Full textThe Criminal Code of 1810 was neutral neither in its principles nor in its implementation. Gender goes througt the wole judicial process. In Haute-Garonne, between 1864 and 1914, those accused of intentional homicide (murder, assassination, infanticide,parricide, poisoning and attempts to commit these crimes) were subjected to the test of a net that mainly retained in its mesh men and women from the working classes. The most privileged were less vulnerable to justice. Men were more expected and wanted for the blood crimes, except for infanticides, for which mothers were almost exclusively suspected. This distribution of accused persons is partly the result of gender stereotypes, based in particular on the naturalizing science of the time. In the 19th century, the individualisation of sentences encouraged the judgment of persons (more than crimes), but the criteria for assessing reputation and morals which influenced the verdicts handed down, the requisitions set out by the Advocate General, and the defence strategies of lawyers differed according to the sex of the accused. The lexicon, used by court reporters (who reported on trials for their journals), investigating judges and prosecutors, is also gendered. To talk about morality or sexuality is to assign differentiated roles to men and women, and to presume a gendered hierarchy. By putting violence into words, magistrates built a gratuated scale of value from acceptable to intolerable and often mitigated violence by women. Full textBetween the 1950s and the beginning of the 21st Century, the Cour des comptes (the French Audit Office), an administrative and financial court and grand corps de l’État whose members are primarily recruited among the top-students of the École nationale d’administration (ENA), has had a peculiar trajectory. While its mandate previously entailed verifying the proper handling of public money, it gradually expanded to include duties deemed more political, such as evaluating public policies. Furthermore, the Cour became a highly-publicized institution. In other words, the magistrates modernized their role, gained new audiences (Parliament, media) and blurred the line between bureaucracy and politics. Eschewing traditional approaches of the grands corps de l’État that focus on how agents circulate within and outside the French State, this dissertation argues that Cour members have institutionalized their auditing and report writing duties in order to strengthen their position at the highest levels of the State. It draws on interviews, oral histories, written archives, ethnography and the analysis of press and official reports, and combines sociological approaches of organizational reputation and institutions. This work first shows how, within a broader context where the State itself was transforming, the role of the magistrates changed as the Cour’s power evolved. It then explains how new and more diverse audiences legitimated and used the expertise of the Cour. Finally, it examines how official reports are produced and received, and in such analyzes how a public institution can lastingly be recognised as “neutral”

Full textIn Rome, the delegations of the participating States agreed that the International Criminal Court (ICC) would only exercise jurisdiction regarding crimes set out in the Statute provided that these crimes were committed on the territory, on board a vessel or aircraft or by a national of a State Party, as stressed in article 12, § 2 of the Statute. This mechanism, which was drafted in the very last hours of the Conference, left open many critical issues. Since then, the scope and content of this provision is the subject of heated debate. These gaps, and the concern they raised until now, have perpetuated the persisting misunderstanding about the ICC and seem to undermine the clarity of the Court’s mission. The study helps to assess the state of the law on the criminal issues that remain so far. As a first step, it aims at clarifying, on the basis of an extensive review of the case-law and practice, the concepts of territorial and personal links defined in the Rome Statute, by marking out their contours and determining their substance. Secondly, it will be demonstrated how these two grounds of jurisdiction set out in the Rome Statute allow the ICC to lawfully expand its jurisdiction, both vis-à-vis State Parties as well as non-Party States

Full textIn the late 20th century, politico-financial scandals and the contaminated blood case formalized the opposition of the public opinion to the immunity-impunity granted to rulers viewed as "liable” but “not guilty”. The recurrent controversy over the legitimacy of the immunities given to the representatives of the nation or their officers was thus rekindled. As the law does offer some guarantees of impartiality to ordinary citizens to be tried, the question is whether it does not provide enough protection for authorities. In that case, should public deciders benefit from increased protection against criminal law ? The answer depends or whether the case is considered from the standpoint of the democratic logic or the representative one. While the former recommends subjecting government officials to criminal law as the expression of the general will, the latter makes it legitimate to apply exceptional arrangements to them. How does substantive law settle the question? Has public law chosen either logic ? Does the specificity of the offices involved not entitle government officials to some immunities ? Are such immunities not likely to promote the drift of popular representation toward oligarchy ? To what extend can they be reconciled with democratic values ? This thesis will attempt to answer such questions

