Abstract:
In Mukeshimana, the Brussels Court of First Instance held that a decision to evacuate a compound in Rwanda, occupied by the Belgian military in the framework of an UN peace operation, was attributable to Belgium, and could engage Belgium’s responsibility. After the evacuation, Interahamwe militia killed most persons who had sought refuge on the compound. The Court fails to provide proper conceptual arguments for such attribution, limiting itself to stating that the case should be distinguished from the Behrami decision of the European Court of Human Rights. Arguably, Mukeshimana should have been based on the effective control standard as laid down in art. 7 of the Draft Articles on the Responsibility of International Organizations for Internationally Wrongful Acts, and as applied by Dutch courts in the Srebrenica litigation against the Dutch State.

Abstract:
The significance of Gasparini lies in the manner in which it applies the Bosphorus presumption to an organization (NATO) that is not the European Union. Furthermore it introduces important distinctions regarding the requirement of state involvement as a precondition for an alleged violation to have arisen within the jurisdiction of the respondent state. Refining some of its earlier case law (Connolly and Boivin), the ECtHR drew a line between actual decisions by the organization and deficiencies in the protection of fundamental rights, rooted in a structural lacuna of the internal mechanism for conflict resolution. Where a structural lacuna exists, the violation is attributable to the member state even though organs of the respondent member state were not immediately involved in the violation.

Abstract:
The Bankovic case is one of few cases in which the European Court of Human Rights took a position that, without an acceptable explanation, restricts the application of rights granted by the European Convention on Human Rights. The application was submitted by individuals who put forward that in 1999 seventeen states parties violated art. 2 (right to life) of the Convention by bombing by aircraft the television and radio station in Belgrade. As a consequence of this NATO directed operation sixteen civilians were killed and another sixteen were seriously injured. The Court found that it had no jurisdiction to entertain the case, as at that time Yugoslavia was not a party to the Convention. The Court gave a too restrictive interpretation of the word ‘jurisdiction’ to basically conclude that the Convention applies only within the territory of states parties. The Bankovic decision has been contradicted by subsequent judgments.

Abstract:
In this decision, the Belgian Court of Cassation adopted a far-reaching interpretation of the Waite and Kennedy jurisprudence of the European Court of Human Rights and its ‘reasonable alternative means’ test to assess if the immunity of an international organization was permissible with regard to the protection of ECHR rights. Not only did the Court of Cassation verify the existence of an internal dispute-settlement mechanism within the WEU—the internal appeals commission—but it also examined its quality with regard to fair trail requirements. Pursuant this check, the Court considered that the commission was not sufficiently independent and consequently rejected the immunity of the organization. Moreover, the Court ruled that, in case of rejection of immunity, the internal law of the organization was to be applied to the dispute, as opposed to domestic law.
