Abstract:
This article analyses the protections the New Zealand intellectual property framework provides for the haka and mātauranga Māori. Part II of this article defines the key terms of "misappropriation", "traditional knowledge" and "mātauranga Māori" in order for the reader to fully understand these concepts in an indigenous, and specifically Māori, context. Part III of this article discusses the importance and significance of haka in Māori culture, particularly looking at the history and significance of Ka Mate, the most well-known haka in New Zealand and the world. Examples of different companies, both New Zealand and internationally-owned, using the haka for commercial benefit are analysed to establish whether or not their use of the haka is misappropriation, and if so, the harm this misappropriation has caused Māori. Part IV discusses the current legal protections New Zealand provides for mātauranga Māori and whether they sufficiently protect the haka and mātauranga Māori generally. It will assess the Haka Ka Mate Attribution Act 2014 as a case study. Part V outlines the limitations of the intellectual framework. Part VI of this article looks to what legal protections would be sufficient to protect against the misappropriation of the haka and mātauranga Māori generally.

Digital era is a phenomenon that happening in the present and digital era is a technological advancement that is used by everyone. Haka Dimsum in conducting promotions in the digital era is the most important activity. The goal promotional activities carried out by Haka Dimsum is to trigger branding, it serves to provide an identity that has a characteristic of the product. To do the branding, Haka Dimsum creates contents in the form of photos and videos. Contents presented to the public, the contents have a role to convey the message by visual communication. This can be helped by using social media, especially Instagram because there are many users. This research discusses about, how to do branding analysis by Haka Dimsum with visual communication.This research method is done by way of case studies theory, which means learning more about a process in this research. This research aims to determine and describe the branding analysis conducted by Haka Dimsum through visual communication. The results of this research, can be seen with the interesting content like to tell a story and entertaining, can make audiences interested with the sales of product and interesting content is the most important part to do selling activity. Era digital adalah fenomena yang terjadi pada masa kini. Era ini merupakan kemajuan teknologi yang dimanfaatkan oleh semua orang. Haka Dimsum dalam melakukan promosi di era digital merupakan kegiatan terpenting. Kegiatan promosi yang dilakukan Haka Dimsum mempunyai tujuan untuk branding, hal tersebut berfungsi untuk memberikan identitas agar mempunyai ciri khas terhadap produk. Untuk melakukan branding Haka Dimsum membuat konten berupa foto dan video, konten yang disajikan kepada khalayak mempunyai peran untuk menyampaikan pesan yaitu dengan cara komunikasi visual. Hal tersebut dapat dibantu dengan menggunakan media sosial terutama Instagram karena penggunanya banyak. Penelitian ini mempunyai tujuan untuk mengetahui dan menggambarkan analisis branding yang dilakukan Haka Dimsum melalui komunikasi visual. Metode penelitian ini dilakukan dengan cara studi kasus yang berarti mempelajari lebih lanjut tentang suatu proses dalam penelitian ini. Penelitian ini dilakukan agar mengetahui dan menggambarkan branding Haka Dimsum melalui komunikasi visual. Hasil penelitian ini dapat diketahui bahwa dengan konten yang menceritakan dan menghibur dapat membuat khalayak tertarik dengan produk yang dijual dan betapa pentingnya ketika menjual produk dengan menggunakan ide konten yang menarik.

In the background where there are many factors affecting Japanese families such as the decrease of children, the change of family structures, gender concept, etc., "family'' has become a noticeable issue attracting much attention nowadays. The type of Japanese traditional family named "IE'' was officially regulated in the law during the Meiji period. After the war, the legal status of "IE'' was eliminated; however, in reality, "IE'' still remains popular. In fact, "IE'' is always considered an important keyword to understand the Japanese family system. In this paper, the author studies about the change of "IE'' through the research on the Japanese family grave "IE haka'' in Japan. "IE haka'' was formed based on "IE'' family background; therefore, doing research on the change of Japanese family grave "IE haka'' makes it possible to clarify the characteristics and trend of IE in Japan. The research outcomes showed that in the post-war period, "IE'' was no longer regulated in law; however, the stable sustainability of "IE haka'' system reflects that traditional family "IE'' has firmly rooted in Japan's culture and society until now. Meanwhile, in the current changing context, "IE haka'' shows deep basic changes including the increase of simple structures, simplification of ancestor worship rituals, etc. Through it, "IE'' could be seen to have fundamentally changed and even been predicted to decline in the future.

