Abstract:
Throughout his academic career Louis Cullen’s main research interest has been foreign trade - originally that of England, Ireland and France, but from the mid-1990s, his focus turned to Japanese history resulting in his critically acclaimed A history of Japan 1582–1941: Internal and External Worlds. Subsequently, he concentrated on the analysis of archival sources and of the problems they pose for the interpretation of Japanese history: papers on some of these themes and their associated statistical dimensions have appeared in Nichibunken’s Japan Review and are republished here together with a collection of other papers including interpreting Tokugawa history and the knowledge and the use of Japanese by the Dutch on Dejima island.

Abstract:
John Henry Newman’s career in Ireland is overshadowed by the later publication of The Idea of a University (1873), one of the most enduringly influential works on the philosophy of higher education. Yet it is impossible to fully understand that book—or Newman’s career as an educator—without a close examination of his experience as rector of the Catholic University of Ireland between 1851 and 1858. In its service Newman wrote the lectures and occasional pieces that became the Idea, but also confronted the challenges of establishing and running a new university while navigating the unfamiliar political, ecclesiastical, and social terrain of Ireland. His administration and philosophy were both informed by his experience of Oxford, and Newman at times struggled to adapt to Irish realities. He found elements of the Irish Catholic hierarchy to be obstructive, and he failed to maintain a working relationship with his patron, Archbishop Paul Cullen of Dublin. Despite its initial promise and substantial financial resources, the Catholic University of Ireland quickly struggled and ultimately failed, an outcome Newman blamed on others. In reality the University’s fate was influenced by a number of causes, including Irish obstructionism, Newman’s own personality, and the refusal of the British government to grant it a charter to award degrees.

Abstract:
Drawing on historical, literary and cultural studies perspectives, this book examines the phenomenon of the “Returned Yank” in the cultural imagination, taking as its point of departure the most exhaustively discussed Returned Yank narrative, The Quiet Man (dir. John Ford, 1952). Often dismissed as a figure that embodies the sentimentality and nostalgia of Irish America writ large, this study argues that the Returned Yank’s role in the Irish cultural imagination is much more varied and complex than this simplistic construction allows. Throughout the twentieth century and into the twenty-first, s/he has been widely discussed in broadcast and print media, and depicted in plays, novels, short stories and films. The imagined figure of the Returned Yank has been the driving impetus behind some of Ireland's most well-known touristic endeavours and festivals. In the form of U.S. Presidential visits, s/he has repeatedly been the catalyst for questions surrounding Irish identity. Most significantly, s/he has been mobilised as an arbiter in one of the most important debates in post-Independence Ireland: should Ireland remain a "traditional" society or should it seek to modernise? His/her repeated appearances in Irish literature and culture after 1952 – in remarkably heterogeneous, often very sophisticated ways – refute claims of the “aesthetic caution” of Irish writers, dramatists and filmmakers responding to the tradition/modernity debate.

Full text
Abstract:
This chapter discusses the structure and devolution of the UK. It first sketches the constitutional history of the UK, presenting a brief outline of events that led to the creation of the UK, i.e. the union of England, Wales, Scotland, and Northern Ireland. The chapter then examines the issue of devolution, which has been particularly important to the people of Scotland and Wales. The key provisions of the devolution legislation enacted in 1998 and more recent legislative developments are reviewed. The chapter concludes by considering the ‘English Question’ and the agreements between the UK Government and the devolved administrations in Scotland, Wales, and Northern Ireland.

O’Leary, Brendan. A Treatise on Northern Ireland, Volume I. Oxford University Press, 2019. http://dx.doi.org/10.1093/oso/9780199243341.001.0001.

Full text
Abstract:
O’Leary’s authoritative treatment of the history of Northern Ireland and its current prospects is genuinely unique. Beginning with an in-depth account of the scale of the recent conflict, he sets out to explain why Northern Ireland recently had the highest incidence of political violence in twentieth-century western Europe. Volume 1 demonstrates the salience of the colonial past in accounting for current collective mentalities, institutions, and rivalrous animosities, culminating in a distinct comparative account of the partition of the island in 1920. The major moments in the development of Irish republicanism and Ulster unionism are freshly treated by this Irish-born political scientist who has spent thirty-five years mastering the relevant historiography. Volume 2 shows how Ulster Unionists improvised a distinctive control system, driven by their fear of abandonment by the metropolitan power in Great Britain, their anxieties about Irish nationalist irredentism, and their inherited settler colonial culture. British political institutions were exploited to organize a sustained political monopoly on power and to disorganize the cultural Catholic minority. At the same juncture, the Irish Free State’s punctuated movement from restricted dominion-level autonomy to sovereign republican independence led to the full-scale political decolonization of the South. Irish state-building had a price, however: it further estranged Ulster Unionists, and Northern nationalists felt abandoned. Volume 3 unpacks the consequences and takes the reader to the present, explaining Northern Ireland’s distinctive consociational settlement, accomplished in 1998, and its subsequently turbulent and currently imperiled implementation. An assessment of the confederation of European Union and the prospects for an Irish confederation close the book, which vividly engages with feasible futures that may unfold from the UK’s exit from the EU.

