Full textAll people with intellectual disability have the right to vote. In fact, a law passed in 2019 granted the right to vote to all individuals under guardianship. The dignity due to every person decreed this opening. This right does not require any condition of capacity, both civil and material. Votes casted by people with intellectual disability are valid and do not affect the sincerity of the vote. It doesn’t cause any breach to the ballot sincerity. However, the effectivity of this right to vote is hindered by various obstacles, which go against the intrinsic dignity of people with intellectual disabilities. The biggest obstacles is a lack of accessibility to the voting process. Living in a facility specialized in intellectual disability, which is a common situation for intellectually disabled people, adds on difficulties to the polls inaccessibility. Therefore, the first important step will be to comply to all the legal accessibility rules. Better supervision of assisted voting should be provided, taking into account the particularities of intellectual disabilities. In addition, the enhancement of the “Prestation de compensation du handicap” (handicap compensation allowance) would enable people without voting solution to exercise their right to vote. All of these steps should help to better uphold the dignity of all people with intellectual disabilities

Full textPenal code article 122-1, paragraph 2, sets : "the person who was suffering, when the events occurred, from psychic or neuropsychic disorders altering his discernment faculties or affecting his own behaviour and acting control remains punishable; however, the court law does consider such circumstance when determining the sentence and defining the settlement". Is this clause a legalization of the previous jurisprudence observance consisting in mitigating the mentally abnormal delinquents' sentence? or is it a first step to a qualitative adaptation of their sentence, that is to say a step to a possible psychiatric adapted care, as a part of the punishment? the actual established difference between insane delinquents and mentally abnormal delinquents, the analysis of the "mitigated responsibility" concept, and the study of the real extent of care as part of the penal sanction, lead to a double conclusion. First of all, the penal code article 122-1 paragraph 2 taking into consideration the mental faculties alteration is consistent as long as the mitigate responsibility thus originates a punishment qualitative adaptation. On the other hand, we have to stress the insufficient practical consequences compared to what might be expected from such a concept. Indeed, there is no control that the judge actually takes into account the mental faculties alteration when determining the sentence. Besides, there are no specialized and adapted prisons, and there is no plan to make up for this, in spite of the bill, being subjected to parliament, which forecasts a therapeutic follow-up for sexual delinquents

Full textThe situation of the mentally challenged people inside the social space is a multiple-themes issue. This vast subject allows us to question the origin of every social organization. The text offers a study starting from the observation of a ritual which function is to prepare someone getting into adulthood. The participation of members from an organization specialized in the activities of a group called "Inter-unit of young adults" is the first step of an initiatory period which eventually leads to another stage of life. This study observes the ways of acquiring this new "adult" status and questions its contents. It tends to show that the development of a ritualized space, based on a principle of age, which is being of age, changes the organization of the institutional taking charge, making easier transmission, elaboration and adherence to the common values of the members of the institution. The ritual puts in a symbolical light the initiate in a social space giving him access to a process helping him towards autonomy. It conforms to the requirements of the initiation, as it is defined by ethnology, taking the initiate away from the childhood world. But the initiation stays "ambiguous" because its organization is restricted to the inside of the institution, therefore sending an individual back to the status of a mentally-handicapped person