Abstract:
This paper makes an attempt to analyze the healing pain through dance in Dinesh Adhikari’s poem “Khuchching” by applying cultural trauma perspective. The poem’s idea is similar to New Zealand’s tribal dance Haka. The poem shows a poor and insurgency affected persona living with traumatic experience and fleeing away from his grief and finally takes refuge to dance which helps him relieve with pains and suffering. Similarly, Haka, a traditional dance of a tribal group – Maori, is performed to pacify the pain and helps them strengthen themselves to face more challenges and strife courageously. In doing so, I have used the critical insight of Caruth as well as cultural ingredients of Haka dance as theoretical parameters to analyze the primary text. Here, I examine the poem linking it with the aim of performing the tribal dance Haka which would, subsequently, help one get relief from personal trauma to the conflict generated consequences in the lives of affected people and their socio-political factors associated with contemporary Nepali society. Discussing the expected findings, this article centers on the common people’s aspirations and embedded peace in the society.

This paper studied the form of the family grave “ie haka” in Japan. Burying cremated ashes into family grave “ie haka” is the second stage of cremation, being practiced more than 90% in Japan. Through inheriting the result of precedence researches and material research, fieldwork of author, making clear the background, the characteristics, the present status, the trend in future, etc. of the family grave “ie haka” is the purpose of this paper. Among that, especially, emphasizing the “traditional characteristic”, which has been still the debate point among the researchers when studying about family grave “ie haka”. Through it, it is possible to understand the current burial method, as well as the religious consciousness, family… of Japan. And today, in Japan, in the background, many influencing factors such as family structure, religious beliefs concerning death, the afterlife, etc. has been changing outstandingly, the current status, change… of burial culture, including the family grave system “ie haka” has been the noticeable topic. This is also a significant keyword to understand Japanese society and culture. But in fact, it almost hasn’t been studied in Vietnam. With this research, I hope to contribute to the study of such related fields of Japan, as mentioned above. And relating with Vietnam, in the context of urbanization and industrialization, many problems of burial cemeteries has occurred, and instead of it, cremation has been received gradually. Based on that, the noticeable change, such as the process of changing from handling burial bodies to cremated ashes, increasing the outside service in ancestor worship practice, etc. has been brought. Like that, through the study about the case of Japan, the similarities, experiences, and application in solving related issues in Vietnam are hoped to be clarified.

Abstract:
This study used a reversal theory framework to examine motivational dominance and changes in motivational state, arousal, stress, and emotions among members of traditional Japanese (Nihon Odori Sports Science (NOSS)) and New Zealand (Kapa Haka) dance groups. Eighty-four participants (50 in Japan and 34 in New Zealand) completed questionnaires on each variable before and after a dance class. The findings indicated that the Kapa Haka dancers were significantly more playful and arousal-seeking than the NOSS dancers. They also reported higher overall arousal, preferred arousal, and effort during performance while the NOSS dancers became more serious afterward. Data on emotions matched those of arousal in that the Kapa Haka dancers felt significantly more excited and provocative after the session. The NOSS dancers were more relaxed and placid, both overall and after dancing. These patterns were consistent with the dancers’ respective motivational states and motivational dominance, and suggest that both dances can be effective in reducing negative affect. They also suggest that psychological effects are dependent upon performers' personal and cultural affiliation with the two dance forms.

W pierwszej części artykułu opublikowanego w Pojazdach Szynowych nr 2/2020 zaprezentowano wybrane wyniki badań symulacyjnych wytrzymałości przedniej części struktury nośnej ciągnika CLAAS ARION 610. Najwięcej uwagi poświęcono analizie wytrzymałości wspornika przedniej osi, który jest podstawowym fabrycznym elementem nośnym przedniej części ciągnika. W drugiej części artykułu przedstawiono wyniki badań wytrzymałości tylnej struktury nośnej ciągnika, gdzie wszystkie części składowe stanowią dodatkowe wyposażenie ciągnika wykonane w Sieci Badawczej Łukasiewicz – IPS „TABOR”, złożone ze skrzyni nośnej, belki zderzakowej oraz haka pociągowego. Belka zderzakowa oraz hak pociągowy stanowią również wyposażenie przedniej struktury nośnej i są one poddane tym samym warunkom obciążeń siłami poziomymi jak w tylnym układzie pociągowo-zderznym. Część pierwsza artykułu została opublikowana w poprzednim numerze kwartalnika Pojazdy Szynowe.

