Full textAs a fundamental driving force of public economy, public procurement has traditionally been an area of diverse and often competing interests. Such contradictory interests are the efficiency of budgetary management and transparency in public life within national legal systems, free competition and open access of financial stakeholders in award procedures within the European regulatory framework. At the same time, the instrumentalisation of public procurement in order to serve political goals not directly linked to it has triggered considerable debate. The attempt of conciliation of social and environmental considerations with the financial requirements of public procurement law aims at enhancing this legal and financial instrument. The role and the legal means for the integration of social and environmental considerations in public procurement, which serve general interest purposes and overriding European law objectives, have not yet been clarified. The regulatory interventions of the Member States, on the one hand, and the harmonization attempts of the European Union, on the other, create a constantly changing political climate. In that context, the role of social and environmental policies is redefined both within the framework of primary objectives of public procurement law, as well as outside this regulatory framework which is used as a policy tool in this context

Full textThe aim of the dissertation is the study of market procurement procedures in the water, energy, transport and telecommunication sectors, which sectors have been excluded from the community regulations of public procurement market until the September 17th,1990 ,90 531 directive, and this because of the heterogeneous character of the adjudicating entities concerned and because of the existence of privileged links with public powers. The first part analyses the content of the new regulations and the legal, national (in Belgium, France, Germany, Netherlands and Spain) and community background. In the second part, the study examines the enforcement of the community regulations for the above mentioned sectors as it results from general and specific mechanisms

Full textThe analysis of guilty plea procedures, in French and English laws, seems, on a prima facie ground, to raise some issues. The inquisitorial and the accusatorial model of criminal justice do not, due to their respective specificities, easily leave a breathing space for any comparative study. Yet, taking into account the European expansion, this assertion does not remain, nowadays, entirely true. Models of criminal justice, in most States governed by the rule of law, do not longer meet the initial dichotomy and gradually tend to be unified towards a standard model within “mixed” criminal justice systems essentially based on the adversarial and fair trial principles. In this perspective, the notion of pre guilty plea needs to be clarified. This notion asserts itself alongside with legislative reforms, thus becoming a genuine tool of criminal policy aiming at a better efficiency in the criminal process through a more prompt handling of criminal offences. Nevertheless, both in France and in England, the increasing resort to pre-guilty plea procedures requires a structural and organisational modification of criminal justice. As a consequence and regarding the global evolution of criminal justice systems, a general tendency has emerged introducing Public Prosecution authorities as the linchpin of the process. Safeguards should be provided in order to maintain a well-balanced criminal justice process, both efficient and legitimate

Full textPublic order is an evasive concept. In domestic legal systems as well as in the European legal system, it conveys diverse meanings. Nevertheless, it is a necessary concept. It is indeed irreducible to other similar concepts: unavailability, illegality and mandatory rules. Although it is hard to define, the concept of public order can be identified thanks to its singularity. Identification criteria such as the wording of the rule and its sanction are generally retained. They are however insufficient and can be usefully completed with the determination of the interest of the rule, the taking into account of its value and the putting of the rule into its context. Thus, the scope of public order being defined, this concept has undeniable advantages from a comparative viewpoint, which subject matter is the domestic legal systems of the European Union. It is a necessary notion for the harmonisation of law in general, and of commercial law in particular. Indeed, the harmonisation of commercial law has to abide by the rules of public order. These rules appear then as an element of explanation for past failures. Whether the obstacles to the harmonisation have been linked to a “structural public order” or to a “functional public order”, these obstacles can be explained by the diversity of the rules of public order. However more than an obstacle, the rules of public order constitute an element of union between the various domestic laws. The protection of some categories of individuals, the war against abuse and fraud, are indeed common goals that are better translated into rules of public order
