Abstract:
Women’s Human Rights: A Social Psychological Perspective on Resistance, Liberation, and Justice contributes to the discussion of why women’s human rights warrant increased focus in the context of globalization. It considers how psychology can provide the links between transnational feminism and the discourse on women’s human rights and neoliberalism by using activist scholarship and empirical findings based on women’s grassroots resistance. The book takes a radically different approach to women’s human rights than disciplines such as law, for example, by developing new ideas regarding how psychology can be relevant in the study or actualization of women’s human rights and by making clear how activist-scholarship can make a unique contribution to the defense of women’s rights. This radical departure from using a legal framework, or examples that have been sensationalized throughout academia and advocacy (e.g., genital cutting), provides a route for better understanding how the mechanisms of violation operate. Thus, it has the potential to offer alternatives for intervention that extend beyond changing laws or monitoring international human rights treaties. The perspectives offered by the authors are largely informed by feminist liberation psychology, women of color, and critical race and queer theories in an attempt to demonstrate how research in psychology can shed light on the diverse experiences of women resisting human rights violations and to suggest means by which psychological processes can effectively challenge the broader structures of power that exacerbate the violation of women’s rights.

Abstract This book analyses the use of the expression ‘serious violations of human rights’—and similar ones, such as ‘gross’ or ‘grave’—in international practice. It highlights some of the recurring responses to and consequences of such violations, and suggests that a new special regime—eponymous with the above-mentioned expression—was formed. This special regime is understood as substantively limited to a very specific issue-area of human rights violations; where a series of monitoring mechanisms and procedures is in place to predominantly highlight, document, and record such violations; where specific measures are taken, aimed at enforcing compliance; where certain consequences arise, focusing primarily on affording the victims of such violations a remedy. As such, this special regime is arguably comprised of at least four thinly interconnected components: the substantive, the monitoring, the enforcement, and the remedial ones. Future practice may dictate alternative interpretations of the role of this category of violations in the international legal order. However, what becomes apparent from this work is that the concept of serious violations of human rights is today becoming a key notion, as it allows the international community to pinpoint those factual situations requiring its attention and action.

The human rights to water and sanitation have developed dramatically under international human rights law over the past forty years, with international political declarations leading to specific state obligations. Yet despite this evolution of human rights under international law, there are few mechanisms to monitor the progressive realization of those rights in national practice. The Water, Sanitation, and Hygiene (WaSH) Performance Index employs frontier analysis to monitor human rights to water and sanitation, across countries and over time. Tracking rates of change in water and sanitation coverage, the WaSH Performance Index allows for measurements of the progressive realization of human rights, publishing quantitative indicators reflective of the human rights to water and sanitation. Such external monitoring of outcome measures, correlating national implementation efforts with water and sanitation coverage data, provides a basis for future research and advocacy to facilitate rights-based accountability for water and sanitation policy.

The very concept of human rights implies governmental accountability. To ensure that governments are held accountable for their treatment of citizens and others, the United Nations has established a wide range of mechanisms to monitor compliance, and to seek to prevent as well as respond to violations. The panoply of implementation measures that the UN has taken since 1945 has resulted in a diverse and complex set of institutional arrangements, the effectiveness of which varies widely. Inevitable instances of politicization and the hostile or ambivalent attitude of most governments has often endangered the fragile progress made on the more technical fronts. In addition, there are major problems of underfunding and insufficient expertise. The complexity of these arrangements and the difficulty in evaluating their impact makes a comprehensive guide of the type provided here all the more indispensable. This book critically examines the functions, procedures, and performance of each of the major UN organs dealing with human rights, including the Security Council and the International Court of Justice as well as the more specialized bodies monitoring the implementation of human rights treaties. Significant attention is devoted to the considerable efforts at reforming the UN’s human rights machinery, as illustrated most notably by the creation and operation of the Human Rights Council. The book also looks at the relationship between the various bodies and the potential for major reforms and restructuring.
