Abstract:
If the issue of prisoners of war has given rise to numerous studies in recent years, nevertheless, this topic is far from exhausted. Built on a large corpus of archival sources, this study fuels the debate on ransoms and prisoners with new material. Its originality lies in its broad chronological framework, i.e. the duration of the Hundred Years War, as well as its perspective – that of lower ranking as well as higher-ranking prisoners on both side of the Channel. What does it mean for those men to live in the once coined ‘golden age of private ransoms’? My investigations hinge around three different themes: the status of prisoners of war, the ransoming process and the networks of assistance. I argue that the widespread practice of ransoming becomes increasingly systematic in the late Middle Ages. More importantly, I show how this evolution comes ‘from below’; from the individual masters and prisoners who faced the multiple obstacles raised by the lack of official structure. Indeed, the ransoming of prisoners remained the preserve of private individuals throughout the war and no sovereign could afford that this became otherwise. It is specifically the non-interventionism of the crown and the large freedom of action of individuals which shaped the ransom system.

Abstract:
This dissertation offers a study of the fifteenth century French polemical treatises written by authors such as Jean de Montreuil, Jean Juvénal des Ursins, Noël de Fribois and Robert Blondel, together with an edition of perhaps the most important of these works, Pour ce que plusieurs (1464). This treatise may have been written by Guillaume Cousinot II, who had been personally involved in the events surrounding the attack upon Fougères in 1449, a subject addressed in highly partial terms by this text; moreover, Cousinot had visited the Lancastrians in exile in Scotland, which might explain how Sir John Fortescue was able to learn of Jean Juvénal's Tres crestien, tres hault, tres puissant roy (1446), and how Pource que plusieurs in turn drew upon the pamphlets of Fortescue. The polemical texts went beyond moral and chivalric discussion of the war, to address the complex legal and historical issues underpinning the conflict. In response to the English claim to the French throne, Jean de Montreuil adopted the Salic Law, a highly dubious and problematic authority, but one that achieved great fame particularly through the influence of Pour ce que plusieurs. Similarly, the polemical writers rejected English demands for Aquitaine and Normandy in full sovereignty by arguing that no French king could alienate the sovereign rights of the crown. In the sixteenth century, both of these principles were elevated to the status of Fundamental Laws. These texts were not intended to serve as propaganda, but were generally produced by royal officials to serve as manuals for their fellow administrators and diplomats, and perhaps also for the king and other members of the court involved in negotiations with the English. Only in exceptional circumstances were such works disseminated beyond the narrow circles of the government and court, though royal officials did draw upon them when speaking at public assemblies.

A knight expressed the desire to his king that he would add to their small army ten thousand of the best archers in England. This thesis utilizes archaeology evidence, financial records, iconographic depictions, literary and chronicle sources to understand the men who fought at the battle of Agincourt within the larger context and traditions of archery in England, the interconnections between archers and men-at-arms and the particular actions of those men in the battle itself.

Abstract:
This PhD deals with the frontier of the enemies, a territory disputed by the French king, the English king and the duke of Burgondy. We can define it as the whole of the parishes taxed by both sides, meaning most of the parishes located less than 30 miles from an enemy’s fortress. In these dangerous areas, people were compelled to face incertitude, and invented new solutions to deal with it. This thesis also focuses on the frontier as a line, an imaginary boundary between obedient and inobedient people to a same king, as well as a real boundary between the parishes subdued to the French or the English king’s authority. Eventually, the frontier of the enemies was a juridical concept which both kings and urban communities used in their correspondence. This concept was part of the identity of the people living in a territory at war, as Jean Juvénal des Ursins, bishop of Beauvais. By writing the history of this frontier during the second part of the Hundred Years War, we reveal how the French conceived their territory and their relations with the princes then at war

Bethell, J. J. "Tactics, strategy and the social composition of the army in England during the Hundred Years War, with particular reference to the periods 1337-1386 and 1413-22." Thesis, University of Cambridge, 2009. http://ethos.bl.uk/OrderDetails.do?uin=uk.bl.ethos.596610.

