Abstract:
A number of social theorists have recently expressed doubts about the possibility of political deliberation in ancient Israel on the grounds that divine initiative in biblical narrative ultimately tends to overwhelm merely human action. Michael Walzer, for example, suggests that debates among tribal elders might provide evidence of political deliberation, but the absence of such debate in biblical narrative leads him to think that elders came to have a “secular and non-covenantal character” in the eyes of biblical narrators. This chapter argues that the arrival of kingship in Israel was forged through the deliberations of tribal elders, rather than through the application of Deuteronomy’s law of kingship, and that this is briefly, but quite explicitly, depicted in a number of narratives. The biblical texts then reveal an ongoing process of reflection on the performance of kings, with northern tribal elders and southern “people of the land” taking decisive political initiatives.

Abstract:
This chapter considers the interaction of some of the applicable norms related to liability and reparation for environmental damage in a post-conflict setting, including human rights and humanitarian law norms (including precedents) and their interaction with each other, with a focus on the potential consequences for victims. Using displacement as a specific case study, the discussion regarding potential consequences is supported by the learning that may be drawn from precedent reparations schemes, including those implemented in a ‘transitional justice’ framework as part of an attempt to afford ‘justice’ for breaches of human rights and humanitarian law (whether related to the environment or otherwise). The chapter considers some of the potential challenges of this interaction, particularly for justice initiatives, and particularly reparations schemes, experienced in the aftermath of conflict, such as constructing a coherent post-conflict narrative, restitution (or ‘truth’), awarding reparation (including ‘restitution’), and reconciliation as part of ‘peacebuilding’.

Johnson made food aid a major element of his foreign relations with several countries. He saw it as a tool, an inducement, a reward or a cudgel. As a product of Senate leadership, he knew how important the role of Congress was in approving and funding his many initiatives, and he sought to ensure that he was not viewed as a “dewy-eyed, give-away boy.” He had to be seen as a tough guy even though he was, at heart, quite a benevolent person. Critics of food aid were suggesting that it could do more harm than good when used outside narrowly defined situations requiring emergency relief. Johnson paid them little heed. He fought with Congress over control of food aid, losing several battle and winning others. His liberal stance on domestic human rights issues lost him votes among conservatives in Congress on his desired food aid reforms.

Christ’s healing of humanity consists, crucially, in forming human beings for loving relationship with himself and others. In this respect, Christ also takes the role of the beautiful beloved. Believers become pilgrims by falling in love with the beautiful Christ by the initiative of the Holy Spirit, who cleanses their eyes to see him as beautiful and enkindles desire in their hearts. By desiring and loving the beautiful Christ, the believer is conformed to him and learns to walk his path. Desiring the beautiful Christ forms a believing community shaped aesthetically and morally for a particular way of life: pilgrimage to the heavenly homeland. Formation is both earthly and eschatological, for so too is the journey and the activity of the pilgrim.

Abstract:
This article examines the concept, development and implementation of the no harm principle and its wider role in public international law. While generally acknowledged in international environmental law protecting other states from physical harm caused to their territory, in other areas of international law the principle is of increasing importance in order to find a balancing mechanism between colliding states’ interest in case of negative externalities caused by one state to the detriment of other states. The article traces implementations of the regulatory mechanism to focus on the adverse effect in other areas of public international law, ranging from trade and monetary agreements to invocation of the concept in current initiatives especially in the context of harmful tax competition and banking regulations. This will show the general capability to balance colliding states’ interest providing solutions for an increasingly interdependent world and giving meaning to the concept of a global community.

Rutherford and Chadwick’s experiments and Rutherford’s explanation were vigorously challenged in 1922 by the Swede, Hans Pettersson and his Austrian partner, Gerhard Kirsch, working in the Institute for Radium Research in Vienna, which had been founded by an Austrian industrialist and philanthropist and officially opened in 1910. Its director, Rutherford’s friend Stefan Meyer, was a cultured Viennese of Jewish descent who created a family-like environment that was unusually supportive of women researchers. Its existence was seriously threatened by the postwar runaway inflation in Austria, whose devastating consequences were somewhat mitigated when Rutherford arranged to purchase the radium loaned to him on Meyer’s initiative by the Vienna Academy of Sciences before the war.

