Abstract:
Throughout its history, the insanity defense specifically and the more general concept of mental defect or incompetence have been grounded in the assumption that those people fit for the rule of law are able to give and to comprehend reasons for their actions. This chapter traces the evolution of perspectives on the nature of mental illness and the manner in which cultural and extra-scientific influences have shaped perspectives. These perspectives are most saliently expressed in statutory provisions and relevant case law summarized here and covering historical developments from ancient Greece and Rome to the present. Significant interactions between law and psychiatry are further highlighted and informed by core and controversial philosophical assumptions. Attention is given to differences between juridical and medical conceptions of responsibility.

Abstract:
This chapter presents the elements of a psychiatric assessment. After hearing the patient’s chief complaint, the physician elicits the patient’s history of the present illness (a chronological, systematic description of the patient’s signs and symptoms) past psychiatric history, medical history, psychosocial history, family history, and review of systems. The physician also obtains the patient’s mental status examination, which is an objective description of his or her current mental state. Integration of the patient’s history and objective findings results in a comprehensive descriptive and diagnostic impression, which summarizes patterns of data, predicts prognosis, and suggests appropriate treatment options. Use of a biopsychosocial and cultural perspective produces a psychiatric assessment that considers the patient’s strengths and vulnerabilities in relation to his or her cultural group.

This chapter discusses a central component of cognitive assessment in clinical practice: cognitive and neuropsychiatric history taking. It suggests a structure and check list for approaching the interview and stresses the importance of establishing a rapport as well as using both open-ended and more directed questioning to explore each of the aspects of cognition described in earlier chapters as well as the impact of the illness on everyday practical function. The chapter stresses the importance of obtaining an independent history from a family member or accompanying adult as well as a detailed past and family history. The final part of the chapter presents tips on physical examination in the context of patients presenting with cognitive disorders.

Abstract:
This article discusses that with a new focus on patients and the quality of care, illness experiences have become an important topic in recent years in scholarly and biographical literature, but also in the wider world of newspaper, inviting comparisons with nineteenth-century accounts of consumptive lives and deaths. This article is about continuities of consumption and tuberculosis and the historical change that has obscured them. It discusses the belief in medical progress and its power, informed by laboratory research in bacteriology and physiology, replacing the feeling of impotence characterizing earlier medical encounters with incurability. It further suggests that the continuities with consumption go beyond descriptions, shaping the ways in which we deal with chronic illness today. It concludes with reasons for the use of comparative accounts to balance the dominance of the American case in the historiography and also histories of chronic illness in the developing world.
