Meeran, Richard, and Jahan Meeran, eds. Human Rights Litigation against Multinationals in Practice. Oxford University Press, 2021. http://dx.doi.org/10.1093/oso/9780198866220.001.0001.

Full text
Abstract:
This book reviews the current position in this field, which has developed over the past 25 years, designed to hold multinationals to account, legally, for human rights abuses in the Global South. The authors are practising lawyers who have litigated and led prominent cases of legal significance in this field. Although the focus is on the Global North, where most of the cases have been brought—United Kingdom, United States, Canada, Australia, France, Netherlands, and Germany—there is also a chapter on South Africa. The cases cited include claims against parent companies for harm caused by subsidiary operations, claims for corporate complicity in violations perpetrated by States, and claims arising in a supply chain context. Whilst other books have included consideration of the legal aspects of many of the cases, the focus here is on the interrelated strategic and practical, as well as legal, considerations on which viability and prospects of success depend. In addition to questions of jurisdiction, applicable law, and theories of liability, obstacles to justice concerning issues such as access to information, collective actions, witness protection, damages and costs, and funding regimes (including a specific chapter on litigation funding), and issues relating to public pressure and settlement, are discussed. Although most of the authors act for victims, there is a substantial chapter providing the perspectives of business. Since this area of litigation has developed concurrently with, and has formed part of, the rapidly mushrooming field of business and human rights, the contextual relevance of the UNGPs is considered.

Peters, Anne, Jérôme de Hemptinne, and Robert Kolb, eds. Animals in the International Law of Armed Conflict. Cambridge University Press, 2022. http://dx.doi.org/10.1017/9781009057301.

Full text
Abstract:
Animals are the unknown victims of armed conflicts. Wildlife populations usually decline during warfare, with disastrous repercussions on the food chain, on fragile ecosystems and precarious habitats. Belligerents take advantage of the chaos of war for poaching and trafficking of animal products. Livestock, companion, and zoo animals, highly dependent on human care, are direct victims of hostilities. The book is the first legal analysis of these issues. It maps the framework of international humanitarian law, examining which and how the concepts, principles, and rationales can be applied and adapted for a better protection of animals. The contributions inter alia discuss precautions for animal civilians, problems of animal combatants and prisoners, a specific status for veterinarian personnel, the recognition of biodiversity hotspots as specially protected zones, and the potential of enforcement mechanisms. The concluding chapter draws together novel interpretations and reform proposals.

Abstract:
Course-focused and comprehensive, the Textbook on series provides an accessible overview of the key areas on the law curriculum. The eighth edition of the Textbook on Immigration and Asylum Law provides expert coverage of case law and legislation, along with analysis of the political context and social impact of the law, and a strong focus on human rights. The volume guides the reader through this constantly developing area of law. Analysis and commentary on the political, social, and historical dimensions of the law brings the subject to life and encourages readers to engage critically with the issues. This edition has been fully updated with recent cases and developments in the law, including the changes to the powers of removal and rights of appeal in the Immigration Acts 2014 and 2016. It also gives an account of the asylum process, and applications for protection for victims of trafficking.

Abstract:
Colombia has the highest number of people displaced by violence in the world. According to the United Nations Refugee Agency (UNHRC), in 2017, 7.7 million people were registered as being internally displaced. Forced migration as a result of displacement caused by armed conflict, in a context of weak protection of the rights of the victim population and low-income generation, represents a challenge for social development, which is limited by high levels of poverty and income concentration. In particular, the territorialisation of the peace agreements is currently still under construction with serious difficulties in the security systems of social leaders and in improving economic opportunities in both legal and formal ways to counteract the damaging effects of criminal economies that are associated with illegal mining and drug trafficking. The research, conducted from the forced migration approach, contributes to building strategies from different areas, mainly from the institutional and labour market, to reduce the obstacles to the reintegration of victims into civil society through a public policy built based on citizen participation. In this sense, governance processes with citizen participation are situated in security concepts that encompass the State’s obligation to offer better income opportunities in legal economies, of protection of human and democratic rights, and consolidation of transitional justice mechanisms, which are a priority in the advance toward sustainable peace.