Abstract:
This thesis takes a thematic, rather than chronological, approach to the questions of tactics, strategy, and the social composition of the army in England, in order to examine the major questions of change and renewal in later medieval warfare. Rather than seeking to catalogue organisational or logistical minutiae, I wish to emphasise what fourteenth century English political society believed it could achieve, sought to achieve, and how it set about realising these ambitions. The thesis first considers the historiography of the period and its problems; it highlights the fact that the secondary literature, though extensive, is patchy and frequently concerned with broader or peripheral issues. The thesis turns first to tactics and in so doing must necessarily take some time to consider certain technical issues of equipment and weaponry which have dominated the limited current debate. It moves next to examine the influences on English tactics and the ancestry of those developments which came to characterise the conduct of English armies in the field; it emphasise the wider historical and geographical context in which their actions are located and reflects on how tactical expertise was passed on. In considering strategic affairs, the thesis presents perhaps the most striking example of the defining dialectic with tactics below and political society above. This chapter subdivides ‘strategy’ into operational and grand-strategic levels, reflecting the distinctive character of medieval monarchical government. In both areas, though, we may trace the influences on English campaigns and witness the emergence of a new strategic approach through trial and error. This chapter presents a new interpretation of the chevauchée and of the campaigns in Northern France. Within the chapter on the social composition of the army, the thesis traces the effect of mobilisation for war on the various strata of English society. With the heavy commitment of the elite to war, albeit an elite invigorated by Edward’s comital creations of 1337, it notes the amalgam of old and new which is so typical of Edward III’s reign – a novel method of performing the traditional role of a warrior of aristocracy. The factors which bound them to this role were likewise both cultural and financial. What also emerges is the creation of a small sub-society, which is in many ways internally classless, becoming dedicated to the profession of perennial expeditionary warfare. The thesis next surveys the reign of Henry V, in whose campaigns it traces the evolution of different aims, and, therefore, different strategies, while still employing some of the same tactical elements. His later grand-strategic ambitions are traced in the operational course of the fifteenth century campaigns with a lasting consequence for the regime which followed his death.

Abstract:
Current scholarship on the devotional practices of late medieval England has emphasized two representations of Christ. The first, considered the dominant trend, is that of the suffering Christ; the second, a minor, but important trend particularly for female audiences, is the maternal Christ. Both are revealing of the nature of late medieval Christo-centric devotion. This project contributes to the understanding of late medieval Christocentric devotion in England during the fourteenth and fifteenth centuries by examining the representation of Christ in a martial role, as presented to clerical and lay audiences through the medium of popular sermons. It is a new contribution to the scholarship of late medieval devotion in its demonstration of a multifaceted Christ; the martial Christ echoes, but in many ways also contrasts, the images of the suffering and maternal Christ, in order to provide its audience with a more complex rendering of the human Christ, one which may have been more accessible to a lay populace seeking to form a relationship with him. This project also contributes to the growing field of sermon studies, intended to be comprehensive in nature. It uses a different approach to sermon studies, in that the entire corpus of nearly 4,500 sermons was reviewed. This was done in order to provide the most complete picture of the martial Christ. As a result, this project examines Christ in various martial roles, as well as his modelling of knighthood for kings, knights, preachers, and the laity. These representations were utilised by preachers to instruct their audiences in devotional practice, specifically forms of affective meditation; it was used as a didactic tool to teach the laity the complex doctrines of redemption and atonement; and finally, it was employed as a means to demonstrate the importance of right living in order to fulfill what Christ had promised on the cross, that is eternal salvation.

Abstract:
This thesis focuses on the Celestine monks of France, a largely neglected and distinctive reformed Benedictine congregation, at their apex of growth (c.1350-1450). Based largely within the kingdom of France, but also including key houses in the contiguous territories of Lorraine and the Comtat, they expanded significantly in this period, from four monasteries to seventeen within a hundred years. They also gained independence from the mother congregation in Italy with the coming of the Great Western Schism (1376-1418). The study aims view the French Celestines against the backdrop of a vibrant culture of 'reform' within both the monastic estate (the Observants) and the Church as a whole, as well as the political instability and war in France. It will reveal a congregation alive with the passions of their times and relevant within them. Following an introductory section, chapter 1 will discuss the previously unstudied Vita of the leading French Celestine Jean Bassand (d.1445) in depth and introduce the key themes of the subsequent chapters. Chapter 2 will examine their Constitutions, in the process providing perspective on their hyper-scrupulous understanding of sin and the relation of their statutes to the Christian idea of 'reform'. Chapter 3 will look to anecdotal evidence concerning the quality of their observance in practice, as well the spiritual and moral writings of Pierre Pocquet (d.1408), another important Celestine leader. Chapter 4 will begin to establish how and why the order grew, examining records of benefaction (contemporary martyrologies and charters) as well as taking view of the financial (and in the end, moral) difficulties brought by war through the documents concerning the reductions of founded masses at the Paris and Sens houses. Chapter 5 will look at monumental and anecdotal/literary evidence, as well as the works of Jean Gerson, a friend of the order, to further define the cultural impact of the monks.

