Esta pesquisa tem como objetivo central apresentar a plausibilidade do enfrentamento de um problema em filosofia de maneira intuitiva. Apresentaremos elementos da filosofia bergsoniana no intuito de explicitar como a duração temporal articula-se com a memória, com a consciência, com a percepção. Na sequência demonstraremos a naturalidade dada por Kant a um tempo espacializado que possibilita todo conhecimento humano. Por fim, enfrentaremos o desafio de compreender os atos do método intuitivo, ao mesmo tempo em que apresentaremos nosso objeto: a plausibilidade da intuição à problematização filosófica.
This paper aims to present the plausibility of confronting the problem in philosophy in an intuitive way. We'll present elements of Bergon's philosophy in purpose to make explicit how the temporal duration articulates with the memory, the conscience and the perception. Right after, we'll demonstrate how the spatial time (which allows every human knowledge) became naturalized in Kant. In the end, we'll face the challenge of understanding the acts of the intuitive method, at the same time, we'll present our objective: a plausibility of intuition to the philosophical problemazation.

Abstract:
Language practitioners the world over have been struggling for professional recognition for many years. In many instances the emphasis has been on establishing measures like legislation to regulate the industry. However, many institutions have also realised that external regulation such as legislation is not enough and that language practitioners in general and text editors specifically needed an internal regulating mechanism. This mechanism was not just something internal to the industry but was more personal, and therefore internal to practitioners themselves. In this regard a properly designed code of ethics was regarded as an indispensable means of setting out to text editors what may be regarded as proper conduct in carrying out their work. No code of ethics for text editors in South Africa exists and text editors who are members of the South African Translators' Association (SATI) subscribe to the code for translators. This is an undesirable state of affairs as it is important for practitioners to feel that a code is specific to them and "belongs" to them in order for them to subscribe to it. More than that, because a code is part of an internal value system it is important for practitioners to internalise such a code for it to be effective. This study, aimed at the design of a code of ethics for text editors, therefore strove to achieve two aims. The first aim was to design a code of ethics for text editors with reference to existing codes in other related fields, gleaning common elements from them. The second aim was to involve a selection of practising text editors in the refinement of the draft code in order to finalise it, thus ensuring that the code would be acceptable to the people most affected by it. The result of the project was the establishment of a code that was acceptable to all the practitioners involved up to the conclusion of the project. This code will be of value in filling the vacuum in this branch of language practice where no ethical guidelines existed before.

Abstract:
Este trabalho analisa a aplicabilidade do conceito fotográfico de momento dado, de Henri Cartier-Bresson, no jornal diário Folha de Londrina. Esta análise acontece por meio de um método que identifica quantitativamente a presença de imagens que apresentam características deste conceito e analisa qualitativamente a aplicação do mesmo. Foram coletadas e analisadas imagens das capas de 30 edições do jornal em questão, no período de 22 de fevereiro à 28 de março de 2017. Para fundamentar a análise qualitativa e para fins investigativos da rotina de produção jornalística, foram aplicadas entrevistas com fotógrafos atuantes no jornal e que tiveram suas imagens selecionadas para a análise. Utilizou-se como fundamentação a teoria do processo criativo do fotógrafo de Boris Kossoy, o qual dialoga com os conceitos filosóficos de Vilém Flusser e Arlindo Machado. Com relação ao momento dado, foi abordado aspectos da formação e produção fotográfica de Henri Cartier-Bresson, considerado o projenitor do conceito, e a questão da tradução do termo que se difundiu como instante decisivo, porém foi idealizada pelo fotógrafo como momento dado. O resultado permite afirmar que a presença do conceito nas páginas do jornal diário são escassas e condicionadas mais à oportunidade do que à intencionalidade de aplicá-lo.
This paper analyzes the applicability of the photographic concept of the given moment, by Henri Cartier-Bresson, in the daily newspaper Folha de Londrina. Through a method that quantitatively identifies the presence of images that present characteristics of this concept and qualitatively analyzes the application of them. Images from the covers of 30 editions of the newspaper in question were collected and analyzed from February 22nd to March 28th, 2017. In order to substantiate the qualitative analysis and for the purposes to investigate the journalistic routine, interviews were conducted with photographers working in the newspaper and had their images selected for analysis. The theory of the photographer?s creative process by Boris Kossoy was used as a foundation, which dialogues with the philosophical concepts of Vilém Flusser and Arlindo Machado. Regarding the given moment it was approached aspects of the educational background and photographic work of Henri Cartier-Bresson, considered the projenitor of the concept, and about the translation of the term that diffused as the decisive moment, but was idealized by the photographer as the given moment. The results allows to affirm that the presence of the concept in the pages of the daily newspaper are scarce and conditioned more to the opportunity than the intensionality of applying it.