Full textAt first glance, the title refers to the judicial activity of the Cour des pairs (1814-1848) and the Senate of the Third Republic (1875-1940). These are the most striking involvements of French legislative bodies in rendering justice. The trials of the ending Restauration ministers, and the one of Louis Malvy seem to be well known, but in reality these are only imperfectly so. In both cases, the upper house has turned away from its initial mission of legislator and supervisor of the government to transform itself, in a very incomplete way, into criminal courts. However, study only these two cases is not enough to define the mission of a parliamentary jurisdiction. The concept of Haute Cour de justice must therefore be understood in its entirety and in its history. A history which, like many others, is marked by the Revolution, which will influence the 19th and 20th centuries, and set a French prototype of political court. These Hautes Cours possess special competencies: ratione personae et ratione materiae. They judge politicians, but since the Revolution one foresees the difficulty of doing so with criminal law, which is hardly suited to the resolution of political disputes. Finally, the French Haute Cour is also a tribunal for major political crimes, namely, serious attacks on sovereignty. It is thereforce a question of recount the history of the “Tribunal supreme” in order to reveal the concept of political justice as an aporia

Full textThe River Selle is a non-channelised stream in the Artois-Picardy basin and is considered as a priority waterbody by the Artois-Picardy Water Agency. The aim of this work was to study the spatio-temporal behaviour of several substances at different time scales, ranging from low-frequency (grab sampling, passive samplers) to high-frequency monitoring. More specifically, tracers of pollution reflecting urban, agricultural and industrial contamination (nitrates, phosphates, trace metal elements, pesticides, pharmaceutical residues, dissolved organic matter) were investigated. We confirmed that the River Selle is mainly fed by a nitrate-rich groundwater. Besides, the nitrates and atrazine concentrations in the river water were similar to those found in the groundwater. At the upstream of the river, the land-use is mainly dominated by agriculture whereas most of the urban islets are located at the downstream of the river. Consequently, during dry weather, ultra-trace concentrations of some pesticides and pharmaceutical residues were recorded and phosphate levels often exceeded 0.2 mg L-1. Due to the minor flow input of the wastewater treatment plants into the river, metallic contamination in the River Selle (particularly Gd and Zn) is quite low despite the high concentrations measured in wastewater effluents. Water quality issues during storm events were identified by high-frequency monitoring. Significant but time-limited peaks in phosphorus and organic carbon were observed, while nitrates were diluted. The composition of dissolved organic matter was studied by fluorescence spectroscopy. The spectral signature of different types of water (groundwater, surface water and wastewater effluents) was characterised as well as the origins of this organic matter (autochtonous vs allochthonous). Finally, these results enable to discuss qualitatively the future effects of climate change at a regional scale on the evolution of the water quality of the River Selle

Full textThe aim of this thesis is the evolution of the fluvial dynamics of a braided river through space and time. The Buech River is a tributary of the durance river located in the Southern Alps. In the first part of the study, the spatial variations of the fluvial system are examined. Old maps (18th century) allow a morphometric analysis of the fluvial forms. This description shows the great variability of breading. The diachronic study from the 18th century to the 20th century reveals a first increase in the fluvial activity between 1780 and 1830 and a renewal of this activity during the second half of the 19th century. This first part ends with the description of the morphogenic disruption since 1960. The second part of the thesis is involved with the origins of this historical change. At the end of the 18th century and during the second half of the 19th century, floods of high energy and frequency are responsible for the increase in the fluvial morphogenesis. Since 1886, floods with such intensity have disappeared. From 1950 on, gravel extraction causes a considerable impact on the river bed. The end of the second part concerns the historical change of sediment delivery. According to old maps (premier cadastre) and old pictures, it seems that the landscape evolution and variations in the activity of the Buech tributaries are unequal, depending on the catchment. The third part of the thesis describes the fluctuations of dynamics through Holocene. From the Preboreal to the Atlantic period, a long stage of aggradation creates specific deposits. The analysis of the sedimentary characteristics allows a tentative interpretation

Full textElectron emission in vacuum from a cathode at high voltage is an important physical phenomenon for the study of vacuum breakdown or electron sources. In the vacuum breakdown, the first step of this mechanism is electron emission at the top of the microprotrusions on the surface. Microprotrusions or emitters in electron sources have the shape of a tip. A numerical model describing the thermo-field emission has been developed for a 2D axisymmetric tip. The problem is multi-physical and it is necessary to solve problems of different natures: quantum mechanics, electrostatic, electric current and thermal heating. With this model, it is possibleto study electron emission and vacuumbreakdown when nanosecond high voltage pulses are applied. Furthermore, the study of electron emission when a picosecond pulsed laser illuminates a high voltage cathode has been performed. A new model has been developped to describe the photo-electric effect and a two-temperature model has been implemented to describe the heating of the cathode in a non-equilibrium regime. Finally, the modeling of the interaction between microparticles and electron emission from microprotusions has been realised, in order to study the breakdown voltage. Different trajectories of microparticles have been identified based on the results, depending on the electron emission current