Abstract:
Poitou during the Hundred Years’ War in the 14th century is alternately dominated by different political dynasties. From 1360 à 1372, Poitou is under English control and is part of the Principality of Aquitaine. An administration is put in place to administer these newly acquired regions. After a difficult reconquest of these regions by Du Guesclin in 1375, Poitou and the western lands are under the French control and are part of the “apanage” of the Duke of Berry. Despite not governing these lands from 1320-1356 and 1375-1415 the English keep these lands under constant military pressure via a series of raids, pillaging and naval landings. English domination while only periodic had very specific effects on these new lands. We can as such uniquely view these regions thanks to their domination both militarily and politically by the English during the Hundred Years’ War. We can also see periods of “recovery” after each tense period or military action, either by the French or the English, and as such study this unique political situation in its globality. Finally, we can also study the integration of this land in a bigger ensemble within the Principality of Aquitaine

Abstract: At the first half of fifteenth-century, military expeditions led to the effective occupation of French domains claimed by English monarchs. Despite the successful results achieved in the campaigns started in 1413, it was generally asserted that, until the beginning of 1450’s, the governance of those territories was characterized by instabilities originated from the inadequate behavior of warriors on both sides of the struggle. Such state of overall jeopardy was noticed by William Worcester (1415-1480/5?) in his treatise Boke of Noblesse, where he denounced a state of disorderly warfare, on the one hand, poorly associated with virtues and, on the other, strongly related to vices, stretched away from Christian recommended models. When compared to his contemporaries ideas, William Worcester’s offer evidences regarding crucial steps in conflict organization and performance, enabling, in like manner, a proper questioning of both French and English martial enterprises characteristics. Aware of such perspective, this inquest targets what was understood as condemnable in war making, and, therefore, it interrogates English writings about the desired paths to be tread on effective conflict development and conquest plans. Shortly, this research aims to question a particular fraction of military history: the reasonings and evaluations concerning warriors’ behaviour, scrutinizing their role as a mirror that enables a deeper interpretation of people’s conducts beyond war itself.

Abstract:
During the 15th century, the French nation emerged and the unification of the country progressively took place, under the rule of the royal state. The question of how to control the territory, in both its intellectual and practical dimensions, was made more urgent by the troubles caused by the Hundred Years’ War. How, in the 15th century, could a King of France visualize his kingdom ? How was he able to govern it ? The territorialisation of power, oscillating between representation and real occupation, became progressively clearer. Differentiated social spaces emerged, depending on whether the regions were directly governed by the King or were entrusted to governors, be it a Prince or a Parliament. At the time when the monarchy gained overall control over the territory within the limits defined by four rivers (Scheldt, Meuse, Saone, Rhone), political society organised itself in a state constituted by offices ruled by royal law. Royal unity and diverging regional structures combined themselves into an original type of nation-state, a mixed territorial state, unitary and heterogeneous at the same time