Abstract:
This thesis examines the nature and dynamics of U.S.-Iran relations during the Cold War under the leadership of U.S. President Richard Nixon, his adviser Henry Kissinger, and Shah Mohammad Reza Pahlavi of Iran. This revisionist account critically examines the popular view of Mohammad Reza Shah as a mere instrument of American strategies of containment during the Cold War. Relying on recently declassified American documents, British government papers, and the diaries, memoirs and oral histories of Iranian actors, this thesis restores agency to the shah as an autonomous Cold War actor and suggests that Iran evolved from a client to a partner of the United States under the Nixon Doctrine. This partnership was forged during Nixon’s first term in office between 1969 and 1972, as the United States embraced a policy of Iranian primacy in the Persian Gulf region. Thanks to a long-standing friendship with the president, the shah was able to exercise extraordinary influence in the Nixon White House. This partnership reached its peak during Nixon’s second term as the United States supported Iran’s regional primacy against the challenge from Iraq. The shah drew Nixon and Kissinger into Iran’s secret war against Iraq in Kurdistan in 1972, by portraying Iran’s long-standing regional conflict with Iraq as a Cold War confrontation with the Soviet-backed Ba’th regime in Baghdad. When the shah unilaterally decided to abandon the Kurds in a deal with Iraq’s Saddam Hussein in 1975, Kissinger had little choice but to acquiesce, despite the personal embarrassment and domestic recriminations that followed. The U.S.-Iran partnership declined following Watergate and Nixon’s resignation in 1974. In spite of the best efforts of the shah and Kissinger, between 1974 and 1976 the United States and Iran were unable to reach an agreement on U.S. nuclear exports to Iran. President Gerald Ford tried to impose a discriminatory nuclear agreement on Iran that was rejected by the shah because it violated Iran’s national sovereignty. Under Ford, the United States reverted to treating Iran as a client rather a partner of the United States.

Abstract:
Diploma thesis called "Financial analysis of the industry of musical instruments" deals with analysis of financial health of producers of musical instruments during the years 2008-2013. There were chosen three Czech and three European companies. It was also made their comparision with the European industry of musical instruments. The thesis is divided into three main parts. In the first part there is described selected methodology which includes horizontal and vertikal analysis, ratio analysis, bankruptcy and credibility models and correlation analysis. In the next part there are presented the specifics of musical instruments industry. After that individual companies are introduced and followed by application of the methodology defined in the first part. The main outcome of analysis is that companies and industry are very sensitive to global economic situation. The impacts of financial crisis in 2008 really damaged this companies and industry of musical instruments.