This chapter focuses on C. Francis Jenkins' television inventions, including the electronic television. Historians consider Jenkins as the American inventor of mechanical television and often portray him as something of a failure because by the early 1930s, his ideas were purchased by competitive corporate powers and then overtaken with the far-better Farnsworth and Zworykin electronic scanning techniques. However, Jenkins' fundamental contributions in television cannot be simply ignored. This chapter begins with an overview of Jenkins' experimental television, followed by a discussion of his various ideas such as the “telectroscope” and optical electrical television. It then takes a look at the Jenkins Laboratories, Discrola Inc., and the Radio Pictures Corporation. It also recounts Jenkins' demonstration of how radio movies could be transmitted and received before concluding with an assessment of Jenkins' collaboration with the American Radio Relay League in television-related initiatives.

This article provides the context for training, development, and competence. In the training section, theory, policy, and practice are considered, including the diversity of national systems for vocational education and training (VET) and the relationship between work organization and workplace learning. The development section is distinguished from training in terms of objectives and scope, while the emergence of Human Resource Development (HRD) is explained not only in terms of a more strategic focus but also in relation to initiatives like corporate universities. The competence section addresses the confusion surrounding the term, contrasting four predominant approaches derived from the USA, the UK, France, and Germany, each of which has influenced other countries to varying degrees. Drawing on these four traditions, a more holistic approach to competence is presented as the model currently being used to structure learning outcomes within the European Qualifications Framework.

This chapter begins with an account of the calendar-reform initiative spearheaded in 1411–17 by Cardinal Pierre d’Ailly at the Councils of Rome and Constance, followed by an in-depth look at the repeated efforts towards a new calendrical legislation made at the Council of Basel in the years 1434–40, which saw the matter debated by a specially created commission or task force. The final part continues the story into the second half of the fifteenth century, highlighting in particular the role of print technology in the dissemination of calendrical and astronomical knowledge. Special attention is given to the activities of the astronomer Johannes Regiomontanus, whose premature death in 1476 prevented him from assisting Pope Sixtus IV in preparing a reform of the ecclesiastical calendar.

India’s first Prime Minister towered over India’s international relations for nearly two critical decades. More than half a century after his death, however, scholars continue to debate the meaning and significance of Nehru’s most important initiatives in foreign policy. Some argue that he was a bold idealist crusader, one who frequently ignored important Indian interests. Others have described him as a subtle practitioner of realpolitik statecraft. This chapter argues that Nehru must be remembered as both an idealist and a realist. To make its case, the chapter delves into three of Nehru’s most important ‘idealistic’ preoccupations in foreign policy: his drive to build up the United Nations, his campaign for non-alignment, and his crusade for nuclear disarmament. In each case, the analysis reveals that Nehru was both sincerely committed to what he saw as a moral cause, but also convinced that advancing it would suit narrower Indian interests as well.

The diversion to Tunis is usually explained either in terms of Louis’s wish to convert the emir or Charles’s desire to extract money from him. These alternatives are often seen as mutually exclusive. The crusade was either a drive for souls or a drive for money, but could not be both. It was either a campaign of elimination or an attempt at accommodation, but could not be both. It was an episode in which religion mattered either very much or very little, but could not be both. This chapter argues that these two ways of understanding the crusade are actually complementary. Louis and Charles both found what they wanted in Tunis: it was a place where Muslim souls could be won and Hafsid money could be had; where Latin Christian commercial interests and missionary initiatives could be advanced; and where methods of militant confrontation and conciliatory diplomacy could be tried.

This chapter focuses on the first serious effort made within the medieval Latin Church to correct the calculation of Easter by legislative means. This effort took place at the court of Pope Clement VI in Avignon, who invited skilled astronomers such as Jean des Murs and Firmin de Beauval to assist him in a planned reform of the Golden Number. The chapter explores the background to this papal initiative and the contributions made by its various protagonists, focusing in particular on a recently discovered Expositio kalendarii novi written by the monk Johannes de Termis in 1345. It also takes a closer look at the parallel discussions that took place in the Byzantine East, where the prospect of a calendar reform was first raised by Nicephorus Gregoras in 1324.