Three instruments attributed to "Hotteterre" are considered the earliest baroque flutes. But two of these, once in the collection of César Charles Snoeck, prove to be copies, made at different times in the nineteenth century in La Couture-Boussey, Normandy. These, and other replicas made for the Brussels Conservatory and Dayton C. Miller collections, have fostered the growing myth of the "Hotteterre flute." Recently discovered flutes by Richard Haka and others argue against the presumption that the baroque flute was a sudden invention. New and wider studies of seventeenth-century woodwind instruments throughout Europe are beginning to indicate that the flute underwent a process of change far more complex than previously thought.

Sannan al’umma ba ta tallafa wa waɗannan mawaƙa ta fuskar shawarwari da sauran abubuwa da suka dace. Daga ƙarshe an ba da shawarwari da suka haɗa da, a riƙa jawo mawaƙa jiki tare da ƙarfafa musu guiwa da nusar da su kan samar da waƙoƙi masu amfani ga al’umma ta fuskar ilimi da zamantakewa.

Pertama, surat ukur berfungsi ketika muncul kesalahan teknis/perubahan berkenaan dengan data fisik dari suatu bidang tanah yang berakibat pada perubahan bats dan luasnya, di samping juga berfungsi menjelaskan tentang letak, luas dan batas dari suatu bidang tanah atau dari satuan rumah susun. Kedua, guna pembuatan surat ukur maka dilakukan pengukuran luas bidang tanah dan ternyata terdapat kelalaian, maka yang bisa diperoleh oleh pihak yang dirugikan ialah bentuk perlindungan hukum preventif, yaitu subjek hukum mempunyai haka tau berkesempatan mengajukan pendapat atau keberatannya, dengan tujuan guna mengantisipasi lahirnya sengketa, sedangkan akibat dari kelalaian tersebut maka pejabatn terkait bisa diajukan gugatan berupa tanggung gugat pribadi.

Shekaru aru-aru da suka shuɗe, manoma da makiyaya na Zamfara suna zaune lami lafiya tsakaninsu da junansu. A wannan zamani da muke ciki, zaman lafiya da amince wa juna ya ƙaranta a tsakanin manoma da akasarin su Hausawa ne da kuma makiyaya da mafi rinjayensu Fulani ne. Tsaro ya yi matuƙar taɓarbarewa a jihar sakamakon rashin jituwa tsakanin waɗannan al’ummomi. Wannan ya sa har ake samun sace-sacen dabbobi da kashe-kashe a tsaninsu musamman ma mazauna karkara. Wannan muƙala ta ƙuduri anniyar yin waiwaye na bin diddigin ayyukan magabata dangane da tsaro a Bahaushiyar al’ada da kuma duba a kan yadda har yanzu ake amfani da su a wasu wurare da nufin samun tsaro. Ra’in da za a gina muƙalar a kai shi ne Bahaushen ra’in da ke cewa, ‘Da Tsohuwar Zuma Ake magani.’ Tunanin wannan muƙala shi ne cewa, watsi tare da kauce wa bin matakan tsaro na gargajiya da aka saba da su kuma suka biya buƙatun tsaro ya taimaka sosai wajen haifar da wannan tayar da zaune tsaye da ake samu a jihar. Wannan ya sanya muƙalar yin waiwaye kan matakan tsaron na gargajiya da nufin zaƙulo yadda za a yi amfani da su a matsayin ‘tsohuwar zuma’ da za a iya amfani da ita wajen magance matsalar tsaro a wannan zamani. Tujuan artikel ini untuk mengetahui reformasi kebijakan pengaturan perkawinan dan perubahan batasan minimal umur perkawinan di Indonesia. Penelitian ini merupakan doktrinal, metode penelitian yang digunakan adalah metode penelitian hukum normatif yaitu metode penelitian hukum yang mendasarkan pada pendekatan perundang-undangan dengan menggunakan analisis deskritif analitis. Hasil penelitian ini menunjukan adanya reformasi atau perubahan terkait pengaturan perkawinan di Indonesia, melalui perubahan UU Perkawinan tahun 1974 menjadi UU Perkawinan tahunn 2019. Subtansi perubahan UU Perkawinan ini berfokus pada perubahan batasan minimal umur perkawinan umur untuk perempuan menjadi 19 tahun. Karena pengaturan batasan umur sebelumnya (16 tahun) tidak sejalan dengan ketentuan yang ada dalam UU Perlindungan Anak yang menyatakan anak adalah seseorang yang berusia belum 18 tahun. Selain itu adanya fakta bahwa perempuan yang menikah diusia 16 tahun lebih rentan mengalamin gaguan kesehatan serta mental. Perubahan ini juga merupakan uapaya pemenuhan hak dasar anak atas perlindungan dari kekerasan dan diskriminasi, hak sipil, haka kesehatan, hak pendidikan dan hak sosial anak yang sulit terpenuhi akibat pernikahan di usia dini.