The purpose of this thesis is to present an original poem of the fouteenth century, preserved in the library of the Château de Chantilly in classification mark 1477.We therefore propose an annotated edition of the text and supplemented by various glossaries and indexes that situate him in the literary history of the Middle Ages.In a second phase, we sought to provide answers about the history of the manuscript, the author, the didicatee in which it was intended. We also attempted to restore the cultural, historical and religious context of the Royal Book and the intentions of its author. The dedication says it was intented to Philippe VI, the first king of the dynasty of Valois and his family ; this dedication makes it possible to date the book from 1345 to 1347. The manuscript is a royal destination and its artistic quality ; it can be likened to a mirror for princes or princesses rather because it seems aimed primarily at a female audience for which it is written in French. Il reflects the vicissitudes of time since it was composed in the first phase of the Hundred Years War that pitted the king Edward III English sovereign. In politics, the Royal Book appears as the work of a publicist in power. Il also reflects the moral and religious concerns of its author, anxious to help train the elite and as such, it is also an example of religious outreach. The Royal Book that draws from many diverse sources presents itself both as a witness to circulation of texts and their reception in the middle of the scholars that the witness of a culture, that of a clerk of the fourteenth century

The defence process in the late Middle Ages raises the question of evolution of communities inhabitanting in Toulouse area. Understanding the defensive dynamics requires a multidisciplinary approach based on the analysis of written, planimetric, iconographic and archaeological sources. The documentation’s precious contents highlight the social relationship and the organization of a group facing danger. The “forts villageois” phenomenon served a larger reflection about types and forms of defensive measures. A comparative approach on the structures questions fortifications models and their evolution. Beyond the human and community scope the multi-scale study points out the relationships between community and lord, the relation to the territory and the interaction between Toulouse and the surrounding villages, as well as the solidarity networks in a shared space protection

Abstract:
At the end of the fourteenth century Jean d’Arras rewrote a popular folktale. The tale told how Mélusine, a fairy who was serpent from the navel down every Saturday, married a knight and founded the fortress of Lusignan. In his introduction to the tale Jean d’Arras presents the ideas of four authority figures to convince the reader that fantastical things are possible and that his work should be taken seriously. These authority figures are David, Aristotle, Paul and Gervaise de Tilbury. It is the contention of this thesis that Jean d’Arras presents these figures in his introduction to provide context and serve as doubles for characters in the narration as well as convince the reader to take the work seriously. Through his allusion to Tilbury, Jean d’Arras establishes a context and a doubling for the story-line which he so repetitiously tells. Through his allusion to David we see a doubling for Raymondin, who in fact bears the name of earthly king, a position which David held in archetype. Through his allusion to Paul we see a doubling for Geoffrey à la grande dent, enfant terrible who becomes a responsible leader. And finally we suggest that Aristotle is a type for Jean d’Arras himself, who is presenting to his reader a methodical study of the telos of earthly kings. The thesis contains a discussion of these four individuals, how they were viewed in the late fourteenth-century and what the implications are for reading the text with them in mind. When viewed in the light of these comparisons the text can be seen, not only as a fantastical story, but as political commentary. Jean d’Arras glorifies the Duke of Berry, his patron, by connecting him to a supernatural being, but he also suggests throughout the narration, that the true justification for nobility and political power is not a supernatural connection, but a practical ability to deal with earthly affairs.

Abstract:
Until the end of the 12th century, the life of Clovis, a Merovingian king and the first Christian king of the Frankish kingdom, who reigned from about the year 481 until his death on November 27, 511, seems to have been rarely depicted in images. From 1200 onwards, however, iconography picturing the Merovingian king expanded, spreading more and more widely in the kingdom of France. This evolution reflects a change in the interest accorded to Clovis over the last three centuries of the Middle Ages. In order to grasp the substance of this change, this study analyzes the importance attributed to the image of Clovis in the kingdom of France between 1200 et 1500. To this end, an examination of known Clodovian iconography has been conducted. First, this evaluation of the quantity and spread of Clodovian imagery in the kingdom allows us to determine the magnitude of the dissemination of the king’s image as well as the scope and diversity of the public to which it was addressed. This examination then allows us to analyze the modalities of depicting the sovereign’s history, based on variations in the message spread by the iconography. Finally, the study of the meaning of the images and of their function yields – at a time when what Colette Beaune calls the “national sentiment” is forming and when the kingdom encounters one of the major conflicts of the period, the Hundred Years War – an understanding of the reasons for the development of the imagery depicting Clovis and for the variations in the place accorded to the king in the iconographic discourse spread between 1200 and 1500 in the kingdom of France