Prices in the Roman economy were generally set by the operation of free market forces. Occasional government interventions in the form of price ceilings occurred in times of crisis, to stabilise volatile or politically important markets, or to signal moral policies. The mechanism of price formation was generally understood, but price shocks were expected to be curbed. In a similar vein, the valuation techniques developed by the Roman jurists were based on “true” prices rather than pure market prices. Even so, party autonomy in price setting was the norm. The grain market was guided to some extent for obvious political reasons, but even here there was room for private initiative. The freedom to contract was stressed as late as Diocletian, but, not much later, rampant inflation forced him to issue his edict on maximum prices, which remains an exceptional regulation in many ways.

In 9 CE, the powerful courtier Wang Mang deposed the infant prince of Han and took power as first emperor of his own dynasty. To help him sustain this claim, Liu Xin created what amounted to a Grand Unified Theory, in which all the important regularities of nature were explained with reference to numbers. We shall look in detail at the Triple Concordance system that resulted from this initiative, and follow through some examples of calculation based on it. Here we shall meet for the first time certain common features of all such systems. Liu Xin also undertook an ambitious project to use his new system to reconstruct the records of astronomical phenomena in a number of historical texts. Liu Xin’s work gives us an in-depth view of how one of the central figures in the early development of Chinese mathematical sciences saw the world.

Though targeted attacks at schools are rare events, educators and behavioral health professionals working in those settings must evaluate threats and threatening situations when they occur. Schools across the world have experimented with different methods over time, but the threat assessment approach—particularly executed by an interdisciplinary team—has emerged as abest practice. This chapter describes the results of the Safe School Initiative, an in-depth case analysis of 37 targeted school attacks involving 41 attackers over a 25-year period, and their implications for understanding the attackers, the situations, the settings, and the targets. It addresses the continuum of threats that schools may encounter and offers some heuristics for decision making, including recent research on key indicators of intent. It concludes by emphasizing the need for schools to have incident and post-incident response plans to mitigate harm if an attack does occur.

Like other church fathers, Hilary sometimes articulates the will as entirely competent; sin is entirely our fault because our will is strong enough to prevent it. However, the ‘anthropological household’ demonstrates another strain in his thought, where the will is affected by the Fall and is now subject to disobedience (infidelitas). Similarly, he sees that humans find it difficult to will to follow God, but suggests that God gives grace for this as long as the human shows the initiative (initium fidei). This is then compared to other early Christian writers. Although they do admit other constraints on human action, Hilary appears to be the first Latin author expressly using the fallen will. He appears to follow Origen, who does articulate constraint in terms of the will. Hilary’s expressions may thus arise under the influence of Stoic thought, which reached him through Origen’s material.

Abstract:
The majority of mentally disordered offenders are never treated within forensic mental health services. Instead, they remain within the criminal justice system, where care and treatment for complex and co-morbid mental health, substance-misuse, and personality disorder issues remain secondary to justice and punishment. In this chapter, we explore the policy, practice, and legislative drivers influencing healthcare delivery throughout the criminal justice pathway. Firstly, we consider the current liaison and diversion programme in England, which aims to identify people with mental health issues at the point of entry into the criminal justice system. Secondly, we review the state of mental healthcare in prisons, a quarter of a century after the clinical improvement partnership between the National Health Service and HM Prison Service. Thirdly, we discuss issues around court mandated mental health treatment in the community. Finally, we consider initiatives designed to meet the discrete needs of offenders with personality disorders.

‘For certain men the stronger their desire, the less likely they are to act.’ With his first glimpse of Madame Arnoux, Frédéric Moreau is convinced he has found his romantic destiny, but when he pursues her to Paris the young student is unable to translate his passion into decisive action. He also finds himself distracted by the equally romantic appeal of political action in the turbulent years leading up to the revolution of 1848, and by the attractions of three other women, each of whom seeks to make him her own: a haughty society lady, a capricious courtesan, and an artless country girl. Flaubert offers a vivid and unsparing portrait of the young men of his generation, struggling to salvage something of their ideals in a city where corruption, consumerism, and a pervasive sense of disenchantment undermine all but the most compromised erotic, aesthetic, and social initiatives. Sentimental Education combines thoroughgoing irony with an impartial but unexpectedly intense sympathy in a novel whose realism competes with that of Balzac and whose innovations in narrative plot and perspective mark a turning-point in the development of literary modernism.
