In 2005, in Ringrow Pty Ltd v BP Australia Pty Ltd,[1] the High Court (Gleeson CJ, Gummow, Kirby, Hayne, Callinan and Heydon JJ) observed that Lord Dunedin’s formulation in Dunlop Pneumatic Tyre Co Ltd v New Garage & Motor Co Ltd,[2] of the principles governing the identification, proof and consequences of penalties in contractual stipulations had endured for 90 years and had been applied countless times in the High Court and other courts. AbstractA quarter of a century after the High Court of Australia's landmark ruling in Voth v Manildra Flour Mills Pty Ltd, this article examines the application of the modern-day forum (non) conveniens doctrine in Australia. It outlines the prevailing view in the academic literature which claims that the Australian doctrine is functionally different from its English counterpart, articulated in Spiliada Maritime Corporation v Cansulex Ltd. Through a detailed assessment of the case law and commentary, this article questions that widely accepted orthodoxy and demonstrates it to be unpersuasive and reconceptualizes our understanding of the forum (non) conveniens doctrine in Australia. Its main contention is that while, theoretically, there may be a narrow conceptual space between Spiliada and Voth, it is so narrow as to be practically non-existent.

Abstract:
This article examines the use of the phrase ‘balancing the interests’ in political debate relating to copyright law. I argue that this phrase no longer leads to broad debate on the proper balance to be struck between private, public and social interests in copyright law. Rather, today the phrase has come to represent a type of police logic which reflects the private interests of copyright owners and users as they already exist. Drawing on the work of Jacques Rancière I suggest that this balance of private interests may be upset by a strategy of ‘subjectivisation’ which challenges the existing distribution of social bodies by making new subjects appear. I conclude that the recent cases of Telstra Corporation v Phone Directories Company Pty Ltd1 and IceTV Pty Ltd v Nine Network Australia Pty Ltd2 represent a surprising and effective use of this strategy by reintroducing the ‘artist’ and the ‘maker’ into copyright law in such a way as to upset and displace the prior claims of copyright owners and users.

With the support and assistance of Sydney Water Corporation (SWC), URS Australia Pty Ltd (URS) have developed an Irrigation and Landscape Efficiency Assessment methodology (ILA) to improve the management of public open space across Sydney. To date over 180 ILAs have been conducted, with a number of key management issues identified. Excessive watering from poor irrigation scheduling practises, low soil water-holding capacity (from shallow or sandy textured soils); and inappropriate location of ornamental plantings are regularly encountered. This paper explores the key issues impacting water management across Sydney's public open spaces, and highlights methods available to rectify these issues and reduce potable water use into the future.

Abstract:
The 2014 judgment in Richardson v Oracle Corporation Australia Pty Ltd (‘ Richardson’) had a seismic effect on workplace sexual harassment claims in Australia. Overnight, the ‘general range’ of damages awarded for non-economic loss in such cases increased from between $12 000 and $20 000 to $100 000 and above. The judgment has made Sex Discrimination Act 1984 (Cth) litigation considerably more attractive for plaintiffs and resulted in greater judicial recognition of the pain and suffering experienced by sexual harassment survivors. Richardson’s impact has also been felt beyond that immediate context, with the judgment cited in support of higher damages in discrimination cases and employment disputes. However, six years and over 40 judicial citations later, Richardson’s broader significance remains unclear—particularly following the emergence of the #MeToo movement. Drawing on a doctrinal analysis of subsequent case law and qualitative interviews with prominent Australian legal practitioners, this article evaluates Richardson’s legacy and considers how sexual harassment litigation may further evolve to reflect changing societal norms.