Abstract:
Formed by Saint Louis in favour of his son Pierre, who died in 1284, the Alençon appanage revived in 1290 when King Philippe le Bel bestowed it upon his brother Charles de Valois. Seven princes, who became dukes as of 1415, succeeded him till 1525. Cousins to Kings and Peers of France, the Valois-Alençons turned the Norman-Percheron appanage into the heart of a principality stretching from the Pays de Caux to the banks of the Loire river, from the « Marches de Bretagne » to the Chartres area. The principates of Pierre II (1367-1404) and his son Jean I, who died in Azincourt in 1415, marked the heyday of this political piece of work supported by the King. Henceforth, rooted in this appannage, the Alençons reformed the administration of territories, surrounded themselves with versatile officers and endowed their principality with institutions traditionally devoted to the governance of states: an active chancellery, a general treasury, an exchequer and even a deemed sovereign court of justice. At the new castle of Argentan, the prince court hosted some two hundred and thirty officers and servants, and sparkled with a so far unsuspected lustre. The prosopographic approach, which studies the sociological features and the influence networks shaping the careers of the agents of authority, herein guides the discovery of the princely administration

Dugaz, Lucien.

Abstract:
The principle study of this doctoral thesis is the critical edition of the last unedited text of Christine de Pizan, the Livre des fais d’armes et de chevalerie. It was composed in 1410, at the outbreak of the first civil war posing Bourguignons against Armagnacs, three years after the assassination of Louis d’Orléans on the orders of Jean the Fearless and five years preceding the Battle of Azincourt. This forgotten masterpiece of Pizan was destined generally to educate young men of arms, and particularly for the instruction of the Dauphin, Louis de Guyenne. The Fais d’armes, a re-writing as much as it is a compilation, was upon its publication a reference work on chivalry, soliciting the authority of Vegetius, Valerius Maximus, Frontinus, L’Arbre des batailles by Honorat Bovet, as well as other oral sources that remain anonymous. This critical edition will allow us to fill significant gaps in the christinienne production of the specula principum and will be equally useful to medievalists as much to jurists and to specialists of military history. This edition, which goes back to the origins of the text, leans on the first exhaustive study of the entire textual tradition (25 text sources, in printed and manuscript forms) that identifies several different versions by the author. This discovery adds a new dimension to the study of this text when considered alongside versions that were re-worked for political purposes. What’s more, the establishment of a stemma codicum allows us to define the relationship between two manuscript families : Family A, which respects Christine de Pizan’s auctorialité ; and Family B, which obliterates her name and femininity.Furthermore, the edition of the text in Middle French, accompanied by philological, linguistic and historical notes and commentaries, allows for future stylistique andlinguistic studies on the author-at-work, changing her text on two occasions. Research on her sources also reveal Christine de Pizan’s techniques as “compilator”. This study also proposes an edition of quotes from Valerius Maximus and Frontinus as translated by Simon de Hesdin to inspire further reading. The edition includes a codicological description of the 25 manuscripts and printed copies, elements describing historical and literary context, and, finally, a linguistic study that adds another voice to the debate surrounding a manuscript containing the Fais d'armes and the question of its potentially “autographic” nature

Abstract:
For a long time, the relations between communication networks and castral sites have been associated with seigniorial taxation (tolls) or military activities (by stopping the trafic). Nevertheless, the coordination of roads, rivers, waterways and castles make appear many dynamic relationships between territories, their economic, political or social organization. The decisive question is to integrate these new perspectives into a representation of the practice of territories to define the real conditions of interrelationship between castral sites and communication networks during the end of the early medieval period and the late Middle Ages. The geographical framework of this thesis, the Lot valley from its source to its confluence, on a course of 485 kilometers (301 miles), allows us to consider the reciprocal permanence of social and spatial relations characterized by a plurality of political groups and struggles of influence between individuals. These different powers (great territorial princes, modest lordships, oligarchy and local aristocracy), whose seigniories and castral domains obtrude along this river, can make spaces, politics, societies and economy interact together to explain the dynamic phenomena that relate to the road, river and castles of the territories observed. This study is enriched by the analysis of archives collected, in nine departmental archive repositories, at the National Library of France (BnF), at the national archives of France or at the Public Record Office of London. This historical work focuses on the various actors of power bordering the Lot and their instruments of land domination in order to understand their logic of power and territorial management regardless of their social rank