En 2010, les Ivoiriens organisaient une élection présidentielle au sortir d’une décennie de guerre civile. Depuis lors, ces élections défraient la chronique, en raison de leur issue critique : crise postélectorale meurtrière en 2011, réconciliation nationale poussive et, depuis 2016, mutineries dans les rangs d’une armée composite et de transition. La présente étude considère ces élections ivoiriennes de 2010 comme un objet d’étude scientifique et se consacre à la communication politique de campagne de trois « grands candidats » : Henri Konan Bédié du Parti Démocratique de Côte d’Ivoire (PDCI), Laurent Gbagbo de la Majorité Présidentielle (LMP) et Alassane Ouattara du Rassemblement Des Républicains (RDR). L’objectif scientifique est ici de déterminer les différents axes de communication partisane, qui éclairent le profil sociopolitique et le comportement de l’électeur ivoirien aux présidentielle de 2010. Plus spécifiquement, nos investigations sont consacrées, d’une part, à la détermination de l’électorat ivoirien dans sa composition sociale, politique et culturelle, mais aussi psychosociologique. Cet électorat est ici défini en termes d’intentions de vote, ou de motivation à voter pour tel ou tel candidat. D’autre part sont observés les moyens de communication utilisés par ces candidats majeurs qui deviennent des points structurants du champ politique ivoirien en s’endossant aux partis mandataires. Dans cette confrontation électorale pour capturer la majorité des voix interfèrent des représentations et des imaginaires politiques très marqués, qui consacrent ces candidats en challengers de la vie politique nationale et des sondages du moment. Ces enjeux affectent et différencient les stratégies de communication politique de campagne, que la thèse analyse en collectant les données et les ressources qui les influencent en sourdine et structurent autant les discours que les pratiques médiatiques des candidats étudiés. En clair, le contexte électoral de 2010 et ses déterminants sociohistoriques forgent les stratégies de communication et le comportement médiatique des candidats majeurs
At the end of the year 2010, the Ivorians organized a presidential election after a decade of civil war. Since then, these elections are still in the news because of their critical outcome: murderous post-electoral crisis in 2011, complicated national reconciliation and, since the year 2016, mutinies in the ranks of a composite and transitional army. This study considers the Ivorian presidential elections of 2010 as a social sciences study subject and is devoted to the political campaign communication of three "great candidates" : Henri Konan Bédié of the Democratic Party of Côte d'Ivoire (PDCI), Laurent Gbagbo of the Presidential Majority (LMP) and Alassane Ouattara of the Rally of Republicans (RDR). The scientific purpose here is to determine the different axes of partisan communication, which illuminate the socio-political profile and behavior of the Ivorian voter in the 2010 presidential election. More specifically, our investigations are devoted, on the one hand, to the determination of the Ivorian electorate in its social, political and cultural composition, but also psycho-sociological dimension. This electorate is here defined in terms of voting intentions, or motivation to vote for a particular candidate. On the other hand are observed the means of communication used by these major candidates who become structuring points of the Ivorian political field by endorsing the mandatory parties. In this electoral confrontation to capture the majority of voices, the study shows how interfere a very strong political representations and imaginings, which consecrate these candidates into challengers of national political life and polls of the moment. These issues affect and differentiate campaign political communication strategies, which the thesis analyzes by collecting data and resources that influence them below and structure both the speeches and the media practices of the candidates studied. Clearly, the electoral context of 2010 and its sociohistorical determinants forge communication strategies and the media behavior of major candidates

Abstract:
During the Peninsular War (1808-1814) the Spanish launched an unprecedented guerrilla insurgency that undermined Napoleon’s grip on that state. The advent of this novel and illegal “system” of warfare ushered in an era of military studies on the use of unconventional strategies in military campaigns – and changed the modern rules of war. A generation later during the Mexican-American War (1846-1848), Henry Halleck and Winfield Scott used the knowledge from the Peninsular War to implement an innovative “conciliatory” counterinsurgency program directed at the Mexican people – which set the U.S. doctrinal standard informing an international consensus on the proper conduct for occupation. The Spanish war against the French influenced both belligerents in Mexico: the Mexicans tried to mount a guerrilla war modeled along Spanish lines, and the Americans adapted their tactics, rules, and laws of war between 1808 to 1848 to avoid the disastrous imperial overreach exemplified by the French in Spain.
Durante la Guerra de la Independencia (1808-1814), los españoles lanzaron una insurgencia guerrillera sin precedentes que socavó el control de Napoleón sobre ese estado. El advenimiento de este “sistema” de guerra novedoso e ilegal marcó el comienzo de una era de estudios militares sobre el uso de estrategias no convencionales en campañas militares, y cambió las reglas modernas de la guerra. Una generación más tarde, durante la Guerra México-Estadounidense (1846-1848), Henry Halleck y Winfield Scott utilizaron el conocimiento de la Guerra Peninsular para implementar un innovador programa de contrainsurgencia "conciliador" dirigido al pueblo mexicano, que estableció el estándar doctrinal de los Estados Unidos informando a un consenso internacional sobre la conducta adecuada para la ocupación. La trame de base de l’étude est essentiellement linguistique et la plupart des catégorisations des éléments relevés sont de cet ordre également, l’étude prenant en compte le langage sous son aspect pragmatique dans les limites de la présentation des situations particulières ainsi que du collationnement des données du corpus.

Deux types de messages ont été choisis :des messages oraux laissés par des appelants sur répondeur téléphonique et des messages – provenant de nouveaux utilisateurs – recueillis dans des forums de discussion sur Internet.