Abstract:
Environmentally safe management of hydrocarbon exploration and production activities is becoming increasingly important, particularly in sensitive marine areas. LeProvost Environmental Consultants have been working closely with Hadson Energy Limited, Western Mining Corporation Ltd and West Australian Petroleum Pty Ltd to produce environmental impact assessments, environmental management plans and monitoring programs for oilfields recently developed on the North West Shelf. Many of the well sites are located in areas with sensitive ecological habitats, including coral reefs, seagrass beds, mangroves and prawn spawning and fishing grounds. Consequently, operators in these areas have been required to produce comprehensive Environmental Management Plans and Oil Spill Contingency Plans, to gain development and operating approvals from the Western Australian Government.Formulation of these plans begins with baseline surveys of the biological, physical and social characteristics of the study area. Hydrodynamic modelling of the metocean conditions produces oil spill prediction envelopes to highlight the areas that may potentially be affected by an oil spill, if one should occur. Site-specific oil spill response procedures are then designed to cater for the sensitive marine habitats of the area, using the resources that are available in the region to deal with an oil spill.Results to date from the Marine Biological Monitoring Programs for three oilfields have supported predictions that no significant adverse impacts on the environment would result from the development and operation of the oilfields.

Abstract:
The petroleum industry in Australia is at the centre of a web of complex laws. In addition to the legislation under which petroleum exploration and production tenements are granted there is a multiplicity of statutes and regulations, Commonwealth and State, which have a direct bearing on the conduct of those involved in exploring for or exploiting Australia's petroleum reserves. For example, the level of participation by foreigners is governed by the Commonwealth Foreign Investment Guidelines and the Foreign Takeovers Act 1975; the Commonwealth has control over the export of petroleum under the Customs (Prohibited Exports) Regulations and domestic markets are subject to the operation of the Crude Oil Allocation Scheme. The Commonwealth continues to have the right to regulate the transfer of funds to and from Australia under the Banking (Foreign Exchange) Regulations. Certain States such as South Australia and New South Wales have their own foreign investment guidelines.Not only this, there are revenue laws which govern very much the way in which petroleum projects are organised, interests transferred and otherwise dealt with and finance made available, such as State stamp duty legislation, Commonwealth income tax laws, and Commonwealth legislation imposing registration fees on dealings in exploration permits and production licences. A new tax, Resource Rent Tax, is to be introduced.Then there are laws which have an indirect bearing on petroleum activities such as the Companies Code which, in addition to governing the administration and organisation of companies, controls the way funds can be raised.The statutory and regulatory framework is only part of the picture. The rights and obligations of participants in petroleum projects as between themselves are almost always set out in a joint venture or joint operating agreement, the combination between the participants being known as an unincorporated joint venture. This form of business organisation is not a partnership; it is not the creature of legislation. Indeed it has been rarely referred to in Acts of Parliament. Problems arising under the joint venture agreement will be considered against the backdrop of the general law which unfortunately has seldom been called upon to resolve disputes between participants in joint ventures. An illustration of one of these rare instances is Brian Pty Ltd v United Dominions Corporation Ltd (1983), where the New South Wales Court of Appeal considered the fiduciary relationship of joint venturers.Despite this legislative and regulatory' backdrop and the uncertainties as to the true effect of joint venture agreements, the industry up until quite recently has survived with little litigation. This is no longer the case. Recent and pending litigation shows that there is no reluctance on the part of participants to take their disputes to court, often at great expense and with unfortunate results for previously close relationships. It must now be said that money spent to achieve proper and clear agreement on organisational and legal matters at the earliest stage of a project is money just as well spent as that on drilling and other operational activities.