Abstract:
The manuscript Aix-en-Provence, municipal library, 428(306) contains two different texts. The first, La Chanson de Bertrand du Guesclin, is a rimed epic poem telling the life of Bertrand du Guesclin (1320-1380), a Britain knight from a modest background who took part of the One Hundred Years War, and would become the constable of France. This biography has been written by a certain Cuvelier between 1380 and 1385, right after Bertrand's death. The second is a set of seven lyric poems written in memory of Bertrand, three of which were written by Eustache Deschamps. The first text, at the same time historical, epic, a tribute, biographie and poem, has a considerable importance in the literary production of the day as the last chanson de geste to be written in French. The poems celebrating the constable are fully in line with the lyric revival of the end of the 14th century. Through our study, we like to discover or rediscover this underrated work ; we will provide original text of the manuscript, descriptions of the other manuscripts, a literary review including a study of the context and new information about the author, a linguistic study, critical notes, a glossary, an index, a list of proverbs, and a comprehensive bibliography

Abstract:
The fortified medieval areas of the Velay (medieval diocese of Puy-en-Velay) are analysed in their constitution and their use. The survey concerns a corpus of castle sites, fortified towns, fortified houses, priories and fortified churches in 145 communes, mostly in the department of Haute-Loire (France-Auvergne). The changes that these fortified spaces operate during the 13th-15th centuries are highlighted: spatial morphology and choices of occupancy of these areas, evolution of individual seigneurial habitats and enclosures in rural and urban context. The nature of the relations between the different social groups building this fortified territory is mainly documented by texts : relationships between the lords and the bishop of Le Puy or the king, relationships between the lords and the urban or rural communities, emergence of new social groups (the small gentry). The purpose focuses on the articulation of these areas and the social and symbolic relationships that each of the social groups has with fortifications. Thus, the intentions of domination and the resistance of each of the medieval social groups are revealed by analysing the plots, the buildings and the form of the fortification

This thesis analyzes the evolution of the power of the abbots of eleven male Benedictine abbeys of the diocese of Rouen between the end of the 12th century and the middle of the 15th century, focusing on the largest of them (Le Bec, Fécamp, Saint-Ouen, Saint-Wandrille...) but also on more modest and unknown monasteries. At the heart of the reasoning lie the relationship of the abbots with the French and English royal powers. After the integration of Normandy in the Capetian royal domain in 1204, the abbots became royal: studying in particular the acts of the practice, this thesis proposes a definition of this category. The role of Philip Augustus in the building of these relationships between crosiers and crowns is underlined. The political continuation of the 13th century and the beginning of the 14th century, coupled with economic prosperity, resulted on the one hand in a real freedom of elections in the Norman monasteries and on the other hand in the advent of abbots managers, who even managed to preserve the property of their abbeys located in the lands of the King of England. The beginnings of the Hundred Years’ War were a real turning point: from then on, the abbots had to engage in political affairs and war (especially in the conflict between the King of France and the King of Navarre, then at the time of the conquest of Normandy by Henry V, after his victory at Azincourt in 1415). Based on a prosopography of one hundred and eighty-eight abbots, the thesis also studies the profile of these superiors (their social and geographical origins, their formartion and career, etc.) and the evolution of the abbatial figure over these three centuries: more and more superiors studied at the university and/or gravitated in the circles of power of the Church or of the kings. As a result, they were less and less physically present in their cloisters, accustoming the monks to their absence, while the freedom of the elections was gradually cut off under the influence of the pope and kings. Besides, the study, in particular, of the narrative and figurative sources shows that the representations of their power evolved in parallel: more and more attentive to their external prestige, marked in particular by the wearing of the pontifical insignia, they looked less and less like to the monks who they were ruling. This thesis proposes to read the setting up of the commendatory system in the continuity of these evolutions of the abbatial power, which appear less as a crisis than as a mutation