L’analyse permet de préciser les souhaits et intentions communicationnels des émetteurs ;d’autre part le relevé des éléments constitutifs du corpus auquel nous avons procédé dans la seconde partie nous a permis d’entrer plus avant dans sa description.

L’énonciation est à l’énoncé ce que le processus de fabrication est à l’objet produit ;l'énoncé est le résultat alors que l'énonciation est l'acte de création du locuteur. C’est cet acte, la procédure de construction du message, les intentions du locuteur, les marques de son intervention en tant que sujet parlant – ses pensées, ses intentions, ses émotions au moment de la « prise de parole » (orale ou écrite) – qui ont fait l’objet de notre propos. Dès lors, les éléments de base du schéma de la communication ont été posés et les particularités de notre corpus explicitées à la suite d’un double choix :celui des outils d’analyse réellement utiles à la démarche et celui des éléments essentiels et nécessaires constitutifs des énoncés retenus et à retenir.

L’énonciation et l’énoncé

Le travail porte sur l’analyse d’un certain type de discours à l’intérieur d’actes de communication sur base d’énoncés, produits d’un acte d'énonciation, qui comportent des marques énonciatives faisant référence à la fois au locuteur et à l'allocutaire.

Il en est tenu compte lors de la description du corpus car les éléments retenus portent non seulement sur la structuration phrastique de l’énoncé mais également sur le sens qui lui est donné ainsi que ses utilisations caractéristiques en fonction des intentions, choix et motivations des destinateurs.

Le sens et le son

La considération du langage sous sa double articulation favorise une analyse appariant les points de vue sémantique et phonologique :le sens et le son.

THESIS ABSTRACT CANDIDATE:SHU-MEI CHUNG TITLE:THE DISCURSIVE PRACTICE OF THE VICTORIAN CODE OF CONDUCT IN THACKERAY’S HENRY ESMOND AND THE VIRGINIANS: A “NEWER” HISTORICIST READING DEGREE: Ph. D. SUBMITTED: JULY 2016 Focusing on close reading of William M. Thackeray’s novel, The History of Henry Esmond, and its sequel, The Virginians: The Tale of the Last Century, I explore Thackeray’s reflections on and criticism of the Victorian code of conduct under the framework of the discursive practice of the gentleman (and gentlewoman), based on Michel Foucault’s theory of discourse, potentially and ideally leading to a “Newer” Historicist approach proposed by Chung-Hsiung Lai in his “Limits and Beyond: Greenblatt, New Historicism and a Feminist Genealogy” and Fernand Braudel’s perspective of the moyenne durée (middle duration), a period of time spanning hundreds of years. Another work of Thackeray’s, Vanity Fair, and two other Victorian writers’ works, including Alfred Tennyson’s The Princess and Oscar Wilde’s An Ideal Husband, are examined in detail to prove that this discursive practice can be seen not only in these two works of Thackeray’s but others as well. The term Victorianism has been frequently used in a derogatory manner. Yet, my aim is to illustrate that, perhaps overly driven by their conscience, the Victorian people were quite valorous and straightforward in self-scrutinizing so-called Victorian attitudes. Accordingly, it can be said that modern commentary on Victorian attitudes simply follows the acute faultfinding and overwhelming scorn raised by many thinkers and writers of literary texts in the Victorian age (Abrams, A Glossary, 329), and Thackeray was definitely a very notable one of these. The study of Thackeray’s novels Henry Esmond and The Virginians thus interacts with the development of “Newer” Historicism—Foucault’s discursive practice. I examine under what circumstances these two historical novels go in providing a fundamental critique of the sexual and political ideologies of the Victorian age; to what extent this discursive practice of literary texts actually contains critical energies; and in doing so prove that what makes Thackeray so ‘Thackerayish’ is exactly his peculiar “individuality and value” (18), a point suggested by René Wellek and Austin Warren in Theory of Literature, which makes him stand out from his contemporary counterparts. Richard Nixon’s trip to China in February 1972 marked a diplomatic breakthrough for Sino-American relations after two decades of mutual animosity since the Korean War. Nevertheless, the bilateral relations underwent a long stalemate in the mid-1970s, before the United States and China finally reached normalization of relations in December 1978. The scholarship on Sino-American relations in the 1970s tends to focus on Nixon’s visit or normalization of relations, without paying adequate attention to how Washington and Beijing dealt with the mid-decade deadlock. My report addresses this gap in the literature by analyzing the changing dynamism of Sino-American relations, determined first by Henry Kissinger and Mao Zedong, and later by Zbigniew Brzezinski and Deng Xiaoping. Kissinger sought to establish a triangular relationship with the Soviet Union and China, where the United States could manipulate the Sino-Soviet antagonism to improve its relations with both communist giants. With the failure of his initial idea of creating an anti-Soviet united front with Washington, Mao, through his Three World theory, championed the Third World struggle against both superpowers in competition for global hegemony in the disguise of détente. With Kissinger clinging to superpower détente and Mao determined to maintain a revolutionary China, their strategies were doomed to a stalemate. Unlike Kissinger, Brzezinski tried to create a bilateral structure, where the United States cooperated with China to confront the Soviet Union, which expanded its influence globally despite ongoing détente. Unlike Mao, Deng sought to replace revolution with development as China’s national agenda, by emphasizing modernization, instead of the Three World theory, in Chinese foreign policy. Their global strategies necessitated mutual cooperation, creating momentum for normalization negotiations, especially after Brzezinski’s trip to China in May 1978. The shifting dynamism in Sino-American relations from the Kissinger-Mao years to Brzezinski-Deng years, therefore, precipitated normalization of relations in the late 1970s.