Full textThe objective of the Phd is to adapt the RTM process to high fluidity thermoplastic polymer, conserving high production rate, as required in the automotive industry. Some innovative polymers with a viscosity 50 to 1000 times lower than traditionally used polymers in thermoplastic injection are adapted to RTM injection, nevertheless, the viscosity is 10 to 100 higher than thermoset resins traditionally used for the RTM process. The injection of these polymers in fibrous preforms can induce high pressures that could generate deformations of the fibrous fabric reinforcement. To optimize the injection pressure and guarantee a short process cycle, it becomes crucial to study the resistance of the fibrous media enduring fluid flow stress. A deepen experimental analysis is realized so as to understand the mechanism of the problem. An analytical model is suggested and allows calculation of the limitating flow rate for a frontal injection. This aims at avoiding displacements of the fabric reinforcement or its constituting yarns

Full textA 2 m profile of intramoraimc organic sediments was cored from the Evian high plateau. Pollen, plant macrofossils and insect remains were used to reconstruct the local palaeoenvironment, which may be compared with a mire surrounded by a dense Abies /Pvsa mixed forest. Moreover, the use of pollen and macrofossil data led necessarily to attribute this peat layer to the final Eemian. Pollen and radiometric analyses of four palaeolacustrine profiles have allowed us to reconstruct vegetation dynamics since the last ice retreat. According to palynostratigraphic and radiocarbon data, the last degladation would have occurred prior to the L. GM Isotopic and magnetic analyses have evidenced some climatic variability during the Lateglacial that had some impact on vegetation dynamics. Accordingly to the geomorphological context of the area, these new data indicate that the Wiirmian maximum of the Rhone glacier might have occurred earlier than assumed, and prior to the Last Glacial Maximum

Full textHigh temperature selective oxidation of alloys usually results in substrate depletion. This phenomenon can be at the origin of stress corrosion cracking (SCC) initiation. To predict the depletion of the oxidizable element, a model based on diffusion in the substrate and fluxes balance at the oxide/alloy interface has been developed. The oxidation kinetics is used as input data of the model in order to drive the oxide/alloy interface displacement when the oxidizable element is "consumed" from the alloy.The depletion model presented in this work has been validated in the case of the oxidation at 850 °C of the Pt-Ni binary alloy by reproducing the Wagner's analytical solution. The two assumptions of a fixed concentration at the oxide/alloy interface, and of a diffusion coefficient homogeneous in the substrate and constant during oxidation, have been relaxed using finite difference method.An initial depletion of a binary alloy in oxidizable element (passivation, pre-oxidation) has a low impact on the substrate depletion evolution during high temperature oxidation. However, when the interdiffusion coefficient in the alloy is greater in subsurface than in the bulk (work-hardening), the oxidizable element concentration at the oxide/alloy interface decreases during the oxidation. Depletion profiles show an inflexion point due to faster diffusion close to the interface.Finally, the model has been applied to oxidation in aquaous media at a temperature of 290 °C to study Cr-depletion of alloy 690 in PWR primary water. Full textRivers are the object of legislation encouraging their restoration, and dam removal operations represent one of the solution to achieve it in France. Riparian vegetation plays a fundamental role in stabilizing and maintaining fluvial systems, being at the interface between terrestrial and aquatic environments. It is therefore a very important component which has to be evaluated in river restoration operations. One of the consequences of dam removal on riparian vegetation is the colonization of the dewatered sediments in the reservoir. The objective of the thesis are to define short term colonization dynamics of vegetation in context of dam removal (Sélune River, Normandy), and to develop long term indicators for the monitoring of riparian vegetation. First, an analysis of intra and interannual colonization dynamics revealed the potential of using drone images to map riparian vegetation, and fast successional dynamics with high passive restoration and sediment stabilization potential. Secondly, the analysis of 3D point clouds extracted from LiDAR data acquired in winter and summer highlighted the complementarity of the two acquisition dates to map indicators of riparian status at large scale, such as main riparian species, shading or density of herbaceous and shrubby strata. These results make it possible to discuss the methodological and operational dimensions of the use of remote sensing approaches for the monitoring of riparian vegetation

Full textOur knowledge of the mechanisms of acquisition of inland water chemistry is limited by the frequency of sampling that can be carried out in the field. Sampling a river every 15 days means neglecting a variability in its composition that is beginning to be suspected and which informs processes or variations of short-term sources integrated over the entire catchment area. The automation of sampling and real-time measurement is an important challenge not only from the point of view of understanding the mechanisms controlling water chemistry, their temporal dynamics, the relations between concentrations and flows, but also from the point of view of applied for the detection of point pollution. This development is of interest to water professionals who are not yet legally constrained, but who could become so.As part of the CRITEX team project, a prototype of a chemical house called "RiverLab", a real laboratory for real-time field analysis, was developed and installed in November 2014 on the experimental watershed of Orgeval, a site studied for 50 years by the IRSTEA teams. This prototype is intended to be deployed on two other sites of the national watershed network (SOERE device). We focus on the two main natural forces that have undergone a watershed, namely precipitation inputs and solar energy revisited in terms of high frequency