Abstract:
In the aftermath of the Hundred Years’ War, the King of France, winner by arms in 1453, displays a policy, a speech, a legislative activity, in order to perpetuate peace. Much attention is paid to the restoration of judicial institutions, which contribute to the redefinition of the jurisdictional geography of a kingdom divided for many years. In this context appears a forgotten institution, which had not been mobilized for nearly half a century: the grands jours, consisting in sending for a few weeks of a group of councilors of the Parliament of Paris in a city chosen by the King, to judge on the spot rather than in Paris the appeals for a determined area. Between 1454 and 1459, seven sessions are held in Poitiers, Thouars, Montferrand and Bordeaux, then disappear again from the institutional landscape for more than twenty years. The grands jours appear in this mid-fifteenth century as a political instrument in formation, in a moment of change in both the history of the kingdom of France and in the history of the institution. This instrument allows an intensification of the judicial policy of royalty and the resumption of a judicial relationship between the king, his representatives and his subjects

Alzubeidi, K. Salameh. "Why has Egypt been under emergency rule for the past hundred years?" Thesis, 2018. http://hdl.handle.net/1959.7/uws:50510.

Abstract:
Egypt has been under a permanent state of emergency for nearly 100 years. This thesis aims at exploring and understanding Egyptian emergency law and its contextual background. It uses a combination of historical and theoretical perspectives to explore how Egypt’s emergency law has developed since its introduction by Britain to the present day. Chapter two examines theories of emergency powers and the failure of traditional theories of emergency powers to explain and justify the permanent state of emergency in Egypt. Chapter three discusses British imperialism in Egypt to show how Britain introduced and enshrined martial law in Egypt’s constitution, as well as other laws, to protect Britain’s political and economic interests in Egypt. Chapter four examines the legal framework of emergency law developed in Egypt after Britain’s departure to show how emergency law developed and expanded from a temporary measure to a permanent one. Chapter five explores the major human rights violations that occurred during, and as a direct result of, the use of a state of emergency. Chapter six examines contemporary imperialism to show how economic pressure from neo-imperialist organisations is used as a tool to enforce certain economic and political ideologies and policies. Further, it examines the resulting increased poverty in developing nations and the subsequent uprisings that occur. This study further explores how different political regimes use such uprisings as justification for using the force that is permitted under a state of emergency. Chapter seven explores how a minority group of elites have used the permanent state of emergency in Egypt to protect their political and economic interests. The research concludes that, given Egypt’s history, it would be naïve to believe that formal constitutional or legal constraints could protect the population from dictatorial ‘emergency’ forms of rule. Further, given the country’s record of colonial and neo-colonial oppression, it is unrealistic to conclude that the solutions lie in Egypt alone. As a result of these conclusions, this thesis recommends social equality, new forms of genuinely participatory democracy, democratic control over all aspects of life (including production, finance and key levers of the economy), guarantees of basic social rights such as education and health, and guarantees of core legal rights such as habeas corpus, open civilian trials and the presumption of innocence.

Abstract:
Why the term 'Anglo-Scottish Struggle' between 1337 and 1346? Why 'The Perspective of English Official Documents'? What influence did the so-called 'Hundred Year's War' have on the Anglo-Scottish relations in the first years of the war? What impact did the 'Scottish issue' have on the policy of the English king during the Anglo-French conflict? How did the perspective of English official documents differ from that of English chronicles or Scottish/French primary sources? What role did the rhetoric of these source play? How was it portrayed? The following thesis will try to analyse some of the aforementioned issues and will strive to prove that the Scottish kingdom had a profound impact on the English policy in multiple respects from the outset of the Hundred Years' War until the battle of Neville's Cross almost ten years later.

Abstract:
This diploma thesis is exploring the topic of legitimacy and legality of the royal power in the late English and French Middle Ages. Specifically, it answers the question whether Edward IV and Charles VII were legitimate kings for their respective subjects, based on analysis and comparison of selected contemporaneous English and French sources. This thesis presents different points of view on the royal power and the royal office according to the medieval authors. It describes the often ambiguous and contradictory opinions on this issue as well as provides a deeper look at the traditions and customs surrounding it. This analysis is presented against the historical backdrop of prolonged armed conflicts and political changes in both kingdoms. The differences between the legal and political situation of Charles VII and Edward IV suggest a wide range of possible interpretations. This thesis, based on the critical analysis and comparison of the relevant historical sources, advocates the view supporting the legitimacy of both kings, based on their respective genealogical and legal claims as well as on the support granted by their subjects.