Abstract:
Introduction: MAVORIC was an open-label, multicenter, randomized phase 3 study evaluating the safety and efficacy of mogamulizumab (moga) compared to vorinostat (vori) in patients with mycosis fungoides (MF) or Sézary syndrome (SS) who had failed at least one prior course of systemic therapy (NCT01728805). Primary results have been reported (Kim et al. Lancet Oncol 2018) and were based on a data cutoff date of December 31, 2016. The primary endpoint was progression-free survival (PFS); patients in the moga treatment arm experienced significantly longer PFS compared to patients in the vori treatment arm (median 7.7 months vs 3.1 months; p<0.0001). The most common treatment-emergent adverse events (TEAEs) of any cause or grade reported in patients randomized to moga were: infusion-related reaction (33.2%), drug eruption (ie, skin rash attributed to moga [23.9%]), diarrhea (23.4%), and fatigue (23.4%). This report provides the final safety results of MAVORIC as of the data available on January 3, 2019. Methods: Patients were randomized 1:1 to moga 1.0 mg/kg administered intravenously on Days 1, 8, 15, and 22 of the first cycle and on Days 1 and 15 of subsequent cycles or vori 400 mg administered orally once daily. Patients randomized to vori were allowed to cross over to moga upon progression or intolerable toxicity. Safety was assessed by reported adverse events (AEs), changes in physical examinations, vital sign measurements, electrocardiograms, and laboratory analyses. Results: In total, 372 patients were randomized (moga, 186; vori, 186), of whom 370 received study drug and were included in the safety analysis (moga, 184; vori, 186). For the final safety analysis, median duration of follow-up was 34.5 months (range, 0.13-70.0) in the randomized part of the study. Median treatment exposure was 170 days (range, 1-1813) for moga and 84 days (4-1230) for vori, which represent the same median values but broader ranges compared to the primary analysis (primary analysis, 170 days [1-1379] for moga and 84 days [4-1058] for vori). The type and frequency of AEs in either the moga or vori treatment groups (Table) were consistent with those reported in the primary analysis. TEAEs, regardless of causality, that were reported at similar rates in the two treatment groups included constipation, peripheral edema, headache, and anemia. TEAEs (all causality) that occurred at higher frequency in the moga vs vori arm included infusion-related reaction (33.2% vs 0.5%) and drug eruption (25.0% vs 1.1%); the majority of these events were grade 1 or 2 (Table). The types and frequencies of AEs attributable to moga (per Investigator assessment) included infusion-related reaction (33.2% [61/184]), drug eruption (23.9% [44/184]), and fatigue (18.5% [34/184]), and for vori, diarrhea (55.4% [103/186]), nausea (38.2% [71/186]), and fatigue (33.3% [62/186]). In patients who crossed over from the vori to moga arm and received study drug (n=135), the most frequently reported AEs attributable to moga were infusion-related reaction (37.8% [51/135]), drug eruption (24.4% [33/135]), fatigue (7.4% [10/135]), increased alanine aminotransferase (7.4% [10/135]), and increased aspartate aminotransferase (7.4% [10/135]). Discontinuation rates due to AEs were similar between treatment arms and in crossover patients (moga, 21.7% [40/184]; vori, 23.7% [44/186]; crossover, 25.9% [35/135]). The most common AEs leading to discontinuation were drug eruption in the moga arm (7.1% [13/184]) and fatigue in the vori arm (4.3% [8/186]). Overall, the rates of drug-related serious TEAEs were similar between treatment arms and in crossover patients (moga, 19.6% [36/184]; vori, 16.7% [31/186]; crossover, 11.9% [16/135]). After the data cutoff for the primary analysis, 1 additional patient randomized to moga (decreased appetite, general physical health deterioration, hypoalbuminemia) and 1 crossover patient (cerebral hemorrhage) experienced TEAEs with an outcome of death, all considered unrelated to study treatment per Investigator. Conclusions: This final safety analysis from the MAVORIC study in patients with previously treated MF and SS demonstrates that moga was generally well tolerated. Longer follow-up and treatment exposure did not identify any new safety signals. The type and incidence of treatment-related AEs among patients receiving moga after crossover were similar to those observed for patients initially randomized to moga. Abstract:
The manufacture of nonionic surfactants generally involves ethoxylation via ethylene oxide condensation onto a hydrophobe substrate, mostly in the presence of an alkaline catalyst. Nonionic surfactants are used widely in industrial applications, such as detergents, health and personal care, coatings, and polymers. In Australia, approximately one-third of the annual consumption of nonionic surfactants is imported from offshore manufacturers; the market is highly competitive with the local manufacturer facing increasing competition from imports. Optimisation is a pressing need for the current manufacturing plant of the industrial partner for this research project, Huntsman Corporation Australia Pty Limited, the sole domestic manufacturer of nonionic surfactants in Australia. Therefore, the objectives of this research project were to gain a better understanding of the various chemical and physical processes occurring simultaneously in an ethoxylation process; to identify the process limitation in an existing production plant operated by Huntsman Corporation Australia, and to explore measures for enhancing the asset productivity of the production plant. An ethoxylation process working model, describing the chemical kinetics and the physical transport processes involved, was developed to aid the exploration of optimisation opportunities, which would otherwise be empirical. Accordingly, this research project was structured into a two-stage program. The first stage determined the ethoxylation kinetics experimentally. The second stage investigated the interactions of physical transport processes numerically using a computational fluid dynamics (CFD) technique. The manufacturing scheme discussed in this thesis gave particular emphasis to the ethoxylation process operated in semi-batch stirred reactors. In the first stage, a series of kinetic experiments was performed in a well-stirred laboratory autoclave under base-catalysed conditions. The experimental outcomes were developed into a comprehensive kinetic model which took into account the non-ideal features in the reactor operation. Time-dependent physical changes of the reaction system, such as liquid volume, ethylene oxide solubility and density were also included. The ethoxylation behaviour predicted by the model was shown to be in good agreement with the experimental measurements. This indicated that the kinetic model was sufficiently robust to reproduce the reaction behaviour of a commercially operated ethoxylation operation. In the second stage, numerical simulations of an existing ethoxylation reactor system were presented. In addition, two components were addressed: identification of the process limitation and increasing productivity of the industrial-scale ethoxylation plant. An important assumption was made for the ethylene oxide injection system used in this research project which subsequently simplified the ethoxylation system into a single liquid with miscible chemical species. In the identification of the process limitation, three possible rate-limiting factors were examined: mixing, heat removal and reactor pressure rating. Examination and analysis of the physical data available from plant batch reports found that the reactor pressure rating and the presence of nitrogen padding were the rate-limiting factors to the ethoxylation operations in the industrial reactors. It was recommended that the reactor pressure rating be increased to raise the asset productivity of the reactor. In the numerical simulations of the ethoxylation reactor, time-dependent CFD models were developed for two systems: the ethylene oxide injection pipe and the stirred ethoxylation reactors. The heat transfer of ethylene oxide liquid injection was calculated in a two-dimensional model of the dip-leg pipe used in an industrial-scale ethoxylation reactor. The computation gave the temperature of the injection outflow which was validated against the calculated value by empirical correlation. The effects of various surrounding reaction temperatures, injection rates and pipe sizes on the heat transfer rate were investigated. From these, a range of operating conditions yielding a liquid ethylene oxide outflow was selected. Furthermore, it was found that boiling of ethylene oxide was significantly reduced with increasing pipe diameters. It was recommended that the asset productivity of the reactor be improved by keeping more ethylene oxide injected as a liquid in the reaction mixture to raise the reaction rate and shorten the reaction time. Three-dimensional simulations of a baffled reactor agitated by a single- or a dual-Rushton impeller were presented for both non-reactive and reactive flows. Multiple frames of reference and sliding grid methods were used in sequence to describe the relative motion between the rotating impeller and the stationary baffles. The turbulence parameters were modelled with the standard k- � turbulence model. The simulations of non-reactive flow were compared with the literature velocity data obtained from both the experiments and simulations. Good agreement was achieved. The model was then extended to incorporate ethoxylation flow with integration of the kinetics established in the first stage. Both the laboratory autoclave and the industrial-scale reactors were simulated. The former took into account the ethoxylation exotherm and the latter was carried out isothermally. Both simulations were validated against reaction data obtained from physical experiments, either the kinetic experiments or the plant batch productions. The validated model allowed us to determine the optimum operating condition and explore a new reactor system with enhanced asset productivity. A 50% increase in productivity could be accomplished if the ethoxylation was operated closer to the current design pressure limit. Furthermore, the operating pressure of a new reactor system needed to be doubled if the asset productivity were to be increased to approximately three times the current performance.