Abstract:
This thesis is dedicated to the rupture between Henry A. Wallace and Truman's administration during the forties of the twentieth century, that is mainly to the Wallace's disagreement with the Democratic Party regarding U. S.-Soviet relations. Disapproval of the former Roosevelt's vicepresident with the official standing of the American foreign policy ultimately lead to his presidency candidacy in 1948 and to the creation of protest Progressive Party, which was supposed to shield this candidacy. The purpose of the thesis was to ascertain to what degree these events had been formed by the commencing Cold War and on the contrary which role was played by Wallace and his followers. In the thesis, I analyzed Wallace's shift in opinion towards Soviet Union, determinants of his viewpoint and direct causes of his leave from Democratic Party. I devoted to the circumstances leading to creation of the Progressive Party, its structure and the role of communists in this process. The core theme is presidential campaign in 1948 and analysis of the reasons behind Wallace's defeat; one chapter is devoted to the reflection of this campaign in the forming Eastern Bloc, including its propaganda employment in the communist media press. Abstract:
American jurisprudence currently applies two incompatible validity standards to determine which laws are enforceable. The natural law tradition evaluates validity by an uncertain standard of divine law, and its methodology relies on contradictory views of human reason. Legal positivism, on the other hand, relies on a methodology that commits the analytic fallacy, separates law from its application, and produces an incomplete model of law. These incompatible standards have created a schism in American jurisprudence that impairs the delivery of justice. This dissertation therefore formulates a new standard for legal validity. This new standard rejects the uncertainties and inconsistencies inherent in natural law theory. It also rejects the narrow linguistic methodology of legal positivism. In their stead, this dissertation adopts a pragmatic methodology that develops a standard for legal validity based on actual legal experience. This approach focuses on the operations of law and its effects upon ongoing human activities, and it evaluates legal principles by applying the experimental method to the social consequences they produce. Because legal history provides a long record of past experimentation with legal principles, legal history is an essential feature of this method. This new validity standard contains three principles. The principle of reason requires legal systems to respect every subject as a rational creature with a free will. The principle of reason also requires procedural due process to protect against the punishment of the innocent and the tyranny of the majority. Legal systems that respect their subjects' status as rational creatures with free wills permit their subjects to orient their own behavior. The principle of reason therefore requires substantive due process to ensure that laws provide dependable guideposts to individuals in orienting their behavior. The principle of consent recognizes that the legitimacy of law derives from the consent of those subject to its power. Common law custom, the doctrine of stare decisis, and legislation sanctioned by the subjects' legitimate representatives all evidence consent. The principle of autonomy establishes the authority of law. Laws must wield supremacy over political rulers, and political rulers must be subject to the same laws as other citizens. Political rulers may not arbitrarily alter the law to accord to their will. Legal history demonstrates that, in the absence of a validity standard based on these principles, legal systems will not treat their subjects as ends in themselves. They will inevitably treat their subjects as mere means to other ends. Once laws do this, men have no rest from evil.