Full text
Abstract:
Since its first edition in 1985, The Changing Constitution has provided analysis of the key issues surrounding the UK’s constitutional development, and debates around reform. The ninth edition of this volume is published at a time of constitutional turbulence, with Brexit putting pressure on key aspects of the UK’s unwritten constitutional system. Other aspects of the UK constitution are also in a state of flux, and continue to generate political and legal controversy: the legal protection of human rights, understanding of parliamentary sovereignty and the rule of law, separation of powers, restructuring of the system of justice, the regulation of access to information and data privacy, and pressures for increased devolution to Scotland, Wales and Northern Ireland. These issues and more are covered in this latest edition of one of the UK’s leading texts on the constitution, which includes contributions from a range of leading public law scholars.

Abstract:
Cases & Materials on Constitutional and Administrative Law is an invaluable resource. Extracts have been chosen from a wide range of historical and contemporary cases and materials to illustrate the reasoning processes of the courts and to show how legal principles are developed. The extracts from the leading cases in the field are combined with legal, political, and philosophical materials and linked together with explanatory text, alongside extensive notes and questions for discussion. The book takes a critical look at the main doctrines of constitutional law as well as the principles of administrative law, examining the operation of the constitution in relation to Parliament, the government, and the citizen. Incisive commentary throughout the text provides explanation and analysis of the key issues and challenges in constitutional and administrative law. The thirteenth edition has been fully revised and updated to reflect the latest developments in legislation, case law, and politics, including the process and implications of exiting the EU, and the UK’s new post-Brexit legal arrangements; continuing change and challenges to the devolution settlement in Scotland, Wales and Northern Ireland; major Supreme Court decisions in Miller (No.2) / Cherry, UNISON, the Scottish Continuity Bill Reference, and Privacy International; new developments in relation to ministerial responsibility and parliamentary accountability (including the impact of the coronavirus pandemic); proposed repeal of the Fixed-term Parliaments Act 2011; and discussion of proposals for reforms of judicial review and tribunal appeal processes, as well as proposed reform of ombudsmen. This text continues to provide instant access to an unrivalled collection of up-to-date judgments, statutory provisions, official publications, and other policy materials.

Abstract:
This book is the first comprehensive history of the anti-diphtheria campaign and the factors which facilitated or hindered the rollout of the national childhood immunization programme in Ireland. It is easy to forget the context in which Irish society opted to embrace mass childhood immunization. Dwyer shows us how we got where we are. He restores Diphtheria’s reputation as one of the most prolific child-killers of nineteenth and early twentieth-century Ireland and explores the factors which allowed the disease to take a heavy toll on child health and life-expectancy. Public health officials in the fledgling Irish Free State set the eradication of diphtheria among their first national goals, and eschewing the reticence of their British counterparts, adopted anti-diphtheria immunization as their weapon of choice. An unofficial alliance between Irish medical officers and the British pharmaceutical company Burroughs Wellcome placed Ireland on the European frontline of the bacteriological revolution, however, Wellcome sponsored vaccine trials in Ireland side-lined the human rights of Ireland’s most vulnerable citizens: institutional children in state care. An immunization accident in County Waterford, and the death of a young girl, raised serious questions regarding the safety of the immunization process itself, resulting in a landmark High Court case and the Irish Medical Union’s twelve-year long withdrawal of immunization services. As childhood immunization is increasingly considered a lifestyle choice, rather than a lifesaving intervention, this book brings historical context to bear on current debate.

