ways that legitimize them vis-à-vis states and other stakeholders; their inner workings; as well as their law-making role. The following Parts consider the various forms of backlash several of the ICs experience, and how the ICs, states, and civil society seek to respond to these challenges. The last Part deals with the fragmentary character of the international judiciary. An epilogue looks to the future of international judicialization.
