Full textThe Criminal Code of 1810 was neutral neither in its principles nor in its implementation. Gender goes througt the wole judicial process. In Haute-Garonne, between 1864 and 1914, those accused of intentional homicide (murder, assassination, infanticide,parricide, poisoning and attempts to commit these crimes) were subjected to the test of a net that mainly retained in its mesh men and women from the working classes. The most privileged were less vulnerable to justice. Men were more expected and wanted for the blood crimes, except for infanticides, for which mothers were almost exclusively suspected. This distribution of accused persons is partly the result of gender stereotypes, based in particular on the naturalizing science of the time. In the 19th century, the individualisation of sentences encouraged the judgment of persons (more than crimes), but the criteria for assessing reputation and morals which influenced the verdicts handed down, the requisitions set out by the Advocate General, and the defence strategies of lawyers differed according to the sex of the accused. The lexicon, used by court reporters (who reported on trials for their journals), investigating judges and prosecutors, is also gendered. To talk about morality or sexuality is to assign differentiated roles to men and women, and to presume a gendered hierarchy. By putting violence into words, magistrates built a gratuated scale of value from acceptable to intolerable and often mitigated violence by women. Full textBetween the 1950s and the beginning of the 21st Century, the Cour des comptes (the French Audit Office), an administrative and financial court and grand corps de l’État whose members are primarily recruited among the top-students of the École nationale d’administration (ENA), has had a peculiar trajectory. While its mandate previously entailed verifying the proper handling of public money, it gradually expanded to include duties deemed more political, such as evaluating public policies. Furthermore, the Cour became a highly-publicized institution. In other words, the magistrates modernized their role, gained new audiences (Parliament, media) and blurred the line between bureaucracy and politics. Eschewing traditional approaches of the grands corps de l’État that focus on how agents circulate within and outside the French State, this dissertation argues that Cour members have institutionalized their auditing and report writing duties in order to strengthen their position at the highest levels of the State. It draws on interviews, oral histories, written archives, ethnography and the analysis of press and official reports, and combines sociological approaches of organizational reputation and institutions. This work first shows how, within a broader context where the State itself was transforming, the role of the magistrates changed as the Cour’s power evolved. It then explains how new and more diverse audiences legitimated and used the expertise of the Cour. Finally, it examines how official reports are produced and received, and in such analyzes how a public institution can lastingly be recognised as “neutral”

Full textIn Rome, the delegations of the participating States agreed that the International Criminal Court (ICC) would only exercise jurisdiction regarding crimes set out in the Statute provided that these crimes were committed on the territory, on board a vessel or aircraft or by a national of a State Party, as stressed in article 12, § 2 of the Statute. This mechanism, which was drafted in the very last hours of the Conference, left open many critical issues. Since then, the scope and content of this provision is the subject of heated debate. These gaps, and the concern they raised until now, have perpetuated the persisting misunderstanding about the ICC and seem to undermine the clarity of the Court’s mission. The study helps to assess the state of the law on the criminal issues that remain so far. As a first step, it aims at clarifying, on the basis of an extensive review of the case-law and practice, the concepts of territorial and personal links defined in the Rome Statute, by marking out their contours and determining their substance. Secondly, it will be demonstrated how these two grounds of jurisdiction set out in the Rome Statute allow the ICC to lawfully expand its jurisdiction, both vis-à-vis State Parties as well as non-Party States

Full textIn the late 20th century, politico-financial scandals and the contaminated blood case formalized the opposition of the public opinion to the immunity-impunity granted to rulers viewed as "liable” but “not guilty”. The recurrent controversy over the legitimacy of the immunities given to the representatives of the nation or their officers was thus rekindled. As the law does offer some guarantees of impartiality to ordinary citizens to be tried, the question is whether it does not provide enough protection for authorities. In that case, should public deciders benefit from increased protection against criminal law ? The answer depends or whether the case is considered from the standpoint of the democratic logic or the representative one. While the former recommends subjecting government officials to criminal law as the expression of the general will, the latter makes it legitimate to apply exceptional arrangements to them. How does substantive law settle the question? Has public law chosen either logic ? Does the specificity of the offices involved not entitle government officials to some immunities ? Are such immunities not likely to promote the drift of popular representation toward oligarchy ? To what extend can they be reconciled with democratic values ? This thesis will attempt to answer such questions