Abstract:
Hayes and Williams’ Family Law, now in its sixth edition, provides critical and case-focused discussion of the key legislation and debates affecting adults and children. The volume takes a critical approach to the subject and includes ‘talking points’ and focused ‘discussion questions’ throughout each chapter which highlight areas of debate or controversy. The introductory chapter within this edition provides a discussion of the law’s understanding of ‘family’ and the extent to which this has changed over time, a detailed overview of the meaning of private and family life within Article 8 of the ECHR, and a discussion of the Family Justice Review and subsequent developments. Part 1 of this edition, supplemented by the ‘Latest Developments’ section, outlines the most up-to-date statistics on the incidence of marriage, civil partnerships and divorce, discusses recent case law on the validity of marriage such as Hayatleh v Mofdy [2017] EWCA Civ 70 and K v K (Nullity: Bigamous Marriage) [2016] EWHC 3380 (Fam), and highlights the recent Supreme Court decision (In the Matter of an Application by Denise Brewster for Judicial Review (Northern Ireland) [2017] 1 WLR 519) on the pension rights of unmarried cohabitants. It also considers the litigation concerning the prohibition of opposite-sex civil partnership registration from the judgment of the Court of Appeal in Steinfeld and Keidan v Secretary of State for Education [2017] EWCA Civ 81 to the important decision of the Supreme Court in R (on the application of Steinfeld and Keidan) (Application) v Secretary of State for International Development (in substitution for the Home Secretary and the Education Secretary) [2018] UKSC 32. This edition also provides an in-depth discussion of the recent Supreme Court decision in Owens v Owens [2018] UKSC 41 regarding the grounds for divorce and includes discussion of Thakkar v Thakkar [2016] EWHC 2488 (Fam) on the divorce procedure. Further, this edition also considers the flurry of cases in the area of financial provision on divorce such as Waggott v Waggott [2018] EWCA Civ 722; TAB v FC (Short Marriage: Needs: Stockpiling) [2016] EWHC 3285; FF v KF [2017] EWHC 1903 (Fam); BD v FD (Financial Remedies: Needs) [2016] EWHC 594 (Fam); Juffali v Juffali [2016] EWHC 1684 (Fam); AAZ v BBZ [2016] EWHC 3234 (Fam); Scatliffe v Scatliffe [2016] UKPC 36; WM v HM [2017] EWFC 25; Hart v Hart [2017] EWCA Civ 1306; Sharp v Sharp [2017] EWCA Civ 408; Work v Gray [2017] EWCA Civ 270, and Birch v Birch [2017] UKSC 53. It also considers the recent decision of the Supreme Court in Mills v Mills [2018] UKSC 38 concerning post-divorce maintenance obligations between former partners, and the Privy Council decision in Marr v Collie [2017] UKPC 17 relating to the joint name purchase by a cohabiting couple of investment property.Part 2 focuses on child law, examining the law on parenthood and parental responsibility, including the parental child support obligation. This edition includes discussion of new case law on provision of child maintenance by way of global financial orders (AB v CD (Jurisdiction: Global Maintenance Orders)[2017] EWHC 3164), new case law and legislative/policy developments on section 54 of the Human Fertilisation and Embryology Act 2008 (parental orders transferring legal parenthood in surrogacy arrangements), and new cases on removing and restricting parental responsibility (Re A and B (Children: Restrictions on Parental Responsibility: Radicalisation and Extremism) [2016] EWFC 40 and Re B and C (Change of Names: Parental Responsibility: Evidence) [2017] EWHC 3250 (Fam)). Orders regulating the exercise of parental responsibility are also examined, and this edition updates the discussion with an account of the new Practice Direction 12J (on contact and domestic abuse), and controversial case law addressing the tension between the paramountcy of the child’s welfare and the protected interests of a parent in the context of a transgender father’s application for contact with his children (Re M (Children) [2017] EWCA Civ 2164). Part 2 also examines the issue of international child abduction, including in this edition the Supreme Court’s latest decision, on the issue of repudiatory retention (Re C (Children) [2018] UKSC 8). In the public law, this edition discusses the Supreme Court’s clarification of the nature and scope of local authority accommodation under section 20 of the Children Act 1989 (Williams v London Borough of Hackney [2018] UKSC 37). In the law of adoption, several new cases involving children who have been relinquished by parents for adoption are examined (Re JL & AO (Babies Relinquished for Adoption),[2016] EWHC 440 (Fam) and see also Re M and N (Twins: Relinquished Babies: Parentage) [2017] EWFC 31, Re TJ (Relinquished Baby: Sibling Contact) [2017] EWFC 6, and Re RA (Baby Relinquished for Adoption: Final Hearing)) [2016] EWFC 47).