Abstract:
Many sports teams engage in collective rituals (e.g., the New Zealand All Blacks’ haka). While the concept has been studied extensively in other fields (e.g., social psychology and cultural anthropology), literature on collective rituals specific to sport is limited. Leveraging theoretical positions and empirical findings from across the human and social sciences, the application of an existing definition of collective ritual in team sports is explored. Complementary research is suggestive of a potential link between collective rituals and two growing topics of interest in group dynamics, namely, team resilience and communal coping. Collective rituals can bolster team resilience by strengthening the group structure and increasing a team’s social capital. They can also serve as communal coping strategies, helping to manage team stressors as they arise. However, at the extremes, collective rituals can become problematic. Over-reliance and abusive rites of passage (i.e., hazing) are considered. Potential applied implications and future research directions in sport psychology are then discussed.

Abstract:
This article traces the journeys of dancing men from the stages of New Zealand to the stages of London during the twentieth century. The oft-repeated history of ‘the hard man’ of New Zealand who belonged to the ‘culture of imperial manliness’ is challenged by the stories of these men who, beginning in the 1920s with Jan Caryll, became professional dancers. I argue that within early twentieth-century New Zealand culture the opportunity existed for men and male bodies to be on display. The Maori haka, which featured men dancing in public exhibitions and ceremonies, had been seen by non-Maori (Pakeha) since first contact, while the emergence of body-building, beginning with the visit in 1902 of Eugen Sandow and a culture of sport, allowed men to be on show. Not least of all, tours to the antipodes of European dancers inspired young men to study ballet and contemporary dance. As a consequence, throughout the twentieth century New Zealand male dancers continued to arrive in London and contributed to both New Zealand and British dance histories.

Zusammenfassung Ziel dieser Feldstudie war, in einem nach den BIO-AUSTRIA-Produktionsrichtlinien wirtschaftenden ökologischen Ferkelerzeugerbetrieb von Sommer 2015 bis Sommer 2017 das vorhandene freie Abferkel-system hinsichtlich der Praxistauglichkeit zu überprüfen, vor allem aber die Ferkelverluste und deren Ursachen zu erfassen. Die sogenannte „Ethobox” (HAKA, Josef Häufele GmbH & Co. KG, Erbach-Dellmensingen, Deutschland) war in zwei Kaltställen mit Ausläufen installiert. Material und Methoden: Die Reproduktionsrate wurde routinemäßig über Stallkarten erfasst. Ferkelverluste wurden in erdrückte Ferkel oder sonstige Verluste eingeteilt und der Zeitpunkt des Verlusts vermerkt. Ergebnisse: Die Datenerfassung erstreckte sich auf 490 Würfe (Sau: Deutsches Edelschwein x Deutsche Landrasse; Eber: Pietrain/Pietrain x Duroc; durchschnittliche Wurfnummer: 2,5 ± 1,3; durchschnittliche Anzahl lebend geborener Ferkel: 10,5 ± 2,8; durchschnittliche Anzahl tot geborener Ferkel: 0,8 ± 1,7). Im Mittel wurden 0,72 Ferkel pro Wurf erdrückt. Die sonstigen Ferkelverluste lagen bei 0,58 Ferkeln pro Wurf. Die Gesamtferkelverlustrate betrug 12,4 %. In der 1. Lebenswoche wurden 98,6 % der Verluste durch Erdrücken dokumentiert. Die sonstigen Verluste machten in diesem Zeitraum einen Anteil von 53,1 % aus. Schlussfolgerung und klinische Relevanz: Die Studie bestätigt, dass die 1. Lebenswoche als “kritische Lebensphase” der Ferkel in Bezug auf Erdrückungsverluste anzusehen ist. Nach den Resultaten hat sich die untersuchte freie Abferkelbucht für den Betrieb als praxistauglich erwiesen. Vor allem die niedrige Anzahl lebend geborener Ferkel dürfte in Bezug auf die vergleichsweise geringen Ferkelverluste eine wesentliche Rolle spielen.
